PAGEPAGE10厂房混凝土浇筑施工合同CONTRACTOFCONCRETEPOURINGPROJECT签署日期DateofSignature甲方：（发包方）PartyA:(Employer)乙方：（承包方）PartyB;(Contractor)鉴于甲方将厂房混凝土浇筑施工项目工程的施工委托给有能力的承包商完成；鉴于乙方系有工程建设资质的承包商，愿意依照本合同条款的约定完成该项目的施工；为顺利完成厂房混凝土浇筑施工项目工程施工，经双方协商一致，就乙方承包本项目的施工事宜签订本合同。WHEREASpartyAwillmakeconsignationofconstructionofconcretepouringprojectforthebuildingoffactorytothecompetentcontractorforaccomplishment;andWHEREASpartyBisthecompetentcontractorwiththeauthorizationofprojectconstruct,andliketocompletethisprojectundertheprovisionsofthiscontract.Forthepurposeofsuccessfulaccomplishmentoftheexecutionofconcretepouringprojectforthebuildingoffactory,thiscontractisconcludedandenteredintobyandthroughmutualnegotiationbetweenpartieshereto,NOWTHEREFORETHISCONTRACTWITNESSESthatitisherebyagreedbyandbetweenthepartiesheretoasfollows:一、工程名称：ProjectName二、施工地点：ProjectPlace三、承包工作内容：ProjectContents按国家规范要求和甲方的施工方案施工，包括基础及主体结构（包括后浇管道井顶板、后浇洞、预制过梁、地沟及盖板、屋面墙及构架等）等混凝土浇捣、操平、养护、操作台搭拆，成品及半成品保护措施，混凝土机械安装；零星混凝土现场拌制；泵送系统堵管时的管道检修以及混凝土缺陷的修补。UndertaketheexecutionasState’sregulationsandpartyA’sprogrammeincludingconcretepouring/vibration,leveling,curingofconcreteforthefoundationandmainstructureconsistingofpostpouringpipeshaftroof,postpouringhole,precastlintel,trenchandcover,wallandroofstructure；anderectionandremovalofoperationplatform,protectionoffinishedproductandsemi-finishedproduct,installationofmachinery,temporaryconcreteon-site,piperepairforblockingpipeofpumpingsystem,inadditiontorepairofconcretedefect.其具体项目如下：ParticularsofProjectasfollows混凝土泵就位，搭泵管架及接泵管等；Locationofconcretepump,installationofpiperacksandconnectionofpipeandotherworksconcerned.凝土的下料和振捣密实及混凝土浇水养护；Materialsofconcrete,vibrationcompactingandwatercuring.混凝土的初步找平；Primaryleveling对相应混凝土材料的质量负责；Liableforthequalityofrelatedmaterialsusedforconcrete.四、承包单价与工程量计算方法：ContractingUnitPriceandCalculate±0.00及以下与屋面以上按元/立方米计价结算，其工程量按施工图或设计变更计算，标准层按承包包干单价：元/㎡，以建筑面积结算；±0.00andbelowinadditiontotheroofabovearesettledaccountsasYuan/m3;thequantityhereofarecalculatedasperdrawingsordesignalteration;standardfloorreferredtothecontractingunitprice,viz.Yuan/m3onbasisofconstructionarea.五、工程质量要求：QualityofProject1、施工质量必须达到国家现行《施工质量验收规范》（GB50300-2001系列）标准的要求。ExecutionqualityshouldbesatisfactorytotherequirementofState’sexistingCODEFORCONSTRUCTIONQUALITYACCEPTANCE(GB50300-2001).2、凡未达到施工质量要求的工程部位，乙方必须无条件的返工，其返工的各项费用由乙方自行负责，并赔偿甲方的各项损失（材料、工期、质量等损失）。Respectingtoanypartofprojectwhichfailtosatisfytherequirementsofprojectquality,partyBshouldreworkunconditionallyandundertakethefeesandcoststhereofforitsownaccount,inadditiontocompensationofpartyA’slossanddamageofvariouskindsincludingthelossofmaterials,workstermandqualityandsoon.