精品文档精心整理精品文档可编辑的精品文档精品文档精心整理精品文档可编辑的精品文档LaborContract劳动合同Date甲方(用人单位):乙方(员工):PartyA(Employer):PartyB(Employee):法定代表人:性别Gender::LegalRepresentative:出生年月BirthDate::身份证号码IDNO.:联系方式ContactInfo.:经营地址:家庭住址:Address:Address:根据《中华人民共和国劳动法》、《中华人民共和国劳动合同法》、《北京市劳动合同条例》的有关规定,双方遵循公平合法、平等自愿、协商一致、诚实信用原则,订立本合同。ThecontractisherebyconcludedbybothpartiesinaccordancewithLaborLawofthePeople'sRepublicofChina,LaborContractLawofthePeople’sRepublicofChina,andRegulationsofShanghaiMunicipalityonLaborContract,intheprinciplesoffairness,legitimacy,equality,voluntariness,consensusthroughnegotiationandgoodfaith.一、合同期限ContractTerm1.甲方与乙方签订固定期限劳动合同。本劳动合同期限为年,自年月日起,至年月日止,其中试用期为个月,自年月日起,至年月日止。PartyAandPartyBsignsafixed-termlaborcontract.Thecontractlastsfor___year(s),from_________to________.Theprobationis____month(s),from________to________;二、工作内容JobResponsibilities2.甲方聘用乙方从事岗位工作。PartyAemploysPartyBtoengagein________.3.工作地点:___________,根据甲方工作需要,经甲乙双方协调一致,可变更工作地点。Theworkplaceis__________________________________,whichcanbechangedonthebasisofmutualagreementasperPartyA’sbusinessrequirements.4.乙方应积极遵守公司所有规章制度,按质、按量、按时完成其本职工作。PartyBshallfulfillhisjobinahigh-quality,quantitativeandtime-efficientmannerandabidebyallthecompanyrules.5.甲方可以根据实际工作需要,根据乙方的工作能力和表现,调整乙方工作岗位或安排乙方临时从事其他工作岗位,乙方应予以认可配合。PartyAmayadjustPartyB’sjoborappointPartyBtodoanotherjobtemporarilybyvirtueofitsbusinessrequirementsaswellasPartyB’scompetenceandperformance.PartyBshallagreeandcooperatewithPartyA.三、工作时间和休息时间WorkingHours&RestHours6.甲、乙双方同意按以下方式确定乙方的工作时间(正常工作时间:09:00—18:00;其中12:30—13:30为午餐时间。)□标准工时制,即每日工作小时,每周周一至周五工作。BothpartiesagreePartyB’sworkinghoursarespecifiedasfollows(normalworkinghours:09:00–18:00;lunchtime:12:30–13:30.)□Standardworkinghourssystem,i.e.____hour(s)/day,WorkfromMondaytoFriday.四、劳动报酬LaborRemuneration7.甲方每月5日前以货币的形式足额支付乙方工资,结算周期为上月月初到上月月末,实行先工作后发薪的制度。PartyAshallpayoffsalarytoPartyBincurrencyonthe5thofeverymonth.Thepayperiodisfromthebeginningtotheendoflastmonth.PartyBworksbeforepaid.8.在试用期,乙方的税前工资为每月________元人民币;在试用期后,乙方薪金模式为工作基本月薪元人民币,加年度奖金模式。其中年度奖金根据公司经营状况和乙方工作表现另行确定。PartyB’sprobationperiodsalaryisRMB___________.Aftertheprobationperiod,PartyB’snormalbasicsalaryis________,plusannualbonus,whichcanbeadjustedasperthecompany’soperationandPartyB’sperformance.9.在甲方取得中国企业营业执照之前,甲方不承担乙方社会保险费用和医疗保险费用;在甲方取得其企业营业执照后,甲方须承担乙方相关社会、医疗保险费用,并按照国家有关规定对乙方所应承担的社会保险费用及个人所得税进行代缴。