1、房屋租赁合同TENANCYAGREEMENT房屋租赁合同TENANCYAGREEMENT第号一、出租人(以下简称甲方)Landlord(hereinafterreferredtoaspartyA)二、承租人(以下简称乙方)Tenant(hereinafterreferredtoaspartyB)三、租赁范围及用途Tenancy:甲方同意将其所有的位于北京市朝阳区光华路 2 号阳光100 座 20 座室的房屋及其设施(包括家具和电器)在良好及可租赁的状态下租给乙方为居住使用、出租房的面积总计约 110 平方米。PartyAherebyagreestoleaseitspropertylocated

2、atRM2001,BuildingB,Sun100GuanghuaRoad,ChaoyangDistrict,Beijingandtherelatedfacilities(includingfurnitureandappliances)ingoodtenantableconditiontoPartyBfor1year.Thesizeoftheleasedpropertyisapproximately110spm.四、租赁期：TermofTenancy:4.1租赁期为青年,自 2010 年 07 月 15 日起至2011 年 7 月 14 日止。Theabovepropertyisherebyl

3、easedforatermofoneyear,commencingonJuly15,2010andexpiringonJuly14,2011.4.2租赁期满，甲方有权收回全部出租房屋，乙方应如期交换。乙方如有要求续租或退租，应提前壹个月通知甲方。Uponexpirationofthetenancy,PartyAhastherighttotakebacktheentireleasedproperty,andPartyBshalldelivertheleasedpropertytoPartyAontime.Alternatively,PartyBhavetheoptontorenewthisagr

4、eementorquitthisagreementupongivingonemonthpriornoticetoPartyAbeforetheexpirationofthisagreement.五、租金及付款方式Rentandthewayofpayment1双方谈定的租金为每月 5800 元。Therent,agreedbybothparties,isRMB5800permonth.1乙方支付甲方每月的租金，应壹个月支付一次。付款日期应在每月 25 日之前。PartyBshallpayOnemonthsrentinadvance,onorbefore25thofeachcalendarmont

6、o05ofthemonthrentperday.六、保证金（押金）：SecurityDesposit:为确保出租房屋及其设施之安全并完好及租赁期内相关费用之如期结算，乙方同意于签订合同当日支付给甲方的租赁押金 5300元作为乙方确保合同履行之保证金。Toensurethewelfareandgoodconditionoftheleasedpropertyandtherelatedfacilitiesaswellasthepromptpaymentandsettlementofallrelatedchargesdurningthetermoftenancy,PartyBagreestopayto

8、cyorsoonerdeterminationofthisagreementafterPartyBsettledallchargesofleasedpropertywithPartyA.七、费用担保：Payment:租赁期间物业费和取暖费由甲方承担。Durningthetermofthetenancy,thepropertymanagementfeesandtheheat-preservationfeesshallbepaidbyPartyA.房屋的冷、热水、电、天然气消耗按每月查表实数由乙方支付。Thecold,hotwater,electricity,andgaspayment(forwa

9、terandtear)ofthepropertyshallbepaidbyPartyBaccordingtoitsactualpaymentpermonth.电话费、有线收视费按实际费用由乙方交付。PartyBaccordingtoitszctualpaymentshallpaythepaymentfortelephoneandinternationalchannel.八、出租人的责任Landlordsobligations:甲方须按时将出租房屋及其设施以良好的状态交付乙方使用。PartyAshalldelivertheleasedpropertyandtherelatedfacilities

10、ingoodconditiontoPartyBonschedule.租赁期内甲方不得收回出出租房屋(除非本合同另有规定)PartyAshallnottakebacktheleasedpropertydurningthetermofthetenancy.(Unlessotherwisestipulatedinthisagreement)在乙方遵守本合同的条款及交付租金的前提下，乙方有权于租赁期内拒绝甲方或其他人骚扰而安静享用出租房屋。ProvidedthatPartyBabidesandperformstheappendixesoftheagreementandthepaymentforthet

