如果承包商因本条中的指示而遭受延误和/或产生费用，则在考虑到雇主要求中规定的合作程度（如果有）的情况下，提供机会和合作是无法预料的，承包商应有权按照第20.2条[付款和/或工期索赔]要求工期索赔和/或此类费用加利润的支付。4.7SettingOut放线TheContractorshallsetouttheWorksinrelationtotheitemsofreferenceunderSub-Clause2.5[SiteDataandItemsofReference].

承包商应根据第2.5条[现场资料和参考项目]对与参考项目有关的工程做放线。TheContractorshall:承包商应：(a)verifytheaccuracyofalltheseitemsofreferencebeforetheyareusedfortheWorks;

在将所有这些参考项目用于工程之前，验证其准确性；(b)rectifyanyerrorintheitemsofreference,positions,levels,dimensionsoralignmentoftheWorks;and

纠正工程的参考项、位置、水平、尺寸或准线方面的任何错误；和(c)beresponsibleforthecorrectpositioningofallpartsoftheWorks.

负责工程各部分的正确位置。4.8HealthandSafety健康与安全义务ObligationsTheContractorshall:承包商应：(a)complywithallapplicablehealthandsafetyregulationsandLaws;

遵守所有适用的健康与安全法规和法律；(b)complywithallapplicablehealthandsafetyobligationsspecifiedintheContract;

遵守合同中规定的所有适用的健康和安全义务；(c)complywithalldirectivesissuedbytheContractor’shealthandsafetyofficer(appointedunderSub-Clause6.7[HealthandSafetyofPersonnel]);

遵守承包商健康与安全官员发布的所有指令（根据第6.7条[人员健康与安全]任命）；(d)takecareofthehealthandsafetyofallpersonsentitledtobeontheSiteandotherplaces(ifany)wheretheWorksarebeingexecuted;

照管有权在现场及正在实施工程的其他地方（如有）的所有人的健康和安全；(e)keeptheSite,Works(andtheotherplaces(ifany)wheretheWorksarebeingexecuted)clearofunnecessaryobstructionsoastoavoiddangertothesepersons;

保持工地、工程（以及正在实施工程的其他地方（如有））没有不必要的障碍，以避免对人员造成危险；(f)providefencing,lighting,safeaccess,guardingandwatchingof:

提供围栏、照明、安全通道、警卫和看护：(i)theWorks,untiltheWorksaretakenoverunderClause10[Employer’sTakingOver];and

有必要对所有有权在现场和正在实施工程的其他地方（如有）的所有人建立和维持健康安全的工作环境。ThismanualshallberevisedasnecessarybytheContractorortheContractor’shealthandsafetyofficer,oratthereasonablerequestoftheEmployer.EachrevisionofthemanualshallbesubmittedpromptlytotheEmployer.

承包商或承包商的健康和安全官员应根据需要对本手册进行修订，或应雇主的合理要求进行修订。手册的每次修订均应立即提交给雇主。Inadditiontothereportingrequirementofsub-paragraph(g)ofSub-Clause4.20[ProgressReports],theContractorshallsubmittotheEmployerdetailsofanyaccidentassoonaspracticableafteritsoccurrenceand,inthecaseofanaccidentcausingseriousinjuryordeath,shallinformtheEmployerimmediately.

承包商应按照雇主的要求以及雇主可能合理要求的方式，保存有关人员的健康和安全以及财产损失的记录并作出报告（符合适用的健康与安全法规和法律）。4.9QualityManagementandComplianceVerificationSystems

质量管理和合规性核验体系4.9.1QualityManagementSystem质量管理体系TheContractorshallprepareandimplementaQMSystemtodemonstratecompliancewiththerequirementsoftheContract.TheQMSystemshallbespecificallypreparedfortheWorksandsubmittedtotheEmployerwithin28daysoftheCommencementDate.Thereafter,whenevertheQMSystemisupdatedorrevised,acopyshallpromptlybesubmittedtotheEmployer.

承包商应编制并实施质量管理体系以证明其符合合同要求。质量管理体系应为工程专门编制，并在开工之日起28天内提交给雇主。此后，无论何时更新或修订质量管理体系，都应立即将副本提交给雇主。TheQMSystemshallbeinaccordancewiththedetailsstatedintheEmployer’sRequirements(ifany)andshallincludetheContractor’sprocedures:

将承包商的文件提交给雇主进行审查。TheContractorshallcarryoutinternalauditsoftheQMSystemregularly,andatleastonceevery6months.TheContractorshallsubmittotheEmployerareportlistingtheresultsofeachinternalauditwithin7daysofcompletion.Eachreportshallinclude,whereappropriate,theproposedmeasurestoimproveand/orrectifytheQMSystemand/oritsimplementation.

