AbouttheOfficeofScienceandTechnologyPolicy
TheOfficeofScienceandTechnologyPolicy(OSTP)
wasestablishedbytheNationalScienceandTechnologyPolicy,Organization,andPrioritiesActof1976toprovidethePresidentandotherswithintheExecutiveOfficeofthePresidentwithadviceonthescientific,engineering,andtechnologicalaspectsoftheeconomy,nationalsecurity,health,foreignrelations,theenvironment,andthetechnologicalrecoveryanduseofresources,amongothertopics.OSTPleadsinteragencyscienceandtechnologypolicycoordinationefforts,assiststheOfficeofManagementandBudget(OMB)withanannualreviewandanalysisofFederalresearchanddevelopmentinbudgets,andservesasasourceofscientificandtechnologicalanalysisandjudgmentforthePresidentwithrespecttomajorpolicies,plans,andprogramsoftheFederalGovernment.

Theappropriateapplicationoftheprinciplessetforthinthiswhitepaperdependssignificantlyonthecontextinwhichautomatedsystemsarebeingutilized.Insomecircumstances,applicationoftheseprinciplesinwholeorinpartmaynotbeappropriategiventheintendeduseofautomatedsystemstoachievegovernmentagencymissions.Futuresector-specificguidancewilllikelybenecessaryandimportantforguidingtheuseofautomatedsystemsincertainsettingssuchasAIsystemsusedaspartofschoolbuildingsecurityorautomatedhealthdiagnosticsystems.
TheBlueprintforanAIBillofRightsrecognizesthatlawenforcementactivitiesrequireabalancingofequities,forexample,betweentheprotectionofsensitivelawenforcementinformationandtheprincipleofnotice;assuch,noticemaynotbeappropriate,ormayneedtobeadjustedtoprotectsources,methods,andotherlawenforcementequities.Evenincontextswheretheseprinciplesmaynotapplyinwholeorinpart,federaldepartmentsandagenciesremainsubjecttojudicial,privacy,andcivillibertiesoversightaswellasexistingpoliciesandsafeguardsthatgovernautomatedsystems,including,forexample,ExecutiveOrder13960,PromotingtheUseofTrustworthyArtificialIntelligenceintheFederalGovernment(December2020).
Thiswhitepaperrecognizesthatnationalsecurity(whichincludescertainlawenforcementandhomelandsecurityactivities)anddefenseactivitiesareofincreasedsensitivityandinteresttoournation’sadversariesandareoftensubjecttospecialrequirements,suchasthosegoverningclassifiedinformationandotherprotecteddata.Suchactivitiesrequirealternative,compatiblesafeguardsthroughexistingpoliciesthatgovernautomatedsystemsandAI,suchastheDepartmentofDefense(DOD)AIEthicalPrinciplesandResponsibleAIImplementationPathwayandtheIntelligenceCommunity(IC)AIEthicsPrinciplesandFramework.TheimplementationofthesepoliciestonationalsecurityanddefenseactivitiescanbeinformedbytheBlueprintforanAIBillofRightswherefeasible.
TheBlueprintforanAIBillofRightsisnotintendedto,anddoesnot,createanylegalright,benefit,ordefense,substantiveorprocedural,enforceableatlaworinequitybyanypartyagainsttheUnitedStates,itsdepartments,agencies,orentities,itsofficers,employees,oragents,oranyotherperson,nordoesitconstituteawaiverofsovereignimmunity.