六、施工工期要求：ProjectTerm1、根据现场施工总进度要求：本分项工程的施工工期为按周进度计划的要求进行；Executiontermofthissubjectshall,pursuanttotherequirementofgeneralprogresson-sit,becarriedoutonthebasisofScheduleofWeek’sProgress.2、为确保施工工期，甲方根据总工期（总工期以签定的合同工期为准）的要求，以周计划进行工期进度的安排，乙方必须严格按照甲方制定的周进度计划安排工作并确保其完成。IntheexpectationofensuringtermofprojectpartyAwill,pursuanttotherequirementofgeneraltermwhichbesubjecttothetermwhichisstipulatedherein,makepreparationofprogresswithweeklyschedulewithwhichpartyBshouldbeinstrictaccordance,andensureitsaccomplishmentthereof.七、安全施工要求：SafetyExecutionOn-site乙方人员必须做到安全施工，材料堆码有序，工完场清料尽，必须服从甲方管理，遵守各项管理制度。PartyB’spersonnelonsiteshoulddosafetyexecution,materialstackingorderly,workendandmaterialclear,andshouldobeythemanagementbypartyA,abidebythemanagementrules.八、材料管理：MaterialsManagement材料进场由乙方项目部验收，甲方派人参与工程材料的验收并签字确认材料的进场数量、质量。ProjectmaterialsenteringthesitewillbecheckedandacceptedbypartyB’sProjectDepartment,andpartyAwilldispatchpersonneltoparticipatethejointacceptanceofprojectmaterialsandmakeconfirmationbysignatureofquantityandqualityofmaterialsenteringthesite.九、工程量验收方法和期限：MethodandTimelimitedofQuantityAcceptance1、记件工程量以每个单项工程为一个结算单位，分为基础工程至六层楼面结构为首次，六层楼面结构以后每月一次，工程竣工一次，工程竣工3个月后一次。记日工每月验收一次；Inrespectofquantityofpiecework,eachindividualprojectwillbedeemedasaunitofaccount,whichdividedintothatinitialtimeofaccountisfoundationprojecttothesixfloorstructure;onceaccountmonthlyafterthesixfloorstructure;oneaccountuponcompletionofproject,oneaccountonthreemonthsfollowingcompletion.Quantityofdayworkwillbeacceptedonceamonth.2、根据乙方完成的工程量和合同规定的付款条件，由甲方项目经理审批付款；Paymentofprojectcostwill,pursuanttotheaccomplishmentquantitybypartyBandpaymentconditionshereof,beeffectedontheexaminationandapprovalofpartyA’sprojectmanager.十一、乙方职责：PartyB’sResponsibilities1、乙方根据施工需要、工程进度、安全及质量要求，安排有施工经验、单项技术全面的技术工人承担该项施工任务。PartyBshall,pursuanttonecessityofexecution,projectprogress,safetyandqualityrequirement,dispatchthecompetenttechnicalworkerwithexperienceandfullskillstoundertakesuchtask.2、乙方施工中使用的手工工具、电动工具，施工电缆电线及灯具自行解决。PartyBshouldprepareonitsownaccountthehandtools,electricaltools,cable/wireusedforexecutionandlightinglamp.3、如果乙方施工不能满足甲方进度、质量的要求，甲方可随时安排其它承包商进场完成，由此产生的费用由乙方承担，而且必要时甲方有权提前解除协议并另选施工承包商。ProvidedthatiftheexecutionofpartyBfailtosatisfypartyA’srequirementofprogressandquality,partyAcanatanytimeprepareothercontractorenterintothesiteforaccomplishingworks,forwhichthecostarisingtherefromshallbeassumedbypartyB,andinnecessary,partyAisentitletodischargethiscontractinadvanceandselectothercontractorfordoingworks.十二、甲方职责：PartyA’sResponsibilities1、甲方负责对乙方进场作好施工前的安全、质量、施工技术交底。