外籍教师合作协议Agreementofcooperation甲方：深圳乐学三人行教育征询有限公司PartyA：ShenzhenLexuesanrenxingEducationalandconsultingcompany以下称乙方：PartyB：名字:性别:生日Name:Gender:Birthdate国籍：护照号码：Nationality：PassportNo.：双方本着和谐合作精神，自愿签订本协议并保证认真履行协议中约定的各项义务。Thetwoparties,inaspiritoffriendlycooperation,agreetosignthiscontractandpledgetofulfilconscientiouslyalltheobligationsstipulatedinit.协议期自起至止。LengthofContract:fromto.甲乙双方合作内容Cooperationcontent:甲方与乙方进行教学合作，乙方为甲方提供教学服务，并接受甲方的监督管理Bothpartiescooperatetogethertofulfilltheteachingtasks.PartyBoffersteachingandorganizingservice.PartyAhastherighttosupervisetheserviceandresultfrompartyBduringthecooperation.乙方在合作期间享受的福利BenefitsofpartyB在合作期间，甲方有责任保证乙方工作环境的安全，并且对此提供相应的援助。Duringcooperation,partyAcanofferassistanceandadviceregardinganyissueswithlocalofficial’senquiringaboutcooperation.甲乙双方合作满半年后，乙方可以享受5天的带薪休假。Aftersix-monthcooperation,partyBiseligiblefor5dayspaidleave.甲方为乙方提供不定期的团队出行和团队用餐的补贴。Onregularoccasion,theschoolwillpayfordaysoutorlunchsubsidies.甲乙双方合作满一年并续签一年新合约，甲方将为乙方提供9000元人民币年终奖励，此奖励将作为办理工作签证的补贴。假如乙方不需要办理工作签证，则可以选择5000元人民币钞票奖励。Uponcompletionofoneyearcooperationandsigninganewcontract,partyAwillofferupto9000RMBsubsidytowardstheworkingvisaofpartyBorreceivea5000RMBbonusifnoassistanceisrequiredfortheworkingvisa.乙方工作时间和工作内容TheworkinghoursofpartyB根据学校的作息时间表，每周工作日为6天（节假日除外），如遇节假日学校调换课程时间则按学校规定安排授课。每周授课时间为23小时（不包含活动），培训时间为4小时。如遇特殊情况，超过的小时数将以¥50/小时支付给乙方。工作时间安排如下：星期一，休息星期二至星期五，15:00-21:00星期六，9:00-12:00,14:00-17:00,17:30-18:30星期日，9:00-12:00,14:00-17:00,17:30-18:30寒假和暑假学期期间的课时安排如下:星期一至星期六，9:00-12:00,14:00-17:00星期日，休息Accordingtotheschool’steachingschedule,teachersusuallywork6daysaweek(exceptholidays).Iftheschoolchangesthescheduleduringtheholiday,teachershavetheobligationtotakeuptheclassesaccordingtotheschool’sarrangement.Thereare21teachinghours(activitiesarenotincluded)and4traininghoursperweek.Everymonth,therearelessthan84teachinghours.Duringthenormalsemester,ifnecessaryandrequired,PartyAwillpayextra¥50/hourtopartyBforeveryadditionalteachinghourmonthly.Thescheduleisasfollows:（theschedulemaybeswitchedbyspecialoccasion）Monday,offTuesdaytoFriday,15:00-21:00Saturday,9:00-12:00,14:00-17:00,19:00-20:00Sunday,9:00-12:00,14:00-18:00Duringthesummerandwintervacationsemesters,theworkingschedulewillbeswitchedtoasfollowsMondaytoSaturday9:00-12:00,14:00-18:00Sunday,Off2.乙方有责任准时到校备课，假如违反一次，将予以警告。违反两次以上，将从乙方每月工资中扣除50元/次，乙方接受甲方各店店长的监督。PartyBhastheobligationtobepresentintheschoolontimeanddonotbelate.IfpartyBdoesn’tobeythisregulationforthefirsttime,partyBwillreceiveaverbalwarning.IfpartyBreceivesasecondwarning,partyAhastherighttocutthesalaryby50RMBeachtimepartyBislate.3.遇甲方在合作学校有特殊活动时，乙方应当参与，如庆祝日、教研活动及一些重要的英语活动等，甲方对此给予乙方一定的交通补贴，但不再支付其他费用。IfpartyAhostssomespecialactivities,partyBshouldattendit.Forexample,celebrationday,teachingresearchactivitiesandsomeimportantEnglishactivities.PartyAwillprovidefinancialhelptowardstransportfeesforpartyB,butnoextrapayment(salary).4.乙方服从甲方分派的教学任务和课程安排；在甲乙双方约定的教学时长和工作时长内，对于甲方的课程安排，乙方不得拒绝接受。乙方应按期完毕工作任务，保证教学工作的质与量。PartyBhastheobligationtoacceptthereasonablearrangementoftheclassesandschedule.PartyBisnotallowedtobeabsentfromtheclasseswithintheteachinghoursasagreed.Ifthereisaspecialreasonforabsence,partyBhastoinformpartyAatleast3daysahead.Incaseofanemergencyorillnessoraccident,partyBhastosubmitpropercertificationdulysignedbyanauthorizedperson.5.乙方有义务遵守甲方的外教管理工作守则，涉及重要工作时间安排，平常工作职责奖惩制度等。乙方有义务认真完毕上级领导所下达的工作任务和准时按质完毕。It’stheobligationforPartyBtofollowtheRulesandRegulationssetoutforallforeignteachers,includingtheworkingschedule,dailyworkandresponsibility,PartyBalsohastheobligationtokeepclassroomscleanandtidyaftereachclasshasfinishedandanyadditionaltasksthatmaybeaskedbythesupervisor.6.