PREAMBLE

WE,THEPEOPLESOftheMemberstatesoftheAssociationofsoutheastAsianNations(ASEAN),asrepresentedbytheHeadsofstateorGovernmentofBruneiDarussalam,thekingdomofcambodia,theRepublicofIndonesia,theLaopeople'sDemocraticRepublic,Malaysia,theunionofMyanmar,theRepublicofthephilippines,theRepublicofsingapore,thekingdomofThailandandthesocialistRepublicofvietNam:

andexpansionofASEANSinceitsestablishmentinBangkokthroughthepromulgationofTheASEANDeclaration;

RECALLINGthedecisionstoestablishanASEANcharterinthevientianeActionprogramme,thekualaLumpurDeclarationontheEstablishmentoftheASEANcharterandthecebuDeclarationontheBlueprintoftheASEANCharter;

MINDFULOftheexistenceofmutualinterestsandinterdependenceamongthepeoplesandMemberstatesofASEANWhichareboundbygeography,commonobjectivesandshareddestiny

andonecaringandsharingcommunity;

aregionoflastingpeace,securityandstability,sustainedeconomicgrowth,sharedprosperityandsocialprogress,andtopromoteourvitalinterests,idealsandaspirations;

RESPECTINGthefundamentalimportanceofamityandcooperation,andtheprinciplesofsovereignty,equality,territorialintegrity,non-interference,consensusandunityindiversity;

lawandgoodgovernance,respectforandprotectionofhumanrightsandfundamentalfreedoms;

RESOLVEDtoensuresustainabledevelopmentforthebenefitofpresentandfuturegenerationsandtoplacethewell-being,livelihoodandwelfareofthepeoplesatthecentreoftheASEANCommunitybuildingprocess;

CONVINCEDOftheneedtostrengthenexistingbondsofregionalsolidaritytorealiseanASEANcommunitythatispoliticallycohesive,economicallyintegratedandsociallyresponsibleinordertoeffectivelyrespondtocurrentandfuturechallengesandopportunities;

COMMITTEDtointensifyingcommunitybuildingthroughenhancedregionalcooperationandintegration,inparticularbyestablishinganASEANCommunitycomprisingtheASEANsecuritycommunity,theASEANEconomiccommunityandtheASEANSocio-cultural

community,asprovidedforintheBaliDeclarationofASEANconcordI;

HEREBYDECIDEtoestablish,throughthischarter,thelegalandinstitutionalframeworkforASEAN,

ANDTOTHISEND,theHeadsofstateorGovernmentoftheMemberstatesofASEAN,assembledinsingapore

foundingofASEAN,haveagreedtothischarter.

CHAPTERI

ARTICLE1PURPOSES

ThepurposesofASEANare:

1.Tomaintainandenhancepeace,securityandstabilityandfurtherstrengthenpeace-orientedvaluesintheregion;

2.TOenhanceregionalresiliencebypromotinggreaterpolitical,security,economicandsocio-culturalcooperation;

3.TOPreservesoutheastAsiaasaNuclearweapon-Freezoneandfreeofallotherweaponsofmassdestruction;

4.TOensurethatthepeoplesandMemberstatesofASEANliveinpeacewiththeworldatlargeinajust,democraticandharmoniousenvironment;

5.Tocreateasinglemarketandproductionbasewhichisstable,prosperous,highlycompetitiveandeconomicallyintegratedwitheffectivefacilitationfortradeandinvestmentinwhichthereisfreeflowofgoods,servicesandinvestment;facilitatedmovementofbusinesspersons,professionals,talentsandlabour;andfreerflowofcapital;

6.ToalleviatepovertyandnarrowthedevelopmentgapwithinASEANthroughmutualassistanceandcooperation;

7.Tostrengthendemocracy,enhancegoodgovernanceandtheruleoflaw,andtopromoteandprotecthumanrightsandfundamentalfreedoms,withdueregardtotherightsandresponsibilitiesoftheMemberstatesofASEAN;