PartyAisliablefortechnicalclarificationofsafety,qualityandexecutionbeforepartyBenteringintothesiteforconstruction.3、负责对乙方安排工程进度，签发施工任务书，督促限期完成。LiableforpreparationofpartyB’sprogress,issueprojectassignmentandurgingcompletionofworksonthedeadline.4、负责对乙方完成工作量的工程验收及结算工程款。LiableforacceptanceofpartyB’scompletionofworksandmakesettlementofprojectcost.十三、工程款的结算与支付：SettlementandPaymentofProjectCost1、 基础工程至六层楼面结构完成，开始支付工程款，支付的额度为已经完成工程的70%，以后根据施工进度，按上个月完成的工程量的70%支付。Initialpaymentofprojectwillbeeffecteduponthecompletionofbaseconstructionandtosixthfloorstructure,theamountofpaymentis70%ofthevalueofcompletedworksandthereafter,pursuanttotheprogressofproject,eachpaymentwillbeeffectedon70%oflastmonth’scompletedworkquantity.2、工程主体完成，付工程款的90%，剩余10%的工程款待工程竣工后3月内付清。90%ofprojectcostwillbeeffecteduponthecompletionofprojectmainstructure,andremaining10%ofprojectcostwillbepaidoffwithinthreemonthsafterprojectcompletion.十四、争议解决Unlessotherwiseagreedtobytheparties,anydisputearisingoutoforinconnectionwiththetransactioncontemplatedbythepartieshereundershallbesubmittedtoandresolvedbyChinaInternationalEconomicandTradeArbitrationCommitteeforarbitrationinaccordancewiththearbitrationrulestheninforce.Thearbitralawardshallbefinalandbindinguponbothparties.与本条款项下交易相关的或由其引起的一切争议应当提交中国国际经济贸易仲裁委员会依据其现行仲裁规则裁决，双方另有约定的除外。仲裁裁决为最终裁决，对双方具有约束力。十五、违约责任：BreachLiabilities1、如果乙方未在合同规定时间完工，应承担所承包范围内工程总额的20％的违约金。PartyBshould,wherefailureofcompletionofworkswithinthetimelimitedwhichstipulatedincontract,assumebreachpenaltyof20%totalamountofcontractedproject.2、如果乙方施工质量不能满足现行施工质量验收规范和甲方对工程质量的具体要求的，甲方有权与乙方中途任何时候终止本施工合同。ProvidedthatifpartyB’sexecutionqualityfailtosatisfythecurrentcodeforacceptanceandpartyA’sspecificrequirementforprojectquality,partyAisentitletoterminatethiscontract.3、在施工期间所发生的工伤、质量、安全、管线、设备、火灾及其它事故，均由造成事故的乙方负责。PartyBshouldassumefullresponsibilitiesandliabilitiesforwork’sinjury,quality,safety,pipeline,equipment,fireandotheraccidentsduringitsexecutionofproject.十六、不可抗力如果合同一方由于不可抗力因素而不能履行合同，比如地震、台风、洪水、火灾、战争及其他无法预见的事件，其发生和后果也无法阻止、无法避免的，该方应立刻以电报通知对方，并在其后十五天内提交公证机关出具的详细的事件描述及有效文件，用以解释其无法履行合同全部或部分条款的原因。双方应通过协商，根据事件对履行合同的影响程度，确定是终止合同或是免除履行合同的责任，或延长合同的履行。Shouldeitherofthepartiestothecontractbepreventedfromexecutingthecontractbyforcemajeure,suchasearthquake,typhoon,flood,fireandwarandotherunforeseeneventsandtheirhappeningandconsequencesareunpreventableandunavoidable,thepreventedpartyshall,bycable,notifytheotherpartywithoutanydelay,andshall,within15daysthereafter,providethedetailedinformationoftheeventsandavaliddocumentforevidenceissuedbytherelevantpublicnotaryorganizationforexplainingthereasonofitsinabilitytoexecuteordelaytheexecutionofallorpartofthecontract.Thepartiestothecontractshall,throughconsultations,inaccordancewiththeeffectsoftheeventsontheperformanceofthecontract,decidewhethertoterminatethecontractortoexemptthepartofobligationsforimplementationofthecontractorwhethertodelaytheexecutionofthecontract.