Unit4InspectionDeclarerⅠ.InspectionDeclarer

InspectiondeclareristhepersonwhoacquiresthequalificationspecifiedbytheAdministrationofQualitySupervision,InspectionandQuarantine,registersatinspectionandquarantineinstitutionandisresponsibletohandleentry-exitinspectionandquarantineformalities.Inspectiondeclarermustserveinacertaininspectiondeclarationunitandcannotworkindependently.Inspectoristhejointnameoftheinspectiondeclarationunitandinspectiondeclarerwhoimplemententry-exitinspectionandquarantineandcustomsinspection/applicationproceduresandformalitiesandundertakethecorrespondingobligationsandlegalresponsibilities.Inordertostrengthenthemanagementoverinspectiondeclarer,inspectionandquarantineinstitutionimplementscertificatesystemforinspectiondeclaration,andinspectiondeclarershallshowhis“CertificateforInspectionDeclaration”whenmakinginspectiondeclaration.GeneralAdministrationofQualitySupervisionhascentralizedthemanagementofthenationalInspectionDeclarers’registration;alldirectlyaffiliatedinspectionandquarantinebureausareresponsiblefortheinspectiondeclarers’registrationmanagementwithintherespectivejurisdictions.Alllocalinspectionandquarantineagenciesareresponsiblefordailysupervisionofinspectiondeclarers’registrationmanagement,whichcarriesoutthesystemoferrorregistrationmanagement.一、报检员报检员是指获得国家质检总局规定的资格，经检验检疫机构注册，负责办理出入境检验检疫报检业务的人员，报检员必须服务于某一个报检单位而不能独立其外。报检人是对履行出入境检验检疫报检/申报程序和手续并承担相应义务和法律责任的报检单位和报检员的统称。为了加强对报检员的管理，检验检疫机构实行凭证报检制度，报检员报检时应主动出示其“报检员证”。国家质检总局统一管理全国报检员的注册管理工作，各直属检验检疫局负责所辖地区报检员注册管理工作，各地检验检疫机构负责报检员注册的日常监督管理工作。检验检疫机构对报检员日常的报检行为实施差错登记管理制度。Ⅱ.QualificationofInspectionDeclarerPersonnelwhoattendtheexaminationforthequalificationsofInspectionDeclarersshallmeetthefollowingconditions：①atleast18yearsoldwithcompletecapacityforcivilconduct;②withgoodmoralcharacter;③withhighschoolorsecondaryprofessionalschooloraboveeducationbackground;④otherconditionsstipulatedbyGeneralAdministrationofQualitySupervision.ThepersonwhohaspassedtheinspectionqualificationexamcanacquiretheQualificationCertificateofInspection,whichwouldbeinvalidautomaticallyifthepersondidnotengageininspectionbusinesswithin2years.二、报检员资格参加报检员资格考试的人员应当符合下列条件：①年满18周岁，具有完全民事行为能力；②具有良好的品行；③具有高中或者中等专业学校以上学历；④国家质检总局规定的其他条件。报检员资格考试合格的人员，取得“报检员资格证”，2年内未从事报检业务的，“报检员资格证”自动失效。Ⅲ.InspectionDeclarers’RegistrationThepersonwhohasobtainedtheQualificationCertificateofInspectioncanapplyforinspectiondeclarerregistration.Theinspectiondeclarer’sregistrationshouldbeappliedbytheenterprisewhichhasregisteredattheinspectionandquarantineinstitutionsandobtainedinspectionunitcodeattheinspectionandquarantineinstitutionattheplaceofregistration,andsubmitthefollowingmaterials：①ApplicationFormforInspectionDeclarers’Registration;②theregistrationcertificateoftheenterprisethattheto-beinspectiondeclarerworksfor,issuedbyinspectionandquarantineinstitutions;③QualificationCertificateofInspectionoftheto-beinspectiondeclarer;④othersupportingdocumentsrequiredbyinspectionandquarantineinstitutions.AsforthosewhoseQualificationCertificateofInspectionisinvalid,orwhoseCertificateforInspectionDeclarationisrevokednomorethan3years,orthosewhohavebeenregisteredininspectionandquarantineagenciesasaninspectiondeclarerbuthavenotgonethroughtheprocessofcancellation,registrationwillnotbehandledforthembytheinspectionandquarantineagencies.

三、报检员注册获得“报检员资格证”的人员，方可申请报检员注册。报检员注册应当由在检验检疫机构登记并取得报检单位代码的企业向登记地检验检疫机构提出申请，并提交下列材料：①报检员注册申请书；②拟任报检员所属企业在检验检疫机构的登记证书；③拟任报检员的《报检员资格证》；④检验检疫机构需要的其他证明文件。对“报检员资格证”失效的，被吊销“报检员证”不满3年的，已在检验检疫机构注册为报检员并且未办理注销手续的，检验检疫机构不予以注册。Ⅳ.TheTransferenceofInspectionDeclarerInspectionstafftransferredtootherlocalenterprisestoengageinthebusinessofinspectionshalltaketheproofdocumentsofthenewenterpriseandapplyfortransferringformalitiesattheissuinginstitutionofinspectionandquarantine.Iftransferredtoenterprisesinadifferentplacetoengageintheinspectionbusiness,heorsheshallapplyfortheinspectionandquarantineinstitutionandgothroughthecancellationprocedures,andreregisterattheinspectionandquarantineinstitutionattheplaceofthenewenterprisewiththecancellationcertificate.四、报检员变更报检员调往当地其他企业从事报检业务的，应当持调入企业的证明文件，向发证检验检疫机构办理变更手续；调往异地企业从事报检业务的，应当向调出地检验检疫机构办理注销手续，并持注销证明向调入企业所在地检验检疫机构重新办理注册手续。Ⅴ.ManagementofInspectionDeclarer1.CertificateofInspectionDeclarationisanidentitycertificateoftheinspectiondeclarerforhandlinginspectiondeclaration,soitshallnotbelentoralteredtoothers.2.Inspectiondeclarershallnotservefortwoormoredeclarationinspectionunitsfortheinspectionworkconcurrently.3.Inordertosupervisetheinspectiondeclarer,inspectionandquarantineagenciesadoptasystemoferrorregistration.4.CertificateforInspectionDeclarationisonlyvalidfor2years,and30daysbeforetheexpirationdate,inspectiondeclarershallapplyforextensionattheissuanceorgan.Inspectionandquarantineagenciesexaminethembytheirdailyinspectionworkrecord.Ifthepersonpassestheexamination,thecertificatecanbeextendedfor2years.Ifnot,thecertificatecanbeextendedfor2yearsaftertheinspectiondeclarer'squalifiedtraining;iftheinspectiondeclarerdidnotapplyforextensionbeforetheprescribedtimelimit,orattendtrainingandexaminationasrequired,orfailedtheexamination,theextensionwouldnotbepermittedandboththeCertificateforInspectionDeclarationandtheQualificationCertificateofInspectionwouldlosevalidity.5.AsforthelossoftheCertificateforInspectionDeclaration,thestatementonthesituationshouldbesubmittedwithin7daystotheissuanceagencywithadeclarationofitsinvalidityinthenewspaper;ifthecertificatewasstillvalid,itcouldbereissued.Beforethereissuance,thedeclarercannothandleinspectiondeclaration.

6.Underanyofthefollowingcircumstances,companieswhichinspectiondeclarersworkforshouldcollecttheCertificateforInspectionDeclarationandhandittothelocalinspectionandquarantineagencies,andapplyforthecancellationproceduresofCertificateforInspectionDeclarationinwrittenform：①theinspectiondeclarernolongerengageininspectionbusiness;②theenterpriseshasstoppedinspectionbusinessforsomereasons;③enterprisehasdismissedtheinspectiondeclarers.Inspectionandquarantineagenciesshalldealwithitintimeaccordingtotheprovisions,andissuetheCancellationCertificateofInspectionDeclarer.Asforthelegaldisputesresultedfromhandlingthecancellationformalities,theenterpriseoftheinspectiondeclarershouldundertakethelegalconsequences.7.IfInspectiondeclarershaveoneoffollowingactions,inspectionandquarantineagenciesshallsuspendtheinspectionqualificationfor3monthsor6months：①notperformobligationsasinspectiondeclarerforsubstitutedinspectionunitandthecircumstancesareserious;②therearethreetimesormoreofinspectionerrorsinayearandthecircumstancesareserious;③lendingoralteringtheCertificateofInspectionDeclaration.