BeforePartyAobtainsitsBusinessLicenseofficially,PartyAisnotresponsibleforpayingoffPartyB’ssocialandmedicalinsurance;afterPartyAobtainsitsBusinessLicense,itmustpayrelatedPartyB’ssocialandmedicalinsuranceandwilldeductPartyB’sownsocialandmedicalinsurancepremiumandindividualincometaxfromPartyB’ssalarytopaytotheChinesegovernment.10.甲方调整乙方工作岗位的,根据乙方能力及其相关职位,双方协商一致后调整乙方劳动报酬。PartyB’slaborremunerationwillbeadjustedasperPartyB’scompetenceandjobrequirementsonthebasisofconsensusincasePartyAadjustPartyB’sjob.11.甲方将每年对乙方的工作成绩、表现,以及劳动报酬进行评估.PartyAwillreviewPartyB’sworkperformanceandsalaryonanannualbasis.五、社会保险和福利待遇SocialWelfare&Benefits12.甲方根据国家有关规定为乙方缴纳北京市城镇社会保险(养老、医疗、失业、工伤),个人缴纳部分由甲方从乙方工资中代扣代缴。甲乙双方解除、终止劳动合同时,甲方按有关规定为乙方办理社会保险相关手续。AccordingtotheState’srelatedrules,PartyAwillpayBeijingsocialinsuranceinurbanarea(i.e.pensioninsurance,unemploymentinsurance,OccupationalInjuryandmedicalinsurance)forPartyB.AndPartyAwilldeductPartyB’spartfromhisorhersalary.Whenthelaborcontractisterminatedbybothparties,PartyAwillhandletherelatedproceduresforPartyB’ssocialinsuranceaccordingtotherelatedregulations.13.乙方非因工疾病或负伤,在医疗期内工资及其医疗待遇按照本合同16条执行。乙方患职业病或因工负伤后的工资和医疗补助执行按照国家和地方的有关法律法规执行。Incaseofillnessesorinjuriesunrelatedtowork,thesalaryduringtheremedialperiodaswellasmedicaltreatmentshallbepaidinaccordancewithClause16.ThesalaryandMedicarebenefitsofPartyBincaseofoccupationaldiseasesorwork-relatedinjuriesshallbepaidinaccordancewiththerelevantnationalandlocallawsandregulations.14.因公出差按公司规定实行差旅费报销与补贴。IncasePartyBtravelsonbusiness,PartyAwillreimbursetravellingexpensesandgivesubsidytoPartyBinaccordancewiththecompanyrules.六、假期安排AnnualLeaveandSickLeave15.带薪年假–雇佣期满一年后,甲方每年为乙方提供十天带薪年假。乙方需根据甲方经营和工作等实际情况,安排年假,尽量将甲方损失最小化。乙方休年假时,必须提前一个月通知甲方,并取得甲方批准,方可休假。AnnualLeave–PartyBshallbeentitledtotakepaidannualleaveoften(10)workingdaysperannumafterthefirstyeartheemployment.Leavemaybetakenasitisaccruedbutmayonlybetakenattimesagreedtobythecompanyinorderthatdisruptionwillbeminimal.Requestforleavemustbesubmittedone(1)monthinadvanceandapprovedbyPartyA.16.病假–如乙方不涉及住院治疗,甲方将每年批准乙方共计15天带薪病假;其中全薪病假五天,三分之二薪金病假五天,以及三分之一薪金病假五天。如乙方病假日期总数超过甲方允许的病假日期总数,超出部分将在乙方带薪年假日期数中扣除;如果乙方病假日期总数超出了甲方允许的病假和带薪年假日期总和,甲方将不会支付乙方超出日期的任何薪金。乙方必须向甲方财务或行政部出具医院的相关病假证明并通知乙方上级部门,如乙方不能提供相关医院病假证明,视为乙方旷工处理,甲方有权不支付乙方旷工期间任何薪金。PartyBisentitledtofive(5)dayssickleaveperfullcalendaryearatfullpay,nextfive(5)dayssickleaveattwo-thirdpayandnextfive(5)dayssickleaveatone-thirdpay,ifnohospitalizationisincurred.MedicalCertificatesmustbesubmittedtoourAccounts/Admindepartmentuponreturningtotheoffice;ifnot,PartyAhasrightnottopayforPartyB’sabsence.PartyBisrequiredtoinformitssupervisorandthedirectorsifPartyBrequiressickleave.AllabsencebeyondPartyB’sallocatedsickleaveisdeductedfromitsvacationtime.lfboththesickleaveandvacationleavesareusedup,PartyBwillnotbeentitledtobepaidforitstimethatPartyBisabsentfromwork.