FOREWORD
Amongthegreatchallengesposedtodemocracytodayistheuseoftechnology,data,andautomatedsystemsinwaysthatthreatentherightsoftheAmericanpublic.Toooften,thesetoolsareusedtolimitouropportunitiesandpreventouraccesstocriticalresourcesorservices.Theseproblemsarewelldocumented.InAmericaandaroundtheworld,systemssupposedtohelpwithpatientcarehaveprovenunsafe,ineffective,orbiased.Algorithmsusedinhiringandcreditdecisionshavebeenfoundtoreflectandreproduceexistingunwantedinequitiesorembednewharmfulbiasanddiscrimination.Uncheckedsocialmediadatacollectionhasbeenusedtothreatenpeople’sopportunities,underminetheirprivacy,orpervasivelytracktheiractivity—oftenwithouttheirknowledgeorconsent.
Theseoutcomesaredeeplyharmful—buttheyarenotinevitable.Automatedsystemshavebroughtaboutextraor-dinarybenefits,fromtechnologythathelpsfarmersgrowfoodmoreefficientlyandcomputersthatpredictstormpaths,toalgorithmsthatcanidentifydiseasesinpatients.Thesetoolsnowdriveimportantdecisionsacrosssectors,whiledataishelpingtorevolutionizeglobalindustries.FueledbythepowerofAmericaninnovation,thesetoolsholdthepotentialtoredefineeverypartofoursocietyandmakelifebetterforeveryone.
Thisimportantprogressmustnotcomeatthepriceofcivilrightsordemocraticvalues,foundationalAmericanprinciplesthatPresidentBidenhasaffirmedasacornerstoneofhisAdministration.Onhisfirstdayinoffice,thePresidentorderedthefullFederalgovernmenttoworktorootoutinequity,embedfairnessindecision-makingprocesses,andaffirmativelyadvancecivilrights,equalopportunity,andracialjusticeinAmerica.1ThePresidenthasspokenforcefullyabouttheurgentchallengesposedtodemocracytodayandhasregularlycalledonpeopleofconsciencetoacttopreservecivilrights—includingtherighttoprivacy,whichhehascalled“thebasisforsomanymorerightsthatwehavecometotakeforgrantedthatareingrainedinthefabricofthiscountry.”2
ToadvancePresidentBiden’svision,theWhiteHouseOfficeofScienceandTechnologyPolicyhasidentifiedfiveprinciplesthatshouldguidethedesign,use,anddeploymentofautomatedsystemstoprotecttheAmericanpublicintheageofartificialintelligence.TheBlueprintforanAIBillofRightsisaguideforasocietythatprotectsallpeoplefromthesethreats—andusestechnologiesinwaysthatreinforceourhighestvalues.RespondingtotheexperiencesoftheAmericanpublic,andinformedbyinsightsfromresearchers,technologists,advocates,journalists,andpolicymakers,thisframeworkisaccompaniedbyatechnicalcompanion—ahandbookforanyoneseekingtoincorporatetheseprotectionsintopolicyandpractice,includingdetailedstepstowardactualizingtheseprinciplesinthetechnologicaldesignprocess.Theseprincipleshelpprovideguidancewheneverautomatedsystemscanmeaningfullyimpactthepublic’srights,opportunities,oraccesstocriticalneeds.

ABOUTTHISFRAMEWORK
TheBlueprintforanAIBillofRightsisasetoffiveprinciplesandassociatedpracticestohelpguidethedesign,use,anddeploymentofautomatedsystemstoprotecttherightsoftheAmericanpublicintheageofartificialintel-ligence.DevelopedthroughextensiveconsultationwiththeAmericanpublic,theseprinciplesareablueprintforbuildinganddeployingautomatedsystemsthatarealignedwithdemocraticvaluesandprotectcivilrights,civilliberties,andprivacy.TheBlueprintforanAIBillofRightsincludesthisForeword,thefiveprinciples,notesonApplyingtheTheBlueprintforanAIBillofRights,andaTechnicalCompanionthatgivesconcretestepsthatcanbetakenbymanykindsoforganizations—fromgovernmentsatalllevelstocompaniesofallsizes—toupholdthesevalues.Expertsfromacrosstheprivatesector,governments,andinternationalconsortiahavepublishedprinciplesandframeworkstoguidetheresponsibleuseofautomatedsystems;thisframeworkprovidesanationalvaluesstatementandtoolkitthatissector-agnostictoinformbuildingtheseprotectionsintopolicy,practice,orthetechnologicaldesignprocess.Whereexistinglaworpolicy—suchassector-specificprivacylawsandoversightrequirements—donotalreadyprovideguidance,theBlueprintforanAIBillofRightsshouldbeusedtoinformpolicydecisions.

TheWhiteHouseOfficeofScienceandTechnologyPolicyhasledayear-longprocesstoseekanddistillinputfrompeopleacrossthecountry—fromimpactedcommunitiesandindustrystakeholderstotechnologydevelop-ersandotherexpertsacrossfieldsandsectors,aswellaspolicymakersthroughouttheFederalgovernment—ontheissueofalgorithmicanddata-drivenharmsandpotentialremedies.Throughpaneldiscussions,publiclisten-ingsessions,meetings,aformalrequestforinformation,andinputtoapubliclyaccessibleandwidely-publicizedemailaddress,peoplethroughouttheUnitedStates,publicservantsacrossFederalagencies,andmembersoftheinternationalcommunityspokeupaboutboththepromisesandpotentialharmsofthesetechnologies,andplayedacentralroleinshapingtheBlueprintforanAIBillofRights.ThecoremessagesgleanedfromthesediscussionsincludethatAIhastransformativepotentialtoimproveAmericans’lives,andthatpreventingtheharmsofthesetechnologiesisbothnecessaryandachievable.TheAppendixincludesafulllistofpublicengage-ments.

