RegulationonBDAenterprisemajorresponsiblepersonimplementingworksafetymanagementresponsibility(Temporary)(Discussiondraft)Chapter1GeneralruleClause1Inordertoenhancethesafetyawarenessofenterprise’smajorresponsiblepersonandfulfillthelegalresponsibilityandobligation,improvetheBDAsafetymanagement,thisregulationismadeinaccordancewith<WorksafetylawofPRC>,<Beijingworksafetyregulation>andotherrelatedlaw/regulationandtheactualconditionofBDA.Clause2Alltheenterprise’smajorresponsiblepersonshouldobeythisregulation.Clause3Theenterprisemajorresponsiblepersonrefertothepersonwhotakestheoverallresponsibilityonproduction/businessandhasthebusinessdecision-makingright.Generallyhe/sheshouldbetheboardchairman,generalmanageroflimitedliabilitycompany,ortheplantmanager,investororlegalrepresentativeofothermanufactureandbusinessunite.Clause4BDAworksafetysupervisiondepartmentsupervisesandmanagestheenterprisemajorresponsibleperson’simplementationonhis/herresponsibilityinaccordancewithrelatedlaw/regulation.Chapter2WorksafetyresponsibilityofenterprisemajorresponsiblepersonClause5Manufactureandbusinessuniteistheresponsibilityentityofworksafetyinproductionandbusinessactivities,unitmajorresponsiblepersonisthefirstresponsiblepersonofworksafety,he/shemustimplementthemajorresponsibility.Thefirstresponsiblepersontakestheoverallresponsibilityforworksafetyandundertakestheresponsibilityofproductionaccident,occupationalhazardpreventionandtheconsequencesocaused.Clause6Theworksafetyresponsibilitiesofenterprisemajorresponsiblepersonare:1)Organize,approveandsignandissuetheworksafetyresponsibilitydocument,worksafetyrulesandinstructions;2)Establishworksafetymanagementdepartmentanddisposepersonnellawfully;3)Organizetodraftandapproveworksafetyinputplantoensurethesafetyinvestmentonsafety.Andundertaketheconsequencewhichiscausedbyinadequateworksafetyfundinput;4)Studyworksafetyproblemsperiodically;5)Superviseandinspectthesafetywork,organizetoestablish/improveproceduresofpotentialhazardinspection&follow-up,documentationsystem.Findandeliminatethepotentialhazardstimely;6)Organizetodraftandimplementemergencyplan,establishemergencyrespond/rescueteam,improveemergencyrescuecondition,carryoutemergencydrills,andreporttoBDAworksafetysupervisiondepartmentforrecordinaccordancewithrelatedregulations;7)Reportaccidentintimeandfaithfully,handlethefollowingactionsonaccident;8)Organizeandsupervisethelegalapprovalandacceptanceprocedureonnew/reconstructed/extensionprojects;9)Worksafetyresponsibilityonrelatedlaws/regulations.Chap3Detailedcontentofenterprisemajorresponsibleperson’ssafetyresponsibilityClause7Theworksafetyresponsibilitysystemdocumentsthatshouldbeapproved,signedandissuedbyenterprisemajorresponsiblepersonshouldincludethefollowinglevels:1)Enterprisemajorresponsibleperson’sworksafetyresponsibility;2)Othermember’sworksafetyresponsibilityinmanagementteam;3)Middle-leveldepartment(department,workshop,branch-company)’sworksafetyresponsibilitiesanddepartmentmanagers’worksafetyresponsibilities.4)Shiftandshiftleader’sworksafetyresponsibility;5)Workstations’andemployees’worksafetyresponsibility;Clause8Enterprisemajorresponsiblepersonshouldestablishsafetymanagementdepartmentanddisposesafetymanagementpersonnelinaccordancewiththefollowingrequirements:1)Constructioncompany,urbanrailtrafficcompany,hazardouschemicalmanufacture/purchasingandselling/storagecompanyshouldsetupworksafetydepartmentanddisposefull-timesafetymanagementpersonnel;2)Companiesotherthandefinedbythefirstitemshouldsetupworksafetydepartmentanddisposefull-timesafetymanagementpersonneliftheemployeenumberismorethan300.Thenumberoffull-timesafetypersonnelshouldnolessthan0.5%ofthetotalnumberofemployees;3)Companiesotherthandefinedbythefirstandtheseconditemsshoulddisposeatleastonefull-timeorpart-timesafetymanagementperson,orconsigntocertificatedqualifiedprofessionalpersontosupplythesafetymanagementservice;4)Full-timeandpart-timesafetymanagementpersonnelmustattendrelatedtrainingrequiredbyrelatedregulationandmusthavecorrespondingsafetymanagementknowledge.Part-timesafetymanagementpersonmustbefamiliarwiththeproductionprocess.Clause9Enterprisemajorresponsiblepersonshouldapprovetheannualsafetyfundinputandsupervisetheeffectiveimplementation.Clause10Enterprisemajorresponsiblepersonshouldorganizesafetyroutinemeetingatleastquarterlyandkeepmeetingminutes.Safetyroutinemeetingshouldinclude:1)Recentstatusanalysis;2)Recentaccident,majoraccidentpotentialhazardsnotification;3)Safetyfindingstatusfollowing-up;4)Actionplanforthenextstep;5)Decisionmakingonimportantissuesonsafety.Clause11Enterprisemajorresponsiblepersonshouldsupervisethesafetyinspection,shouldfollowthebelow4levels:1)Enterprisemajorresponsiblepersonshouldorganizesafetyinspectionmonthly(includinginspectionsbeforeholidays);2)Safetymanagementpersonshoulddosafetyinspectionatleastweekly;3)Workshopresponsiblepersonshoulddosafetyinspectionatleastweekly;4)Shiftleadershoulddosafetyinspectioneveryday.Clarifythe“four-confirmation”forfindings-------Confirmcorrectiveactionsandrequirement,confirmresponsibleperson,confirmthedeadline,confirmtheverifierandkeeptherecord.Safetymanagementpersonshouldsummarizethefindingandreporttoenterpriseresponsiblepersonatleastmonthly.Enhancetheoverduefinding’sfollow-up.Clause12EnterprisemajorresponsiblepersonshouldattendsafetytraininginaccordancewithBDAworksafetysupervisiondepartments.Trainingforthefirsttimeshouldnolessthan32hours,yearlyrefreshsafetytrainingshouldnolessthan12hours.Trainingforhazardouschemicalproductionandbusinesscompanymajorresponsiblepersonshouldnolessthan48hours;yearlyrefreshtrainingshouldnotlessthan16hours;Clause13Enterprisemajorresponsiblepersonshouldorganizeemergencyplanandimplementinaccordancewiththefollowingrequirement:1)Emergencyplanshouldcomposedof3-levelplanofgeneralplan,specialplanandsite-handlingplan;(二)Practicabilityandmaneuverabilityshouldbeputtohighprioritywhendraftingemergencyplan;(三)Organizeatleast2drillstoensurepeoplewhoareinvolvedinemergencyplantobefamiliarwithhis/herresponsibilityandtotakeappropriateactions.Revisetheemergencyplanintimeinaccordancewiththeproblemsappearedindrill;Clause14Afteraccidenthappened,therelatedpersononsitemustreporttoenterprisemajorresponsiblepersonimmediately.Onceenterprisemajorresponsiblepersonreceivetheaccidentreport,he/sheshouldstartupemergencyplantorescueinjuredpersonandtopreventfurthermoreaccident,reducepersonnelinjuryandpropertyloss.EnterprisemajorresponsiblepersonmustassignaspecialpersontoreportaccidenttoBDAworksafetymanagementdepartmentandrelateddepartmentin1hourafterreceivingtheaccidentreport.Themaincontentofccidentreportshouldinclude:1)Generalsituationofcompany;2)Accidenttime,venueandthesceneofaccident;3)Accidentbriefdescription;4)Injuredpersons’numberorpossibleinjuredperson’snumber(includingpersonsnotfound)andthedirecteconomylossbypreliminaryestimate;(五)Actionshavingbeentaken;(六)Otherinformationwhichshouldbereported.Chapter4SupervisionandmanagementactionsClause15BDAworksafetysupervisiondepartmentshouldevaluatetheperformanceofimplementationofenterprisemajorresponsiblepersonyearlyinaccordancewithrelatedevaluationstandardatyearend;Year-endevaluationiscomposedofpreliminaryevaluationandfinalevaluation.Evaluationresultsare:excellent,eligible,ineligible.EnterprisemajorresponsiblepersonhasrighttopleadtoBDAsafetysupervisiondepartmentin7workingdaysafterreceivingpreliminaryevaluationnotification,oritwillberegardedasagreeingthepreliminaryresult.Clause16Afterpleadingperiod,BDAsafetysupervisiondepartmentshouldnotifythepreliminaryresultintheBDAscopepublicly,shouldfollowupthedenouncedsafetyproblems,shouldholdre-evaluationmeetingforcaseswithseriousproblems;Clause17Fortheenterprisemajorresponsiblepersonandsafetymanagementpersonwhoisevaluatedas“excellent”,BDAsafetysupervisiondepartmentshouldgivethemhonor.Thiscompanycangivethembonusof2monthsalary.Fortheenterprisemajorresponsiblepersonandsafetymanagementpersonwhoisevaluatedas“eligible”,BDAsafetysupervisiondepartmentshouldgivethemhonor.Thiscompanycangivethembonusof1monthsalary.Fortheenterprisemajorresponsiblepersonandsafetymanagementpersonwhoisevaluatedas“ineligible”,BDAsafetysupervisiondepartmentshouldgivethemanoticeofcriticism,meantime,requirethiscompanytosubmitwrittencorrectiveactionplantoBDAsafetysupervisiondepartment.Clause18Ifenterprisemajorresponsiblepersondoesn’timplementhis/herworksafetyresponsibility,BDAsafetysupervisiondepartmentshouldgivethemadministrativepenaltiesinaccordancewith<WorksafetylawofPRC>,<Beijingworksafetyregulation>,<Worksafetyaccidentreportandinvestigationregulation>,<Worksafetyviolationpunishregulation>,etc.Clause19Fortheenterprisemajorresponsiblepersonwhodidn’timplementhis/hersafetyresponsibilityandthereforeseriousinjuryhappened,itshouldbepunishedinaccordancewithapprovedaccidentinvestigationresult对因未履行安全生产职责、造成重伤以上责任事故的单位主要负责人,将依据经批复的事故调查报告的处理意见进行处理,触犯刑法的应依法移送司法机关追究其刑事责任。第二十条本《规定》由开发区管理委员会负责解释。第二十一条本《规定》自2010年月日起实施。北京经济技术开发区生产经营单位主要负责人履行安全生产管理职责规定(暂行)(讨论稿)第一章总则第一条为强化北京经济技术开发区(以下简称开发区)的生产经营单位主要负责人(以下简称单位主要负责人)安全生产管理意识,切实落实法定职责与义务,加强开发区区域范围内生产经营单位的安全生产管理工作,依据《中华人民共和国安全生产法》、《北京市安全生产条例》等法律法规,结合开发区实际情况,制定本规定。第二条凡开发区区域范围内从事生产经营活动的单位主要负责人均应遵守本规定。第三条本规定单位主要负责人,指对本单位生产经营活动负全面责任,有生产经营决策权的人员,具体指有限责任公司或股份有限公司的董事长、总经理,其他生产经营单位的厂长、投资人或法定代表人。第四条开发区安全生产监督管理部门依法对单位主要负责人依法履职行为进行监督管理。第二章单位主要负责人应履行的安全生产职责第五条生产经营单位是生产经营活动过程中安全生产的责任主体,单位主要负责人是本单位安全生产的第一责任人,必须依法履行安全生产责任主体职责。第一责任人对本单位安全生产工作全面负责,并对本单位生产事故、职业危害的预防和产生的后果承担责任。第六条单位主要负责人对本单位安全生产工作负有下列职责:(一)组织制定本单位安全生产责任制、安全生产规章制度和操作规程,并负责审批、签发;(二)依法建立适应本单位安全生产工作需要的安全生产管理机构,配备安全生产管理人员;(三)组织制定、审批安全生产投入计划,保证本单位安全生产资金投入的有效实施,并对由于安全生产所必需的资金投入不足导致的后果承担责任;(四)定期研究安全生产问题;(五)督促、检查本单位的安全生产工作,组织建立健全事故隐患排查治理和建档监控制度,及时发现、消除生产事故隐患;(六)组织制定并实施本单位的生产事故应急救援预案,建立应急救援组织,完善应急救援条件,开展应急救援演练,并按有关规定报送开发区安全生产监督管理部门及有关部门备案;(七)及时、如实按规定报告生产安全事故,落实生产安全事故处理的有关工作;(八)组织、督促本单位新建、改建、扩建工程项目依法办理安全生产审验手续;(九)有关法律、法规规定的安全生产职责。第三章单位主要负责人应履行职责的具体内容第七条单位主要负责人审批签发的安全生产责任制度应包括以下五个层面内容:(一)主要负责人的安全生产责任;(二)生产经营管理层其他负责人的安全生产责任;(三)中层部门(各管理科室、车间、分公司)和部门负责人的安全生产责任;(四)班组和班组长安全生产责任;(五)具体岗位和从业人员的安全生产责任。第八条单位主要负责人应按以下要求配置本单位安全生产管理机构并配备安全生产管理人员:(一)建筑施工单位、城市轨道交通运营单位、危险物品的生产、经营、储存单位应当设置安全生产管理机构,按照国家或者本市有关规定,配备专职安全生产管理人员;(二)第一款规定以外的其他生产经营单位,从业人员超过300人的,应当设置安全生产管理机构或者配备专职安全生产管理人员,专职安全生产管理人员配备人数不低于企业从业人员总数的0.5%;(三)第一、二款规定以外的生产经营单位,应当至少配备一名专职或兼职安全生产管理人员,或者委托具有国家规定的相关专业技术资格的工程技术人员提供安全生产管理服务;(四)专职、兼职企业安全生产管理人员均须按照有关要求参加相关培训并具备相应的安全管理专业知识。兼职安全生产管理人员必须由熟悉主要生产工艺的工程技术管理人员担任。第九条单位主要负责人应对本单位安全生产资金投入年度计划进行审批,并监督该计划的有效实施。第十条单位主要负责人应至少每季度组织召开一次安全生产例会,并留存会议记录。安全生产例会内容应包括以下事项:(一)近期企业安全生产形势分析;(二)近期发生事故、重大事故隐患的情况通报;(三)安全生产检查及隐患整改情况的追溯;(四)下一阶段安全生产工作部署;(五)单位重大安全生产事宜的审定。第十一条单位主要负责人应督促企业内部进行安全生产检查,分为四级检查:(一)单位主要负责人每月至少组织检查一次(包含节假日前检查);(二)单位安全生产管理人员每周至少检查一次;(三)车间负责人每周至少检查一次;(四)班组长每日检查一次。对于发现的隐患应明确“四定”——定整改内容和要求、定整改责任人
