PLANTPROTECTIONACTAnActtopreventtheimportation,exportationandspreadofpestsinjurioustoplantsandtoprovidefortheircontrolanderadicationandforthecertificationofplantsandotherthingsPURPOSE--s.2PurposeoftheAct--s.22.ThepurposeofthisActistoprotectplantlifeandtheagriculturalandforestrysectorsoftheCanadianeconomybypreventingtheimportation,exportationandspreadofpestsandbycontrollingoreradicatingpestsinCanada.CONTROLOFPESTS--ss.5to10General--ss.5to6DutytonotifyMinister--s.55.Whereapersonbecomesawareoftheexistenceofathingthatthepersonsuspectstobeapestinanareawherethepesthasnotpreviouslybeenknowntoexist,thepersonshallimmediatelynotifytheMinisterofthesuspectedpestandprovidetheMinisterwithaspecimenofit.Prohibition--s.6(1)6.(1)ExceptaspermittedunderthisActortheregulations,nopersonshallmove,grow,raise,cultureorproduceanythingthattherearereasonablegroundstobelieveisapest,thatisorcouldbeinfestedwithapestorthatconstitutesorcouldconstituteabiologicalobstacletothecontrolofapest.Prohibitionofmovement--s.6(2)(2)Whereaninspectorbelievesonreasonablegroundsthatathingisapest,isorcouldbeinfestedwithapestorconstitutesorcouldconstituteabiologicalobstacletothecontrolofapest,theinspectormayprohibittheownerofthethingorthepersonhavingthepossession,careorcontrolofitfrommovingitwithoutthewrittenauthorizationofaninspector.Notice--s.6(3)(3)Aprohibitionundersubsection(2)shallbecommunicatedbypersonaldeliveryofanoticetotheownerorpersonhavingthepossession,careorcontrol,orbysendingthenoticetotheownerorperson.PermissiontomoveundertheRegulations4.Forthepurposesofsection5oftheAct,thespecimenofasuspectedpestthatistobeprovidedtotheMinistershallbetreated,packaged,containedandmovedinsuchamannerastopreventthesuspectedpestfromescaping.ProhibitionexemptionsundertheRegulations5.(1)Forthepurposesofsubsection6(1)oftheAct,apersonmayundertakeanyactivityreferredtointhatsubsectioninrespectofathingthatisapest,isorcouldbeinfestedorisorcouldconstituteabiologicalobstacletothecontrolofapestif(a)theMinisteroraninspectordeterminesthattheactivityisforthepurposeofscientificresearch,educational,processing,industrialorexhibitionpurposes;(b)thepersonobtainsawrittenauthorizationissuedbytheMinisteroraninspectorinaccordancewithsubsection(2);(c)thethingispackaged,transported,handled,controlledandusedinamannerthatensuresapestorbiologicalobstacletothecontrolofapestisnotspreadwithinorfromCanada;(d)thethingismovedinaccordancewiththerequirementsofPartIII;and(e)wherethethingoranyremainsofthethingorportionthereofistobedisposedof,theownerorthepersonhavingthepossession,careorcontrolofthething,remainsorportionthereofdisposesofitinamannerthat (i)ensuresthatapestorbiologicalobstacletothecontrolofapestwillnotspread,and (ii)destroysanypestorbiologicalobstacletothecontrolofapestorensuresthatthepestorbiologicalobstacletothecontrolofapestisnon-viable.CONTROLOFPESTS--ss.5to10ImportationandExportation--ss.7to9Presentationforinspection--s.7(1)7.(1)NopersonshallimportoradmitintoCanadaorexportfromCanadaanythingthatisapest,thatisorcouldbeinfestedwithapestorthatconstitutesorcouldconstituteabiologicalobstacletothecontrolofapest,unless(a)thethingisorhasbeenpresentedtoaninspectorinaccordancewithsubsection(2)ataplacedesignatedbytheregulationsorbyaninspector;(b)thepersonhasproducedtoaninspectorallpermits,certificatesandotherdocumentationrequiredbytheregulations;and(c)thethingisimportedorexportedinaccordancewithanyotherrequirementsoftheregulations.Mannerofpresentationforinspection--s.7(2)(2)Athingthatisrequiredtobeinspectedshallbepresentedinsuchmannerandundersuchconditionsastheinspectorconsidersnecessarytocarryouttheinspection.ImportRequirementsundertheRegulations39.Everypersonshall,atthetimeofimportationintoCanadaofanythingthatisapest,isorcouldbeinfestedorconstitutesorcouldconstituteabiologicalobstacletothecontrolofapest,declarethatthingtoaninspectororcustomsofficerataplaceofentrysetoutinsubsection40(1).40.(1)TheCanadiancustomsofficesandAgencyofficesatthefollowingplacesaredesignatedasplacesofentrywherethingsshallbepresentedforinspectionandadmittancetoCanada:CONTROLOFPESTS--ss.5to10ImportationandExportation--ss.7to9Removalofimports--s.8(1)8.(1)WhereaninspectorbelievesonreasonablegroundsthatathinghasbeenimportedintoCanadaandthatit(a)wasimportedincontraventionofthisActortheregulations,or(b)isapest,isorcouldbeinfestedwithapestorconstitutesorcouldconstituteabiologicalobstacletothecontrolofapest,theinspectormay,whetherornotthethingisseized,requiretheownerofthethingorthepersonhavingthepossession,careorcontrolofittoremoveitfromCanada.Notice--s.8(2)(2)Arequirementundersubsection(1)shallbecommunicatedbypersonaldeliveryofanoticetotheownerorpersonhavingthepossession,careorcontrolofthething,orbysendingthenoticetotheownerorperson,andthenoticemayspecifytheperiodwithinwhichorthemannerinwhichthethingistoberemoved.CONTROLOFPESTS--ss.5to10ImportationandExportation--ss.7to9Forfeiturewherenon-compliance--s.8(3)(3)WhereathingisnotremovedfromCanadaasrequiredunderthissection,itshall,notwithstandingsection32,beforfeitedtoHerMajestyinrightofCanadaandmaybedisposedofastheMinistermaydirect.Prohibitionofpossessionordisposition--s.9(1)9.(1)NopersonshallpossessordisposeofathingthatthepersonknowswasimportedincontraventionofthisActortheregulations.Presumption--s.9(2)(2)Inanyprosecutionforanoffenceundersubsection(1),anaccusedwhoisfoundtohavebeeninpossessionofathingthatwasimportedincontraventionofthisActortheregulationsshallbeconsidered,intheabsenceofevidencetothecontrary,tohaveknownthatthethingwassoimported.CONTROLOFPESTS--ss.5to10InternationalAssistance--s.10AssistanceincontrollingoreradicatingpestsoutsideCanada--s.1010.TheMinistermayprovidefinancialortechnicalassistancetoanypersonorgovernmentoutsideCanadaincontrollingoreradicatingapestthataffectsorcouldaffectplants,orproductsorby-productsofplants,inCanada.INFESTEDPLACES--ss.11to18Declarationofinfestedplace--s.11(1)11.(1)Whereaninspectorsuspectsordeterminesthataplaceisinfestedwithapestandisoftheopinionthatthepestcouldspread,theinspectormayinwritingdeclarethattheplaceisinfested.Deliveryofdeclaration--s.11(2)(2)Whenthedeclarationisdeliveredtotheoccupierorowneroftheplacetowhichitrelates,theplace,togetherwithallcontiguouslands,buildingsandotherplacesoccupiedorownedbytheoccupierorowner,constitutesaninfestedplaceuntiltheMinisterdeterminesotherwise.Furtherdeclaration--s.12(1)12.(1)Whereaninspectordeclaresundersection11thataplaceisinfestedandisoftheopinionthatthepestcouldspreadtoanyotherland,buildingorplace,theinspectormayinwritingdeclarethattheotherland,buildingorplaceisinfested.Deliveryofdeclaration--s.12(2)(2)Whenadeclarationisdeliveredtotheoccupierorownerofanyland,buildingorplacementionedinsubsection(1),theland,buildingorplace,togetherwithallcontiguouslands,buildingsandplacesoccupiedorownedbythesameoccupierorowner,constitutespartoftheinfestedplace.INFESTEDPLACES--ss.11to18Interimpowersofinspector--s.13(1)13.