andrestraintsystemsongroundsrelatingtotheirdesignormethodoffunctioningiftheybeartheEECcomponenttype-approvalmark.2.Nevertheless,aMemberStatemayprohibittheplacingonthemarketofsafetybeltsandrestraintsystemsbearingtheEECcomponenttype-approvalmarkwhichconsistentlyfailtoconformtothe共182页第7页1977L0541——2004年01月05日—010.001B第1条1.每一成员国应该对任何满足附件IV到附件XIV之附件I中2规定的设计和试验要求的任何3点或搭接安全带和约束系统授予EEC部件型式认证。2.授予EEC部件型式认证的成员国，在必要的时候，应该采取必要措施验证生产型式与认证型式的一致性，如果有必要可以与其它成员国的主管当局进行合作。3.为了实现第2段的规定，成员国应该充分保证至少适用附件I的2.8.1中规定的质量控制程序。然而，如果各成员国进行检验或由其授权的试验室进行检验，所采用的方法的可靠性要达到第1段中规定的程序的可靠性。附录I的2.8.2中规定的程序是一种特别适当的方法。第2条对于按照第1条获得认证的安全带或约束系统，各成员国应该向制造商颁发EEC部件型式认证标志，标志样式与附件III给出的样式之一一致。成员国应该采取各种适当的措施，防止按照第1条获得型式认证的安全带或约束系统的标志与其它装置的标志之间出现混乱。第3条1.如果安全带和约束系统贴有EEC部件型式认证标志，任何成员国不得依据其设计或使用方法禁止其投入市场。2.然而，如果贴有EEC部件型式认证标志的安全带和约束系统与认证的型式不一致，成员国可以禁止其投入市场。共182页第8页1977L0541—EN—01.05.2004—010.001BThatStateshallinformtheotherMemberStatesandtheCommissionforthwithofthemeasurestaken,specifyingthereasonsforitsdecision.▼M5Article4ThecompetentauthoritiesoftheMemberStatesshallinformeachother,bymeansoftheprocedurespecifiedinArticle4(6)ofDirective70/156/EEC,ofeachtypeofsafetybeltandrestraintsystemsforwhichanapprovalhasbeengranted,refusedorwithdrawn.▼BArticle51.IfaMemberStatewhichhasgrantedEECcomponenttype-approvalfindsthatanumberofsafetybeltsandrestraintsystemsbearingthesameEECcomponenttype-approvalmarkdonotconformtothetypewhichithasapproved,itshalltakethenecessarymeasurestoensurethatproductionmodelsconformtotheapprovedtype.ThecompetentauthoritiesofthatStateshalladvisethoseoftheotherMemberStatesofthemeasurestaken,whichmay,wherethereisconsistentfailuretoconform,extendtowithdrawalofEECcomponenttype-approval.ThesaidauthoritiesshalltakethesamemeasuresiftheyareinformedbythecompetentauthoritiesofanotherMemberStateofsuchfailuretoconform.2.ThecompetentauthoritiesoftheMemberStatesshallinformoneanotherwithinonemonthofanywithdrawalofEECcomponenttype-approvalandofthereasonsforsuchmeasure.3.IfaMemberStatewhichhasgrantedEECcomponenttype-approvaldisputesthefailuretoconformnotifiedtoit,theMemberStatesconcernedshallendeavourtosettlethedispute.TheCommissionshallbekeptinformedandshall,wherenecessary,holdappropriateconsultationsforthepurposeofreachingasettlement.共182页第9页1977L0541——2004年01月05日—010.001▼B该成员国应该立即向其它成员国通告所采取的措施，说明其决定的理由。▼M5第4条对于任何一种型式的安全带和约束系统的认证的授予、拒绝或撤回，各成员国的主管当局应该通过指令70/156/EEC第4(6)条规定的程序彼此通告。▼B第5条1.如果授予EEC部件型式认证的成员国发现贴有相同的EEC部件型式认证标志的许多安全带和约束系统与认证的型式不一致，它应该采取必要的措施以保证生产型式与认证型式的一致。