2、ALS鉴于甲方愿意录用乙方，乙方愿意到甲方工作，按照中华人民共和国劳动法、中华人民共和国劳动合同法和上海市劳动和同条例等我国国家和地方政府的有关法律法规和行政规章,以及甲方制定的各项规章制度，本着平等、自愿的原则，经甲、乙双方协商一致，特签订本劳动合同（以下简称“本合同”）。WHEREAS,PartyAintendstoemployPartyBandPartyBintendstoworkforPartyA,InaccordancewithLabourLawofthePeoplesRepublicofChina,LawofthePeoplesRepublicofChinaonEmployment

8、rcumstances:1、乙方的工作地点由所在部门安排。今后因工作需要乙方在甲方所在本市的全部经营办公场所及附属场所（包括公司自有产权的物业或租赁的物业，）之间调整时。1. PartyB'sworkingsiteistobearrangedbythedivisionheorsheworksin;PartyAistochangePartyB'sworkingsitewithinallitsbusinessofficesandattachedsitesinthecitywherePartyAisdomiciled（includingPartyA'sownpropertyo

9、rotherpremisesleasedbyPartyA）,onthebasisofPartyA'sworkingrequirement;2、甲方因工作需要，临时指派乙方到境内外短期出差地点工作的。2. PartyAassignsPartyBtoworkathomeorabroadonbusinesstravelforashorttermonthebasisofPartyA'sworkingrequirement.3、甲方因工作需要，安排乙方临时外借到其它部门或其它他单位工作的。3. Inresponsetoworkingrequirement,PartyAtemporaril

11、lconsentthroughnegotiation.第三条（工作时间和休息休假）Article3WorkingHoursandHoliday（一）乙方的岗位实行全日制标准工时工作制度，甲方安排乙方每日工作时间不超过8小时，每周工作五天。PartyBistoworkunderthefull-timestandardworkingtimesystem:PartyAmayrequirePartyBtoworkfornomorethan8hourseverydayandforfivedayseveryweek.（二）甲方由于工作需要，经与乙方协商后可以延长工作时间，一般每日不超过1小时，因特殊原因需

12、要延长工作时间的，在保障乙方身体健康的前提下工作时间不得超过3小时，每月不得超过36小时。Ifnecessaryforwork,PartyAmay,onthebasisofnegotiationwithPartyB,extendPartyBsworkinghoursfornomorethanonehoureverydaygenerally;whereitisnecessarytoextendworkinghoursunderspecialcircumstances,suchextensionofworkinghoursmaynotexceedthreehourseverydayonthepre

13、miseofbeingnoharmfultoPartyBshealth,andnomorethanatotalof36hourseverymonth.（三）乙方有享受国家规定的各类休息休假的权利，具体按甲方的职工工作时间及休息休假管理办法执行。PartyBisentitledtoalltheholidaysandleavesprovidedbytheState,towhichtheImplementationRulesforEmployeesWorkingHoursandHolidaysformulatedbyPartyAshallapply.（四）如遇国家或本市政府有关部门调整工作时间和休息

14、、休假时间，或甲方在特殊季节临时调整休息、休假时间的，不作本合同变更处理。WheretheStateortherelevantauthoritiesofthislocalmunicipalityreadjuststheprovisionsonworkinghours,holidaysorleaves,orPartyAreadjuststheprovisionsonholidaysorleaves,thisAgreementmaynotbedeemedasbeingaltered.第四条（劳动报酬）Article4Remuneration（一）乙方的劳动报酬包括每月发放的固定工资和以及相关的津贴

15、补贴、每季度考核发放的绩效工资等部分组成，按照甲方薪酬管理规定执行。合同签订后甲方发给职工薪酬告知书，具体明确薪酬类别和标准。职工薪酬告知书作为本合同的附件，与本合同具有同等法律效力。TheremunerationforPartyBincludesfixedmonthlysalary,allowance,quarterlyperformance-basedwageandthelike,andtheremunerationistobepaidinaccordancewithPartyAsregulationsonremuneration.Afterexecutionhereof,PartyAis

16、tosendPartyBaNotificationofEmployeesRemuneration,whichspecifiesthetypeandstandardoftheremuneration;suchNotificationconstitutesanannextothisAgreementandhavethesamelegalbingingforceasthisAgreement.（二）在履行本合同期间的日常操作中，甲方依照职工薪酬告知书中约定的薪酬标准作以下扣除处理的，本合同不作变更处理。If,inthecourseoftheperformanceofthisAgreement,Par

17、tyAdeductsanypaymentoftheremunerationinaccordancewiththeNotificationofEmployeesRemuneration,thisAgreementmaynotbedeemedasbeingaltered.1、由公司代扣代缴的个人所得税。2、由职工个人承担的社会保险费、住房公积金、企业年金的扣款。3、因职工违反公司规章制度所发生违约金、赔偿等扣款。4、因职工发生事假等非带薪假期所作的扣款。5、因法院对职工涉案判决所指定公司执行的扣款。6、其它符合法律及公司制度而发生的扣款。1. 19、leaveswithpayment;5. DeductionofremunerationmadebyPartyAundertheorderofcourtonthebasisofthejudgementofcaseconcerningPartyB;6. DeductionofremunerationincompliancewithlawsorPartyAsregulationsystem.（三）在本合同期间，甲方因调增职工薪酬标准的，本合同不作变更处理。If,duringthevaliditytermofthisAgreement,PartyAincreasestheremunerationfo

20、remployees,thisAgreementmaynotbedeemedasbeingaltered.（四）甲方每月5日以货币形式通过银行转账到乙方个人帐户的办法支付乙方工资，包括岗位工资、工龄工资及按月发放的相关补贴。乙方同意属于乙方可得的绩效工资、补贴津贴等按甲方薪酬管理规定的日期和形式发放，届时甲方以电子邮件等形式通知乙方。PartyAshall,onthefifthdayofeachandeverymonth,payPartyBremunerationbytransferringthecurrencytoPartyBsaccountthroughbank,includingpost

21、-basedwage,workingage-basedwageandrelevantallowancetobepaidonamonthlybasis.PartyBagreesthatalltheperformance-basedwage,allowanceandthelikemaybepaidonthedateandbythemeansprovidedbyPartyAwithrespecttoremuneration,andPartyAistonotifyPartyBbymeansofemailofthepaymentthereafter.（五）若乙方提供了正常劳动，甲方支付给乙方的工资报酬不

22、得低于本市政府规定的最低工资标准。TheremunerationpaidbyPartyAtoPartyBmaynotbelessthantheminimumlevelprovidedbythelocalmunicipalgovernment,providedthatPartyBprovidesnormalworkforPartyA.（六）甲方每月向乙方发放上月工资清单。该清单属于保密范围，应妥善保管，不得泄露给本人家庭成员以外的任何第三人、员工之间不得相互打探，如有疑义可以向甲方人力资源部咨询。PartyAshall,onamonthlybasis,sendPartyBremuneration

23、listforthelastmonth;suchremunerationlistmustbetreatedasconfidentialinformationandkeptproperly,andsuchlistmaynotbedisclosedtoanythirdpartiesotherthanthefamilymembersofPartyB;employeesmaynotenquireofoneanotherabouttheremuneration;intheeventofanyobjection,PartyBmayconsultPartyAshumanresourcedepartment.

24、第五条（社会保险及其它）Article5SocialInsuranceandOtherMatters（一）甲方按照国家和上海市的有关规定，为乙方交纳社会保险和住房公积金。PartyAshallpaysocialinsurancepremiumandhousingaccumulationfundsforPartyBinaccordancewiththerelevantregulationsoftheStateandShanghaimunicipality.（二）乙方原意按照国家和上海市的有关规定，由个人承担的社会保险、住房公积金部分由甲方在工资中代扣代缴。PartyBagreesthatPart

25、yAmay,fromtheremunerationpayabletoPartyB,withholdthepartofsocialinsurancepremiumandpublicremunerationfundtobebornebyPartyBandPartyAmaypaysuchwithheldpartonbehalf,inaccordancewiththerelevantregulationsoftheStateandShanghaimunicipality.（三）乙方因病或非因工负伤期间，享有上海市规定的医疗期和疾病休假待遇。IfPartyBsufferssicknessornon-wo

26、rk-relatedinjury,PartyBisentitledtomedicaltreatmentperiodandsickleavetreatmentprovidedbyShanghaimunicipality.（四）符合计划生育政策的乙方（女职工）享有本市规定的产假和其它特殊待遇，事前乙方须提出申请，经甲方（但不限于甲方，如果需要政府有关机构审核批准的）核准后执行。PartyB（ifPartyBisafemaleemployee）isentitledtomaternityleaveandotherspecialtreatmentprovidedbythislocalmunicipali

27、ty,providedthatshemustbeincompliancewiththeStatesfamilyplanningpolicyandPartyBshallsubmitanapplicationtoPartyA（iftheapprovalofthegovernmentisnecessary,PartyBshallsubmitsuchapplicationtocompetentauthorities）forapprovalinadvance.（五）乙方享有甲方按国家或本市政府及甲方的规定设定的福利待遇，具体按甲方的有关办法执行。PartyBisentitledtothewelfarep