十七、其他事项：Miscellaneous1、本合同附件为：混凝土工程施工技术方案。ThiscontractisaccompaniedbyanappendixofTechnicalAppendixofConcreteconstruction2、本合同一式三份，乙方执一份、甲方执二份。其他未尽事项，双方协商解决。ThiscontractismadethreecopiesforpartyBholdingoneandpartyAholdingtwocopies.Anyoutstandingissuehereinwillbesettledthroughconsultationbetweenpartieshereto.INWITNESSWHEREOF,eachofthePartiesheretohascausedthiscontracttobeexecutedbyitsdulyauthorizedrepresentativeonthedatefirstsetforthabove.双方正式授权代表已于文首所载日期签署本合同，以资证明。甲方（盖章）：PartyA(Seal)乙方（盖章）：PartyB(Seal)法人代表或委托人：法人代表委托人：LegalRepresentativeorDeputyforPartyALegalRepresentativeorDeputyforPartyB附件：Appendix:混凝土浇筑工程施工技术方案TechnicalSchemeofConcretePouring1、混凝土施工基本要求GeneralRequirementofConcrete混凝土的配合比统一由试验室根据混凝土的强度等级，结合现场气温、施工部位、浇筑方式、运输距离及砂石料含水率等各种因素的影响而进行设计。混凝土浇筑过程中，试验室按规定到现场取试件进行28天抗压强度试验，对混凝土质量进行严格的控制。Mixtureratioofconcretewillbematchedbytestroombasedonthestrengthofconcrete,sitetemperature,constructionposition,poring,transportation,moisturecontentratio.Whilepouringtheconcrete,thesampleshallbefetchedatsitebyTestRoom,the28dayscompressivestrengthforthesampleshallbedone,andqualityofconcreteshallbestrictcontrolled.2、混凝土施工难点：Difficultiesofconcreteconstruction:本工程设计地下室混凝土为S8级抗渗混凝土，因此必须加强混凝土的振捣及养护工作，防止因混凝土产生裂缝而导致渗漏现象的发生。ThedesignedbasementconcreteisS8waterproofconcrete,soitisvitaltopreventitfromleakage.emphasisontheconcretevibrationandcuring.本工程混凝土柱截面大、高度高，混凝土浇筑时侧压力比较大，施工中要控制好单柱的一次浇筑高度，避免模板变形及跑模，以满足清水混凝土的质量要求。Thecolumnhaslargesectionandhighlayerwithgreatpressureofconcretecasting.Duringconcretecasting,theheightofone-offcastingheightshallbecontrolledtopreventtheformworkfromdistortionandbulgingisanimportantpremisetomeettherequirementsoffair-facedconcrete.本工程所有的钢筋混凝土构件如梁、墙和柱等拆模后的表面必须达到清水混凝土的要求。ForRCcomponents,includingbeams,wallandcolumns,qualityrequirementonsurfaceshouldachieve“fair-facedconcrete”qualitylevel.3、混凝土浇筑Castscheme混凝土的浇筑和捣实是使混凝土获得良好的密实度的关键工序。浇筑柱子时，先在柱子底部铺一层与混凝土组分相同的去石砂浆作为结合层，可以避免柱子施工缝处产生蜂窝麻面现象。混凝土要分层浇筑，每层浇筑厚度约为振动棒作用部分长度的1.25倍，不可连续卸料太多；边下料边振捣，连续作业浇灌到顶，中间不留施工缝。拆模时要注意保护柱面及棱角不受损坏，拆模后，浇水养护，并用塑料薄膜及麻袋覆盖，实行保水养护。Pouringandroddingisoneofkeysequencetoanicedensityconcrete;aprimercementmortarshallbelaidatthebottompriortopouringthecolumn,soastoavoidthevoidsandpits.Theconcreteshallbepouredlayerbylayer，eachlayerofpouringshallbe1.25timeslengthasthevibratingneedle.Whileunloadingtheconcrete,pouringatthesametime.Constructionjointwillnotremainatthemiddleofcolumn.Removingtheform,takecareofthesurfaceandtheedge.Afterremovetheform,curingwithwater,coverbygunny-bag.