8.IftheinspectiondeclarerwantstoapplyforregistrationoftheCertificateofInspectionDeclarationafteritscancellation,inadditiontoprovidingthesamematerialasthefirsttime,youshouldprovidetheCancellationCertificateofInspectionDeclarerissuedbytheinspectionandquarantineorganattheplaceoftheoriginalregistration;iftheCertificateforInspectionDeclarationwasnotregisteredwithin2yearsaftercancellation,theQualificationCertificateofInspectionwouldbeinvalidautomatically.9.Inspectiondeclarersfromself-serviceinspectionunitscanhandleinspectionformalitiesofthesubordinateunitsintheinspectionandquarantineinstitutionsoutsidetheregistrationplacesandreceivethemanagementofthelocalinspectionandquarantineinstitutions.10.Inspectionandquarantineinstitutionsadoptascoringsystemfortheerrorsandregulationviolationsofinspectiondeclarersduringhandlinginspectionformalities.

五.报检员管理1.“报检员证”是报检员办理报检业务的身份凭证，不得转借、涂改。2.报检员不得同时兼任两个或两个以上报检单位的报检工作。3.检验检疫机构对报检员的管理实施差错登记制度。4.“报检员证”的有效期为2年，有效期届满的，在30日前，报检员应当向发证机构提出延期申请，检验检疫机构结合日常报检工作记录对报检员进行审核，审核合格的，延期2年；审核不合格的，经过培训合格的，延期2年；没有在规定期限前提出延期申请，或未按要求参加培训和考试的，或考试不合格的，不予延长，其“报检员证”和“报检员资格证”同时失效。5.遗失“报检员证”的，应在7日内向发证机构递交情况说明，并登报声明作废；在有效期内的，予以补发，补发前不得办理报检业务。6.有下列情形之一的，报检员所属企业应该收回其“报检员证”交当地检验检疫机构，并以书面形式申请“报检员证”注销手续：①报检员不再从事报检业务的；②企业因故停止报检业务的；③企业解聘报检员的。检验检疫机构按规定及时予以办理，并出具“报检员证注销证明”。因为办理“报检员证”注销手续而产生的法律纠纷由报检员所属的企业承担法律后果。7.报检员有下列行为之一的，由检验检疫机构暂停其3个月或者6个月报检资格：①不履行代理报检单位报检员义务，情节严重的；②1年内出现3次以上报检差错行为，情节严重的；③转借或者涂改报检员证的。8.“报检员证”注销后申请重新注册的，除提供与首次注册相同的材料外，还应提交原注册地检验检疫机构出具的“报检员注销证明”；“报检员证”注销后二年内未申请重新注册的，“报检员资格证”自动失效。9.自理报检单位的报检员可以在注册地以外的检验检疫机构办理本单位的报检业务，并接受当地检验检疫机构的管理。10.检验检疫机构对报检员在办理报检业务过程中出现的差错或违规行为实行记分管理。First,scoringmethod.①Accordingtotheerrorortheseverityoftheviolations,thetotalscoreforeachtimeisdividedintofourtypesincluding12points,4points,2pointsand1point.②Thescoringperiodisoneyearandthefullmarkis12points.CountingfromtheinitialissuancedateoftheCertificateofInspectionDeclaration,ifthetotalscoredoesnotaccumulateto12pointsattheendofthescoringperiod,thescoreofthisperiodwillbeeliminatedandnotbetransferredintothenextperiod.③Iftwoormorescoringeventstakeplaceinoneinspectionbusiness,thescoreshouldbecalculatedseparatelyandaccumulated.④AsfortheCertificateofInspectionDeclarationwhichhasbeenreregisteredaftercancellationorreissuedowingtoalterationofpersonalregistrationinformation,theoriginalscoresarestillvalid.⑤Wheninspectionandquarantineagenciesrecordtheerrorsorillegalbehaviorsofinspectiondeclarers,theyshouldfillinthe"InspectionDeclarerError/RegulationViolationsRecordSheet,andrequiretheinspectiondeclarerstoconfirmandsignit.Thesheetshouldbeputonrecordforfuturereference.⑥Havinganyobjectiontothescores,theinspectiondeclarerisallowedtoappealitonthespotorwithin3days,inspectionandquarantineagenciesshallfullylistentotheopinionsandcarryoutreverification.Duringscoring,theinspectionandquarantineagenciesshouldalsohelptocorrecttheerrorsorirregularitiesandannouncethescoringperiod,scoringevents,scoresandrelevantsettlementregulations.