七、劳动纪律LaborDisciplines17.合同期间,乙方应严格遵守国家的各项法律法规及甲方依法制定的各项规章制度及要求,严格遵守劳动安全卫生、操作规程及工作规范;应爱护甲方财产,遵守职业道德,积极维护公司荣誉和利益。Withinthecontractterm,PartyBshallabidebytheState’slawsandregulationsaswellastherulesformulatedbyPartyAaccordingtothelaws;followlaborsecurityandhygienesystems,productionprocesses,operatinginstructionsandjobspecifications;takegoodcareofPartyA’sproperty;andsafeguardthebenefitsandreputationofthecompany.18.乙方违反劳动纪律,甲方可依据本公司的规章制度给予纪律处分,直至解除本劳动合同。另外,由于乙方的原因对甲方造成经济损失的,原则上必须按照实际损失金额由乙方向甲方承担损害赔偿责任,数目重大者甲方有权追究其法律责任。IncasePartyBviolatesanyofthelabordisciplines,PartyAmaypunishPartyBorevenreleasethecontractaccordingtotherulesandregulationsofthecompany.Moreover,PartyBwillbeheldliableforPartyA’seconomiclossesonacase-by-casebasis,intheeventthatPartyB’sbehaviordamagesPartyA’sinterests.Incaseoftheconsiderableamountoflosses,PartyAwillretaintherighttopursuelegalactionsagainstPartyB.19.在本合同履行过程中,甲方根据国家有关规定可以制定新的规章制度,也可以对公司制定的规章制度进行修改,发布的各种规章制度、操作规定、通知、公告等均对乙方有约束力。Duringthecontractperformance,PartyAmayformulateneworreviserulesandregulationsbasedontheState’srelatedregulations.Therulesandregulations,operatingprovisions,noticesandproclamationsarebindingonPartyB.八、劳动合同的履行和变更LaborContractPerformance&Alternation20.甲方应按照约定为乙方提供适当的工作场所、劳动条件和工作岗位,并按时向乙方支付劳动报酬。乙方应当认真履行自己的劳动职责,并亲自完成本合同约定的工作任务。PartyAshallfurnishPartyBwithproperworkingplace,laborconditionsandposition,andshallalsopaytheremunerationtoPartyBontime,conformingtotheprovisionsherein.PartyBshallfulfillhisresponsibilitieshereininduediligence.21.甲、乙双方协商一致,可以变更本合同内容,并以书面的形式确定。Thecontractmayberevisedinwrittenform,afterbothparties’agreementthroughnegotiation.九、劳动合同的解除、终止和续订LaborContractCancellation,Termination&Renewal22.经甲、乙双方当事人协商一致,本合同可以解除。双方应提前三十日(试用期为提前三日)以书面形式通知对方或以支付一个月工资代替通知,方可解除本协议。Thecontractmaybecanceledbasedonbothparties’mutualnegotiation.Eitherpartyintendingtocancelthecontractshallinformtheotherpartyinwrittenform30daysinadvance(Probationperiod:five(3)daysinadvance)orone(1)monthsalaryinlieuofthenotice.23.乙方有下列情形之一的,甲方可以随时解除本合同:严重违反劳动纪律和规章制度的;严重失职,营私舞弊,给甲方造成重大损失的;乙方没有经过甲方同意,同时与其他用人单位建立劳动关系,对完成甲方的工作任务造成严重影响,或者经甲方提出,拒不改正的;因劳动合同期满致使本合同无效的;依法被追究刑事责任或劳动教养的;乙方利用职务之便收受贿赂的或泄漏公司机密造成公司损失的。