上海巿房屋租赁协议上海市房屋土地资源管理局上海市工商行政管理局 制订二04月印制WhilealltermsandconditionsshallbebasedontheChineseversionofTenancyAgreement,thisEnglishversionshallbeforreferenceonly.上海房屋租赁协议SHANGHAIMUNICIPALITY(协议编号: )(ContractNo._________)本协议双方当事人:PartiestoContract(出租)出租人(甲方) :Lessor(PartyA) :承租方(乙方) :Lessee(PartyB) :依据《中国协议法》、《上海市房屋租赁条例》(以下简称:《条例》)要求,甲、乙双方在平等、自愿、公平和老实信用基础上,经协商一致,就乙方承租甲方可依出租(出租)商品房(房屋/商品房)事宜,签订本协议。InaccordancewiththeLawsofContractofthePeople’sRepublicofChinaandtheTenancyRegulationsoftheShanghaiMunicipality(hereinafterreferredtoas“theProvisions”),PartyAandPartyB,havingreachedanagreementbasedontheprinciplesofequality,willingnessandmutualbenefit,herebyenterintothisContractonmattersinrelationtotheLeaseofthePropertybyPartyAtoPartyB.一、出租房屋情况ConditionoftheLeaseorPre-LeaseProperty1-1甲方出租(出租)给乙方房屋座落在本市 (区/县)路号(弄/新村)(号/幢)室(部位)(以下简称该房屋)。该房屋实测(【出租】实测)建筑面积为平方米,房屋用途住宅,房屋结构为钢混 。甲方已向乙方出示:PartyAshallleasePartyBthePropertysituatedat,,(hereinafterreferredtoas“theProperty”).ThetotalgrossareaoftheLeasePropertyshallbe_________squaremeters,thepurposeoftheLandshallbeforConsolidatedPurpose,thetypeofPropertyshallbeResidentialBuilding,thestructureshallbe.ThefloorplanofthePropertyseeAppendix1ofthisContract.PartyAhasalreadypresentedtoPartyB:
1)【出租】房地产权证/房屋全部权证/沪房地产权证市字;(证书编号:号。[Lease]ShanghaiCertificateofOwnershipoftheProperty(CertificateNo. ).1-2甲方作为该房屋房地产权利人 (房地产权利人/代管人/法律要求其她权利人)与乙方建立租赁关系。签署本协议前,甲方已通知乙方该房屋(已/未)设定抵押。PartyAbeingtheOwnerofthePropertyandPartyBhavedevelopedalessor/lesseerelationship.BeforethesigningofthisContract,PartyAhasalreadyinformedPartyBthatthePropertysubjecttoamortgage.1-3该房屋公用或适用部位使用范围、条件和要求;现有装修、隶属设施、设备情况和甲方同意乙方自行装修和增设隶属设施内容、标准及需约定相关事宜,由甲、乙双方分别在本协议附件(二)、(三)中加以列明。甲、乙双方同意该附件作为甲方向乙方交付该房屋和本协议终止时乙方向甲方返还该房屋验收依据。TheareaandtheuseofthepublicorcommonpartoftheProperty;theexistingfixtures,facilities,conditionofequipmentandthecontents,standardandotherrelevantmatterstobeascertainedinrelationtothefixturesandthefacilitiesaddedbyPartyBwiththeconsentofPartyAshallbespecifiedinAppendix2,3ofthisContract.PartyAandPartyBhaveagreedthesaidAppendixshallrepresenttheconditionofthePropertyatthetimeofhandoverofthePropertybyPartyAtoPartyBandwhenPartyBdeliverupthePropertytoPartyAattheexpiryofthisContract.二、租赁用途PurposeoftheProperty2-1乙方向甲方承诺,租赁该房屋作为住宅使用,并遵守国家和本市相关房屋使用和物业管理要求。PartyBwarrantstoPartyAthatthePropertyshallbeusedforResidentialpurposeandfollowstheregulationsoftheStateandthisMunicipalityinrelationtotheuseandmanagementofProperty.2-2乙方确保,在租赁期内未取得甲方书面同意以及按要求须经相关部门审批核准前,不私自改变上款约定使用用途。PartyBguaranteethatduringtheleaseterm,itshallnotalterthepurposeofthePropertywithoutPartyA‘spriorwrittenconsentaswellastheapprovalfromtherelevantgovernmentaldepartment.三、交付日期和租赁期限DeliveryDateandLeaseTerm3-1甲乙双方约定,甲方于年月日向乙方交付该房屋。【出租】房屋租赁期自年月日起至年月日止。
