1、上海市房屋租赁合同中英文上海市房屋租赁合同TENANCY AGREEMENT7/12上海市房屋租赁合同中英文本合同双方当事人:出租方(甲方)Landlord (Party A):庞国伟/受托人:邓磊承租方(乙方)Tenant (Party B):欧陆分析技术(服务)苏州有限公司根据中华人民共和国合同法、上海市房屋租赁条例(以下简称:条例) 的规定,甲、乙双方在平等自愿公平和诚实信用的基础上,经协商一致,就乙方承 租甲方可依法出租的商品房事宜,订立本合同。Whereas Party A Shall lease to Party B and Party B shall rent from Part
2、y A, the releva nt Premises legally owned by Party A and Par ty B agrees to sign this lease Agreement (this uAgreementn ) after friendly consulation and negotiation on the basis of equality and mutual benefits in accordance with the relevant national and municipal laws and regulations一、出租屋情况Articlel
3、 Location, Area and Renovation1- 1甲方将其所有的位于上海市徐汇区建国西路581弄4号233室该房屋实测建 筑面积为119. 77平方米,土地用途为住宅,房屋类型为商品房、结构为钢 7昆。 (The uPremisesv ) The livable area of the Premises square meterss1-2甲方作为该房屋的As the Property,二、租赁用途Article 2 Purpose of lease:上海市房屋租赁合同中英文2- 1乙方向甲方承诺,租赁该房屋作为 物业管理的规定。2-2乙方保证,在租 赁期内未征得甲方书面同意以
4、及按规定须经有关部门审批而未核准前,不擅自改变 上述约定的使用用途。Party B promises, during the lease period, Party B shall not use the Premises for and other purposes without Party A s prior written consent and the relevant government agency? s consent三、交付Fl期和租赁期限Article 3 Term of lease3- 1甲乙双方约定,甲方于年【出租】房屋租赁期自2012年2月13日起至2013年2月1
5、2日止。3- 2租赁期满,甲方有权收回该房屋,乙方应如期返还。乙方需继续承租房屋的, 则应于租赁期届满前一个月,向甲方提出续租书面要求,经甲方同意后重新签订 租赁合同。 Party A is entitled to take back the Premises and Party B shall return the Premises upon the expiration of the lease period If Party B desires to renew this Agreement, Party B shall give a new lease agreement upon P

8、r fees, elec trical fees, gas fees as per the bills in time五、保证金和其他费用Article 5 Deposit and Other Expenses甲乙双方约定,甲方为照顾乙方生活,同意其2012年2月13日先进屋入住,但 乙方务必于2012年2月13日前向甲方支付房屋租赁保证金,保证金为一个月的 租金,即(6000元)。甲方收取保证金后向乙方开具收款凭证。租赁关系终止时,甲方收取的房屋租赁保证金除用以抵充合同约定由乙方承担的 费用外,剩余部分无息归还乙方。Whereas Party A and Party B agree that

10、expenses it has to pay according to this contract六、甲方该房屋内的家俱和家用电器应列明清单(见附件),于2月13日移交乙 方确认使用。Part A shall make a furniture list of the house and turn over to Part B onl3th February. (The furniture list see the attachment)七、房屋使用要求和维修责任Article 7 The responsibility of repairing the Premises7-1租赁期间,乙方发现该
11、房屋及其附属设施有损坏或故障时,应及时通知甲方 修复;甲方应在接到乙方通知后的三日内进行维修。逾期不维修的,乙方可代为 维修,费用由甲方承担。During the lease period, Party B shall inform Party A when Party B finds that something is wrong with the Property of attached facilities; when party A receives the information from Party If Party A delays in performing the repai
12、r, Party B can instead of Party A repair it by itself and Party A shall reimburse Party B for the expenses7-2租赁期间,乙方应合理使用并爱护该房屋及其附属设施。因乙方使用不当或 不合理使用,使该房屋及其附属设施损坏或发生故障的,乙方应负责维修。乙方拒 不维修,甲方可代为维修,费用由乙方承担。上海市房屋租赁合同中英文During the lease period, Party B shall take care of and use the Premises and the attache

In the event that the Premises and facilities are damaged by Party B due to its improper use, Party B shall immediately repair and pay for the costs of such repairs In the event that Party B fails to repair items damaged due to improper use by Party B, Party A shall have the r
14、ight to repair and the costs of such repairs is to be reimbursed to Party A by Party B.7- 3租赁期间,甲方保证该房屋及其附属设施处于正常的可使用和安全的状态。 甲方对该房屋进行检查、养护,应提前 三日通知乙方。检查养护时,乙方应予以 配合。甲方应减少对乙方使用该房屋的影响。During the lease period, Party A shall ensure the Premises are in the good and safe conditio n Party A shall give a wr
15、it ten notice to Par ty days prior to inspection and maintain the Premises and the attached facilities Party B shall assist in and cooperate with Party A willingly.Party A shall reduce and inconvenience caused to Party B.八、房屋返还时的状态Article 8 Premises returning situation8- 1除甲方同意乙方续租外,乙方应在本合同的租期届满后的当日