8.TOrespondeffectively,inaccordancewiththeprincipleofcomprehensivesecurity,toallformsofthreats,transnationalcrimesandtransboundarychallenges;

9.Topromotesustainabledevelopmentsoastoensuretheprotectionoftheregion'senvironment,thesustainabilityofitsnaturalresources,thepreservationofitsculturalheritageandthehighqualityoflifeofitspeoples;

10.TOdevelophumanresourcesthroughclosercooperationineducationandlife-longlearning,andin

scienceandtechnology,fortheempowermentofthepeoplesofASEANandforthestrengtheningoftheASEANcommunity;

11.TOenhancethewell-beingandlivelihoodofthepeoplesofASEANbyprovidingthemwithequitableaccesstoopportunitiesforhumandevelopment,socialwelfareandjustice;

12.Tostrengthencooperationinbuildingasafe,secureanddrug-freeenvironmentforthepeoplesofASEAN;

13.TOPromoteapeople-orientedASEANinwhichallsectorsofsocietyareencouragedtoparticipatein,andbenefitfrom,theprocessofASEANintegrationandcommunitybuilding;

14.TopromoteanASEANidentitythroughthefosteringofgreaterawarenessofthediversecultureandheritageoftheregion;and

15.TomaintainthecentralityandproactiveroleofASEANastheprimarydrivingforceinitsrelationsandcooperationwithitsexternalpartnersinaregionalarchitecturethatisopen,transparentandinclusive.

ARTICLE2PRINCIPLES

1.InpursuitofthepurposesstatedinArticle1,ASEAN

anditsMemberstatesreaffirmandadheretothefundamentalprinciplescontainedinthedeclarations,

agreements,conventions,concords,treatiesandotherinstrumentsofASEAN.

2.ASEANanditsMemberstatesshallactinaccordancewiththefollowingprinciples:

(a)respectfortheindependence,sovereignty,equality,territorialintegrityandnationalidentityofallASEANMemberstates;

(b)sharedcommitmentandcollectiveresponsibilityinenhancingregionalpeace,securityandprosperity;

(c)renunciationofaggressionandofthethreatoruseofforceorotheractionsinanymannerinconsistentwithinternationallaw;

(d)relianceonpeacefulsettlementofdisputes;

(e)non-interferenceintheinternalaffairsofASEAN

Memberstates;

(f)respectfortherightofeveryMemberstateto

leaditsnationalexistencefreefromexternalinterference,subversionandcoercion;

(g)enhancedconsultationsonmattersseriouslyaffectingthecommoninterestofASEAN;

(h)adherencetotheruleoflaw,goodgovernance,theprinciplesofdemocracyandconstitutionalgovernment;

(i)respectforfundamentalfreedoms,thepromotionandprotectionofhumanrights,andthepromotionofsocialjustice;

(i)upholdingtheunitedNationscharterandinternationallaw,includinginternationalhumanitarianlaw,subscribedtobyASEANMemberstates;

(k)abstentionfromparticipationinanypolicyoractivity,includingtheuseofitsterritory,pursuedbyanyASEANMemberstateornon-ASEANstateoranynon-stateactor,whichthreatensthesovereignty,territorialintegrityorpoliticalandeconomicstabilityofASEANMemberstates;

()respectforthedifferentcultures,languagesandreligionsofthepeoplesofASEAN,whileemphasisingtheircommonvaluesinthespiritofunityindiversity;

(m)thecentralityofASEANinexternalpolitical,economic,socialandculturalrelationswhileremainingactivelyengaged,outward-looking,inclusiveandnon-discriminatory;and

(n)adherencetomultilateraltraderulesandASEAN'srules-basedregimesforeffectiveimplementationofeconomiccommitmentsandprogressivereductiontowardseliminationofallbarrierstoregionaleconomicintegration,inamarket-driveneconomy.

CHAPTERIl

ARTICLE3

ASEAN,asaninter-governmentalorganisation,isherebyconferredlegalpersonality.