PartyAandPartyBhaveagreedthatPartyAshallhandoverthePropertytoPartyBbefore.[Lease] TheleasetermofthePropertyshallbefromuntil .3-2租赁期满,甲方有权收回该房屋,乙方应准期返还。乙方需继续承租房屋,则应于租赁期届满前 2个月,向甲方提出续租书面要求,经甲方同意后重新签署租赁协议。Uponexpiryoftheleaseterm,PartyAshallhavetherighttorepossessthePropertyinitsentiretyandPartyBshalldeliveritupaccordingly.IfPartyBwishestorenewthelease,itshallsubmitsuchintentinwritingtoPartyAtwomonthspriortotheexpiryoftheleaseandsignanewleasecontractwiththeconsentofPartyA.四、租金、支付方法和期限Rent,MethodofPaymentandTerm4-1甲、乙双方约定,【出租】月租金人民币()(大写:)。该房屋租金(年)内不变。自第(年)起,双方可协商对租金进行调整。相关调整事宜由甲、乙双方在补充条款中约定。PartyAandPartyBhaveagreedthat.[Lease]ThetotalmonthlyrentshallbeRMBYuan.Therentshallremainunchangedforyear.Therentmaybeadjustedbybothpartiesthroughconsultationcommencingfromyear.MattersrelatedtotheadjustmentshallbeagreedbyPartyAandPartyBinsupplementaryclauses.4-2乙方应于每个月 日前向甲方支付租金。逾期支付,每逾期一日,则乙方需按日租金 %支付违约金。PartyBshallpaytherentbytheofeachmonth.LatepaymentbyPartyBshallbesubjecttoapenaltyof%ofthemonthlyrentperday.4-3乙方支付租金方法以下:TherentshallbepaidbyPartyBasfollows:----------------------------------------------------------------------------------------------------------------五、确保金和其她费用DepositandOtherFeesandCharges5-1甲、乙双方约定,甲方交付该房屋时,乙方应向甲方支付房屋租赁确保金,确保金为贰个月租金,即(人民币贰万贰仟元整)。甲方收取确保金后应向乙方开具收款凭证。租赁关系终止时,甲方收取房屋租赁确保金除用以抵充协议约定由乙方负担费用外,剩下部分一周内无息归还乙方。PartyAandPartyBhaveagreedthatatthetimeofthehandoverofthePropertybyPartyA,PartyBshallpaytoPartyAarentaldepositoftheProperty,thedepositshallbeTwomonthsofrent,thatis(RMBCurrencyTwenty-twothousandyuan. PartyAshallissueareceipttoPartyBafterreceivingpaymentofdeposit.Attheterminationofthelessor/lesseerelationship,theremainingdepositoftheleaseofthePropertyobtainedbyPartyAshallberefundedtoPartyBaftersettingoffthefeesandexpensesbornebyPartyBundertheContractwithoutinterestwithinoneweek.5-2租赁期间,使用该房屋所发生水、电、煤气、通讯费用及ADSL安装费由 乙方(甲方/乙方)负担。其她物业管理费、卫星电视收视费和现场家庭会所卡两人,均由 甲方(甲方/乙方)负担。Duringtheleaseterm,thewater,electricity,gas,communicationoftheProperty,ADSLusagefeeandotherfeesresultedfromtheuseofthePropertyshallbebornebyPartyB.Allothermanagementfee,satelliteTVinstallation,onsiteclubmembershipcardshallbeborneby PartyA .5-3 乙方(甲方/乙方)负担上述费用,计算或分摊措施、支付方法和时间: 依据上述企事业单位列出帐单凭证支付,如不按期付款,滞纳金由乙方负担。PartyBshallberesponsibletopaytheabovefeesandcharges,thecomputationoramortization,methodandtimeofpayment:Accordingtothedemandnotes,ifdelayingpayment,PartyBshouldberesponsibleforthepenalty.六、房屋使用要求和维修责任StandardRequiredforUseofPropertyandResponsibilityofPropertyMaintenanceandRepair6-1租赁期间,乙方发觉该房屋及其隶属设施有损坏或故障时,应立刻通知甲方修复;甲方应在接到乙方通知后日内进行维修。逾期不维修,乙方可代为维修,费用由甲方负担。Duringtheleaseterm,ifPartyBdiscoversanydamagesordefectsofthePropertyandfacilitiesattached,itshallnotifyPartyAimmediatelyforrepair.PartyAshallcarryouttherepairwithindaysafterreceivingnotificationfromPartyB.AnydelayinrepairmayberepairedbyPartyBonPartyA’sbehalfandtheexpensesincurredshallbebornebyPartyA.6-2租赁期间,乙方应合理使用并珍惜该房屋其隶属设施。因乙方使用不妥或不合理使用,致使该房屋及其隶属设施损坏或发生故障,乙方应负责维修。乙方拒不维修,甲方可代为维修,费用由乙方负担。