(1)Whereaninspectorisoftheopinionthatimmediateactionisrequiredtocontrolapest,theinspectormay,inadeclarationundersection11or12,andforaperiodofnotmorethanninetydays,prohibitorrestrictthemovementofpersonsandthingswithin,intooroutoftheinfestedplaceforthepurposeofcontrollingthepest.Cessationofprohibitionorrestriction--s.13(2)(2)Aprohibitionorrestrictioncontainedinadeclarationundersection11or12ceasestohaveeffectwhere(a)theinspectorrescindstheprohibitionorrestriction;or(b)thedeclarationisrevokedbytheMinisterundersubsection15(2).Whereoccupierorownernotfound--s.1414.Whereaninspectorcannot,aftertheexerciseofduediligence,findtheoccupierorownerofanyland,buildingorotherplace,deliveryofadeclarationmaybeeffectedbypostingitonthebuildingoronanybuildingorconspicuousobjectonthelandorattheplace.INFESTEDPLACES--ss.11to18ReporttoMinister--s.15(1)15.(1)Aninspectorwhodeclaresthataplaceisinfestedshall,assoonasispracticable,sendareportofthedeclarationtotheMinister.Revocationofdeclaration--s.15(2)(2)Whereaplacehasbeendeclaredinfestedundersection11or12,theMinistermayrevokethedeclarationand,onrevocation,theplaceshallceasetobeaninfestedplace.PowersofMinister--s.15(3)(3)TheMinistermay,byorder,(a)declareanyplacetobeinfestedthatisnotalreadythesubjectofadeclarationundersection11or12;(b)determineandsubsequentlyvarytheareaofanyplacethatisdeclaredinfested;(c)extendtheperiodofanyprohibitionorrestrictiondeclaredbyaninspectorundersubsection13(1);(d)prohibitorrestrictthemovementofpersonsandthingswithin,intooroutofanyplacethatisdeclaredinfested;and(e)permitanymovementofpersonsandthingswithin,intooroutofaplacethatwouldotherwisebeprohibitedbythissectionorsection6.INFESTEDPLACES--ss.11to18Descriptionofareaofinfestedplace--s.1616.Inadeclarationundersection11or12orsubsection15(3),theareaofaninfestedplacemaybedescribedbyreferencetoamaporplandepositedandpubliclyavailableataplacespecifiedinthedeclaration,orbyreferencetoanyfarm,county,district,municipality,provinceoranypartthereof.Prohibitionorrestrictionsupersedes--s.1717.AprohibitionorrestrictionimposedbytheMinisteroraninspectorsupersedesanyorderofalocalauthoritythatisinconsistentwithit.Notastatutoryinstrument--s.1818.Adeclarationundersection11or12,arevocationofadeclarationundersubsection15(2)andanorderundersubsection15(3)arenotstatutoryinstrumentsforthepurposesoftheStatutoryInstrumentsAct,buttheMinistershalltakesuchstepsasmaybepracticableinthecircumstancestobringanyorderundersubsection15(3)tothenoticeofpersonslikelytobeaffectedbyit.ADMINISTRATION--ss.19to36Facilities--ss.19to20Designationoffacilities--s.1919.TheMinistermaydesignateareas,offices,laboratoriesorotherfacilitiesinsideoroutsideCanadaforaspecifiedpurposeorgenerallyfortheadministrationofthisActortheregulationsandmayatanytimeamend,cancelorreinstateanysuchdesignation.Definitionof"internationaltransportationundertaking"--s.20(1)20.(1)Forthepurposesofthissection,"internationaltransportationundertaking"means(a)anundertakingthattransportspersonsorthingsinternationally;(b)aninternationalroad,railway,bridgeortunnel;(c)anairportthatreceivesanyaircraftoperatingonaninternationalflight;(d)aportthatreceivesanyshipsailingonaninternationalvoyage;and(e)awarehouseorotherfacilitythatreceivesanyinternationalair,water,railorroadtraffic.Requiredfacilities--s.20(2)(2)Theowneroroperatorofaninternationaltransportationundertakingshall,whererequiredinwritingbytheMinister,provideandmaintainadequateareas,offices,laboratoriesandotherfacilities,includingbuildings,accommodation,equipment,furnishingsandfixtures,forinspectionorforanyotherpurposerelatedtotheadministrationofthisActortheregulations.ADMINISTRATION--ss.19to36Facilities--ss.19to20PowersofMinister--s.20(3)(3)TheMinistermay(a)causetobemadesuchimprovementsastheMinisterconsidersdesirabletoanyarea,office,laboratoryorotherfacilityprovidedpursuanttosubsection(2);(b)post,onoraboutthearea,office,laboratoryorotherfacility,anysignsthattheMinisterconsidersappropriateforitsoperationorsafeuseorfortheadministrationofthisActortheregulations;and(c)continuetousethearea,office,laboratoryorotherfacilityforaslongastheMinisterrequiresitfortheadministrationofthisActortheregulations.Constructionorrepairs--s.20(4)(4)Whereanarea,office,laboratoryorotherfacilitythatisprovidedbyanowneroroperatorpursuanttosubsection(2)isnotadequateforthepurposesmentionedinthatsubsection,theMinistermayrequiretheowneroroperatortocarryoutanyconstructionorrepairsinordertorenderthearea,office,laboratoryorotherfacilityadequateforthosepurposes,andiftheowneroroperatorfailstodoso,theMinistermaycausetheconstructionorrepairstobecarriedoutandtheowneroroperatorshallbeliableforallreasonablecostsincurredbytheMinisterandthosecostsmayberecoveredbyHerMajestyinrightofCanada.ADMINISTRATION--ss.19to36Facilities--ss.19to20Notice--s.20(5)(5)Arequirementundersubsection(4)shallbecommunicatedbypersonaldeliveryofanoticetotheowneroroperatororbysendingthenoticetotheowneroroperator,andthenoticemayspecifytheperiodwithinwhichorthemannerinwhichtheconstructionorrepairsaretobecarriedout.Arbitration--s.20(6)(6)Subjecttosubsection(7)andanyregulationsmadeundersubsection(8),adisputeovertheadequacyofanyarea,office,laboratoryorotherfacilitymayberesolvedbyarbitrationinaccordancewiththeCommercialArbitrationAct.CanadaLabourCode--s.20(7)(7)Anyarea,office,laboratoryorotherfacilitythatfailstomeettheapplicablerequirementsofPartIIoftheCanadaLabourCodeshallbedeemedtobenotadequateforthepurposesmentionedinsubsection(2).Regulations--s.20(8)(8)TheGovernorinCouncilmaymakeregulationsfordeterminingtheadequacyofanyarea,office,laboratoryorotherfacilityforthepurposesmentionedinsubsection(2).Regulationsundersubsection(8)(3)AninspectormayinspectafacilityorconveyanceusedforanyactivityundertakeninrespectofanythingthatrequiresaCanadianPhytosanitaryCertificate,CanadianPhytosanitaryCertificateforRe-exportoranyotherphytosanitarydocumentandanyinspectormayrequiretheownerorpersonhavingthepossession,careorcontrolofthefacilityorconveyancetotreatorcleanit.ADMINISTRATION--ss.19to36Inspectors--ss.21to23Designationofinspectors--s.21(1)21.(1)ThePresidentoftheCanadianFoodInspectionAgencymaydesignateinspectorsundersection13oftheCanadianFoodInspectionAgencyActforthepurposesofthisAct.Certificatetobeproduced--s.21(2)(2)InspectorsshallbegivencertificatesinaformestablishedbythePresidentoftheCanadianFoodInspectionAgencyattestingtotheirdesignationand,onenteringanyplaceunderthisAct,aninspectorshallshowthecertificatetothepersoninchargeoftheplaceifthepersonrequestsproofoftheinspector'sdesignation.InspectorsmayexerciseMinister'spowers--s.22(1)22.(1)Aninspectormay,subjecttoanyrestrictionsorlimitationsspecifiedbytheMinister,exerciseanyofthepowersandperformanyofthedutiesorfunctionsoftheMinisterunderthisAct,exceptthepowersmentionedinsubsection15(3).Powersconcerningmovementandloading--s.22(2)(2)Forthepurposeofdeterminingwhetheraconveyanceorotherthingisfreeofanypest,aninspectormay(a)permitorrequiretheconveyanceorotherthingtobemovedorprohibititsmovement;or(b)prohibitorinterrupttheloading,unloadingorpartialloadingoftheconveyanceorotherthingorpermitorrequiretheconveyanceorotherthingtobeloaded,unloadedorpartiallyloaded.ADMINISTRATION--ss.19to36Inspectors--ss.21to23Impedinginspector--s.23(1)23.(1)NopersonshallobstructorhinderormakeanyfalseormisleadingstatementeitherorallyorinwritingtoaninspectorwhoisperformingdutiesorfunctionsunderthisActortheregulations.Assistancetoinspectors--s.23(2)(2)Theownerorthepersoninchargeofaplaceenteredbyaninspectorundersection25andeverypersonfoundintheplaceshall(a)givetheinspectorallreasonableassistanceintheowner'sorperson'spowertoenabletheinspectortoperformdutiesandfunctionsunderthisActortheregulations;and(b)furnishtheinspectorwithsuchinformationrelevanttotheadministrationofthisActortheregulationsastheinspectormayreasonablyrequire.Assistanceofpeaceofficer--s.23(3)(3)ApeaceofficershallprovidesuchassistanceasaninspectormayrequestforthepurposeofenforcingthisActortheregulations.ADMINISTRATION--ss.19to36Seals--s.24Brokenseal--s.24(1)24.(1)Whereasealorotheridentifyingdeviceauthorizedbytheregulationshasbeenaffixedtoaconveyanceorotherthingandthesealordeviceisbroken,altered,tamperedwithorremovedincontraventionoftheregulations,aninspectormayrequirethattheconveyanceorotherthing,oranythingcontainedinit,bestored,treated,placedinquarantine,disposedoformovedastheinspectormaydirect.Notice--s.24(2)(2)Arequirementundersubsection(1)shallbecommunicatedbypersonaldeliveryofanoticetotheownerorpersonhavingthepossession,careorcontroloftheconveyanceorotherthingorbysendingthenoticetotheownerorperson,andthenoticemayspecifytheperiodwithinwhichorthemannerinwhichtheconveyanceorotherthingistobestored,treated,quarantined,disposedoformoved.TamperingwithidentifyingdevicesundertheRegulations(s.24ofAct)7.(1)Exceptasauthorizedbyaninspectorpursuanttosubsection(2),noperson,otherthananinspector,shallremove,break,tamperwithoralteraseal.(2)Whereitwouldbeimpracticableforaninspectortoremoveorbreakaseal,anyinspectormayauthorizeanypersoninwritingtodosoontheinspector'sbehalf.(3)Anownerorapersonhavingthepossession,careorcontrolofaconveyanceoranyotherthingonwhichasealisaffixed,shallensurethatthesealisnotremoved,broken,tamperedwithoralteredexceptinaccordancewiththissection.ADMINISTRATION--ss.19to36Inspection--ss.25to27Inspection--s.25(1)25.(1)ForthepurposeofdetectingpestsorensuringcompliancewiththisActandtheregulations,aninspectormay(a)subjecttosection26,atanyreasonabletime,enterandinspectanyplace,orstopanyconveyance,inwhichtheinspectorbelievesonreasonablegroundsthereisanythinginrespectofwhichthisActortheregulationsapply;(b)openanyreceptacle,baggage,package,cageorotherthingthattheinspectorbelievesonreasonablegroundscontainsanythinginrespectofwhichthisActortheregulationsapply;(c)examineanythinginrespectofwhichthisActortheregulationsapplyandtakesamplesofit;(d)requireanypersontoproduceforinspectionorcopying,inwholeorinpart,anyrecordorotherdocumentthattheinspectorbelievesonreasonablegroundscontainsanyinformationrelevanttotheadministrationofthisActortheregulations;and(e)conductanytestsoranalysesortakeanymeasurements.ADMINISTRATION--ss.19to36Operationofdataprocessingandcopyingequipment--s.25(2)(2)Incarryingoutaninspectionatanyplaceunderthissection,aninspectormay(a)useorcausetobeusedanydataprocessingsystemattheplacetoexamineanydatacontainedinoravailabletothesystem;(b)reproduceanyrecordorcauseittobereproducedfromthedataintheformofaprint-outorotherintelligibleoutputandtaketheprint-outorotheroutputforexaminationorcopying;and(c)useorcausetobeusedanycopyingequipmentattheplacetomakecopiesofanyrecordorotherdocument.Warrantrequiredtoenterdwelling-place--s.26(1)26.