withnewtechnology,tobeabletodeliver

servicesthataddvaluetoclients.

So,whatcanweexpectfor2023(and

beyond)?

Whenwestartedintroducinglegaltechbackin2021,wefocusedonthequestion:“Whichtechnologyshouldweuse”?Thelegaltechmarketatthattimewasstillquitesmallandthenumberoftoolsavailablewasoverseeable.Therewasmaybeevenonlyonetoolavailablepercategoryatall,e.g.incontractdrafting.Sofirmsstartedtolookintosuchtoolsandprettyroughlymatchedtheirneed“Wewantatoolforcontractdrafting”–andthetool.

Manyprojectsfailed.AndIamconvincedthatoneofthemainreasonsforsuchfailureswasthatthetooldidnotsolvetherightproblem.Itsolvedaprobleminitscategory,butthespecificfeaturesdidnotmatchthatspecificcompany’srequirements.Orthetechnologywastoocomplicatedtouse,andnotenoughpeopleweretrainedinthesoftware.

Inmanyinstances,legalpractitionersactuallydonotwanttogettrainedintheuseofasoftwaresystem.Theywishforthetooltobesetupandforeverybodytobeabletojustuseit.

Andthisbringsustoanotherverycommonprobleminlegalinnovation:mostlegalpractitionersarefocusingonsolvinglegalproblems.Andwhilethiswillremaintobepartofourprofession,itwillnotbetheonlysellingpointinthefuture.Thequestionoflegaldeliverywillincreasinglybecomethefocusofthepractice.

Hencelawyersshouldbetrainedin

suchmethods,whichshouldleadtounderstandinghowtechnologyworksandshouldopentheirmindsettochangingthewayoflookingatthings.

Sothefirststepistohavealookatthejourneyofthecontractsorknow-how.Whereisknow-howdeveloped?Canitbereused?Howcanweincentivizeknow-howinputfromlawyers?Andforlawfirms:whatwouldbeagoodpricingmodel?WhichotherlegaltechtoolscanbeconnectedviaAPIsorplatforms?Sotherearemanystepstogobeforesuchmetadataofcontractcanstrategicallybecollectedandused.Solutionscomingupinthisareashouldbeeasytoinstall,oratleastforthelawfirmeasytohaveitinstalled.Automatedtextcollectionandrecognitionsystemscanbeofgreathelptostructureavailabledataandmakeitaccessible.Butthentheyalsohavetobefriendlyfromauser’sperspective.Themoreintuitivetouse,thelowerthehurdleforlegaliststouseit.Evenabitofgamificationcouldbehelpful,aslawyersliketohavesomefunaswell.;-)

Wehaveseenmanytoolscomingandgoingoverthelastfewyears.Ifyouchangethemindsetofthelawyersandcombineitwitheasilyaccessibletools,thenlegaltechwillprosperoverthenextyearsonaverybroadscale.

Wehavestartedalegaldesignprojecttodiscovertheclient’sjourneywithourfirm.Inmanyinterviewswithallofthedifferentstakeholders,includingclients,wehavemappedtheupsanddownsofthewayourlawfirminteractswithclientsandcases.Thisisgreatinsightandgivesusajourneymapfortheintegrationoftherighttools

Increasingly,legalworkflowsarebeingundertakenthroughtechnology.Wheretechnologyinthepracticeoflawwasoncelimitedtofoundationalsupporttools,itisnowdisruptingthewaythatlawyerspractice.Advancesintechnologyoverthe

evolutions.Duediligencewillbecome,by

default,automatedduediligence.Drafting

willalwaysinvolvesomecomponentof

automationandwewilllookbackwith

amazementatthedayswhenlawyers

Evenwiththisadvancedtechnology,the

legalindustryisnotheadinginadirectionwherelawyersarereplacedbymachines.Lawyerswhoarenotusingmoderntechnology,however,andarenotbeingstrategicaboutautomatingthepartsoflegalpracticethatlendthemselvestoit,arevulnerable.Thelawyerswhowillthriveinthefuturearethosewhoembracetechnologyandunderstanditspotentialtoimprovethewaytheypractice,thewaytheydeliverlegalservicestoclients,andtooptimizethequalityoftheworkthattheydo.

Legalteamswonderinghowtheyshouldgetstartedwhenitcomestolegaltechnologyshouldreviewtheirpracticetoidentifyareasofworkthatareovertlymanualandrepetitive.Themeswilllikelyarisefromthisreview,withproblemareasarising,forexample,inworkflowsaroundworkintake,documentdrafting,contractmanagement,ortasktracking.Onceyouidentifythemostcommonpainpointforyourteam,youwillbeabletofocusyourinitialeffortstowardsdigitizationonthisusecaseandidentifyfromtherethetypeoftechnologythatwillhavethemostpositiveimpactonyourlegalpractice.