CHAPTERIllMEMBERSHIP

ARTICLE4

TheMemberstatesofASEANareBruneiDarussalam,thekingdomofcambodia,theRepublicofIndonesia,theLaopeople'SDemocraticRepublic,Malaysia,theunionofMyanmar,theRepublicofthephilippines,theRepublicofsingapore,thekingdomofThailandandthesocialistRepublicofvietNam.

ARTICLE5

1.Memberstatesshallhaveequalrightsandobligations

underthischarter.

2.Memberstatesshalltakeallnecessarymeasures,

includingtheenactmentofappropriatedomesticlegislation,toeffectivelyimplementtheprovisionsofthischarterandtocomplywithallobligationsofmembership.

compliance,themattershallbereferredtoArticle20.

ARTICLE6

1.TheprocedureforapplicationandadmissiontoASEANShallbeprescribedbytheASEANCoordinatingcouncil.

2.Admissionshallbebasedonthefollowingcriteria:

(a)locationintherecognisedgeographicalregionof

southeastAsia;

(b)recognitionbyallASEANMemberstates;

(c)agreementtobeboundandtoabidebythe

charter;and

(d)abilityandwillingnesstocarryouttheobligationsofMembership.

3.AdmissionshallbedecidedbyconsensusbytheASEANsummit,upontherecommendationoftheASEANcoordinatingcouncil.

4.AnapplicantstateshallbeadmittedtoASEANUponsigninganInstrumentofAccessiontothecharter.

CHAPTERIVORGANS

ARTICLE7

ASEANSUMMIT

1.TheASEANSummitshallcomprisetheHeadsof

stateorGovernmentoftheMemberstates.

2.TheASEANSummitshall:

(a)bethesupremepolicy-makingbodyofASEAN;

(b)deliberate,providepolicyguidanceandtakedecisionsonkeyissuespertainingtotherealisationoftheobjectivesofASEAN,importantmattersofinteresttoMemberstatesandallissuesreferredtoitbytheASEANCoordinatingcouncil,theASEANcommunitycouncilsandASEANSectoralMinisterialBodies;

(c)instructtherelevantMinistersineachofthecouncilsconcernedtoholdadhocinter-Ministerialmeetings,andaddressimportantissuesconcerningASEANthatcutacrossthecommunitycouncils.RulesofprocedureforsuchmeetingsshallbeadoptedbytheASEANcoordinatingcouncil;

(d)addressemergencysituationsaffectingASEANbytakingappropriateactions;

(e)decideonmattersreferredtoitunderchapters

VIlandvIll;

(f)authorisetheestablishmentandthedissolution

ofsectoralMinisterialBodiesandotherASEANinstitutions;and

(g)appointthesecretary-GeneralofASEAN,withtherankandstatusofMinister,whowillservewiththeconfidenceandatthepleasureoftheHeadsofstateorGovernmentupontherecommendationoftheASEANForeignMinistersMeeting.

3.ASEANsummitMeetingsshallbe:

(a)heldtwiceannually,andbehostedbytheMemberstateholdingtheASEANchairmanship;and

(b)convened,whenevernecessary,asspecialoradhocmeetingstobechairedbytheMemberstateholdingtheASEANChairmanship,atvenuestobeagreeduponbyASEANMemberstates.

ARTICLE8

1.TheASEANCoordinatingcouncilshallcomprisetheASEANForeignMinistersandmeetatleasttwiceayear.

2.TheASEANCoordinatingcouncilshall:

(a)preparethemeetingsoftheASEANSummit;

(b)coordinatetheimplementationofagreementsand

decisionsoftheASEANSummit;

(c)coordinatewiththeASEANcommunitycouncilstoenhancepolicycoherence,efficiencyandcooperationamongthem;

(d)coordinatethereportsoftheASEANcommunity

councilstotheASEANSummit;

(e)considertheannualreportofthesecretary-

GeneralontheworkofASEAN;

(f)considerthereportofthesecretary-GeneralonthefunctionsandoperationsoftheASEANsecretariatandotherrelevantbodies;

(g)approvetheappointmentandterminationoftheDeputysecretaries-Generalupontherecommendationofthesecretary-General;and

(h)undertakeothertasksprovidedforinthischarterorsuchotherfunctionsasmaybeassignedbytheASEANSummit.