PartyAmaycancelthecontractincaseanyofthefollowingoccurs:PartyBseverelyviolatesthelabordisciplinesandregulations;PartyB’sgrossnegligenceorjobberycausesgreatlossesforPartyA;PartyBholdsanotherjobwithoutthepermitofPartyA,whichseriouslyaffectsthecompletionofPartyA’sworktask,orPartyBrefusestocorrecttheerrorafterPartyA’swarning;Thecontractturnsinvalidduetoexpiration;PartyBisheldcriminallyresponsibleorreeducatedthroughlabor;orPartyBacceptsbribesbytakingadvantageofdutyorcausesthelossofthecompanybyvirtueofdivulgingthecommercialsecrets.24.有下列情形之一的,乙方可以随时通知甲方解除本合同。在试用期内的;甲方以暴力、威胁或者非法限制人身自由的手段强迫劳动的;甲方未按照劳动合同约定支付劳动报酬或者提供劳动条件的。PartyBmaynotifyPartyAofterminatingthecontractatanytime,incaseanyofthefollowingoccurs:Withintheprobation;PartyAforcesPartyBtoworkbyviolence,threatorillegallimitationsofPartyB’sfreedom.PartyAfailstopayPartyB’ssalaryorprovideworkconditionsasstipulatedherein.25.符合下列情形之一的,甲方提前三十日(试用期为提前三日)以书面形式通知乙方或以支付一个月工资代替通知,解除本合同:患病或非因工负伤,在规定医疗期满后,不能从事原工作,也不能从事甲方另行安排的工作的;乙方不能胜任工作,经过调整工作岗位,仍不能胜任工作的;本合同订立时所依据的客观情况发生重大变化,致使本合同无法履行,经甲、乙双方协商,未能变更本合同内容达成协议的;按照相关法规及程序甲方依法裁员的。PartyAmaycancelthecontractuponthirty(30)days’priorwrittennoticetoPartyB(Probation:three(3)daysinadvance)orone(1)monthsalaryinlieuofthenotice,incaseanyofthefollowingoccurs:PartyB,duetosicknessorinjuryinflictedoffthejob,cannotresumehisorherworkordotheotherjobreassignedbyPartyAafterspecifiedperiodofmedicaltreatment;PartyBisunqualified,evenafteratrainingorjobadjustment;Theobjectiveconditionsonwhichthecontractisbasedhavemateriallychangedtotheextentthatitisimpossibletoperformthecontractwhilebothpartiescannotreachanagreementtoamendthecontracttoreflectthechangedconditions;orPartyAdownsizesaccordingtorelatedlawsandprocedures.26.乙方有下列情形之一的,甲方不得按本合同第二十五条的约定与乙方解除劳动和同:在甲方工作期间患职业病或者因工负伤并被确认丧失或者部分丧失劳动能力的;患病或因工负伤,在规定的医疗期间的;女职工在孕期、产期、哺乳期的;法律、行政法规规定的其他情形。PartyAisnotallowedtocancelthelaborcontractasperClause25incaseanyofthefollowingoccurs:PartyBisconfirmedpartlyortotallyincapacitatedduetoanindustrialinjuryoranoccupationaldiseasewhenworkingforPartyA;PartyBisinaperiodofmedicaltreatmentforsicknessorworkinjury;Thefemaleemployeeisinpregnancy,maternityorlactation;orOthersituationsstipulatedinlawsandadministrativeprovisions.27.符合下列情形之一的,本劳动合同即可终止:劳动合同期满;乙方死亡、或者被法院宣告死亡或者宣告失踪的;甲方依法被宣告破产的;甲方被吊销营业执照、责令关闭、撤销或者甲方决定提前解散的;法律、行政法规规定的其他情形。Thecontractwillterminateincaseanyofthefollowingoccurs:Thelaborcontractexpires;PartyBisdead,pronounceddeadorpronouncedmissingbythepeople'scourt;PartyAisdeclaredbankruptcylegally;PartyA’sbusinesslicenseisrevoked;PartyAiscompelledtoclosedownordissolve;orPartyAdecidestodissolveinadvance;orOthersituationsstipulatedinlawsandadministrativeprovisions.