Duringtheleaseterm,PartyBshallreasonablyuseandtakegoodcareofthePropertyandthefacilitiesattached.PartyBshallberesponsibletorepairimmediatelythedamagescausedtothePropertyand/orfacilitiesduetoimproperandunreasonableusebyPartyB.IfPartyBrefusestorepair,PartyAmayrepaironitsbehalfandtheexpensesincurredshallbebornebyPartyB.6-3租赁期间,甲方确保该房屋及其隶属设施处于正常可使用和安全状态。甲方对该房屋进行检验、养护,应提前日通知乙方。检验养护时,乙方应给予配合。甲方应降低对乙方使用该房屋影响。Duringtheleaseterm,PartyAshallguaranteethenormalusableandsafeconditionofthePropertyandfacilitiesattached.PartyAshallnotifyPartyBdaysinadvancebeforecarryingoutexaminationandmaintenanceworks.PartyBshallrendercooperationduringtheexaminationandmaintenance.PartyAshallreducetheeffectcausedtoPartyBinusingtheProperty.6-4乙方需装修或者增设隶属设施和设备,应事先取得甲方书面同意,按要求须向相关部门审批,则还应由甲方(甲方/甲方委托乙方)报请相关部门同意后,方可进行。乙方增设隶属设施设备归属及其维修责任由甲、乙双方另行书面约定。ExceptforAppendix3ofthisContract,beforecarryingoutanyextrarenovationoradditionoffacilitiesattachedandequipment,PartyBshallobtainthewrittenconsentofPartyAandsubmitthesametotherelevantauthorityforexaminationandapprovalinaccordancewiththeregulations.TheworkscouldonlybecarriedoutuponcompletionoftheprocedureofapprovalwiththerelevantauthoritybyPartyA.TheresponsibilityofthemaintenanceoftheaddedfacilitiesbyPartyBshallbeagreedbyPartyAandPartyBinseparatewrittenagreement.七、房屋返还时状态ConditionofPropertyatDeliveryBack7-1除甲方同意乙方续租外,乙方应在本协议租期届满后日内返还该房屋,未经甲方同意逾期返还房屋,每逾期一日,乙方应按 向甲方支付该房屋占用期间使用费。ExceptfortherenewalofleaseagreedbyPartyA,PartyBshalldeliverupthePropertywithinaftertheexpirationofleasetermofthisContract.LatedeliveryofthePropertywithouttheconsentofPartyAshallbesubjecttoachargeforadversepossessionofthePropertyattimeofrentperday.7-2乙方返还该房屋应该符合正常使用后状态。返还时,应经甲方验收认可,并相互结清各自应该负担费用。ThePropertyatthetimeofdeliveryupbyPartyBshallbeofaconditionafternormaluse.ThedeliveryupshallbeexaminedandauthorizedbyPartyAandthefeeandchargesresponsiblebythepartiesshallbeclearedatthetimeofdeliveryup.八、转租、转让和交换Sublease,AssignmentandExchange8-1除甲方已在本协议补充条款中同意乙方转租外,乙方在租赁期内,需事先取得甲方书面同意,方同将该房屋部分或全部转租给她人。但同一间居住房屋,不得分割转租。UnlessotherwiseagreedinthesupplementaryclausesofthisContract,PartyBshallobtainthewrittenapprovalfromPartyAbeforeitcouldsubleasepartorallofthePropertytoathirdpartyduringtheleaseterm.PartyBshallnotsubleasepartofthePropertyorsubleasetotwolesseesormorethantwolesseesatthesametime.8-2乙方转租该房屋,应按要求与接收转租方签订书面转租协议。并按要求向该房屋所在区、县房地产交易中心或农场系统受理处办理登记立案。WhenPartyBsubleasestheProperty,itshallenterintoasubleasecontractwiththelesseeinwritinginaccordancewiththeregulations.ThesubleasecontractshallberegisteredandfiledwiththeRealEstateTradeManagementDepartmentortheMinistryofAgriculturalSystemswherethePropertyislocated.8-3在租赁期内,乙方将该房屋转让给她人承租或与她人承租房屋进行交换,必需事先取得甲方书面同意。转让或交换后,该房屋承租权受让人或交换人应与甲方签署租赁主体变更协议并继续推行本协议。Duringtheleaseterm,PartyBshallobtainthewrittenconsentfromPartyAbeforeassigningthePropertytoathirdpartyforsubleaseorexchangethePropertysubleasedbyathirdparty.Aftertheassignmentorexchange,theassigneeofthePropertyorthepartytotheexchangeshallsigntheContractfortheamendmentoftheleaseandcontinuetoenforcethisContract.8-4在租赁期内,甲方如需出售该房屋,应提前三个月通知乙方。