使用插入式振动器时，遵循“快插慢拔”的原则，使振动棒自然垂直地沉入混凝土中。为使上下层混凝土结合成整体，振动棒应插入下一层混凝土中3～5cm。振动棒要上下抽动，以保证上下部分的混凝土振捣均匀。棒的尾部要露出1/3～1/4，软轴部分不要插入混凝土中。振动棒应插点均匀，不要忽远忽近，一般不超过振动棒有效作用半径的1.5倍。但是最边缘插点距离模板不应大于有效作用半径的二分之一。振动棒在各插点的振动时间，以见到混凝土表面基本平坦，泛出水泥浆，混凝土不再显著下沉，直至无气泡排出为止。振动时尽量避免撞及钢筋、埋件和模板。Usinginsertvibratingneedleshallfollowtheruleof“FastInsert,SlowPull”;vibratingneedleshallfallintoconcretevertically.Tocombinatetheupperandbottomconcretewell,thevibratingneedleshallbe3~5cmdeeptothelayerconcrete.Itshallbetwitchedupanddown,soastoassuretheconcreteuniform.Theendofvibratingneedleshallberemain1/3~1/4,thesoftportionshallnotbeintotheconcrete,theinsertpointsshallbeuniform,andshallnotover1.5timeseffectiveradius.Thevibratingshalllasttillnobubbleorairbubblefromconcrete.Trytoavoidtouchthesteelbar,embeddedandformswhilevibratingconcrete.有台阶基础浇筑混凝土时，上下台阶不应一次浇到顶。先浇筑下级台阶，待混凝土初凝前，再依次浇筑上级台阶，以防止柱子混凝土从柱脚冒出，形成蜂窝或麻面。Theconcreteshallnotbepouredfrombottomtotheupperonetimewhencastingthefoundationofstep;pouringthebottomstepfirst,andthenpouringtheupperstepspriortopre-settingsoastoavoidvoidsandpits.侧模的拆除前应给混凝土强度发展有足够的时间，防止拆模过早碰坏混凝土棱角。在施工缝处浇筑混凝土以前，要对施工缝表面垃圾水泥薄膜松动砂石等进行清除，并进行凿毛处理。凿毛以混凝土表面露出石头深浅不一为准。但靠模板的外边一圈宜处理成水平线，以免柱表面呈现犬牙交错现象。Concreteshallbecuredenoughtimetoassurethestrengthbeforeremovalform,toavoidtoughingtheedgeofconcrete.Cleanthesurfaceofjointsandmakeitroughnesspriortopouringtheconstructionjoints;theoutsidejointsshallbedealtwithahorizontalline.本工程混凝土采用泵送商品混凝土，采用机械振捣、人工整平压实，派专人养护。混凝土运输、浇筑及间歇的时间不应超过混凝土的初凝时间。同一施工段的混凝土应连续浇筑，并应在底层混凝土初凝之前将上层混凝土浇筑完毕。Castingshallusethemethodof“conveyingcommercialconcretebyconcrete-pump,mechanicalvibration,artificialplanning、pressingandcuringbyprofessorworkers”inTheProject.Transportation,pouringandbreaktimeshallnotbeovertimeofinitialconcreting.Itshouldbepouringcontinuallyinonestep,andfinishpouringbeforeinitialconcretingonbottomlayer.混凝土浇筑前应验收好钢筋和模板。混凝土的浇筑高度不得大于2米，混凝土浇筑高度超过2米时可以采用混凝土串筒浇筑。梁及类似构件的混凝土应一次性浇筑完毕，墙、柱等类似构件混凝土每层浇筑时间间隔不得超过30分钟。Noconcreteshallbeplaceduntilthesteelreinforcementormouldhasbeenchecked,andapprovedbythesupervisor.Theconcretemustnotbetippedfromaheightofmorethan2mbutshallbeloweredinchutesorskips.Concreteforbeamsandsimilarmembersshallbeplacedinsingleoperationtothefullthicknessandconcrete(inwalls,columnsandsimilarmembers)shallbeplacedinhorizontallayerseachnotnormallyexceed30minutes.新旧混凝土浇筑时，旧混凝土表面浇筑前应清理干净、凿毛后在涂刷西卡、大师等混凝土粘合剂。