劳动合同LaborContract甲方（用人单位）：PartyA(employer):性质：有限责任公司Property:LimitedLiabilityCompany地址：Address:乙方PartyB（劳动者Laborer）姓名Name______性别Gender______年龄Age______身份证号IDNo.______________________家庭住址HomeAdd.______________________联系电话ContactNo.______________________根据《劳动合同法》和国家有关规定，甲乙双方经平等协商一致，自愿签订本合同，共同遵守本合同条款：Accordingtothe"laborcontractlaw"andtherelevantprovisionsofthestate,throughequalconsultationbetweenbothparties’agreement,signthiscontractvoluntarily,abidebythetermsofthiscontract一、劳动合同期限TermoftheLaborContract本合同期限类型为______期限合同Thetypeofthecontractis___________contract（填“有固定或无固定”其中一项）(Fulfillterminableordateless)。本合同期限为___年Thetermofthecontractis_____years，自___年___月___日起至___年___月___日止。from____________to____________.双方约定的试用期至___年____月____日止，期限为3个月。Thetwosidesagreedprobationperiodendson____________,3months'duration.表现优异者，甲方可缩短试用期，但不能少于1个月。Fortheoutstandinglaborer,theprobationperiodcanbeshortenedbyPartyA,butnolessthan1month.以完成一定工作为期限：Basedonafixedworkingterm:从___年___月___日起，到任务完成时止。startingfrom_____________untilthetaskisfinished.二、工作内容和义务JobContentandResponsibility1、乙方同意根据甲方工作需要,AccordingtoPartyA’sdemand,在部门，从事______（管理、销售、技术、生产、后勤等）工作，并遵守岗位工作制度与合理的工作安排（包括但不限于工作内容、工作地点）。PartyBagreestoengagein__________(management/sales/technology/manufacture/logisticsetc.)workinthedepartmentandabidebytheworksystemandreasonableworkarrangement.(Includedbutunlimitedtojobcontent&workingplace.)2、乙方应当按照甲方岗位职责要求，保质保量完成工作任务；AccordingtoPartyA’spostresponsibilityrequirement,PartyBshouldfinishworkingtaskwithqualityandquantityguaranteed.3、甲方本着“一专多能、一职多岗”的用人原则，可以根据经营需要及乙方的工作能力调整乙方的工作职务和岗位，乙方应服从安排。Basedontheprincipleof“oneskillwithmultipleability,onepostwithmultiplework”,andaccordingtothebusinessdemandandPartyB’scompetence,PartyAmayadjustPartyB’sdutyandpost,whilePartyBshouldobeytheadjustment.三、劳动保护和劳动条件LaborProtection&LaborCondition1、甲方根据国家有关安全生产、劳动保护、职业卫生的规定，为乙方提供必要的工作条件和劳动保护设施，保障乙方的安全与健康；Accordingtotherelatedstipulationofsafetymanufacture/laborprotection/occupationalhealthfromthestate,PartyAprovidesnecessaryworkingconditionandlaborprotectionfacilities,insuringPartyB’ssafetyandhealth.2、甲方根据国家有关规定制定工时制度，乙方确因生产经营需要延时的，甲方应当依法安排乙方补休或支付相应的加班费；若乙方实行的是级别工资，则在当月的绩效考核中体现；Accordingtotherelevantregulationsofworkinghoursystem，ifPartyBneedstoextendtheworkinghoursduetotheneedofproductionandoperation,partyAshallarrangepartyBcompensatorytimeofforpayovertimesalaryinaccordancewiththelaw;IfpartyBisimplementedwagelevels,thecompensationshouldbereflectedintheperformanceappraisalforthemonth.3、甲方根据国家有关规定为孕期、产期、哺乳期的女职工提供劳动保护；PartyAshouldprovideprotectionforwomenworkersinpregnancy,childbirth,breastfeeding,inaccordancewiththeprescribedperiodofmedicaltreatment.3、女职工在孕期、产期、哺乳期的；womenworkersinpregnancy,childbirth,breastfeeding.4、在本单位连续工作满十五年，且距法定退休年龄不足五年的；Workedcontinuouslyfor15yearsandlessthanfiveyearsawayfromhislegalretirementageInthisunit.5、法律、行政法规规定的其他情形。Othercircumstancesstipulatedbylawsandadministrativeregulations.（六）乙方解除劳动合同，应当提前三十日（试用期内提前三日）以书面形式通知甲方，甲方在乙方完成业务以及清理完债权债务的情况下，可以解除劳动合同。Ofthefollowingcircumstances,PartyBshallgivenoticetoinformPartyAtoterminatethelaborcontractaheadof30daysaftercleaningupthecreditsanddebts.（七）有下列情形之一的，乙方可以通知甲方解除劳动合同：Ofthefollowingcircumstances,PartyBmaygivenoticetoinformPartyAtoterminatethelaborcontract.1、在试用期内的；Duringthetrialperiod.2、甲方以暴力、威胁或者非法限制人身自由的手段强迫劳动的；PartyAforcedPartyAtolaborbyviolence,threatorillegalrestrictionofpersonalfreedom.3、甲方未按劳动合同约定提供劳动保护和劳动条件的；PartyAfailedtoprovidethelaborprotectionandlaborconditions.4、甲方未按照劳动合同的约定支付工资报酬的；PartyAfailedtopaywagesinaccordancewiththelaborcontract.5、法律、行政法规规定劳动者可以解除劳动合同的其他情形。