其一，记分方法①一次记分的分值,依据差错或违规行为的严重程度,分为12分,4分,2分和1分四种。②记分周期为一年度,满分12分,从“报检员证”初次发证之日起计算，一个记分周期期满后,记分分值累计未达到12分的,该周期内的记分分值予以消除,不转入下一个记分周期。③报检员在同一批次报检业务中出现两处或以上记分事项的,应分别计算,累加分值。④报检员经注销后重新注册或变更个人注册信息换发“报检员证”的,原记分分值继续有效。⑤检验检疫机构对报检员的差错或违规行为进行记分时,应填制“报检员差错/违规行为记录单”，并要求报检员签字确认,存档备查。⑥对记分有异议的,应允许报检员当场或在3日内提出申诉,检验检疫机构应充分听取其意见并进行复核。检验检疫机构在对报检员记分的同时，应对其差错或违规行为进行纠正，并将有关记分周期、记分事项与分值以及处理规定等内容予以公告。Second,supervisionandadministration.Underanyofthefollowingcircumstances,thequalificationofinspectiondeclarationshouldbesuspended：①Asfortheinspectiondeclarerwithascoringupto12pointswithinoneperiod,inspectionandquarantineinstitutionsshouldsuspendtheinspectionqualificationforthreemonths;②Ifthescoreisaccumulatedto12pointsagainduringorafterthesuspensionoftheinspectionqualificationwithinthesamescoringperiod,theinspectionandquarantineinstitutionsshallsuspendthequalificationfor6months;③Whenthesuspensionofthequalificationcomestotheend,theoriginalscorewouldbeclearedandresettilltheendofthisperiod;④Inspectiondeclarersshallnotdealwiththeinspectionbusinessduringtheperiodwheninspectionqualificationissuspended.TheinspectionandquarantineinstitutionsshalltemporarilycollecttheCertificateforInspectionDeclarationandmakeanannouncementaboutthesuspensionifthecertificatescannotbecollected;⑤Asfortheinspectiondeclarerstransferredtothelocalenterprisesorenterprisesintheotherplacesforinspectionbusinessduringthecertificatesuspensionperiod,theinspectionandquarantineinstitutionsshallnotgothroughtransferenceformalitiesforthem,orissueCancellationCertificateofInspectionDeclarer.Underanyofthefollowingcircumstances,inspectionandquarantineinstitutionsshallcanceltheinspectiondeclarers’inspectionqualificationandrevoketheirCertificateforInspectionDeclaration：①unfaithfulinspectionresultinginseriousconsequences;②providingfakecontracts,invoices,billofladinganddocuments;③counterfeiting,faking,buying,selling,stealingoralteringthecustomsclearancecertificate,documents,stamps,logos,sealingandqualitycertificationmarksofinspectionandquarantine;④otheractsviolatinglawsandregulationsoninspectionandquarantineregulationsandthecircumstancesareserious.

其二，监督管理报检员有下列情形之一的，暂停其报检资格：①对在一个记分周期内记分满12分的报检员,检验检疫机构应暂停其3个月报检资格；②在同一记分周期内,被检验检疫机构暂停报检资格期间或期限届满后,被再次记满12分的,检验检疫机构应暂停其6个月报检资格；③报检员被暂停报检资格期限届满后,原记分分值予以清除,重新记分至该记分周期终止；④报检员在被暂停报检资格期间,不得办理报检业务。检验检疫机构应暂时收回有关“报检员证”,无法收回的应予以公告；⑤被暂停期限未满,调往当地或异地其他企业从事报检业务的,检验检疫机构不予办理变更手续,不予出具“报检员证注销证明”。报检员出现下列情况之一的，检验检疫机构应取消其报检资格，吊销“报检员证”：①不如实报检，造成严重后果的；②提供虚假合同、发票、提单等单据的；③伪造、变造、买卖或者盗窃、涂改检验检疫通关证明、检验检疫证单、印章、标志、封识和质量认证标志的；④其他违反检验检疫法律法规规定，情节严重的。11.Iftheinspectiondeclarerdoesnotactfaithfullyduringinspectiondeclarationandthecircumstancesareserious,thequalificationwillbecancelledandtheCertificateforInspectionDeclarationwillbesuspended.Thosewhoseinspectionqualificationshavebeencancelledarenotallowedtoattendinspectionqualificationexaminationwithinthreeyears.11.报检员在报检活动中没有如实报检的，情节严重的，取消其报检资格，吊销其“报检员证”，被取消报检员资格的，3年内不允许参加报检员资格考试。

