ThisContract(hereinafterreferredtoas"theContract")isherebyexecutedandenteredintobyandbetweentheEmployer(hereinafterreferredtoas"theEmployer")andtheEmployee(hereinafterreferredtoas"theEmployee")onthedateofthisContract,inaccordancewiththeprovisionsoftheLaborLawofthePeople'sRepublicofChinaandotherrelevantlawsandregulations.
I.PartiestotheContract
1.1Employer:[Employer'sName],withitsregisteredaddressat[Employer'sAddress],registeredwiththe[Employer'sRegistrationAuthority],andwiththeregistrationnumber[Employer'sRegistrationNumber].
1.2Employee:[Employee'sName],withtheidentitycardnumber[Employee'sIdentityCardNumber],andtheaddressat[Employee'sAddress].
II.EmploymentRelationship
2.1TheEmployeragreestoemploytheEmployeeasafull-timeemployee,andtheEmployeeagreestoworkfortheEmployerunderthetermsandconditionssetforthinthisContract.
2.2ThepositionoftheEmployeeis[Employee'sPosition],andtheworklocationis[WorkLocation].
III.EmploymentDuration
3.1ThedurationofthisContractshallbe[EmploymentDuration],startingfrom[StartDate]to[EndDate].
3.2ThepartiesmayagreetoextendthedurationofthisContractuponmutualconsent,providedthattheextensionshallnotexceed[MaximumExtensionDuration].
IV.WorkHoursandSalary
4.1TheEmployeeshallwork[WorkHoursperDay]hoursperday,[WorkDaysperWeek]daysperweek,and[OvertimeHoursperMonth]overtimehourspermonth,inaccordancewiththeprovisionsoftheLaborLawandtheEmployer'sinternalregulations.
4.2ThemonthlysalaryoftheEmployeeshallbe[MonthlySalary],whichshallbepaidin[PaymentFrequency],andthepaymentdateshallbe[PaymentDate].
V.BenefitsandCompensation
5.1TheEmployershallprovidetheEmployeewiththefollowingbenefitsandcompensation:
5.1.1SocialInsuranceandHousingFund:TheEmployershallpaytheEmployee'ssocialinsuranceandhousingfundcontributionsinaccordancewiththerelevantlawsandregulations.
5.1.2AnnualLeave:TheEmployeeshallbeentitledto[AnnualLeaveDays]annualleavedaysperyear,inaccordancewiththeprovisionsoftheLaborLaw.
5.1.3MaternityLeave:TheEmployeeshallbeentitledto[MaternityLeaveDays]maternityleavedays,inaccordancewiththeprovisionsoftheLaborLaw.
5.1.4SickLeave:TheEmployeeshallbeentitledto[SickLeaveDays]sickleavedays,inaccordancewiththeprovisionsoftheLaborLaw.
VI.ConfidentialityandNon-Compete
6.1TheEmployeeagreestokeepconfidentialalltheEmployer'stradesecrets,businessinformation,andotherconfidentialinformationduringandaftertheemploymentrelationship.
6.2TheEmployeeagreesnottoengageinanybusinessactivitiesthatcompetewiththeEmployer'sbusinesswithin[Non-CompetePeriod]yearsaftertheterminationofthisContract.
VII.TerminationoftheContract
7.1TheContractmaybeterminatedbyeitherpartyinaccordancewiththeprovisionsoftheLaborLawandthisContract.
7.2TheEmployermayterminatethisContractforthefollowingreasons:
7.2.1TheEmployee'sviolationoftheEmployer'sinternalregulationsortheprovisionsofthisContract.
7.2.2TheEmployee'sfailuretoperformthejobdutiesasrequired.
7.2.3TheEmployee'sillnessordisabilitythatpreventstheEmployeefromperformingthejobduties.
VIII.DisputeResolution
8.1AnydisputesarisingfromtheexecutionofthisContractshallberesolvedthroughfriendlynegotiationsbetweentheparties.
8.2Ifthepartiesfailtoreachanagreementthroughfriendlynegotiations,thedisputeshallbesubmittedtothePeople'sCourtwithjurisdictionovertheEmployer'splaceofbusinessfortrial.
IX.GeneralProvisions
9.1ThisContractisexecutedintwocopies,oneforeachparty.
9.2ThisContractshallbebindingonbothpartiesuponthesignatureofbothparties.
9.3AnyamendmentorsupplementtothisContractshallbemadeinwritingandshallbebindingonbothparties.

II.ThirdParty'sRole
2.1PartyCshallactasanintermediarybetweenPartyAandPartyB,providingservicesrelatedtotheemploymentrelationshipandensuringthecomplianceofPartyBwiththetermsandconditionssetforthinthisContract.
III.PartyA'sRightsandObligations
3.1PartyAhastherightto:
3.1.1EmployPartyBinaccordancewiththeprovisionsofthisContract.