该成员国主管当局应该建议其它成员国的主管当局采取措施，如果仍然无法达到一致，可以撤回EEC部件型式认证。上述主管当局如果得到其它成员国主管当局无法达到一致性的通告，也应该采取相同的措施。2.在撤回EEC部件型式认证的1个月之内，各成员国的主管当局应该相互通告并告知采取这样的措施的理由。3.如果授予EEC部件型式认证的成员国对于通告的产品不一致性存在争议，各有关成员国应该尽力解决争端。应该随时与委员会保持沟通，必要时委员会可以召开协商会来解决争端。共182页第10页1977L0541—EN—01.05.2004—010.001BArticle6AnydecisiontakenpursuanttotheprovisionsadoptedinimplementationofthisDirectivetorefuseorwithdrawEECcomponenttype-approvalforsafetybeltsorrestraintsystemsorprohibittheirplacingonthemarketoruseshallsetoutindetailthereasonsonwhichitisbased.Suchdecisionsshallbenotifiedtothepartyconcerned,whoshallatthesametimebeinformedoftheremediesavailabletohimunderthelawsinforceintheMemberStatesandofthetimelimitsallowedfortheexerciseofsuchremedies.Article7NoMemberStatemayrefusetograntEECtype-approvalornationaltype-approvalforavehicleongroundsrelatingtothesafetybeltsorrestraintsystemswithwhichitisequipped,ifthesebeartheEECcomponenttype-approvalmarkandarefittedinaccordancewiththerequirementslaiddownin3ofAnnexI.Article8NoMemberStatemayrefuseorprohibitthesale,registration,entryintoserviceoruseofanyvehicleongroundsrelatingtoitssafetybeltsorrestraintsystems,ifthesebeartheEECcomponenttype-approvalmarkandarefittedinaccordancewiththerequirementslaiddownin3ofAnnexI.▼M1Article9ForthepurposesofthisDirective,'vehicle'meansanymotorvehicleincategoriesMandNasdefinedin►M5AnnexIIA◄toDirective70/156/EECintendedforuseontheroad,havingatleastfourwheelsandamaximumdesignspeedexceeding25km/h.▼BArticle10TheamendmentsnecessaryforadaptingtheAnnexestotakeaccountoftechnicalprogressshallbeadoptedinaccordancewiththeprocedurelaiddowninArticle13ofDirective70/156/EEC.共182页第11页1977L0541——2004年01月05日—010.001B第6条在履行本指令的过程中按照规定做出决定，拒绝或撤回安全带的EEC部件型式认证或者禁止它们的投入市场或投入使用，应该详细说明其理由。决定应该正式通知有关方面，并同时告知其在各成员国有效的法律框架内有效的补救措施，以及采取补救措施的时间期限。第7条如果安全带或约束系统贴有EEC部件型式认证并且其安装符合附录I中3规定的要求，任何成员国不得因为安全带或约束系统的原因拒绝授予车辆EEC型式认证或者国家型式认证。第8条如果安全带或约束系统，贴有EEC部件型式认证并且其安装符合附录I中3规定的要求，任何成员国不得因为安全带或约束系统的原因拒绝或者禁止车辆的销售、注册、投入服务或使用。▼M1第9条本指令中“车辆”是指指令70/156/EEC之附件I中定义的M类和N类、用于道路行驶、至少有4个车轮以及最大设计速度超过25km/h的任何汽车辆。▼B第10条由于技术的进步而对附件中的要求进行必要的修订时，应该按照指令70/156/EEC第13条中规定的程序进行。共182页第12页1977L0541—EN—01.05.2004—010.001BArticle111.MemberStatesshallbringintoforcetheprovisionsnecessaryinordertocomplywiththisDirectivewithin18monthsofitsnotificationandshallforthwithinformtheCommissionthereof.2.MemberStatesshallensurethatthetextsofthemainprovisionsofnationallawwhichtheyadoptinthefieldcoveredbythisDirectivearecommunicatedtotheCommission.Article12ThisDirectiveisaddressedtotheMemberStates.
