1、Laytime Definitions for Charter Parties 2013Words, phrases, acronyms and abbreviations (“ Words and Phrases ” ) used in a CharterParty shall be defined, for the purposes of Laytime only, in accordance with the corresponding Words and Phrases set out below, when any or all such definitions are expres

2、sly incorporated into the Charter Party.Charter Party shall include any form of contract of carriage or affreightment including contracts evidenced by bills of lading.Singular/PluralThe singular includes the plural and vice versa as the context admits or requires.List of Definitions1. PORT shall mea

3、n any area where vessels load or discharge cargo and shall include, but not be limited to, berths, wharves, anchorages, buoys and offshore facilities as well as places outside the legal, fiscal or administrative area where vessels are ordered to wait for their turn no matter the distance from that a

REACHABLE ON ARRIV AL shall mean that the charterer undertakes that an available loading or discharging Berth be provided to the Vessel on arrival at the Port which the Vessel can reach safely without del

LAYTIME shall mean the period of time agreed between the parties during which the owner will make and keep the Ve

PER HATCH PER DAYshall mean that the Laytime is to be calculated by dividingthe quantity of cargo by the result of multiplying the agreed daily rate per hatch by thenumberoftheV

9、essel shatches.Thus:Laytime =DailyQuantityofcargoDays hatchesratexNumberofEach pair of parallel twin hatches shall count as one hatch. Nevertheless, a hatch that is capable of being worked by two gangs simultaneously shall be counted as two hatches. 装卸时间的计算是用货物数量,除以每天每舱口约定装卸率与船舶舱口数的乘积。 每对平行舱口按一个舱口计算

PER WORKING HATCH PER DAY (WHD) or PER WORKABLE HATCH PERDAY (WHD) 每日每可工作舱口或每日每可工作舱口 shall mean that the Laytime is to be calculated by dividing the quantity of cargo in the hold with the largest quantity by the result of multiplying the agreed daily rate per working or

11、workable hatch by the number of hatches serving that hold. Thus:Largest quantity in one holdLaytime = = Days Daily rate per hatch x Number of hatches serving that holdEach pair of parallel twin hatches shall count as one hatch. Nevertheless, a hatch that is capable of being worked by two gangs simul

13、 DAYshall mean a period of twenty-four (24) consecutive hours runningfrom 0000 hours to 2400 hours. CONVENTIONAL DAY shall mean a period of twenty-four (24) consecutive hours running from any identifi

HOLIDAYshall mean a Day other than the normal weekly Day(s) of rest, or partthereof, when by local law or practice work during what would otherwise be ordinary working hours is

WEATHER WORKING DAY(晴天工作日) shall mean a Working Day or part of aWorking Day during which it is or, if the Vessel is still waiting for her turn, it would be possible to load/discharge the cargo without interruption

If such interruption occurs (or would have occurred if work had been in progress), there shall be excluded from the Laytime a period calculated by reference to the ratio which the duration of the interruption bears to the time which would have or could have been worked but for th

19、ll waiting for her turn, it would be possible to load/discharge the cargo without interruption due to the weather. If such interruption occurs (or would have occurred if work had been in progress) there shall be excluded from the Laytime the period during which the weather interrupted or would have

If such interruption occurs (or would have occurred if work had been in progress), there shall be excluded from Laytime the actual period of such interruption. 指 由一个或多个工作日的工作时间加起来构成 24 小时,在此时间内,船舶可以 (若在 等待靠泊,其有可能在)没有天气

EXCEPTEDor EXCLUDEDshallmean that theDays specified donot count asLaytime even if loadingordischargingis carried outon them.20. UNLESS SOONER

23、COMMENCED (除非提前开始)shall mean that if turn-time hasnot expired but loading or discharging is carried out, Laytime shall commence.准备就绪通知书已递交,而合同约定的装卸时间尚未开始前,装卸已经开始,则装卸时间 开始计算。21. UNLESS SOONER COMMENCED, IN WHICH CASE ACTUAL TIME USED TOCOUNT shall mean that actual time used during turn-time shall cou

UNLESS USED shall mean that if Laytime has commenced but loading or discharging is carried out during excepted periods, actual time used shall count as Laytime. 装卸时间 已开始计算,但作业在除外时间内进行,则此段实际使用时间计入装卸时间。23. TO AVERAGE LAYTIME (装卸时间分段计

25、算) shall mean that separate calculations are to be made for loading and discharging and that any time saved in one operation is to be set off against any excess time used in the other.分别计算装和卸时间, 用一个作业中 节省的时间抵消另一个作业中超用的时间。24. REVERSIBLE LAYTIME (装卸时间合并计算) shall mean an option given to the charterer t

26、o add together the time allowed for loading and discharging. Where the option is exercised the effect is the same as a total time being specified to cover both operations. 租家有权选择将约定的装和卸的时间加在一起计算,就如同约定了装卸作业的总时 间。25. NOTICE OF READINESS (NOR 准备就绪通知书)shall mean the notice to thecharterer, shipper, rece

27、iver or other person as required by the CharterParty that the Vessel has arrived at the Port or Berth, as the case may be, and is ready to load or discharge. 按租 约要求,向租家 收发货人或其他人递交的关于船舶已经到达港口或泊位并已经准备 就绪进行装卸作业的通知书。26. TIME LOST WAITING FOR BERTH TO COUNT AS LOADING OR DISCHARGING TIME or AS LAYTIME (等

28、泊损失的时间记为装卸时间) shall mean that if no loading or discharging Berth is available and the Vessel is unable to tender Notice of Readiness at the waiting-place then any time lost to the Vessel is counted as if Laytime were running, or as time on Demurrage if Laytime has expired. Such time ceases to count

29、once the Berth becomes available. When the Vessel reaches a place where she is able to tender Notice of Readiness, Laytime or time on Demurrage resumes after such tender and, in respect of Laytime, on expiry of any notice time provided in the CharterParty. 若没有空闲的装卸泊位而船舶无法在等候的地点递交准备就绪通知 书时,船舶损失的时间同开始

WHETHER IN BERTH OR NOT (WIBON) or BERTH OR NO BERTH(不论在泊与否或有无泊位) shall mean that if the designated loading or discharging Berth is not available on arrival, the Vessel on reaching any usual wa

31、iting place at the Port, shall be entitled to tender Notice of Readiness from it and Laytime shall commence in accordance with the Charter Party. 指船舶抵达装卸泊位没有空闲时, 船舶抵达港口的任何通常等 候地点即有权递交准备就绪通知书,装卸时间应按租约规定开始计算。28. WHETHER IN PORT OR NOT (WIPON)(无论在港与否) shall mean that if thedesignated loading or dischar

32、ging Berth and the usual waiting place at the Port are not available on arrival, the Vessel shall be entitled to tender Notice of Readiness from anyrecognised waiting place off the Port and Laytime shall commence in accordance with the Charter Party. 指泊位和通常的等候地点均无空闲时,船舶有权在任何港口之外的认 可的等候地点递交准备就绪通知书,装卸时间应按租约规定开始计算。29. VESSEL BEING IN FREE PRATIQUE 船