(1)Aninspectormaynotenteradwelling-placeexceptwiththeconsentoftheoccupantofthedwelling-placeorundertheauthorityofawarrant.Authoritytoissuewarrant--s.26(2)(2)Whereonexparteapplicationajusticeissatisfiedbyinformationonoaththat(a)theconditionsforentrydescribedinsection25existinrelationtoadwelling-place,(b)entrytothedwelling-placeisnecessaryforanypurposerelatingtotheadministrationofthisActortheregulations,and(c)entrytothedwelling-placehasbeenrefusedortherearereasonablegroundstobelievethatentrywillberefused,thejusticemayatanytimesignandissueawarrantauthorizingtheinspectornamedinthewarranttoenterthedwelling-place,subjecttoanyconditionsthatmaybespecifiedinthewarrant.ADMINISTRATION--ss.19to36Useofforce--s.26(3)(3)Theinspectorwhoexecutesawarrantshallnotuseforceunlesstheinspectorisaccompaniedbyapeaceofficerandtheuseofforceisspecificallyauthorizedinthewarrant.Seizure--s.2727.Whereaninspectorbelievesonreasonablegroundsthataviolation,oranoffenceunderthisAct,hasbeencommitted,theinspectormayseizeanddetainanything(a)bymeansoforinrelationtowhichtheinspectorbelievesonreasonablegroundstheviolationoroffencewascommitted;or(b)thattheinspectorbelievesonreasonablegroundswillaffordevidenceinrespectofthecommissionofaviolation,oranoffenceunderthisAct.Exceptionstosection26undertheRegulations16.(1)Subjecttosection26oftheAct,aninspectormay,atanyreasonabletime,enteranyplaceandconductaninvestigationorsurveyofthatplaceoranythinginthatplaceinordertodetectpestsorbiologicalobstaclestothecontrolofpestsandtoidentifyareasinwhichapestorbiologicalobstacletothecontrolofapestisorcouldbefound.ADMINISTRATION--ss.19to36Search--s.28Warrant--s.28(1)28.(1)Whereonexparteapplicationajusticeissatisfiedbyinformationonoaththattherearereasonablegroundstobelievethatthereisinanyplaceanything(a)bymeansoforinrelationtowhichaviolation,oranoffenceunderthisAct,hasbeencommittedorissuspectedofhavingbeencommitted,or(b)thattherearereasonablegroundstobelievewillaffordevidenceinrespectofthecommissionofaviolationoranoffenceunderthisAct,thejusticemayatanytimesignandissueawarrantauthorizingtheinspectornamedinthewarranttoenterandsearchtheplaceforthethingand,subjecttoanyconditionsthatmaybespecifiedinthewarrant,toseizeanddetainit.ADMINISTRATION--ss.19to36Search--s.28Searchandseizurepowers--s.28(2)(2)Theinspectorwhoexecutesawarrantmayexercisethepowersdescribedinsection25andmayseizeanddetain,inadditiontoanythingmentionedinthewarrant,anyotherthing(a)bymeansoforinrelationtowhichtheinspectorbelievesonreasonablegroundsaviolation,oranoffenceunderthisAct,hasbeencommitted;or(b)thattheinspectorbelievesonreasonablegroundswillaffordevidenceinrespectofthecommissionofaviolation,oranoffenceunderthisAct.Executionofsearchwarrant--s.28(3)(3)Awarrantshallbeexecutedbydayunlessthejusticeauthorizesitsexecutionbynight.Wherewarrantnotnecessary--s.28(4)(4)Aninspectormayexerciseanyofthepowersreferredtoinsubsections(1)and(2)withoutawarrantiftheconditionsforobtainingawarrantexistbut,byreasonofexigentcircumstances,itwouldnotbepracticaltoobtainawarrant.ADMINISTRATION--ss.19to36DispositionofSeizedThings--ss.29to34Noticeofreasonforseizure--s.2929.AninspectorwhoseizesanddetainsathingunderthisActshall,assoonasispracticable,advisetheownerofthethingorthepersonhavingthepossession,careorcontrolofitatthetimeofitsseizureofthereasonfortheseizure.Storage,removal,etc.--s.30(1)30.