VIII.GoverningLawandDisputeResolution

8.1ThisContractshallbegovernedbythelawsofthecountryinwhichtheEmployerislocated.

8.2AnydisputesarisingfromthisContractshallberesolvedthroughfriendlynegotiation.Ifthepartiesfailtoreachanagreement,thedisputeshallbesubmittedtothecompetentcourtforresolution.

VII.RightsandObligationsoftheEmployee

7.1TheEmployeeshallhavethefollowingrights:

(3)Toworkinasafeandhealthyenvironment.

7.2TheEmployeeshallhavethefollowingobligations:

X.违约及限制条款

10.1IftheEmployeefailstoperformthedutiesassignedorviolatesanyprovisionofthisContract,theEmployershallhavetherighttoterminatetheemploymentrelationshipwithimmediateeffect.

10.2TheEmployeeshallnotdiscloseanyconfidentialinformationobtainedduringtheemploymentperiodtoanythirdpartywithoutthepriorwrittenconsentoftheEmployer.

10.3TheContractorshallbeliableforanylossesordamagescausedbythefailuretoperformtheservicesortasksinaccordancewiththetermsofthisContract.

XI.GoverningLawandDisputeResolution

11.1ThisContractshallbegovernedbythelawsofthecountryinwhichtheEmployerislocated.

11.2AnydisputesarisingfromthisContractshallberesolvedthroughfriendlynegotiation.Ifthepartiesfailtoreachanagreement,thedisputeshallbesubmittedtothecompetentcourtforresolution.

XII.Attachments

(4)ServiceAgreementbetweentheEmployerandtheContractor.

XIII.Conclusion

13.1TheinvolvementoftheContractorinthisContractensuresthattheEmployer'sinterestsareadequatelyprotectedandthatthenecessarysupportandresourcesareprovidedtotheEmployeeforthesuccessfulperformanceoftheirduties.

13.2TheEmployer'sdominanceinthisContractisintendedtoensurethattheirrightsandinterestsareprioritized,whilestillprovidingfairtreatmentandbenefitstotheEmployeeandContractor.

13.3ByincorporatingtheContractorintotheemploymentrelationship,theEmployercanleveragetheirexpertiseandresourcestoenhancetheoverallefficiencyandeffectivenessoftheEmployee'swork.