乙方在相同条件下有优先购置权。若乙方无意购置该物业,本租赁协议继续生效。Duringtheleaseterm,ifPartyAshallselltheProperty,itshallnotifyPartyB3monthsinadvance.PartyBshallhavetheprioritytopurchaseunderthesameconditions.九、解除本协议条件ConditionsforTerminatingthisContract9-1甲、乙双方同意在租赁期内,有下列情形之一,本协议终止,双方互不负担责任:PartyAandPartyBhaveagreedthatduringtheleaseterm,thisContractshallbeterminatedunderanyofthefollowingcircumstancesandbothpartiesshallnotbeheldresponsibleasaresultthereof:该房屋占用范围内土地使用权依法提前收回;TherighttouseoflandwithinthescopeofthePropertywasearlyresumedinaccordancewiththelaws;该房屋因社会公共利益被依法征用;ThePropertywasresumedforpublicinterests;该房屋因城市建设需要被依法列入房屋拆迁许可范围;ThePropertyhasbeenclassifiedaspremisestobedemolishedaccordingtothelawfortheneedoftownplanning;该房屋毁损、灭失或者被判定为危险房屋;Damages,firehazardsoccurredtothePropertyorotherwisebeenclassifieddangerouspremises;甲方已通知乙方该房屋出租前已设定抵押,现被处分。PenaltyasaresultofthemortgagecreatedoverthePropertyasnotifiedtoPartyBbyPartyAbeforethelease;9-2甲、乙双方同意,有下列情形之一,一方可书面通知另一方解除本协议。违反协议一方,应向另一方按月租金2倍支付违约金;给对方造成损失,支付违约金不足抵付一方损失,还应赔偿造成损失与违约金差额部分:PartyAandPartyBhaveagreedthatonepartymayterminatethisContractbywrittennoticetotheotherpartyunderanyofthefollowingcircumstances.Thepartyinbreachshallpaytotheotherpartyapenaltyof2timesoftherentpermonth;ifdamagesiscausedtotheotherpartyandthepenaltyisnotsufficienttooffsetthedamagesoftheotherparty,thepartyinbreachshallalsocompensateforthedifferencebetweenthepenaltyandthedamagescaused:(一)甲方未按时交付该房屋,经乙方催告后7日内仍未交付;PartyAfailstodeliverupthePropertyaccordinglyandremainfailtodeliverwithin7daysafterdemandgivenbyPartyB;(二)甲方交付该房屋不符合本协议约定,致使不能实现租赁目;或甲方交付房屋存在缺点,危及乙方安全。ThePropertydeliveredupbyPartyAfallsshortoftheagreementofthisContract,causingfailuretorealizethepurposeofthelease;orthePropertydeliveredbyPartyAisdefectiveandaffectsthesafetyofPartyB;(三)乙方未取得甲方书面同意改变房屋用途,致使房屋损坏;PartyBalterstheuseofthePropertywithoutthewrittenconsentofPartyA,causingdamagestotheProperty;(四)因乙方原因造成房屋主体结构损坏;DamagescausedtothemainstructureofthePropertyattributabletoPartyB;(五)乙方私自转租该房屋、转让该房屋承租权或与她人交换各自承租房屋;PartyBsubleasestheProperty,assignsthePropertytoorexchangesthePropertywiththethirdpartywithoutconsent;(六)乙方逾期不支付租金累计超出壹月;PartyBfailstopayrentforover1months;十、违约责任LiabilitiesforBreachofContract10-1该房屋交付时存在缺点,甲方应自交付之日起 日内进行修复,逾期不修复,甲方同意降低租金并变更相关租金条款。Fordefectsexistatthetimeofdeliveryoftheproperty,PartyAshallperformtherepairworkwithindaysafterthedelivery,intheeventofdelayandnon-repair,PartyAagreestoreducetherentpayableandalterstherelevantrentalprovisions.10-2因甲方未通知乙方,该房屋出租前已抵押或产权转移已受到限制,造成乙方损失,甲方应负责赔偿。 PartyAshallbeliabletocompensationforlossincurredbyPartyBduetoPartyA’sfailureinnotifyingPartyBoftherestrictionofthePropertyundermortgageorassignmentofinterestsbeforetheleaseoftheProperty.10-3租赁期间,甲方不立刻推行本协议约定维修、养护责任,致使房屋损坏,造成乙方财产损失或人身伤害,甲方应负担赔偿责任。