1.0Recitals

2.0PropertyDescription

2.1TheLandlordherebyleasestotheTenant,andtheTenantherebyleasesfromtheLandlord,theProperty,togetherwithallimprovementsandappurtenancesthereto,onthetermsandconditionssetforthinthisAgreement.

3.0TermandRent

3.1ThetermofthisAgreementshallcommenceon[StartDate]andshallcontinueforaperiodof[NumberofYears]years,unlessterminatedearlierinaccordancewiththeprovisionsofthisAgreement.

3.2TheTenantshallpaytotheLandlordamonthlyrentof[Amount]dollars,payableinadvanceonthefirstdayofeachmonth.

4.0SecurityDeposit

4.2ThesecuritydepositshallbeheldbytheLandlordandshallberefundabletotheTenantuponterminationofthisAgreement,subjecttotheprovisionsofSection9ofthisAgreement.

5.0UseofProperty

5.1TheTenantshallusethePropertysolelyforresidentialpurposesandshallnotusethePropertyforanyotherpurposewithoutthepriorwrittenconsentoftheLandlord.

5.2TheTenantshallcomplywithallapplicablelocal,state,andfederallawsandregulationsgoverningtheuseandoccupancyoftheProperty.

6.0MaintenanceandRepairs

6.1TheLandlordshallmaintainthePropertyingoodrepairduringthetermofthisAgreement,exceptforwearandtearresultingfromnormaluse.

6.2TheTenantshallkeepthePropertyinacleanandsafeconditionandshallpromptlyreportanynecessaryrepairsormaintenancetotheLandlord.

7.0AlterationsandImprovements

7.1TheTenantshallnotmakeanyalterationsorimprovementstothePropertywithoutthepriorwrittenconsentoftheLandlord.

7.2AnyalterationsorimprovementsmadebytheTenantwiththeLandlord'sconsentshallremainthepropertyoftheLandlorduponterminationofthisAgreement.

8.0TerminationandSurrender

8.1ThisAgreementmaybeterminatedbyeitherPartyupon[NoticePeriod]days'writtennoticetotheotherParty.

8.2UponterminationofthisAgreement,theTenantshallsurrenderthePropertytotheLandlordinthesameconditionasatthecommencementofthisAgreement,ordinarywearandtearexcepted.

9.0SecurityDepositRefund

9.1UponterminationofthisAgreement,theLandlordshallpromptlyrefundthesecuritydeposittotheTenant,lessanydamagesorcostsincurredbytheLandlordasaresultoftheTenant'sbreachofthisAgreement.

10.0Miscellaneous

10.1ThisAgreementconstitutestheentireagreementbetweenthePartiesandsupersedesallprioragreements,understandings,andnegotiations,whetherwrittenororal,relatingtothesubjectmatterhereof.

10.2ThisAgreementmaybeamendedormodifiedonlybyawritteninstrumentexecutedbybothParties.

10.3IfanyprovisionofthisAgreementisfoundtobeunenforceable,theremainingprovisionsshallremaininfullforceandeffect.

4.2TheThirdPartyshallnotmakeanydecisionsregardingalterationsorimprovementstothePropertywithoutthepriorwrittenconsentoftheLandlord.

5.0Landlord'sRightsandInterests

5.1TheLandlordshallhavetherightto:

a)ApproveorrejectanymodificationsorimprovementsproposedbytheTenantortheThirdParty;

b)MonitortheperformanceoftheThirdPartyandensurecompliancewiththetermsofthisAgreement;

c)RequesttheTenanttovacatethePropertyiftheTenantbreachesthisAgreementorposesarisktotheLandlord'sinterests;

d)Retaintherighttosell,lease,orotherwisedisposeofthePropertyatanytimewithoutpriornoticetotheTenant.

6.0Tenant'sRightsandInterests

6.1TheTenantshallhavetherightto:

a)OccupancyofthePropertyduringthetermofthisAgreement;

b)UsethePropertyforresidentialpurposesonly;

c)NotifytheLandlordortheThirdPartyofanynecessaryrepairsormaintenance;

7.0Tenant'sObligationsandLimitations

7.1TheTenantshall:

a)Complywithallapplicablelawsandregulations;

b)MaintainthePropertyinacleanandsafecondition;

c)NotifytheLandlordortheThirdPartyofanyalterationsorimprovementsmadetotheProperty;

d)NotsubletthePropertywithoutthepriorwrittenconsentoftheLandlord.

7.2TheTenantshallbeliableforanydamagesorlossescausedtothePropertyduetonegligenceorintentionalmisconduct.

8.0ThirdParty'sObligationsandLimitations

8.1TheThirdPartyshall:

a)PerformitsserviceswithduediligenceandinaccordancewiththetermsofthisAgreement;

b)MaintainconfidentialityofanyinformationprovidedbytheLandlordortheTenant;

c)ProvideregularreportstotheLandlordontheconditionofthePropertyandanyissuesthatarise.

8.2TheThirdPartyshallbeliableforanybreachofitsobligationsunderthisAgreement,includinganydamagesorlossescausedtotheLandlordortheTenantasaresultofitsnegligenceorintentionalmisconduct.

9.0TerminationandSurrender

9.1ThisAgreementmaybeterminatedbyeitherPartyupon[NoticePeriod]days'writtennoticetotheotherParty.

9.2UponterminationofthisAgreement,theTenantshallsurrenderthePropertytotheLandlordinthesameconditionasatthecommencementofthisAgreement,ordinarywearandtearexcepted.

10.0Miscellaneous

10.1ThisAgreementconstitutestheentireagreementbetweenthePartiesandsupersedesallprioragreements,understandings,andnegotiations,whetherwrittenororal,relatingtothesubjectmatterhereof.

10.2ThisAgreementmaybeamendedormodifiedonlybyawritteninstrumentexecutedbyallParties.

d)HaveadesignatedpointofcontactattheThirdPartyforalltenant-relatedmatters.

6.0Tenant'sObligations

6.1TheTenantshall:

a)Complywithallapplicablelawsandregulations;

b)MaintainthePropertyinacleanandsafecondition;

c)NotifytheThirdPartyofanydamagesorissuestothePropertypromptly;

7.0Landlord'sObligations

7.1TheLandlordshall:

a)ProvidetheTenantwithaccesstothePropertyasagreedupon;

b)EnsurethePropertyisinahabitableconditionatthecommencementofthelease;

c)AllowtheTenanttoterminatetheleasewithpropernoticeifthePropertybecomesuninhabitable.

8.0Landlord'sRightsandLimitations

8.1TheLandlordshallhavetherightto:

a)InspectthePropertyatreasonabletimeswithadvancenotice;

b)RequesttheTenanttovacatethePropertyiftheTenantbreachestheleaseagreement;

c)LimittheTenant'srighttomakealterationstothePropertywithoutconsent.

9.0ThirdParty'sRightsandObligations

9.1TheThirdPartyshallhavetherightto:

a)CollectfeesforservicesprovidedunderthisAgreement;

b)Employsub-contractorstoperformmaintenanceandrepairservicesifnecessary;

c)TerminatetheagreementwiththeTenantiftheTenantfailstopayfeesorbreachesthetermsoftheagreement.

9.2TheThirdPartyshallbeobligatedto:
