ModuleObjectives

Thismoduleaimstoprovidestudentswithanunderstandingofthelawapplicabletotheemploymentrelationshipbyexaminingtheprinciplecommonlawandlegislativeenactments,bothIrishandEuropean,affectingworkersandemployers.Themodulefocussesupondiscriminatorytreatment,dataprotectionandtheterminationoftherelationship.Italsoaddressesaspectsofhealthandsafetylaw.ThemodulebuildsupontheprincipleslearnedinEmploymentLaw-Contracts.Themoduleaimstoequipstudentswithaknowledgeofemploymentlawsoastoenablethemtoengagecompetentlywithlegaladvisorsandensurecompliancewithlegislation.Theindicativecontentwillbeexpandeduponand/ormodifiedtoreflectchangestothelegalenvironment.

Breakdownoftheemploymentrelationship

Dismissal-Noticeentitlements,Unfairdismissal-qualifications,process,presumption,grounds,constructivedismissal,remedies.Wrongfuldismissal,Injunctiverelief.Principlesofproportionalityandreasonableness.FairProcedures-naturaljustice,representation.Constructivedismissal.Redundancy-grounds,entitlements,fairselectionandunfairdismissalsclaims,consultation,collectiveredundancies,compromiseagreements.Transferofundertakings-application,liability,dismissals,dataprotectionimplications.

TeachingandLearningStrategy

Teachingandlearningwilltakeplaceduringthelectureviaacombinationofmethodsincludinginclassdiscussion,casestudiesandproblemsolvingexercises.Complexproblemsolvingexerciseswillbedistributedeitherbeforeorduringthelectureandwillbeusedtoapplythelegaltheorytoreallifesituations.Studentswillworkingroupsduringthelecturetoidentifytheemploymentlawissuesinvolvedintheproblemandwillberequiredtoidentifyandapplysolutionsthatarelegallysound.Someproblembasedquestionsmayrequirestudentstodopreparatoryworkastheywillbeexploringtheapplicationofthelawinpractice.Theproblembasedquestionswillgivestudentsanindicationoftheirstrengthsandweaknessesthroughouttheterm.Presentationsusedbythelecturermaycontaindirecthyperlinkstorelevantreadingsinparticulartolegislationandcaselaw.
