法律语篇权力意志的体现与翻译 摘要 进入新世纪，随着我国加入w t o 、实施西部大开发战略、加速发展信息产 业，必然进一步提高对外开放的水平，发展开放型经济，以适应经济全球化趋势。 这些方面的举措都要求法制建设的相应发展。在当今这个地球村，法制建设必然 离不开法律语言研究和法律翻译。著名语言学家胡壮麟先生说过，语言学理论不 可闭锁在象牙塔内，应大胆地走出校园、走出书斋。正是基于大师的教诲，本文 作者试图在前人研究的基础上，运用所学语言学知识研究法律语篇的权力机制， 探讨法律语篇如何体现国家的权力意志以及如何在译文中再现这种权力意志。 法律语言学研究在我国刚刚起步，基本上还停留在法律语言的表层层面：句 法、用词特征等的研究。很少有人从语言角度研究法律和法律实践。从语篇角度 研究分析法律语言以及法律翻译的人更少。本文从系统功能语言学视角结合语篇 分析理论研究法律语篇的权力机制。研究数据采用中华人民共和国刑事诉讼 法，同时运用定性和定量式研究方法。 韩礼德( 1 9 8 5 ，1 9 9 4 ) 等功能语言学家将语言看成是社会符号系统，将语言 的功能概括为三大纯理功能：概念功能、人际功能和语篇功能。这三种功能是语 言意义的三个方面，在交际中同时发挥作用。从微观角度看，意义由更为细节性 的语法系统来实现，比如及物性系统、语气系统和主位系统。在本研究中，概念 功能用经验功能和逻辑功能分析，人际功能用语气和情态等来分析，语篇功能用 主位结构、信息结构和衔接系统等来分析。研究结果表明：为了反映权威性、客 观性、正式性、精确性和包容性，立法语篇中含有大量的内嵌式复句、主从复句、 被动语态、标记性的信息结构等，多限制性或修饰性成分，多条件和假设成分，