承包商应定期进行质量管理体系的内部审核，至少每6个月进行一次。承包商应在竣工后7天内向雇主提交一份报告，列出每次内部审核的结果。每份报告均应酌情包括改善和/或纠正质量管理体系和/或其实施的建议措施。IftheContractorisrequiredbytheContractor’squalityassurancecertificationtobesubjecttoexternalaudit,theContractorshallimmediatelygiveaNoticetotheEmployerdescribinganyfailing(s)identifiedinanyexternalaudit.IftheContractorisaJV,thisobligationshallapplytoeachmemberoftheJV.

如果承包商的质量保证证书要求承包商进行外部审核，则承包商应立即向雇主发出通知，说明在任何外部审核中发现的任何不符合情况。如果承包商是合营体，则此义务应适用于合营体的每个成员。4.9.2ComplianceVerificationSystem合规性核验体系

TheContractorshallprepareandimplementaComplianceVerificationSystemtodemonstratethatthedesign,Materials,Employer-SuppliedMaterials(ifany),Plant,workandworkmanshipcomplyinallrespectswiththeContract.

承包商应编制并实施合规性验证系统，以证明设计、材料、雇主提供的材料（如果有）、生产设备，工作和工艺在各个方面均符合合同。TheComplianceVerificationSystemshallbeinaccordancewiththedetailsstatedintheEmployer’sRequirements(ifany)andshallincludeamethodforreportingtheresultsofallinspectionsandtestscarriedoutbytheContractor.Intheeventthatanyinspectionortestidentifiesanon-compliancewiththeContract,Sub-Clause7.5[DefectsandRejection]shallapply.合规性核验体系应符合雇主要求中规定的具体要求（如有），并应包括一种报告承包商进行的所有检查和测试结果的方法。如果任何检查或测试表明不遵守合同，则应适用第7.5条[缺陷和拒收]。4.9.3Generalprovision一般规定CompliancewiththeQMSystemand/orComplianceVerificationSystemshallnotrelievetheContractorfromanyduty,obligationorresponsibilityunderorinconnectionwiththeContract.

遵守质量管理体系和/或合规性核验体系不应免除承包商根据合同或与合同有关的任何义务或责任。4.10UseofSiteData现场资料的使用TheContractorshallberesponsibleforverifyingandinterpretingalldatamadeavailablebytheEmployerunderSub-Clause2.5[SiteDataandItemsofReference].承包商应负责核实和解释雇主根据第2.5条[现场资料和参考项目]提供的所有数据。4.11SufficiencyoftheContractPrice合同价格的充分性TheContractorshallbedeemedtohavesatisfiedhimself/herselfastothecorrectnessandsufficiencyoftheContractPricestatedintheContractAgreement.

承包商应被视为已对合同协议中规定的合同价格的正确性和充分性感到满意。UnlessotherwisestatedintheContract,theContractPricestatedintheContractAgreementshallbedeemedtocoveralltheContractor’sobligationsundertheContractandallthingsnecessaryfortheproperexecutionoftheWorksinaccordancewiththeContract.

除非合同中另有说明，否则合同协议中规定的合同价格应被视为涵盖了合同规定的所有承包商义务以及按照合同正确实施工程所需的所有一切。4.12UnforeseeableDifficulties不可预见的困难ExceptasotherwisestatedintheParticularConditions:除非特殊情况另有规定：(a)theContractorshallbedeemedtohaveobtainedallnecessaryinformationastorisks,contingenciesandothercircumstanceswhichmayinfluenceoraffecttheWorks;承包商应被认为已取得了对工程可能产生影响的有关风险、意外事件和其他情况的全部必要资料；(b)bysigningtheContractAgreement,theContractoracceptstotalresponsibilityforhavingforeseenalldifficultiesandcostsofsuccessfullycompletingtheWorks;and通过签署合同,承包商承担对预见到的为顺利完成工程的所有困难和费用的全部职责；(c)theContractPriceshallnotbeadjustedtotakeaccountofanyUnforeseeableorunforeseendifficultiesorcosts.合同价格对任何未预见到的困难和费用不应考虑予以调整。

4.13RightsofWayandFacilities通行权和设施权TheContractorshallbearallcostsandchargesforspecialand/ortemporaryrights-of-waywhichmayberequiredforthepurposesoftheWorks,includingthoseforaccesstotheSite.

承包商应承担为工程目的可能需要的专用和/或临时通行权的所有费用，包括进入工地的费用。TheContractorshallalsoobtain,attheContractor’sriskandcost,anyadditionalfacilitiesoutsidetheSitewhichmayberequiredforthepurposesoftheWorks.