3.1.2Settheworkschedule,workhours,andovertimepolicyforPartyB.
3.1.3DeterminethesalaryandcompensationpackageforPartyB.
3.1.4MonitorPartyB'sperformanceandcompliancewiththeEmployer'sinternalregulations.
3.2PartyAisobligatedto:
3.2.1ProvidePartyBwithasafeandhealthyworkingenvironment.
3.2.2PayPartyB'ssalaryandbenefitsinaccordancewiththetermsofthisContract.
3.2.3EnsurethatPartyB'srightsandinterestsareprotectedinaccordancewiththeLaborLaw.
3.2.4ProvidePartyBwiththenecessarytrainingandprofessionaldevelopmentopportunities.
IV.PartyB'sRightsandObligations
4.1PartyBhastherightto:
4.1.1ReceivethesalaryandbenefitsasstipulatedinthisContract.
4.1.2EnjoytheprotectionsprovidedbytheLaborLaw,includingannualleave,sickleave,andmaternityleave.
4.1.3ParticipateintheEmployer'sprofessionaldevelopmentprograms.
4.2PartyBisobligatedto:
4.2.1PerformthejobdutiesasrequiredbyPartyA.
4.2.2ComplywiththeEmployer'sinternalregulationsandpolicies.
4.2.3NotifyPartyAinwritingofanychangesinpersonalinformation.
V.PartyC'sRightsandObligations
5.1PartyChastherightto:
5.1.1Receiveafeeforprovidingintermediaryservicesasagreeduponbytheparties.
5.1.2EnsurethecomplianceofPartyBwiththetermsofthisContract.
5.1.3MediateanydisputesbetweenPartyAandPartyB,asnecessary.
5.2PartyCisobligatedto:
5.2.1ActasanimpartialintermediaryandfacilitatetheemploymentrelationshipbetweenPartyAandPartyB.
5.2.2Maintainconfidentialityregardingtheinformationobtainedduringtheperformanceofitsduties.
5.2.3ProvidePartyAandPartyBwithregularupdatesonPartyB'sperformanceandcompliancewiththeContract.
VI.PartyB'sBreachofContractandLimitations
6.1IfPartyBbreachesthetermsofthisContract,PartyAmay,atitssolediscretion,takeanyofthefollowingactions:
6.1.1IssueawrittenwarningtoPartyB.
6.1.2SuspendPartyB'semploymentwithoutpay.
6.1.3TerminatethisContractinaccordancewiththeprovisionsoftheLaborLaw.
6.2PartyBagreestoindemnifyPartyAforanylossesincurredasaresultofPartyB'sbreachofthisContract.
VII.GeneralProvisions
7.1ThisContractconstitutestheentireagreementbetweenthepartiesandsupersedesallprioragreements,whetherwrittenororal.
7.2AnyamendmentorsupplementtothisContractmustbemadeinwritingandsignedbyallparties.
7.3ThisContractisbindingonthepartiesandtheirsuccessorsandassigns.

IV.PartyC'sRightsandObligations
4.1PartyChastherightto:
4.1.1ChargeafeefortheservicesprovidedtoPartyB,asagreeduponbytheparties.
4.1.2FacilitatethecommunicationbetweenPartyAandPartyBtoensurethesmoothprogressionoftheemploymentprocess.
4.1.3Maintainconfidentialityregardingthepersonalandemployment-relatedinformationofPartyB.
4.2PartyCisobligatedto:
4.2.1ProvidePartyBwithadequatesupportandguidancethroughouttheemploymentprocess.
4.2.2EnsurethattheemploymentopportunitiesofferedtoPartyBareincompliancewiththerelevantlawsandregulations.
4.2.3MediateanydisputesthatmayarisebetweenPartyAandPartyB,withthegoalofreachingamutuallyacceptableresolution.
V.PartyA'sRightsandObligations
5.1PartyAhastherightto:
5.1.1Selectthemostsuitablecandidateforthejobposition,basedontheinformationprovidedbyPartyBandPartyC.
5.1.2Determinethetermsofemployment,includingsalary,benefits,andworkingconditions.
5.1.3RequirePartyBtocomplywiththeEmployer'sinternalpoliciesandprocedures.
5.2PartyAisobligatedto:
5.2.1ProvidePartyBwiththeagreed-uponsalaryandbenefits.
5.2.2EnsurethatPartyB'sworkingconditionsaresafeandincompliancewiththeLaborLaw.
5.2.3RespectPartyB'srightsandinterestsasanemployee.
VI.PartyA'sBreachofContractandLimitations
6.1IfPartyAbreachesthetermsofthisContract,PartyBmay,atitssolediscretion,takeanyofthefollowingactions:
6.1.1RequestawrittenexplanationfromPartyA.
6.1.2SeekmediationthroughPartyCtoresolvethed