19、Premises without Party A s written consent十、解除本合同的条件Article 10 The condition of dissolution10- 1甲乙双方同意在租赁期内,有下列情况之一的,本合同终止,双方互不承担 责任:(一)该房屋占用范围内的土地使用权依法提前收回的;(二)该房屋因社会公共利益被依法征用的;(三)该房屋毁损、灭或者被鉴定为危险房屋的;上海市房屋租赁合同中英文During the lease period, this Agreement shall be terminated when one of the following ev
20、ents occurs.(1) The land use right of the area where the Premises is located shall be taken back aheadof the schedule according to the law;(2 ) The Premises shall be confiscated for the benefit of public interest;(3) The Premises is damage, or be appraised as dangerous Premises.10- 2甲乙双方同意,有下列情形之一的,
21、一方可书面通知另一方解除本合同。违 反合同的一方,应向另一方按月租金的双倍支付违约金;给对方造成损失的,支 付的违约金不足抵付一方损失的,还应赔偿造成的损失及违约金的差额部分;(一)甲方未按时交付该房屋,经乙方催告后十日内仍未交付的;(二)甲方交付的该房屋不符合本合同的约定,致使不能实现租赁目的的;或甲 方交付的房屋危及乙方安全的。(三)乙方未征得甲方书而同意改变房屋用途,致使房屋损坏的;(四)因乙方原因造成房屋主体结构损失的;(五)乙方擅自分租或隔间群租或转租该房屋、转让该房屋承租权或及他人交换 各自承租的房屋的;(六)乙方逾期不支付租金累计超过半个月的;(七)乙方逾期不支付房屋租赁保证金的
22、。Both of Party A and Party B agree that one party can notify the other Party to terminate the contract under the following circumstances. 23、 s losses exceeds the default penalty, the Party breaking the terms of this Agreement shall pay the default penalty as mentioned above and be responsible to compensated the other Partyf s losses(1) In the event that Party A fails to deliver the Premises to Party B in accordance with days but stills
24、have not delivered;(2)(3)(4)(5)(6)(7)十一、违约责任Article 10 responsibilities for Breach Party A delivers the Premises not accordance with the Agreement, rendering it not rent able; or Party A delivers the defec tive Premises to Party B, making it unsafe; Without Party A s writ ten consent, Party B change
25、s the use of the Premises as stipulated in this Agreement thereby damaging the Premises; Due to any other reasons of Party B, making the Premise s main st rue ture defec ti ve; Party B wit hout Party A s written consent sub-lease, assign or sublet the Premises to others of exchange the Premises with
26、 others; Party B delay in payment for the rental for more than days Party B delay in payment for the deposit.上海市房屋租赁合同中英文11- 1租赁期间,甲方不及时履行本合同约定的维修、养护责任,致使房屋损坏, 造成乙方财产损失或人身伤害的,甲方应承担赔偿责任。During the lease period, due to the delay in performing repair and maintenance as agreed by Party A, Party A shall
27、be responsible to compensate for the damages of the Premises and / or the property damages and/or the personal injuries of Party B.11- 2租赁期间,非本合同规定的情况甲方擅自解除本合同,提前收回该房屋的, 甲方应向乙方支付违约金。若支付的违约金不足抵付乙方损失的,甲方还应负责赔 偿。 During the lease period, Party A shall pay penalty to Party B in the event that Party A te
28、rminates this Agreement and takes back the Premises before the expiration date for reasons other than that as provided in the Agreements Party A shall be responsible to compensate. For Party B s losses in the event that default penalty is insufficient to cover Party s losses11-3乙方未征得甲方书面同意或者超出甲方书面同意
29、的范围和要求装修房屋或 者超出甲方书面同意的范围和要求装修房屋或者增设附属设施的,甲方可以要求乙 方赔偿损失。If Party B has not obtained Party A s prior written consent or exceeds the scope of Party A, s prior written consent to renovate the Premises and ins tall attached appliances, Par t A have righ t to ask Party B cover its loss cover its losses11-

31、ty A s losses十二、其他条款Article 12 Miscellanties12- 1本合同自生效。This Agreement shall come into effect after12- 2本合同未尽事宜,经甲、乙双方协商一致,可订立补充条款。本合同补充条 款及附件均为本合同不可分割的一部分,本合同及其补充条款和附件内空格部分填写 的文字及铅印文字具有同等效力。The matters not covered in this Agreeme nt may be included in a suppl eme nt ary agreement after consultation and consent by both Parties hereto However, the terms of supplementary agreement and the schedule shall be the integral part of t his Agreemen t The handwrit ten charac ters will have the same effect as the printed characters12-3甲、乙双方在签署本合同时,对各自的权利、义务、责任清楚明白,并愿按
