餐饮服务岗位劳动合同英文版合同编号:__________partiesthiscontract(hereinafterreferredtoasthe"contract")isenteredintoasofthedatefirstabovewrittenandbetween[insertnameofemployer](hereinafterreferredtoasthe"employer")and[insertnameofemployee](hereinafterreferredtoasthe"employee").recitalswhereas,theemployerisengagedinthebusinessofprovidingcateringservices(hereinafterreferredtoasthe"business");whereas,theemployeeiswillingtorenderservicestotheemployerinthecapacityofacateringserviceposition(hereinafterreferredtoasthe"position");whereas,theemployerdesirestoemploytheemployeeandtheemployeedesirestobeemployedtheemployer,uponthetermsandconditionssetforthherein.now,therefore,inconsiderationofthemutualpromisescontainedherein,thepartiesheretoagreeasfollows:articlesarticle1:employment1.1employmentstatus.theemploymentrelationshipbetweentheemployerandtheemployeeshallbethatofanatwillemployee,unlessotherwiseprovidedherein.article2:dutiesandresponsibilities2.1duties.theemployeeshallperformsuchdutiesandresponsibilitiesasareconsistentwiththeposition,asmaybeassignedtheemployerfromtimetotime,withreasonablenotice.3.1salary.theemployeeshallreceiveamonthlysalaryof[insertsalaryamount],payableonthelastworkingdayofeachmonth.3.2benefits.theemployeeshallbeendtosuchbenefitsasmaybeprovidedfromtimetotimetheemployer,initssolediscretion,includingbutnotlimitedtohealthinsurance,paidtimeoffandretirementbenefits.article4:workinghoursandleave4.1workinghours.theemployeeshallwork[insertnumberofhours]hoursperweek,asscheduledtheemployer.4.2leave.theemployeeshallbeendto[insertnumberofdays]daysofpaidtimeoffperyear,proratedbasedontheemployee'sstartdate.article5:termination5.1terminationeitherparty.eitherpartymayterminatethiscontractatanytime,withorwithoutcause,uponwrittennoticetotheotherparty.5.2terminationemployer.theemployermayterminatethiscontractimmediatelyuponwrittennoticetotheemployeeforcause,includingbutnotlimitedtobreachofthiscontract,misconductorfailuretoperformthedutiesandresponsibilitiesoftheposition.5.3terminationemployee.theemployeemayterminatethiscontractimmediatelyuponwrittennoticetotheemployerforanyreason.article6:confidentialityandnondisclosure6.1confidentiality.theemployeeshallmaintaininstrictconfidenceandshallnotdisclosetoanyperson,firmorentityanyconfidentialinformationoftheemployer,exceptasmayberequiredlaworcourtorder.6.2nondisclosure.theemployeeshallnot,duringthetermofthiscontractoratanytimethereafter,directlyorindirectlysolicitorattempttosolicitanycustomers,clientsoremployeesoftheemployerforanypurposewhatsoever,exceptasmayberequiredlaworcourtorder.article7:indemnification7.1indemnificationemployee.theemployeeshallindemnifyandholdharmlesstheemployerfromanyandallclaims,demands,actions,suits,damages,liabilities,costsandexpenses(includingbutnotlimitedtoreasonableattorney'sfees)arisingoutoforinconnectionwithanybreachofthiscontracttheemployee.7.2indemnificationemployer.theemployershallindemnifyandholdharmlesstheemployeefromanyandallclaims,demands,actions,suits,damages,liabilities,costsandexpenses(includingbutnotlimitedtoreasonableattorney'sfees)arisingoutoforinconnectionwiththeemployee'sperformanceofdutiesandresponsibilitiesunderthiscontract,exceptasmaybecausedtheemployee'sgrossnegligenceorwillfulmisconduct.article8:miscellaneous8.1EntireAgreement.ThisContract(includinganyexhibitsattachedhereto)constitutestheentireagreementbetweenthepartiesandsupersedesallprioragreements,understandings,negotiationsanddiscussions,whetheroralorwritten,oftheparties.8.2一、附件列表:1.员工简历2.职位描述3.薪资结构说明4.福利计划细节5.工作时间表6.假期政策7.保密协议8.非竞争协议9.员工手册10.公司规章制度二、违约行为及认定:1.员工未能履行合同约定的dutiesandresponsibilities视为违约。2.雇主未能按时支付salary视为违约。3.未能提供合同约定的benefits视为违约。4.未经对方同意,单方面终止合同视为违约。5.违反confidentialityandnondisclosure条款视为违约。6.违反indemnification条款视为违约。三、法律名词及解释:1.Atwillemployment:指雇主和员工双方都可以随时无理由终止雇佣关系的就业状态。2.Cateringservice:餐饮服务。3.Confidentialinformation:保密信息。4.Nondisclosureagreement:保密协议。5.Grossnegligence:重大疏忽。6.Willfulmisconduct:故意不当行为。四、执行中遇到的问题及解决办法:1.员工迟