Atalljunctionsbetweennewandexistingconcretework,thesurfaceoftheexistingconcreteshallbecleanedandroughed,immediatelybeforethenewconcreteisdeposited,thesurfaceshallbecleaned,washedandcoatedconcretebondingagentsuchasSIKAorMasterBuilder施工缝和后浇带的位置应按设计要求和施工技术方案确定，施工缝处按设计要求在墙板中间留设止水带,后浇带部位应浇筑UEA膨胀混凝土。Constructionjointandpost-pouringbeltshallbedoneinaccordancewithdesignandtechnology.Constructionjointsshallbefilledwithwater-stopinthemiddleofthewallslab.Post-poutingbeltshallcastUEAexpansionconcrete.本工程要达到优质结构，混凝土必须达到清水混凝土效果，对振捣要求较高，既不能漏振，也不能过振。混凝土浇筑过程中的振捣各个施工部位时责任到人，细化具体部位，做好各个部位的振捣记录。拆模后各个部位的振捣质量反馈给各个振捣手，促使其改进工作，达到提高混凝土振捣质量的目的。Toachievequalitystructureoftheproject,theconcretemustbefair-facedconcrete,thusitrequireshigh-qualityvibration,whichshallnotbemissedorovervibrated.Allconstructionsectionsofvibrationduringconcretepouringshallreachresponsibilitytothepeople,thedetailedsectionshallbesubdivided,andthevibrationrecordsofeachsectionshallbefinished.Afterformworkdisassembly,thevibrationqualityofeachsectionshallbefeedbacktothevibratingoperatorstoimprovetheirwork,andtoachievetheobjectiveofimprovingthevibrationquality.采用插入式振捣器振捣，振捣厚度不得大于振捣棒的长度。混凝土的振捣采用随浇随振捣，振捣棒垂直插入混凝土，插入到下层尚未初凝的混凝土中约50～100mm，以使上下层互相结合；操作时要做到快插慢拔，如插入速度慢会先将表面混凝土振捣密实，导致与下部混凝土发生分层离析现象；如拔出速度过快，混凝土来不及填补而在振捣器抽出的位置形成空洞。Theimmersionvibratorshallbeadopted,andvibrationthicknessshallnotexceedthelengthofvibratingneedle.Thevibrationshallbeperformedalongwiththepouringofconcrete,andthevibratingneedleshallinsertintotheconcretevertically,withthedepthof50-100mmbelowtheconcretewhichhasn'tinitialsetonthelowerlayer,sothattheupperandlowerlayercancombine;thevibratingneedleshallbefastandpulledslowlywhenoperating,thesurfaceconcreteshallbefirmlyvibratedifinsertingslowly,andshallsegregatewiththeconcreteonlowerlayer;ifpullingtoofast,theconcretecannotfilltimelyandahollowwillbeformedinthepositionofvibratorwhichwaspulledout.振捣器的插点要均匀排列，排列方式采用行列式和交错式两种，由振捣手灵活掌握。插点间距距不超过40cm，振捣器距模板应大于20cm；用振捣器振捣时应避免碰振钢筋、模板、及预埋件。Theinsertingpointofvibratorshallbearrangeduniformly,thedeterminantandstaggeredarrangementshallbeadopted,andthearrangementshallbemasteredflexiblybyvibratingoperators.Thedistancebetweeninsertingpointsshallnotexceed40cm,andthedistancebetweenvibratorandtemplateshallbemorethan20cm;thereinforcements,templatesandpre-buriedpartsshallbeavoidedtocollidedwhenvibratingwithvibrator.当浇筑过程中出现泌水现象时，如不严重，不应把水直接排走，以免带走水泥浆，可采用海绵吸水亦可进行二次振捣或二次抹光；如泌水现象严重时，应改变配合比或掺用减水剂；本次施工中采用改变减水剂的用量，下次施工时调整混凝土的配合比。Whentheweepingphenomenonoccurringinpouringprocess,iftheconditionisnotserious,thewatershallnotbedrainedawaydirectlytoavoidtakingawaycementslurry,however,thewatershallbeabsorbedwithsponge,andsecondaryvibrationorsecondarysmoothingcana