Othercircumstancesstipulatedbylaws,administrativeregulationsbywhichemployeemayterminatethelaborcontract.九、劳动合同的终止Terminationoflaborcontracts（一）有下列情形之一的，劳动合同即行终止：Ofanyofthefollowingcircumstances,thelaborcontractmaybeimmediatelyterminate1、劳动合同期满的；Thelaborcontractexpired.2、劳动者开始依法享受养老保险待遇的；Workersbegantoenjoyendowmentinsurancetreatmentlawfully.3、劳动者死亡，或者被人民法院宣告死亡或者宣告失踪的；Laborerdied,orwasdeclareddeadormissingbythepeople'scourt.4、甲方被依法宣告破产的；PartyAwasdeclaredbankruptbythepeople'scourt5、甲方被吊销营业执照、责令关闭、撤销或者提前解散的；BusinesslicenseofPartyBwasrevoked,orderedtoclose,cancellationorearlydissolutionof.6、法律、行政法规规定的其他情形。Othercircumstancesstipulatedbylaws,administrativeregulations.（二）乙方应在劳动合同期满前30天通知甲方，甲方同意续订，乙方应及时申请办理续订手续；若甲方不同意续订，到期即办理终止合同手续。乙方未办理终止合同手续而离职的，甲方保留追究其法律责任的权利。PartyBshallgivenoticetoinformPartyAtorenewthelaborcontractaheadof30days.IfPartyAdisagreedtonewalease,thelaborcontractwouldgoexpire.IfPartyBleftwithouttheterminationprocedures,PartyAwouldretainrighttopursueitslegalresponsibility.十、违反劳动合同的责任Breachofdutyofthelaborcontract（一）赔偿经济损失Compensationforeconomiclosses甲方有下列情形之一，给乙方造成经济损失的，应当承担赔偿责任：Ofanythefollowingcircumstances,partyAshallbeliableforcompensationoftheeconomiclossesofpartyB.1、由于甲方制定的劳动合同条款无效的；SinceLaborPartyestablishedthetermsoftheinvalidcontract;2、违反劳动合同法规定的条件解除劳动合同的。Conditionsinviolationoftheprovisionsofthe“LaborContractLaw“toterminatethelaborcontract.乙方有下列情形之一，给甲方造成经济损失的，还应当承担赔偿责任：Ofanythefollowingcircumstances,partyBshallbeliableforcompensationoftheeconomiclossesofpartyA.1、乙方违反《劳动合同法》规定的条件或者劳动合同的约定解除劳动合同，给甲方造成经济损失的，应当按照损失的程度，承担赔偿责任；PartyBviolatedtheconditionsinthe"LaborContractLaw"orterminatedthelaborcontracttocausetheeconomiclossesofpartyA,PartyBshallbeliableforcompensationoftheeconomiclossesofpartyA.2、乙方违反劳动合同约定的保密事项，给甲方造成经济损失的，应当依法承担赔偿责任；ConfidentialmattersPartyviolationsoflaborcontract,causingeconomiclossestothePartyshallbeliableforcompensationaccordingtolaw.3、乙方在合同期内严重违反甲方的有关规章制度、操作规程给甲方造成损失或致甲方聘用的其他劳动者人身损害的，由乙方根据责任的大小负责赔偿。Inthecontractperiod,ifPartyBcausedseriousviolationsofrelevantrulesandregulationsoftheParty,procedures,orcausedlosses,orcausespersonalinjuryofotherworkersemployedbythePartyA.PartyBshallpaycompensationinaccordancewiththesizeoftheresponsibility.（二）违约金Penalty1、甲方为乙方提供专项技能培训，乙方违反培训协议，须向甲方支付违约金；PartyAshallprovidespecialskillstrainingforPartyB.IfPartyBviolatedtrainingprotocol,PartyBshallpayliquidateddamagestoPartyA.2、甲方对乙方实施了竞业限制，乙方违反竞业限制条款，须向甲方支付违约金。PartyAimplementedthenon-competitionforthePartyB.Ifitisviolated,PartyBshallpayliquidateddamages十一、双方约定条款AgreedTermsbytwoParties（一）甲方采取了保密措施保护的商业秘密，乙方负有保密义务；PartyAhastakenmeasurestoprotecttheconfidentialityoftradesecrets,PartyBhastheconfidentialityobligations.（二）甲方可以就保密的内容、范围和地点，双方的权利义务，保密期限，违约责任以及竞业限制条款等与乙方签订协议；PartyAcansignwithPartyonconfidentialityincontent,scopeandlocationoftherightsandobligationsofbothparties,theconfidentialityperiod,andbreachofcontractandnon-competeclause.（三）若乙方在甲方是从事过管理、经营、技术工作的，在离开甲方两年以内，不得在本行业内其它企业工作，不得泄露甲方的生产、经营秘密；IfPartyBisengagedinthemanagement,operation,technicalwork.Afterleavingthepartyinlessthantwoyears,PartyBcannotworkinothercompaniesinthisindustry,andshallnotdivulgeproduction,businesssecretsofPartyA.（四）劳动合同依法解除或终止时，乙方应当归还甲方的保密资料。Whenthelaborcontractwascancelledorterminated,PartyBshallreturnconfidentialinformation十二、劳动争议处理Labordisputesettlement本合同发生劳动争议，甲乙双方应本着平等友好原则协商解决，若协商不成，乙方可以向甲方所在地劳动争议仲裁委员会申请仲裁。Forthecontractlabordispute,bothpartiesshouldhasaequalityamicablesettlementnegotiation,ifthenegotiationfails,PartyBcanseatlabordisputearbitrationcommitteeforarbitrationofPartyA.十三、附则Bylaws（一）本合同未尽事宜可按国家和甲方有关规定执行，没有规定的由甲乙双方协商解决；Thiscontractmaybeoutstandingissuesrelevantpro