28、rovidedbyPartyAinaccordancewiththerelevantprovisionsmadebytheState,thelocalmunicipalgovernmentorPartyA;PartyAsrelevantimplementationrulesshallapplytothewelfare.（六）如遇国家或本市政府调整社会保险、住房公积金的政策，甲方相应调整乙方的社会保险、住房公积金的，本合同不作变更处理。If,intheeventofthereadjustmentmadebytheStateorlocalmunicipalgovernmentofthepolicy

29、onsocialinsuranceorhousingaccumulationfund,PartyAreadjuststhesocialinsuranceandhousingaccumulationfundforPartyBaccordingly,thisAgreementmaynotbedeemedasbeingaltered.第六条（劳动保护、劳动条件和职业危害防护）Article6LaborProtection,WorkingConditionandPreventionagainstOccupationalHazard（一）乙方享有甲方提供的相应的劳动保护和劳动条件。（二）乙方享有甲方执行

30、的国家劳动标准提供的职业危害防护条件。PartyBisentitledtothecorrespondinglaborprotectionandworkingconditionbyprovidedbyPartyA.PartyAshallprovidePartyBwithpreventingconditionsagainstoccupationalhazardinaccordancewiththeStateslaborstandard.第七条（劳动纪律和规章制度）Article7LaborDisciplineandRegulationsandRules（一）甲方应根据国家有关法律、法规，依法制定各

31、项规章制度。（二）乙方应诚实守信，自觉遵守国家的法律、法规和社会公德、职业道德，自觉维护甲方的声誉和利益，保守甲方秘密。（三）甲方有权根据乙方的表现或行为，依据国家的法律、法规、行政规章和甲方的规章制度，给予乙方相应的奖励或处理。其中：1、乙方如发生符合甲方职工奖励办法规定的积极行为的，甲方可以按照职工奖励办法给与乙方奖励；2、乙方如发生违反甲方规章制度的消极行为的，甲方有权按职工违规处理办法给与处理。PartyAshallformulatevariousregulationsandrulesinaccordancewiththeStatelawsandregulations.PartyBsh

32、alldeporthimselfwithsincerityandgoodfaith,abidebytheStateslawsandregulationsandsocialethicsandprofessionalethics,maintainPartyAsreputationandinterestsinitiativelyandkeepsecretPartyAsconfidentialinformation.PartyAmayawardortreatPartyBasfollowsinthelightofPartyBsperformanceandactsandinaccordancewithth

33、eStateslaws,regulationsandadministrativerulesandPartyAsregulationsandrules.1） IfPartyBhasanypositiveactionsdeservingawardasprovidedinPartyAsRulesofAwardingEmployees,PartyAmayawardPartyBinaccordancewiththeRulesofAwardingEmployees.2） IfPartyBhascommittedanyactionsinbreachofPartyAsregulationsorrules,Pa

34、rtyAmaytreathimorherinaccordancewiththeRulesforTreatmentofEmployeesinBreachofRegulations.第八条（教育与培训）Article8EducationandTraining（一）甲方可以根据工作需要不定期地对乙方进行所必须的教育与培训。（二）乙方应参加甲方的各项教育与培训安排。（三）凡由甲方出资培训乙方，双方另行签订培训/教育协议，因乙方原因而提前解除劳动合同，乙方应赔偿甲方的培训等费用，具体赔偿标准执行培训/教育协议的约定。PartyAmayeducateortrainPartyBirregularlywhen

35、necessaryinthelightoftheworkingrequirements.PartyBshallparticipateinalltheeducationandtrainingcoursesarrangedbyPartyA.WherePartyAinvestsintrainingofPartyB,thetwopartiesshallconcludeagreementforeducation/trainingseparately;ifthisEmploymentAgreementisterminatedearlierthanoriginallystipulatedforreasons

36、attributabletoPartyB,PartyBshallcompensatePartyAthetrainingfeeinaccordancewiththestipulationsinsuchagreementforeducation/training.第九条（保密约定）Article9Confidentiality（一）双方签订本合同后，乙方应遵守甲方保密条例，不得泄露甲方秘密，不得在合同期内再受聘其他任何单位从事与甲方相同或类似或有竞争冲突的业务。不得引诱甲方的其他在职职工离职。PartyBshall,aftersigningofthisAgreement,observePartyAsConfidentialityRules,andmaynotdiscloseanyofPartyAsconfidentialinformation;duringthevaliditytermhereof,PartyBmaynotengageinanybusinesssimilarwithorincompetitionwithPartyAsbusinessforanyotheremp