承包商还应自担风险和费用，获取为进行工程目的可能需要在现场以外的任何其他设施。4.14AvoidanceofInterference避免干扰TheContractorshallnotinterfereunnecessarilyorimproperlywith:承包商应避免对以下事项产生不必要或不当的干扰

(a)theconvenienceofthepublic;or公众的方便；或(b)theaccesstoanduseandoccupationofallroadsandfootpaths,irrespectiveofwhethertheyarepublicorinthepossessionoftheEmployerorofothers.所有道路和人行道的进入、使用和占用,不论他们是公共的,雇主或是其他人所有的。

TheContractorshallindemnifyandholdtheEmployerharmlessagainstandfromalldamages,lossesandexpenses(includinglegalfeesandexpenses)resultingfromanysuchunnecessaryorimproperinterference.承包商应保障并保持雇主免受因任何此类不必要或不当的干扰造成任何损害赔偿费、损失和开支(包括法律费用和开支)的伤害。4.15AccessRoute进场通路

TheContractorshallbedeemedtohavebeensatisfied,attheBaseDate,astothesuitabilityandavailabilityoftheaccessroutestotheSite.TheContractorshalltakeallnecessarymeasurestopreventanyroadorbridgefrombeingdamagedbytheContractor’strafficorbytheContractor’sPersonnel.Thesemeasuresshallincludetheproperuseofappropriatevehicles(conformingtolegalloadandwidthlimits(ifany)andanyotherrestrictions)androutes.承包商应被认为在基准日对到达工地的通道的适合性和可用性感到满意。承包商应采取一切必要措施，以防止道路或桥梁被承包商的交通或承包商的人员损坏。这些措施应包括适当使用适当的车辆（符合法律规定的载重和宽度限制（如有）以及任何其他限制）和路线。12.1TestsafterCompletion竣工后的测试ProcedureforTestsafterCompletion竣工后的测试程序IfTestsafterCompletionarespecifiedintheEmployer’sRequirements,thisClauseshallapply.如果雇主要求中规定了竣工后的测试，则本条适用。ThetimingoftheTestsafterCompletionshallbeassoonasisreasonablypracticableaftertheWorksorSection(asthecasemaybe)havebeentakenoverbytheEmployer.

竣工后测试的时间应在雇主接收工程或区段（视情况）后，在合理可行的范围内尽快。TheEmployershallprovideallelectricity,water,sewage(ifapplicable),fuel,consumables,materials,andmaketheEmployer’sPersonnelandPlantavailablefortheTestsafterCompletion.TheContractorshall:

雇主应提供雇主人员和生产设备在竣工后测试需要的所有电力、水、污水排放（如适用）、燃料、消耗品、材料。承包商应：(a)provideallotherapparatus,assistance,documentsandotherinformation,equipment,instruments,labour,andsuitablyqualified,experiencedandcompetentstaff,asarenecessarytocarryouttheTestsafterCompletionefficientlyandproperly;

提供的所有其他设备、协助、文件和其他资料、仪器、仪表、劳动力和进行竣工后测试必需的有适当资质、经验和能力的工作人员；(b)submittotheEmployer,notlaterthan42daysbeforethedatetheContractorintendstocommencetheTestsafterCompletion,adetailedtestprogrammeshowingtheintendedtimingandresourcesrequiredforthesetests.TheEmployermayReviewtheproposedtestprogrammeandmaygiveaNoticetotheContractorstatingtheextenttowhichitdoesnotcomplywiththeContract.Within14daysafterreceivingthisNotice,theContractorshallrevisethetestprogrammetorectifysuchnon-compliance.IftheEmployergivesnosuchNoticewithin14daysafterreceivingthetestprogramme(orrevisedtestprogramme),theEmployershallbedeemedtohavegivenaNoticeofNo-objection;

在承包商拟在竣工后开始测试之日之前的42天之内，向雇主提交一份详细的测试计划，该计划应说明这些测试的预期时间和所需资源。雇主可以审查拟议的测试计划，并可以向承包商发出通知，说明其不符合合同的程度。在收到本通知后的14天内，承包商应修改测试程序以纠正这种不符合项。如果雇主在收到测试计划（或修订的测试计划）后的14天内未发出此类通知，则应视为雇主发出了无异议通知；(c)inadditiontoanydate(s)showninthetestprogramme,giveaNoticetotheEmployerofnotlessthan21days,ofthedateafterwhichtheContractorwillbereadytocarryouteachoftheTestsafterCompletion;

除测试计划中反映的任何日期外，还应至少提前21天向雇主发出通知，自该日起，承包商将在竣工日期后准备进行每项测试；(d)notcommencetheTestsafterCompletionuntilaNoticeofNo-objectionisgiven(orisdeemedtohavebeengiven)bytheEmployertotheContractor’stestprogramme;

在雇主对承包商的测试计划发出（或认为已经给予反对）通知之前，不得在竣工后开始测试；(e)commencetheTestsafterCompletionwithin14daysafterthedatestatedintheNoticeundersub-paragraph(c)above,oronsuchdayordaysastheEmployershallinstruct;

在上条（c）款中的通知中规定的日期后14天内，或在雇主应指示的一个或多个日内，在竣工后开始测试；(f)proceedtocarryouttheTestsafterCompletioninaccordancewith:

在竣工后根据以下条件进行测试：(i)theContractor’stestprogrammetowhichtheEmployerhasgiven(orisdeemedtohavegiven)aNoticeofNo-objection;