11、enancy,PartyBhastherighttorefusetheinterruptionfromPartyAtoenjoythelifesatisfactionandpeace.房屋基本设施和结构，甲方有修缮的责任并承担有关的费用，并对其做定期修缮。PartyAisresponsibleforrepairingandmaintainingthebasicfacilitiesoftheleasedpropertyandforbearingallcoststhereto.甲方谨在此声明及保证甲方为出租房屋的合法拥有人并由合法地位出租此房屋与乙方。PartyAherebyrepresentsa

12、ndwarrantsthatPartyAisthelegalowneroftheleasedpropertyandhasthenecessarylegalcapacitytoleasethepropertytoPartyB.如在租赁期内，租赁房屋发生所有权全部或部分转移、或其他影响乙方权益的事情时， 甲方应保证所有权人或者其他影响乙方权益的第三者，能继续遵守本合同所有条款，如乙方与本合同的权益人首次等所有权人或第三者所影响或损害，甲方须负责任补偿乙方的所有损失、损害、支出及费用Ifdurningthetermofthetenancy,allorpartoftheleasedpropertyis

13、transferredorPartyBSrighttousetheleasedpropertyisattested,PartyAshallensurethatsuchtransfereeorthirdpartyhavinganeffectonPartyBsrighttousetheleasedpropertywillcontinuetoabidebythetermsofthisAgreement.PartyAshallalsobeliabletokeepPartyBbefullyindemnifiedagainstanycosts,expenses,losses,anddamagessuffe

14、redbyPartyBifanyofPartyBsinterestshereinareaffectedorprejudicedbyathirdparty.九、承租人的责任：TenantsObligatons:乙方应按合同的规定，按时支付租金，保证金及其他各项应付费用。PartyBshallberesponsibletopayallrentsandfeesinattimelymanneraccordingtothetermsofthecontract.乙方经甲方事先同意，可在承担租用房内进行装修及添置设备，租赁期满必须恢复原状(正常损耗除外)，并承担其费用，经甲方验收认可后归还甲方。PartyB

15、withthepriorconsentofPartyA,canrenovateandinstalladditionalfacilitiesintheleasedproperty.UponexpirationifthetenancytheleasedpropertyshallberesumedtoPartyAinitsoriginalconditions(fairwearandtearexempted)andallexpensesarisingtherefromshallbebornebyPartyB.乙方应爱护使用租赁的房屋，如因乙方的过失或过错致使房屋及设施受到损失(正常损耗除外)乙方应负赔

16、偿责任。PartyBshalltreattheleasedpropertywithcare.BecauseofPartyBsnegligenceormisconduct,theleasedpropertyandtherelatedfacilitiessufferanydamage(fairwaerandtearexempted)PartyBshallberesponsibleforcompensatingPartyAforsuchdamages.乙方应按本合同的规定合法使用租赁房屋，不得擅自改变其性质，不应存放中华人民共和国法律下所禁止的危险物品，如因此发生损害，乙方应承担全部责任。Party

17、Bshallusetheleasedpropertylegallyasagreedinthisagreementandmaynotchangesuchuseonitsown.PartyBshallnotstoreanydangerousitems,whichareprohibitedbythelawsinthePeoplesRepublicofChinaintheleasedpropertyandshallbefullyresponsibleforanydamagesoraresultthereof.租赁期即将结束之日，经乙方同意，甲方可以带其他客户看房。Uponexpirationofthe

18、tenancyorsoonerdeterminationofthisagreement,PartyAcouldtakeotherstochecktheapartmentwiththePartyBagreement.中英文条款及意思如有不一致之处，双方协调解决。IntheeventthatthereistheconflictbetweentheChineseversionandEnglishversion,insuchcasePartyAandPartyBshallgotogetherandresolvetheproblem.十、违约处理：BreachofAgreement乙方如有下列行为之一的，甲方有权终止本合同，收回出租房屋，并且扣除房屋保证金。PartyAshallhavetherighttoterminatethisagreementrepossesstheleasedpropertyandporfeitthemoneyofthesecuritydespositifPartyBcommitsoneofthefollowings.未得甲方同意将承租房屋擅自拆改结构改变用途Altersthestructureoftheleasedpropertyw