(1)AninspectorwhoseizesanddetainsathingunderthisAct,oranypersondesignatedbytheinspector,may(a)store,treat,quarantineordisposeofthethingattheplacewhereitwasseizedormoveittoanyotherplaceforstorage,treatment,quarantineordisposition;or(b)requireitsownerorthepersonhavingthepossession,careorcontrolofitatthetimeofitsseizuretostore,treat,quarantineordisposeofitormoveittoanyotherplaceandstore,treat,quarantineordisposeofit.Notice--s.30(2)(2)Arequirementunderparagraph(1)(b)shallbecommunicatedbypersonaldeliveryofanoticetotheownerorpersonhavingthepossession,careorcontrolofthethingorbysendingthenoticetotheownerorperson,andthenoticemayspecifytheperiodwithinwhichorthemannerinwhichthethingistobemoved,stored,treated,quarantinedordisposedof.ADMINISTRATION--ss.19to36DispositionofSeizedThings--ss.29to34Proceeds--s.30(3)(3)AninspectorwhoseizesanddetainsathingunderthisActmaydisposeofitandanyproceedsrealizedfromitsdispositionshallbepaidtotheReceiverGeneral.Interferencewithseizedthings--s.3131.Exceptasauthorizedinwritingbyaninspector,nopersonshallremove,alterorinterfereinanywaywithathingthatisseizedanddetainedunderthisAct.Detention--s.32(1)32.(1)AthingthatisseizedanddetainedunderthisAct,oranyproceedsrealizedfromitsdisposition,shallnotbedetainedafter(a)adeterminationbyaninspectorthatthethingisinconformitywiththeprovisionsofthisActandtheregulations,or(b)theexpirationofonehundredandeightydaysafterthedayofseizure,orsuchlongerperiodasmaybeprescribed,unlessbeforethattimeproceedingsareinstitutedinrelationtothething,inwhichcaseit,ortheproceedsfromitsdisposition,maybedetaineduntiltheproceedingsarefinallyconcluded.LongerperiodofDetentionunderRegulation26.(2)Forthepurposesofparagraph32(1)(b)oftheAct,theperiodofdetentionisthreeyears(a)whererequiredtopermitaninspectortoidentifyavirus,viroid,mycoplasma,mycoplasma-likeorganism,rickettsia-likeorganism,bacteriumorfungusthatispresentorsuspectedofbeingpresentinathing;(b)wherefraudhasoccurredorissuspected;or(c)toidentify,testoranalyseathingthathasbeengrown,raised,cultured,producedoralteredbybiotechnology,asthattermisdefinedinsubsection3(1)oftheCanadianEnvironmentalProtectionAct.ADMINISTRATION--ss.19to36DispositionofSeizedThings--ss.29to34Applicationforreturn--s.32(2)(2)Whereproceedingsareinstitutedinaccordancewithsubsection(1)inrespectofthethingandithasnotbeendisposedof,confiscatedorforfeitedunderthisActortheregulations,theownerofthethingorthepersonhavingthepossession,careorcontrolofitatthetimeofitsseizuremayapply(a)inthecaseofaviolation,totheTribunal,or(b)inthecaseofanoffence,tothecourtbeforewhichtheproceedingsarebeingheld,foranorderthatitbereturned.Order--s.32(3)(3)TheTribunalorcourt,asthecasemaybe,mayorderthatthethingbereturnedtotheapplicant,subjecttosuchconditionsastheTribunalorcourtmayimposetoensurethatitispreservedforanypurposeforwhichitmaysubsequentlyberequired,wheretheTribunalorcourtissatisfiedthatsufficientevidenceexistsormayreasonablybeobtainedwithoutdetainingthethingandthatitisnotapest,isnotinfestedwithapestanddoesnotconstituteabiologicalobstacletothecontrolofapest.ADMINISTRATION--ss.19to36DispositionofSeizedThings--ss.29to34Forfeiture--s.33(1)33.(1)WheretheTribunaldecidesthatapersonhascommittedaviolation,orapersonisconvictedofanoffenceunderthisAct,theTribunalortheconvictingcourt,asthecasemaybe,may,onitsownmotionorattherequestofanypartytotheproceedings,inadditiontoanypenaltyorpunishmentimposed,orderthatanythingbymeansoforinrelationtowhichtheviolationoroffencewascommitted,oranyproceedsrealizedfromitsdisposition,beforfeitedtoHerMajestyinrightofCanada.Forfeiturewithoutconviction--s.33(2)(2)Whereth
