LO1. Identifyandexamineindetailtherelevantlegislationand/orcommonlawapplicabletoanemploymentissueandrecognisetheresponsibilities,rightsanddutieswhichariseintheemployer/employeerelationship.
LO2. Demonstrateanunderstandingoftherelevanceofprivacyanddataprotectionatworkandobligationsoftheemployer.
LO3. Identifyandappreciatethedifferentmechanismsbywhichtheemployeecanenforcetheirstatutoryandcommonlawrights.
LO4. Demonstrateanunderstandingoftheimportanceofdignityintheworkplaceandhowtheworkplaceshouldbeinclusiveandsupportive.
LO5. Identifyandapplythekeyprovisionsofrelevantlegislationand/orcommonlawtosituationswheretheemploymentrelationshipbreaksdownandapplyprinciplesoffairness.
ModuleObjectives
Thismoduleaimstoprovidestudentswithanunderstandingofthelawapplicabletotheemploymentrelationshipbyexaminingtheprinciplecommonlawandlegislativeenactments,bothIrishandEuropean,affectingworkersandemployers.Themodulefocussesupondiscriminatorytreatment,dataprotectionandtheterminationoftherelationship.Italsoaddressesaspectsofhealthandsafetylaw.ThemodulebuildsupontheprincipleslearnedinEmploymentLaw-Contracts.Themoduleaimstoequipstudentswithaknowledgeofemploymentlawsoastoenablethemtoengagecompetentlywithlegaladvisorsandensurecompliancewithlegislation.Theindicativecontentwillbeexpandeduponand/ormodifiedtoreflectchangestothelegalenvironment.

TeachingandLearningStrategy
Teachingandlearningwilltakeplaceduringthelectureviaacombinationofmethodsincludinginclassdiscussion,casestudiesandproblemsolvingexercises.Complexproblemsolvingexerciseswillbedistributedeitherbeforeorduringthelectureandwillbeusedtoapplythelegaltheorytoreallifesituations.Studentswillworkingroupsduringthelecturetoidentifytheemploymentlawissuesinvolvedintheproblemandwillberequiredtoidentifyandapplysolutionsthatarelegallysound.Someproblembasedquestionsmayrequirestudentstodopreparatoryworkastheywillbeexploringtheapplicationofthelawinpractice.Theproblembasedquestionswillgivestudentsanindicationoftheirstrengthsandweaknessesthroughouttheterm.Presentationsusedbythelecturermaycontaindirecthyperlinkstorelevantreadingsinparticulartolegislationandcaselaw.
