11、portionoftheclaimasthe sum insuredofthedamagedpropertybearstoitssoundmarketvalue. if the insuredpropertyenumeratedinthesched uleismorethanoneitem, the provisionofthisclauseshallapplytoeachthereof.onatotallossbasis,thesalvagevalueofsuchitemshallbededucted company may, at its option,declinetheabandonm

12、entofanydamagedpropertybytheinsured.any equipment item insuredformingpartofapairorset,thecompanyshallnotbeliablein respectofeachofsuchitemlostordamagedformorethanitsproportionate partofthesuminsuredonthecompletepairorset. ,thecompanyshallalsopaytheinsuredfortheexpensesreasonablyincurredfortakingnece

13、ssarymeasurestominimizelossordamagetotheleastextent,butinnocaseshall suchexpensesreferredheretoexceedthesuminsuredoftheinsuredproperty. ,anendorsementshallbeissued by thecompanytoreducet hesuminsuredcorrespondingtothe property lost ordamagedbytheamountsosettledfromthedateof loss, and no the suminsur

14、edisrequiredbythe insured upon settlement of the claim, anadditionalpremiumforthereinstatedamountshallbechargedatanagreedrate,andbecalculatedonproratadailybasisfromthedateof loss totheexpiryoftheinsurance.under this insurance shall notexceedaperiodoftwoyearcountingfromthedateofloss.sobligationsthefo

16、ents. ,theinsuredshallat his ownexpensetake all reasonable precautions, including paying sufficientattentiontoandputtingintopracticethereasonable recommendations ofthecompany,prudentlyselectingtheworkmenandemployees and complyingwithallstatutoryregulationsandsafetyoperationprocedures.aclaimunderthis

17、policy,theinsuredorhisrepresentativeshall: (7) days or anyfurtherperiodasmaybeagreedby the company in writing, furnish awrittenreporttoindicatethecourse,probablereasonandextentof lossordamage the loss ordamageandminimizeittotheleastextent; preserve the spot affected and defective parts before aninsp

18、ectioniscarried out by a representative or surveyor from thecompany;information and documentary evidence as thecompanymayrequireforsupportingtheclaim. thedueobservanceandfulfilmentofthetermsandconditionsof thispolicyinsofarastheyrelatetoanythingtobedoneorcompliedwithbytheinsuredshallbeaconditionprec

19、edenttoanyliabilityofthecompanyunderthispolicy. thispolicyshallbe voidable in the event of misrepresentation,m sdescriptionornon-disclosuremadebytheinsuredorhisrepresentativeinanymaterialparticularinrespectofthisinsurance. unlessitscontinuancebeadmittedbythe company in writing, thispolicyshallbeauto

20、maticallyterminatedif: ; afterterminationofthepolicy,thepremiumshallberefundedto theinsuredcalculatedonproratadailybasisfortheperiodfromthedateofterminationtothedateofexpiry. thispolicymaybecanceledatanytimeattherequestofthe insuredinwritingorattheoptionofthecompanybygivingafifteen (15) rmratebasisf

21、orthetime the policy hasbeeninforcewhileinthelattercasesuchpremiumshallbecalculatedonproratadailybasis.eitofbenefit iftheclaimisinanyrespectfraudulent,orifanyfraudulent meansordevicesareusedbytheinsuredorhis representative to obtain anybenefitunderthispolicyorifanylossordamageis occasioned by theint

22、entionalactorintheconnivanceoftheinsuredorhisrepresentative,theninanyofthesecases,alltherightsand benefits of the insuredunderthispolicyshallbeforfeited,andall consequent losses arisingtherefromincludingtheamountofclaim paid by the company shall beindemnifiedbytheinsured. therepresentativeofthe comp

23、any shall at any suitable time beentitledtoattendthesiteandinspectorexaminetherisk explosure ,the insured shall provide fullassistanceandalldetailsandinformationrequiredbythecompanyas maybe necessary for the assessment of the risk. the above mentionedinspectionorexamination shall in no circumstances

24、 be held as anyadmissiontotheinsuredbythecompany. shouldanyloss,damage,expensesorliabilityrecoverable under thepolicybealsocoveredbyanyotherinsurance,thecompanyshall only beliabletopayorcontributehisproportionoftheclaimirrespectiveastowhethertheotherinsuranceisarrangedbytheinsuredor others on hisbeh

25、alf,orwhetheranyindemnification is obtainable under such otherinsurance. whereathirdpartyshallbeheldresponsiblefortheloss or damagecoveredunderthispolicy,theinsuredshall,whetherbeingindemnifiedbythecompanyornot,takeallnecessarymeasurestoenforceorreserve therightofrecoveryagainstsuchthirdparty,andupo

26、nbeingindemnified bythecompany,subrogatetot hecompanyalltherightofrecovery, transferallnecessarydocumentstoandassistthe company in pursuing recoveryfromtheresponsibleparty. alldisputesunderthisinsurancearisingbetweentheinsuredand thecompanyshallbesettledthrough friendly negotiations. where the twopa

27、rtiesfailtoreachanagreementafternegotiations,suchdispute shallbesubmitted to arbitration or to court for legal actions. unlessotherwiseagreed,sucharbitrationorlegalactionshallbecarriedoutintheplacewherethedefendantisdomiciled.thefollowingprovisionsshallbeappliedtoallpartsofthis policyandshalloverridetheothertermsandconditionsofthis policy if pertyinsurancepolicyp olicyno.: whereastheinsurednamedinth