3.TheASEANcoordinatingcouncilshallbesupportedbytherelevantseniorofficials.

ARTICLE9

1.TheASEANcommunitycouncilsshallcomprisetheASEANPolitical-securitycommunitycouncil,ASEANEconomiccommunitycouncil,andASEANSocio-culturalcommunitycouncil.

2.EachASEANCommunitycouncilshallhaveunderitspurviewtherelevantASEANSectoralMinisterialBodies.

3.EachMemberstateshalldesignateitsnationarepresentationforeachASEANcommunitycouncilmeeting.

4.InordertorealisetheobjectivesofeachofthethreepillarsoftheASEANCommunity,eachASEANcommunitycouncilshall:

(a)ensuretheimplementationoftherelevant

decisionsoftheASEANSummit;

(b)coordinatetheworkofthedifferentsectorsunder

itspurview,andonissueswhichcutacrosstheothercommunitycouncils;and

(c)submitreportsandrecommendationstotheASEANSummitonmattersunderitspurview.

5.EachASEANCommunitycouncilshallmeetatleasttwiceayearandshallbechairedbytheappropriateMinisterfromtheMemberstateholdingtheASEANchairmanship.

6.EachASEANcommunitycouncilshallbesupportedbytherelevantseniorofficials.

ARTICLE10

(a)functioninaccordancewiththeirrespective

establishedmandates;

(b)implementtheagreementsanddecisionsoftheASEANSummitundertheirrespectivepurview;

(c)strengthencooperationintheirrespectivefieldsinsupportofASEANintegrationandcommunitybuilding;and

(d)submitreportsandrecommendationstotheirrespectivecommunitycouncils.

2.EachASEANSectoralMinisterialBodymayhaveunderitspurviewtherelevantseniorofficialsandsubsidiarybodiestoundertakeitsfunctionsascontainedinAnnex1.TheAnnexmaybeupdatedbythesecretary-GeneralofASEANUpontherecommendationofthecommitteeofpermanentRepresentativeswithoutrecoursetotheprovisiononAmendmentsunderthischarter.

ARTICLE11

1.Thesecretary-GeneralofASEANshallbeappointedbytheASEANsummitforanon-renewabletermofoffice

offiveyears,selectedfromamongnationalsoftheASEANMemberstatesbasedonalphabeticalrotation,withdueconsiderationtointegrity,capabilityandprofessionalexperience,andgenderequality.

2.Thesecretary-Generalshall:

(a)carryoutthedutiesandresponsibilitiesofthishighofficeinaccordancewiththeprovisionsofthischarterandrelevantASEANinstruments,protocolsandestablishedpractices;

(b)facilitateandmonitorprogressintheimplementationofASEANagreementsanddecisions,andsubmitanannualreportontheworkofASEANtotheASEANSummit;

(c)participateinmeetingsoftheASEANSummit,theASEANCommunitycouncils,theASEANcoordinatingcouncil,andASEANSectoralMinisterialBodiesandotherrelevantASEANmeetings;

(d)presenttheviewsofASEANandparticipateinmeetingswithexternalpartiesinaccordancewithapprovedpolicyguidelinesandmandategiventothesecretary-General;and

(e)recommendtheappointmentandterminationoftheDeputysecretaries-GeneraltotheASEANcoordinatingcouncilforapproval.

3.Thesecretary-Generalshallalsobethechief

AdministrativeofficerofASEAN.

4.Thesecretary-GeneralshallbeassistedbyfourDeputysecretaries-GeneralwiththerankandstatusofDeputyMinisters.TheDeputysecretaries-Generalshallbeaccountabletothesecretary-Generalincarryingouttheirfunctions.