十、赔偿责任、违约责任CompensationfortheBreachorCancellationoftheContract28.乙方造成直接损失的赔偿金:赔偿金按乙方实际造成的损失计算,赔偿金的范围包括:乙方损坏甲方财物而导致的直接经济损失;乙方疏忽导致的甲方直接经济损失;乙方拒绝合理的工作安排而导致甲方经济损失。IncasePartyB’sbehaviorcausesthelossesofPartyA,thecompensationamountiscalculatedbasedontheactuallossescausedbyPartyB.Thecompensationincludes:ThedirecteconomiclossescausedbyPartyB’sdamagesofPartyA’sproperty;ThedirecteconomiclossesresultingfromPartyB’snegligence;andTheeconomiclossesduetoPartyB’srejectionofthereasonableworkassignedbyPartyA.29.甲乙双方任何一方违反本合同,给另一方造成经济损失的,根据违约责任大小,需承担违约责任。Incasethateitherpartybreachesthecontractorcausestheeconomiclossesoftheotherparty,thedefaultpartywillbeheldliableforbreachofcontractonacase-by-casebasis.30.乙方不得在任何情况下将甲方的保密资料、数据、运营模式、工具等直接或者间接泄露给任何第三方,如经甲方发现按甲方损失大小赔偿。Inanycase,PartyBshallnotdirectlyorindirectlydivulgethecommercialsecrets(includingbutnotlimitedinformation,data,managementmodelsandtools)ofPartyAtoanythethirdparty.IncasePartyBisfoundtodivulgethecommercialsecretsbyPartyA,PartyBshallcompensatePartyAforthelossofaccordingtotheextent.31.如果乙方接受了甲方提供的培训和/或教育资助,并且乙方在其同意的为甲方服务的期限(自培训结束之日起计算)内解除本合同,乙方应在本合同终止十二个月内向甲方赔偿甲方给予乙方的培训和/或教育资助。IncasePartyBisgrantedtrainingand/oreducationfinancialaidfromPartyAandifPartyBterminatesthisContactbeforetheterm(fromthecompletiondateofthetraining)duringwhichPartyBhasagreedtoservePartyA,PartyBshallcompensatePartyAforincurredtrainingexpensesand/oreducationfinancialaidgrantedtoPartyBbyPartyAoverthetwelve(12)monthsperiodfollowingtheterminationofthisContract.十、劳动争议的处理LaborDisputeResolutions32.甲乙双方协商解决。Anydisputeshallbesolvedbynegotiation.33.甲乙双方协商不成,可由争议的一方申请劳动仲裁。Incaseofunsuccessfulnegotiation,thecontendingpartymayapplyforlaborarbitration.十一、其他Miscellaneous34.本合同未尽事宜,按国家和当地政府有关法律、法规规定办理。Otherissuesnotmentionedhereinshallbesubjecttothelaws,statuesandprovisionsstipulatedbythelocalandcentralgovernments.35.本合同一式两份,甲乙双方各执一份,经甲乙双方签字盖章后生效。两份合同具同等法律效力。Thecontractisinduplicate,heldbyPartyAandPartyBrespectively.Thecontractcomesintoeffectuponsignaturesorsealsofbothparties.Thetwocopiesareequallyauthentic.甲方PartyA:乙方:(签字)PartyB:法定代表人或委托代理人:(签字或盖章)LegalRepresentativeorEntrustedAgent:(signatureorseal)签订日期:年月日签订日期:年月日Date:Date:精品文档精心整理精品文档可编辑的精品文档劳动合同书甲方:库尔勒伊阳咖啡店法人代表(或负责人):身份证号码:乙方:赵兵身份证号码:为保证甲方餐厅正常营业,甲乙双方在公平、公正、相互协商达成一致的情况下,就甲方聘用乙方为甲方伊阳咖啡店经理的相关事宜,达成如下协议:一、甲方聘用乙方为甲方餐厅经理,负责伊阳咖啡店的正常营业及餐厅日常管理,岗位工资为每个月6000元/月(其它福利及提成双方后期协商另计)。二、甲方职责:1、本店在总经理的统一领导及安排下开展工作。2、甲方对乙方的日常管理行为,进行合理的监督及管理。3、甲方负责对乙方制定的合理的管理方案进行决策及落实。4、甲方为乙方的正常管理