Duringtheleaseterm,ifPartyAfailstoperformthedutiesofmaintenanceandrepairunderthisContract,causingdamagesorlossestothePropertyand/orpersonalinjuriestoPartyB,PartyAshallbeliabletocompensation.10-4租赁期间,非本协议要求情况,甲方私自解除本协议,提前收回该房屋,甲方应按月租金2倍向乙方支付违约金。若违约金不足抵付乙方损失,甲方还应负责赔偿。Duringtheleaseterm,ifPartyAterminatesthisContractandtakesbackthePropertybeforetheexpirationoftheleaseinanyeventotherthanthosestipulatedinthisContract,itshallpaytoPartyBapenaltyof2timesofrentpayablefortheremainingdaysoftheterm.PartyAshallbeliableforcompensationifthepenaltyisnotsufficienttooffsetthelossessufferedbyPartyB.10-5乙方未取得甲方书面同意或者超出甲方书面同意范围和要求装修房屋或者增设隶属设施,甲方能够要求乙方 恢复房屋原状 (恢复房屋原状/赔偿损失)。PartyBhasrenovatedthePropertyoraddedfacilitiesattachedtothePropertywithoutobtainingthewrittenconsentofPartyAoroutsidethescopeofthewrittenapprovalofPartyA,PartyAmayrequirePartyBtorestorethePropertytoitsoriginalstate.10-6租赁期间,非本协议要求情况,乙方中途私自退租,乙方应按月租金2倍向甲方支付违约金。若违约金不足抵付甲方损失,乙方还应负责赔偿。甲方可从租赁确保金中抵扣。确保金不足抵扣,不足部分则由乙方另行交付。Duringtheleaseterm,exceptforcircumstancesstipulatedinthisContract,ifPartyBwithdrawsfromtheleasewithoutobtainingtheapprovalofPartyA.PartyBshallpayapenaltytoPartyA2timestherentpayablefortheremainingdaysoftheterm.IfthepenaltyisnotsufficienttooffsetthelosssufferedbyPartyA,PartyBshallbeliabletocompensation.PartyAmayoffsettheamountfromthedeposit.Ifthedepositisnotsufficienttooffsettheamount,theoutstandingamountshallbepaidbyPartyB.十一、其她条款OtherClauses11-1租赁期间,甲方需抵押该房屋,应该书面通知乙方,并向乙方承诺房屋抵押后当事人协议以折价、变卖方法处分该房屋前叁十日书面咨询乙方购置该房屋意见。Duringtheleaseterm,ifPartyAshallrequiretomortgagetheProperty,itshallnotifyPartyBinwritingandguaranteetoPartyBthatafterthemortgageoftheProperty,PartyB’sopinionastothepurchaseofthePropertywouldbeconsultedinwriting30daysbeforeagreementonmethodofdisposalofthePropertyisreached.11-2本协议自双方签字/签字后立即生效。生效后15日内,由甲方负责按要求向房屋所在地域、县房地产交易中心或农场系统受理处办理登记立案,领取房屋租赁登记立案证实;本协议经登记立案后,凡变更、终止本协议,由甲方(甲方/乙方)负责在本协议变更终止之日起15日内,向原登记机构办理变更、终止登记立案手续。因甲方未办理房屋租赁登记立案或变更、终止登记立案,所引发法律纠纷,由甲方负担一切责任。ThisContractshalltakeeffectaftersignedbybothparties.Within15daysofthesigningofthisContract,PartyAshallberesponsibletoregisterwiththeRealEstateTradeManagementDepartmentortheMinistryofAgriculturalSystemswherethePropertyislocatedandobtaintheCertificateofLeaseuponregistration:IncasesofmodificationorterminationofthisContractaftertheregistrationofthisContract,PartyAshallberesponsibletoregisterthemodificationorterminationwiththeoriginalregistrationofficewithin15daysofsuchmodificationortermination.AnylegaldisputesarisingfromthefailureofPartyAtoregistertheCertificateofLeaseortoregisterthemodificationorterminationshallbebornebyPartyA.11-3本协议未尽事宜,经甲、乙双方协商一致,可签订补充条款。本协议补充条款及附件均为本协议不可分割一部分,本协议及其补充条款和附件内空格部分填写文字与铅印文字含有相同效力。PartyAandPartyBmaythroughmutualconsultationenterintothesupplementaryclausesonmattersnotstipulatedinthisContract.TheSupplementaryclausesandappendicesshallformanindispensablepartofthisContract.WordsintheblanksprovidedinthisContractanditssupplementaryclausesandappendicessh
