第一章总则第一条为加强开发区管理,完善基础设施建设,发挥综合服务功能,为投资者发明良好的投资环境和生产经营条件。根据《甘肃省人民政府有关深入加紧全省开发区发展的意见》,特制定本措施。第二章管理机构与职责第二条甘肃临夏经济开发区管理委员会(如下简称管委会)为州人民政府派出机构。根据州人民政府授权,在开发区内行使行政管理、经济管理和审批权,按照“封闭式管理、开放式运行、自主式开发、一站式服务”的运行机制建设和管理开发区,重要负责:1、编制和组织实行开发区建设规划、产业发展规划;2、负责开发区土地储备、开发,基础设施、共同设施规划、建设和管理,跟踪贯彻开发区各类项目和国投项目;3、负责编制并组织实行开发区年度招商发展计划;负责招商宣传筹划、项目推介和大型招商活动的组织参与;4、负责开发区项目引进、立项、审批和管理立案工作,贯彻招商引资优惠政策;5、负责开发区内企业设置、入驻、审核等工作,协调、管理和服务开发区内企事业单位,指导开发辨别支机构或派出机构的工作;6、负责编制开发区财政年度预、决算方案,对开发区经济运行及财政收入进行综合调控,对开发区国有资产进行综合管理;7、负责开发区内规划、财政、建设、科技、教育、卫生、文化、安全、人力资源和社会保障、环境保护、记录、计划生育等工作;8、负责协调处理开发区在建设和管理过程中所碰到的各类矛盾纠纷;9、负责开发区企事业单位水、电、气、暖、通讯等基础设施和公共设施的服务保障工作;负责开发区内物业管理工作;10、负责行使州政府授予的其他职权。第三章规划与建设第三条甘肃临夏经济开发区(如下简称开发区)是经省政府同意设置的省级开发区,位于临夏县境内,规划为清真食品加工区,民族特需用品加工区,新型建筑材料加工区(含企业孵化区),中药材加工、生化制品及其他兼容产业加工区五个产业功能区。按照“高起点规划,高原则建设,高水平管理”和各产业功能区坚持“突出风格,突出集约”的原则,严格按照总体规划和控制性详规进行建设与管理。第四条开发区总体规划纳入都市总体规划范围,由州规划部门进行统一编制。控制性详细规划由管委会会同州规划部门编制,按规定程序报批实行。第五条开发区建设用地纳入州、县年度用地计划,由开发区管委会分期分批、统一储备土地,按项目供地。坚持州、县属地管理的原则,由临夏县政府详细负责土地征收。土地运用计划指标由临夏州、临夏县国土部门协调处理,临夏县政府负责贯彻耕地补充任务。第六条开发区土地依法实行有偿有期使用制度,投资者以招拍挂方式获得开发区内的土地使用权。按照企业投资总额、著名度、品牌影响力等详细状况实行对应的土地政策。开发区内的土地需变更用途的,必须按规定报请同意。第七条开发区投资项目供地之前,项目投资者必须向管委会缴纳履约保证金1万元/亩,项目竣工到达审批设计规定后来,退还履约保证金。第八条开发区规划范围内土地严禁私下交易,任何单位和个人不得私自进行建设,所有的建设项目应按规定报请同意。第九条建设项目在获得建设工程选址意见书、建设用地规划许可证、建设工程施工许可证等审批手续后,方可动工建设。管委会对建设项目进行监督管理。第十条开发区基础设施建设严格贯彻项目法人责任制、招标投标制、协议管理制、工程监理制,保证建设项目管理规范合法。第十一条开发区基础设施建设资金以财政资金和政策性贷款为主。按照谁投资、谁受益的原则,鼓励各类投资主体采用多种形式参与基础设施建设。第十二条开发区各类投资项目,必须按期投入资金、按期动工建设。不能按期进行建设的,应提前申请延期,未经同意延期不投资、不建设逾期2年,依法收回土地使用权。第十三条开发区内生产经营差、税收逐年下降,持续停产达1年以上,无法恢复生产的企业,实行退出机制。退出时按照土地出让价格的50%退还土地费用,对地上附着物由退出企业限期清理,土地使用权收回。第十四条开发区内所规划的商业、住宅、公用设施及配套服务项目的收益、土地拍卖所得及经营收益,重要用于开发区滚动发展。第四章项目审批第十五条投资项目必须符合国家、省、州的产业政策导向和开发区产业布局规定,并符合国家环境保护规定。第十六条在开发区兴办投资项目,应向管委会提出申请,由管委会审核后办理环境保护、土地使用、工商登记和税务登记等手续。第十七条入驻项目必须编制可行性研究汇报或项目提议书,固定资产投资3000万元(含3000万元)以上的项目必须委托有资质的设计单位编制可行性研究汇报。管委会组织专家征询委员会进行评审。第十八条入驻项目固定资产投资必须在3000万元(含3000万元)以上,投资强度不低于50万元/亩,容积率符合行业分类控制指标,对投资强度低于原则的建设项目原则上不予供地。固定资产投资在3000万元如下的项目,原则上进入开发区企业孵化区。第十九条开发区内企业设置、变更法人、合并、分立、迁移、歇业等须报管委会审核立案。第五章服务与管理第二十条积极引导环境保护型、循环型、低碳型特色产业项目入驻开发区。优先引进产业带动能力强、投资能力强、税收就业奉献率高的项目,严格控制产品档次低、科技含量少、附加值低的项目入驻。第二十一条开发区管委会严格贯彻首问责任制,实行限时办结制和服务承诺制,对企业入驻、建设、经营提供全程服务。第二十二条开发区管委会要积极引入金融、电信、邮政等公共服务机构和中介机构,为企业提供全方位服务。第二十三条开发区管委会应及时掌握并协调处理企业运行中存在的困难问题,加强对开发区内企业运行服务工作。第二十四条开发区管委会实行季度动态通报制度,对开发区内投资、建设、运行及存在的问题进行通报;对记录汇总进行综合分析,为企业提供市场信息,协助企业搞好市场预测。第二十五条开发区管委会对入区企业实行政策指导和依法管理,规范对入区企业的行政执法检查和收费管理。任何单位和部门对开发区企业进行检查、验收应事先告知管委会。严禁任何单位和部门向企业乱收费、乱摊派、乱罚款。第二十六条开发区管委会根据企业需要对企业用工从技术、安全、法律法规等方面提供优质服务,同步督促企业与从业人员签订劳动协议,维护其合法权益。第二十七条开发区管委会要加强社会治安综合治理,坚决打击侵犯经营者人身和财产安全的多种违法犯罪行为,提供良好的治安环境。第二十八条工商、国税、地税、国土、电力、公安、质检、食品药物监督等职能部门应在开发区设置派出机构,设置办事服务窗口,为企业入驻实行“一站式”服务。第二十九条各职能部门简化办事程序,提高办事效率,采用“一企一策”、“现场办公”等方式提供最便捷服务。对规定前置审批的,实行“工商受理,抄告有关,关联审批,限时完毕”的方式,在10个工作日内办理完毕审批手续。第三十条开发区各企事业单位要按《记录法》有关规定,及时精确地向管委会上报多种记录报表和运行状况。