5.ThefourDeputysecretaries-Generalshallbeofdifferentnationalitiesfromthesecretary-GeneralandshallcomefromfourdifferentASEANMemberstates.

6.ThefourDeputysecretaries-Generalshallcomprise:

(a)twoDeputysecretaries-Generalwhowillserveanon-renewabletermofthreeyears,selectedfromamongnationalsoftheASEANMemberstatesbasedonalphabeticalrotation,withdueconsiderationtointegrity,qualifications,competence,experienceandgenderequality;and

(b)twoDeputysecretaries-Generalwhowillserveatermofthreeyears,whichmayberenewedforanotherthreeyears.ThesetwoDeputysecretaries-Generalshallbeopenlyrecruitedbasedonmerit.

7.TheASEANsecretariatshallcomprisethesecretary-Generalandsuchstaffasmayberequired.

8.Thesecretary-Generalandthestaffshall:

(a)upholdthehigheststandardsofintegrity,efficiency,andcompetenceintheperformanceoftheirduties;

(b)notseekorreceiveinstructionsfromanygovernmentorexternalpartyoutsideofASEAN;and

(c)refrainfromanyactionwhichmightreflectontheirpositionasASEANSecretariatofficialsresponsibleonlytoASEAN.

9.EachASEANMemberstateundertakestorespecttheexclusivelyASEANCharacteroftheresponsibilitiesofthesecretary-Generalandthestaff,andnottoseektoinfluencetheminthedischargeoftheirresponsibilities.

ARTICLE12

TOASEAN

1.EachASEANMemberstateshallappointapermanentRepresentativetoASEANwiththerankofAmbassadorbasedinJakarta.

2.ThepermanentRepresentativescollectivelyconstituteacommitteeofpermanentRepresentatives,whichshall:

(a)supporttheworkoftheASEANCommunity

councilsandASEANsectoralMinisterialBodies;

(b)coordinatewithASEANNationalsecretariatsand

otherASEANsectoralMinisterialBodies;

(c)liaisewiththesecretary-GeneralofASEANandtheASEANSecretariatonallsubjectsrelevanttoitswork

(d)facilitateASEANCooperationwithexternalpartners;and

(e)performsuchotherfunctionsasmaybedeterminedbytheASEANCoordinatingcouncil.

ARTICLE13

(a)serveasthenationalfocalpoint;

(b)betherepositoryofinformationonallASEAN

mattersatthenationallevel;

(c)coordinatetheimplementationofASEAN

decisionsatthenationallevel;

(d)coordinateandsupportthenationalpreparationsofASEANmeetings;

(e)promoteASEANidentityandawarenessatthe

nationallevel;and

(f)contributetoASEANCommunitybuilding.

ARTICLE14

1.InconformitywiththepurposesandprinciplesoftheASEANCharterrelatingtothepromotionandprotectionofhumanrightsandfundamentalfreedoms,ASEANshallestablishanASEANhumanrightsbody.

2.ThisASEANhumanrightsbodyshalloperatein

accordancewiththetermsofreferencetobedeterminedbytheASEANForeignMinistersMeeting.

ARTICLE15

1.TheASEANFoundationshallsupportthesecretary-GeneralofASEANandcollaboratewiththerelevantASEANbodiestosupportASEANCommunitybuildingbypromotinggreaterawarenessoftheASEANidentity,people-to-peopleinteraction,andclosecollaborationamongthebusinesssector,civilsociety,academiaandotherstakeholdersinASEAN.

2.TheASEANFoundationshallbeaccountabletothesecretary-GeneralofASEAN,whoshallsubmititsreporttotheASEANsummitthroughtheASEANCoordinatingcouncil.

CHAPTERV

ARTICLE16

1.ASEANmayengagewithentitieswhichsupporttheASEANcharter,inparticularitspurposesandprinciples.TheseassociatedentitiesarelistedinAnnex2.

2.RulesofprocedureandcriteriaforengagementshallbeprescribedbythecommitteeofpermanentRepresentativesupontherecommendationofthesecretary-GeneralofASEAN.