Ⅵ.RightsandObligationsofInspectionDeclarerRights：1.Fortheexitgoods,inspectiondeclarersshouldhandleinspectionformalitiesattheinspectionandquarantineinstitutionsattheprescribedplacewithinprescribedtimebyentry-exitinspectionandquarantineorgans.2.Fortheentrygoods,inspectiondeclarershavetherighttorequestinspectionandquarantineinstitutionstocompleteinspectionandquarantineworkwithintheprescribedtimeorclaimperiodstatedintheforeigntradecontract,andissuetheproofdocumentsafterhandlinginspectionformalitiesattheprescribedplacewithinprescribedtimebyinspectionandquarantineinstitutionsandprovidingeveryconditionofsampling,inspectionandquarantine.3.Ifinspectiondeclarershaveobjectiontotheinspectionandquarantineresultsmadebyinspectionandquarantineinstitutions,theyhavetherighttoapplytooriginalinspectionandquarantineinstitutionsorsuperiorinstitutionsforreinspectionaccordingtorelevantlaws.4.Ifinspectiondeclarershavejustifiablereasonstocanceltheinspectiondeclaration,theyhavetherighttohandlethecancellationformalitiesinaccordancewithrelevantregulations.5.Theinspectiondeclarershavetherighttorequireinspectionandquarantineinstitutionanditsstafftokeepsecret,whentheyproviderelevantcommercialandshippingdocumentsinconfidentialcircumstances.6.Theinspectiondeclarershavetherighttochargeandaccusethestaffininspectionandquarantineinstitutionsoftheiranyactivitiesviolatinglawsorregulationslikeabuseofpower,malpracticesandfalsificationofinspectionandquarantineresults.Obligations：1.Inspectiondeclarersshallnotconcurrentlyserveforself-serviceinspectionunits,substitutedinspectionunitsormorethanoneunit.2.Inspectiondeclarershavethedutytoconveyandexplaintherelevantlaws,regulations,announcementsandadministrativemeasuresonentry-exitinspectionandquarantinetotheirsubordinateenterprises.3.Inspectiondeclarers

shallabidebytherelevantlawsandregulationsofinspectionandquarantine,handleinspectiondeclarationformalitiesattheprescribedplaceandtime,providefaithfuldata,completeandvaliddocumentstotheinspectionandquarantineinstitutions,andfillinthedeclarationformaccurately,detailedlyandclearly.Allthesubmitteddocumentsshouldbecompleteandauthentic,andhelpthesubordinateenterpriseswiththefilingofinspectionmaterials.4.Inspectiondeclarershavethedutytoprovidenecessaryworkingconditionsforinspectionandquarantineinstitutions,suchassampling,inspection,quarantine.5.Theinspectiondeclarershavethedutytostrengthenthebatchmanagementofgoodsthathavepassedtheinspectionandquarantineconductedbytheinspectionandquarantineinstitutions.Wrongdeliveryormissingdeliveryisnotpermittedincasethatdocumentsandgoodsdonotconformwitheachother;theentrygoodssubjecttostatutoryinspectionandquarantinecannotbesold,used,unloadedordeliveredwithoutinspectionandquarantineorpermissionfrominspectionandquarantineinstitutions.6.Inspectiondeclarersshouldpayinspectionandquarantinefeesinaccordancewithregulationswhenapplyingforinspection,quarantineandappraisal.7.Inspectiondeclarers

muststrictlyabidebythelawsandregulationsoninspectionandquarantine,andtheyshallnotalter,falsifyorcounterfeitinspectionandquarantinecertificates（paper）withoutpermission.8.Asfortheins