第三十一条入区企业要遵守国家的法律法规和有关政策,自主经营,自负盈亏,自觉接受管委会检查、监督与管理。第三十二条区内企业要建立健全财务制度,真实反应经营状况,如实申报各项应缴税款。如发现篡改财务报表,未真实反应企业经营状况,瞒报企业税款的现象,取消有关优惠政策,并按照有关税收政策予以惩罚。对弄虚作假,采用欺骗手段获得产品认证获奖的由主管部门收缴其证书,追回有关奖励资金,并按有关法规进行惩罚。第三十三条开发区内的单位和个人不得随意破坏和私自变化开发区地上、地下设施,严禁挖土、采砂等破坏土地资源行为。第六章附则第三十四条本措施由甘肃临夏经济开发区管委会负责解释。第三十五条本措施自公布之日起施行。第三十六条本措施有效期为三年。十二月三十一日LinxiaeconomicdevelopmentzonemanagementmethodsofGansuprovinceChapteroneGeneralrulesArticle1:Inaccordancewith“theopinionofthepeople’sgovernmentofGansuprovincethatdevelopsaboutacceleratingdevelopmentzonesinprovince”,thesemethodsareformulatedforthepurposeofstrengtheningmanagementofdevelopmentzone,perfectinginfrastructureconstruction,givingplaytothefunctionofcomprehensiveserviceandcreatingfavorableinvestmentenvironmentandproductionandmanagementconditions.ChaptertwoAdministrativeOrganizationanditsdutyArticle2:LinxiaeconomicdevelopmentzonemanagementcommitteeofGansuprovince(hereinafterreferredtoasmanagementcommittee)isadispatchedinstitutionbystategovernment.Authorizedbystatepeople’sgovernment,itexercisesauthorityofadministrativemanagement,economicmanagementandexaminationandapproval,andconstructsandmanagesdevelopmentzoneaccordingtotheoperatingmechanismof“closedmanagement,openoperational,autonomousdevelopment,one-stopservice”.Itismainlyresponsibleforthefollowingitems:1.Compilationandexecutionofdevelopmentzoneconstructionplanandindustrydevelopmentplan.2.Landreserveanddevelopment,planning,constructionandmanagementofinfrastructureandpublicutilities,trackingandputtingkindsofprojectsindevelopmentzoneandprojectsinvestedbycountryintopractice.3.Compilationandexecutionofannualinvestmentattractiondevelopmentplanofdevelopmentzone,organizingandparticipationofinvestmentattractionpropagandaplan,projectmarketingandlarge-scaleinvestmentattractionactivity.4.Workingofprojectintroduction,projectestablishment,examinationandapproval,managementregistrationindevelopmentzone,puttingpreferentialpolicyofinvestmentattractionintopractice.5.Workingofenterpriseestablishment,settlement,examinationandverification,providingcoordination,managementandserviceforenterprisesandpublicinstitutionsindevelopmentzone,guidingtheworkingofbranchesanddispatchedinstitutionsindevelopmentzone.6.Compilationoffiscalyearbudgetandfinalaccountingprogramofdevelopmentzone,providingcomprehensiveregulationandcontrolforeconomicoperationandfinancialrevenue,comprehensivemanagementforstate-ownedpropertyindevelopment.7.Manyworkingsuchasplanning,finance,construction,scienceandtechnology,education,health,culture,safety,humanresourceandsocialsecurity,environmentprotection,statistics,familyplanning.8.Coordinatinganddealingwithkindsofcontradictionsanddisputesexistinconstructionandmanagementindevelopmentzone.9.Providingserviceandguaranteeforinfrastructureandpublicutilitiesinenterprisesandpublicinstitutionssuchaswatersupply,electricity,naturalgas,heatingandcommunication,andprovidingpropertymanagementfordevelopmentzone.10.Exercisingotherfunctionsandpowersauthorizedbystategovernment.ChapterthreePlanningandconstructionArticle3:LocatedintheLinxiacountyofGansuprovince,LinxiaeconomicdevelopmentzoneofGansuprovince(hereinafterreferredtoasdevelopmentzone)isaprovincialdevelopmentzoneapprovedbyprovincialgovernment.Accordingtoitsplanning,itisdividedintofiveindustryfunctionalzones,namely,halalfoodprocessingzone,processingzoneofgoodsneededforethnicgroup,newbuildingmaterialsprocessingzone(includesenterprisehatchingarea),Chinesemedicinalplantprocessingandbiochemistryprocessingzone,compatibleindustryprocessingzone.Ontheprincipleof“highstartingpointplanning,highstandardconstruction,highlevelmanagement”and“highlightingstyleandintensive”,itexecutesconstructionandmanagementinaccordancewithoverallplanandcontrolleddetailedplanningstrictly.Article4:Theoverallplanofdevelopmentzoneisincludedinthescopeofurbanmasterplanningandcompileduniformlybystateplanningdepartment.Thecontrolleddetailedplanningiscompiledbymanagementcommitteetogetherwithstateplanningdepartmentandthenexecutesitafterbeingapprovedthroughregulatedprocedure.Article5:Landforconstructionindevelopmentzoneisincludedinannuallandutilizationplanningofstateandcounty,andthenreserveduniformlybymanagementcommitteeofdevelopmentzonebystagesandingroups,landissuppliedasrequiredbyproject.Itinsistsontheprincipleofdependencyadministrationofstateandcounty,andLinxiacountygovernmentisresponsibleforthelandexpropriation.LandutilizationplantargetiscoordinatedandsolvedbylanddepartmentofLinxiastateandLinxiacounty,andLinxiacountygovernmentisresponsiblefortheexecutionofarablelandsupplement.Article6:Itcarriesoutlandpaidandtermutilizationsystemindevelopmentzone,theinvestorsobtainrighttouselandthroughmakingwayforstrokes.Itexecutescorrespondinglandpolicyinaccordancewithspecificconditionssuchastotalenterpriseinvestmentamount,popularityandbrandimpact.Itmustsubmitreportforapprovalasrequiredbyprovisionifitneedstomodifyapplicationoflandindevelopmentzone.Article7:Beforethelandforinvestmentprojectindevelopmentzoneissupplied,theprojectinvestormustpayperformancebondRMB10,000permutomanagementcommittee.Itshallrefundperformancebondwhencompletedprojectmeetsrequirementsofexaminationandapproval.Article8:Itisforbiddentohaveprivatelandtransactionwithinplanningscopeindevelopmentzone,anyunitandindividualisprohibitedtocarryoutconstructioninprivate,alltheconstructionprojectsshallbeapprovedasrequiedbyprovision.Article9:Itshallnotbeginconstructionunlesstheapprovalproceduresofconstructionprojectsuchasopiniononconstructionprojectsiteselection,planningpermitofconstructionland,buildingconstructionpermit.Themanagementcommitteeshallsuperviseandmanagetheconstructionproject.Article10:Toguaranteethestandardandlawfulofconstructionprojectmanagement,theinfrastructureconstructionindevelopmentzoneputsprojectlegalpersonresponsiblesystem,thesystemofpublicbiddingforproject,contractmanagementsystemandprojectsupervisionsystemintopractice.Article11:Thefundsofinfrastructureconstructionindevelopmentzonearemainlyfromfinancialfundsandpolicyloans.Accordingtotheprincipleof“profitsshouldgotothosewhohaveinvested”,itencourageskindsofmajorinvestorstakevariousmethodstoparticipateininfrastructureconstruction.Article12:Itmustinvestinvariousinvestmentprojectsonschedulefortheirbeginningconstructiontimely.Forthoserwhichcannotbeconstructedontime,itmustapplyforextensinginadvance,andrecoverland-userightpursuanttothelawiftheoverdueperiodofwithoutinvestmentandconstructionwhichisunapprovedis2years.Article13:Itcarriesoutwithdrawalmechanismforthoseenterpriseswhicharepoorinproductionandoperation,reducedfortaxyearafteryear,andtheperiodofcontinuousproductionhaltbeyond1yearevencannotrecoverproduction.Itshallrefundlandcostsinthepriceof50%landtransferringcostswhenitwithdraws,withrespecttoattachedobjectsontheground,theyaredisposedbywithdrawalenterpriseswithintimelimit,andtherighttouselandshallbewithdrawn.Article14:Theprofitsandearningsandoperationgainsresultingfrombusiness,housing,publicutilityandsupplementaryserviceitemsprovidedindevelopmentzonearemainlyusedintheincreasingdevelopmentofdevelopmentzone.ChapterfourProjectExaminationandapprovalArticle15:Theinvestmentprojectmustmeettherequirementsofindustrialpolicydirectionofnation,provinceandstate,andofindustrydistribution,ofnationalenvironmentalprotection.Article16:Beforeestablishinginvestmentprojectindevelopmentzone,itshallapplytomanagementcommitteefirstlyandthentransactthenecessaryproceduressuchasenvironmentalprotection,landutilization,businessregistrationandtaxregistrationafterbeingexaminedandverifiedbymanagementcommittee.Article17:Itmustcompilefeasibilitystudyreportorprojectproposalsforestablishedproject,forthoseprojectswhosefixedinvestmentsexceedRMB30,000,000(30,000,000isincluded),itmustentrustqualifieddesignorganizationtocompilefeasibilitystudyreport,andthenmanagementcommitteeorganizesadvisorycommitteeofexpertstocarryoutevaluation.Article18:ThefixedinvestmentsforestablishedprojectsindevelopmentzonemustexceedRMB30,000,000(30,000,000isincluded),investmentintensityisnotlessthanRMB500,000permu,andplotratiomeetshallmeetcontrolparameterofindustryclassification.Forthoseconstructionprojectswhoseinvestmentintensityarelessthanstandardarenotgivenlandinprinciple.ForthoseprojectswhosefixedinvestmentsarelessthanRMB30,000,000,itshallenterintoenterprisehatchingareaindevelopmentzoneinprinciple.Article19:Itmustreportittomanagementcommitteeforapprovalandfilinginrespectofenterpriseestablishment,legalpersonmodification,merger,division,removalandgoingoutofbusiness.ChapterfiveServiceandmanagementArticle20:Itencouragestheprojectswithdistinguishingfeaturesofenvironmentfriendly,recyclingandlowcarbontoestablishindevelopmentzone.Thoseprojectswhichhavestrongindustrydrivingcapabilityandinvestmentcapacity,highcontributiontotaxrevenueandemploymentarepreferential。Onthecontrary,theprojectswhichhavelowlevelofproduct,lessscienceandtechnology,lowaddedvaluearecontrolledstrictly.Article21:Themanagementcommitteeputsfirstinquiryresponsibilitysystemintopracticestrictly,carriesoutlimitedtimehandlesystemandservicecommitmentsystem,providesfullservicefortheestablishment,constructionandoperationofenterprises.Article22:Themanagementcommitteeshallintroducepublicserviceagenciesandintermediarysuchasfinance,telecommunication,postalservice,andprovidefull-serviceforenterprises.Article23:Themanagementcommitteeshallknowandcoordinatetheresolutionproblemsintimeexistinenterpriseoperation,andstrengthentheserviceforenterpriseoperation.\Article24:Themanagementcommitteeexecutesquarterlydynamicsreportsystem,informsconditionsofinvestment,construction,operationandproblemsamongthem,givescomprehensiveanalysisforstatisticsafterbeingcombined,providesmarketinformationforenterprisesandassistsmarketforecast.Article25:Themanagementcommitteecarriesoutpolicyguidanceandmanagementpursuanttothelawforestablishedenterprisesindevelopmentzone,makesadministrativeenforcementoflawcheckandchargemanagementstandard.Itshallnotifymanagementcommitteeinadvancebeforeanyunitanddepartmentinspectsorchecksenterprises.Arbitrarychargesandlevies,finestowardsenterprisesareprohibitedforanyunitanddepartment.Article26:Themanagementcommitteeshallprovidequalityservicefrompointoftechnology,safety,lawsandregulationsforenterpriseemploymentasrequiredbyenterprise,andurgeenterprisestosignlaborcontractwithemployeestosafeguardtheirlawfulrightsandinterests.Article27:Toprovidesafepublicsecurityenvironment,themanagementcommitteeshallimproveallfacetsofpublicsecurity,struggleagainstallkindsofcriminalactswhichviolatepersonalandpropertysafetyofoperators.Article28:Functionaldepartmentssuchasindustryandcommerce,nationaltax,localtax,landandresourcesadministration,electricity,publicsecurity,qualityinspectionandfoodanddrugadministrationshallsetupagencyandservicewindowindevelopmentzonetoprovide“one-stop”serviceforenterprises.Article29:AllFunctionaldepartmentsshallsimplifyserviceproceduresandimproveserviceefficiencytoprovideconvenientservicethrough“onepolicytooneenterprise”,“handleofficialbusinessonthespot”.Forthoseenterpriseswhichneedadvanceexaminationandapproval,itcarriesout“acceptedbyindustryandcommerce,notifyrelevant,examineandapproverelated,completewithint