3.Annex2maybeupdatedbythesecretary-GeneralofASEANUpontherecommendationofthecommitteeofpermanentRepresentativeswithoutrecoursetotheprovisiononAmendmentsunderthischarter.

CHAPTERVI

ARTICLE17

1.ASEANShallenjoyintheteritoriesoftheMemberstatessuchimmunitiesandprivilegesasarenecessaryforthefulfilmentofitspurposes.

2.TheimmunitiesandprivilegesshallbelaiddowninseparateagreementsbetweenASEANandthehostMemberstate.

ARTICLE18

IMMUNITIESANDPRIVILEGESOFTHE

1.Thesecretary-GeneralofASEANandstaffoftheASEANSecretariatparticipatinginofficialASEANactivitiesorrepresentingASEANintheMemberstatesshallenjoysuchimmunitiesandprivilegesasarenecessaryfortheindependentexerciseoftheirfunctions.

2.TheimmunitiesandprivilegesunderthisArticleshallbelaiddowninaseparateASEANagreement.

ARTICLE19

IMMUNITIESANDPRIVILEGESOFTHE

1.ThepermanentRepresentativesoftheMemberstatestoASEANandofficialsoftheMemberstatesparticipatinginoficialASEANactivitiesorrepresentingASEANintheMemberstatesshallenjoysuchimmunitiesandprivilegesasarenecessaryfortheexerciseoftheirfunctions.

2.TheimmunitiesandprivilegesofthepermanentRepresentativesandofficialsonASEANdutiesshallbe

governedbythe1961viennaconventiononDiplomatic

CHAPTERVIl

ARTICLE20

1.Asabasicprinciple,decision-makinginASEANshall

bebasedonconsultationandconsensus.

2.whereconsensuscannotbeachieved,theASEANsummitmaydecidehowaspecificdecisioncanbemade.

ARTICLE23

GOODOFFICES,CONCILIATIONANDMEDIATION

1.Memberstateswhicharepartiestoadisputemayatanytimeagreetoresorttogoodoffices,conciliationormediationinordertoresolvethedisputewithinanagreedtimelimit.

2.partiestothedisputemayrequestthechairmanofASEANorthesecretary-GeneralofASEAN,actinginanex-officiocapacity,toprovidegoodoffices,conciliationormediation.

ARTICLE24

INSTRUMENTS

1.DisputesrelatingtospecificASEANinstrumentsshallbesettledthroughthemechanismsandproceduresprovidedforinsuchinstruments.

2.DisputeswhichdonotconcerntheinterpretationorapplicationofanyASEANinstrumentshallberesolvedpeacefullyinaccordancewiththeTreatyofAmityandcooperationinsoutheastAsiaanditsrulesofprocedure.

3.wherenototherwisespecificallyprovided,disputeswhichconcerntheinterpretationorapplicationofASEANeconomicagreementsshallbesettledinaccordancewiththeASEANProtocolonEnhancedDisputesettlementMechanism.

ARTICLE25

MECHANISMS

wherenototherwisespecificallyprovided,appropriatedisputesettlementmechanisms,includingarbitration,shallbeestablishedfordisputeswhichconcerntheinterpretationorapplicationofthischarterandotherASEANinstruments.

ARTICLE26

whenadisputeremainsunresolved,aftertheapplicationoftheprecedingprovisionsofthischapter,thisdisputeshallbereferredtotheASEANSummit,foritsdecision.

ARTICLE27COMPLIANCE

1.Thesecretary-GeneralofASEAN,assistedbytheASEANsecretariatoranyotherdesignatedASEANbody,shallmonitorthecompliancewiththefindings,recommendationsordecisionsresultingfromanASEANdisputesettlementmechanism,andsubmitareporttotheASEANSummit.

2.AnyMemberstateaffectedbynon-compliancewiththefindings,recommendationsordecisionsresultingfromanASEANdisputesettlementmechanism,mayreferthemattertotheASEANSummitforadecision.
