2、02年5月1日起实行新的强制性产品认证制度。 在此之前，对国产品和进口品存在对内、对外两套认证管理体系，原国家质量技术监督局对国产品和部分进口品实施认证管理；原国家出入境检验检疫局对进口品实施安全质量许可制度。不符合WTO规则，同时也存在政出多门、重复认证、重复收费等问题。 3背景资料 为适应市场经济的需要，遵循世贸协议和国际通行规则，于2001年成立国家质量监督检验总局和国家认证认可监督管理委员会，建立新的国家强制性产品认证制度。4什么是新的强制性产品认证制度 制定强制性认证的产品目录 实施强制性产品认证的程序 实施强制性的检测和审核凡是列入目录的产品，没有获得指定认证机构的认证证书，没有加

4、用者对生产、销售、进口、使用的产品负 责。8与国际接轨 遵循WTO/TBT国民待遇原则； 遵循ISO/IEC有关国际指南和标准。9与境外认证机构的认证/检测结果互认的问题 根据平等互利的原则，认证/检测结果的互认是以政府机构间或政府承认的双边或多边协议为基础的。10设立外商投资的认证机构应当符合的条件 外方投资者取得其所在国家或者地区 认可机构的认可； 外方投资者具有3年以上从事认证活 动的业务经历。 设立外商投资认证机构的申请、批准和登记，按照有关外商投资法律、行政法规和国家有关规定办理。11境外认证机构在中华人民共和国境内设立代表机构的规定 须经批准，并向工商行政管理部门依法办理登记手续后

5、，方可从事与所从属机构的业务范围相关的推广活动，但不得从事认证活动。 境外认证机构在中华人民共和国境内设立代表机构的申请、批准和登记，按照有关外商投资法律、行政法规和国家有关规定办理。12第一批列入强制性产品认证目录的产品 对于涉及人民生命财产安全、环保及国家安全的十九大类一百三十六种产品的市场准入，中国政府实行统一的强制性产品认证制度（3C）,消防产品包含其中。13Fundamental of Admittance system China operates compulsory certification on products of 19 categories,136 kinds whi