甲方为乙方提供教学内容和教学材料，乙方有责任提前完毕备课任务，并与助教和教学主管核对每周备课内容。PartyBwillbegivenmaterialforeachclass,theymustfullypreparebeforecommencementofeachclassandisobligedandrequiredtofulfillthistasktothelevelrequiredbytheschoolorsupervisor.7.乙方有责任参与甲方举行的户外推广活动。如因推广活动而导致超时工作，超过30分钟将按加班工资核算。OccasionallypartyBisrequiredtoparticipateandattendpromotionalactivitiesandoutdooractivitiestopromotethecauseoftheschool.Thisperiodiswithintheworkinghours.Anyextratimeextending30minuteswillbepaidaccordingly.8．每三个小时的课程将有两个课间休息，每次休息不得超过10分钟。在此期间，乙方必须留在学校，不允许在此期间抽烟、喝酒、接打私人电话。Twobreaksoftenminutesarepermittedwithineach3-hourclass.PartyBmustremainonschoolpremisesduringthesebreaksandisnotpermittedtosmokeordrinkalcoholorattendpersonalphonecalls.Supervisionisstillrequiredofthechildrenduringthesebreaks.9.乙方在工作时间不允许闲聊，玩手机，玩电脑游戏，外出用餐，外出购物等活动。如需外出，需向上级提出口头申请，并经得各店店长批准。AnyperiodduringtheworkinghourswhenpartyBisnotteaching,mustrefrainfromusingtheirmobilephonefromanyuseapartfrommakingorreceivingphonecalls.Anyuseofschoolequipmentsuchascomputersismeantforofficialworkandnotforplayinggames,etc.PartyBisnotallowedtoleavetheschoolwithoutpermissionofthesupervisor.10.UniformprovidedbytheschoolmustbewornatalltimeswhenpartAisinschool.三、授课地点Workingaddressandlocation甲方根据乙方的实际情况，为乙方安排的课程在内，如有其他变化，双方协商解决。Onrareoccasions,partyBmayberequestedtocoverorsubstituteanotherteacheratoursecondbranchwithorwithoutpriornotice.四、薪酬标准Salarycriteria1.双方协商达成一致，按月薪资的方式计算工资，首月工资结算自入职日起至每月最后一天，按实际工作天数结算。次月工资自每月第一天起，自每月最后一天为止。每月甲方支付乙方人民币_____10000______元整，每月15日发放上月工资。Whenthetwopartiesagreewitheachother,partyBwillbepaidmonthly.PartyBwillreceivetheirsalaryafterthecompletionofeachmonthonthe15thofeverymonth.PartyApaysPartyB______10000________RMBpercalendarmonth.(Forexample,ifpartyBsignstheagreementon20thofthemonth,thenthesalaryfrom20thofthatmonthtothelastdayofthatmonthwillbepaidonthe15thofthenextmonth.Thesalaryofthefirstdayofthecalendarmonthtothelastdayofthemonthwillbepaidonthe15thofthenextmonth)双方合作期间，甲方为乙方提供____1000/月______交通补贴。Duringthetimeofcooperation,partyAofferspartyBanadditional¥1000/monthsubsidytowardsthecostsoftransportation. 五、其他事项Mattersofreference:1.乙方在合作期间的健康及医疗由乙方自行解决。Personalmattersincludingaccommodation,healthandillnessaretheresponsibilityofpartyB.PartyAisavailableforadviceandhelpatalltime.2.病假及事假：Sickleaveandcompassionateleave（1）假如乙方因患病并经医院证明确不能工作，可以向甲方提出请假。假如乙方连续7天请病假，甲方可以按照国家外专局协议有关规定中止与受聘方的协议。Intheeventofsickness,partyBmustproduceadequatecertificationfromthecorrecthospitaltoprovetheirsicknessinregardstosickleave.Uponprovidingcertificatesickleavewillbegranted.Ifthesickleaverunsfor7dayscontinually,partyAhastherighttoterminatethecontractaccordingtothecontractissuedbystateadministrationoftheForeignExpertsAffairs.（2）假如乙方在工作时间内需要请事假，须得到甲方的批准；假如乙方未向甲方提出请假，而旷工不上课，甲方有权在其旷工期间罚扣其一个月工资IfPartyBappliesforadayoffbecauseofpersonalreasonsduringtheworktime,itmustbeconfirmedbypartyA.IfpartyBisabsentfromclasswithoutapplicationorinforming,thenpartyAhastherighttocutonemonth’ssalarytocoverthelossofouradministrationcosts,reputationandhiringofareplacementteacher.七．保密协议confidentialityagreement1.双方不得将合作内容和任何合作具体信息透露给第三方，涉及甲方内部员工。BothpartiesarenotallowedtodivulgeanyinformationordetailsregardingeithertheschoolorpartyB.AllaspectsofcooperationbetweenpartyAandBareconfidential2.在任何情况下，甲乙双方不得将工资，协议内容，国籍，年龄，教学年限和中介来源透漏给第三方，涉及甲方公司员工。Thetwopartiesarenotallowedtodivulgepersonalinformationregardingsalaries,contract,nationality,andageorrecruitmentagency.UnderNOCIRCUMSTANCEcanthisinformationordetailsbepassedontoanyoftheotherstaff.IfpartyBhasbeenfoundguiltyofthisconfidentiality,breachwillresultininstantdismissalwithoutpay.