SAFEANDEFFECTIVESYSTEMS
Youshouldbeprotectedfromunsafeorineffectivesystems.Automatedsystemsshouldbedevelopedwithconsultationfromdiversecommunities,stakeholders,anddomainexpertstoidentifyconcerns,risks,andpotentialimpactsofthesystem.Systemsshouldundergopre-deploymenttesting,riskidentificationandmitigation,andongoingmonitoringthatdemonstratetheyaresafeandeffectivebasedontheirintendeduse,mitigationofunsafeoutcomesincludingthosebeyondtheintendeduse,andadherencetodomain-specificstandards.Outcomesoftheseprotectivemeasuresshouldincludethepossibilityofnotdeployingthesystemorremovingasystemfromuse.Automatedsystemsshouldnotbedesignedwithanintentorreasonablyforeseeablepossibilityofendangeringyoursafetyorthesafetyofyourcommunity.Theyshouldbedesignedtoproactivelyprotectyoufromharmsstemmingfromunintended,yetforeseeable,usesorimpactsofautomatedsystems.Youshouldbeprotectedfrominappropriateorirrelevantdatauseinthe
design,development,anddeploymentofautomatedsystems,andfromthecompoundedharmofitsreuse.Independentevaluationandreportingthatconfirmsthatthesystemissafeandeffective,includingreportingofstepstakentomitigatepotentialharms,shouldbeperformedandtheresultsmadepublicwheneverpossible.
ALGORITHMICDISCRIMINATIONPROTECTIONS
Youshouldnotfacediscriminationbyalgorithmsandsystemsshouldbeusedanddesignedinanequitableway.Algorithmicdiscriminationoccurswhenautomatedsystemscontributetounjustifieddifferenttreatmentorimpactsdisfavoringpeoplebasedontheirrace,color,ethnicity,sex(includingpregnancy,childbirth,andrelatedmedicalconditions,genderidentity,intersexstatus,andsexualorientation),religion,age,nationalorigin,disability,veteranstatus,geneticinformation,oranyotherclassificationprotectedbylaw.Dependingonthespecificcircumstances,suchalgorithmicdiscriminationmayviolatelegalprotections.Designers,developers,anddeployersofautomatedsystemsshouldtakeproactiveandcontinuousmeasurestoprotectindividualsandcommunitiesfromalgorithmicdiscriminationandtouseanddesignsystemsinanequitableway.Thisprotectionshouldincludeproactiveequityassessmentsaspartofthesystemdesign,useofrepresentativedataandprotectionagainstproxiesfordemographicfeatures,ensuringaccessibilityforpeoplewithdisabilitiesindesignanddevelopment,pre-deploymentandongoingdisparitytestingandmitigation,andclearorganizationaloversight.Independentevaluationandplainlanguagereportingintheformofanalgorithmicimpactassessment,includingdisparitytestingresultsandmitigationinformation,shouldbeperformedandmadepublicwheneverpossibletoconfirmtheseprotections.

DATAPRIVACY
Youshouldbeprotectedfromabusivedatapracticesviabuilt-inprotectionsandyoushouldhaveagencyoverhowdataaboutyouisused.Youshouldbeprotectedfromviolationsofprivacythroughdesignchoicesthatensuresuchprotectionsareincludedbydefault,includingensuringthatdatacollectionconformstoreasonableexpectationsandthatonlydatastrictlynecessaryforthespecificcontextiscollected.Designers,developers,anddeployersofautomatedsystemsshouldseekyourpermissionandrespectyourdecisionsregardingcollection,use,access,transfer,anddeletionofyourdatainappropriatewaysandtothegreatestextentpossible;wherenotpossible,alternativeprivacybydesignsafeguardsshouldbeused.Systemsshouldnotemployuserexperienceanddesigndecisionsthatobfuscateuserchoiceorburdenuserswithdefaultsthatareprivacyinvasive.Consentshouldonlybeusedtojustifycollectionofdataincaseswhereitcanbeappropriatelyandmeaningfullygiven.Anyconsentrequestsshouldbebrief,beunderstandableinplainlanguage,andgiveyouagencyoverdatacollectionandthespecificcontextofuse;currenthard-to-
understandnotice-and-choicepracticesforbroadusesofdatashouldbechanged.Enhancedprotectionsand
restrictionsfordataandinferencesrelatedtosensitivedomains,includinghealth,work,education,criminaljustice,andfinance,andfordatapertainingtoyouthshouldputyoufirst.Insensitivedomains,yourdataandrelatedinferencesshouldonlybeusedfornecessaryfunctions,andyoushouldbeprotectedbyethicalreviewanduseprohibitions.Youandyourcommunitiesshouldbefreefromuncheckedsurveillance;surveillancetechnologiesshouldbesubjecttoheightenedoversightthatincludesatleastpre-deploymentassessmentoftheirpotentialharmsandscopelimitstoprotectprivacyandcivilliberties.Continuoussurveillanceandmonitoringshouldnotbeusedineducation,work,housing,orinothercontextswheretheuseofsuchsurveillancetechnologiesislikelytolimitrights,opportunities,oraccess.Wheneverpossible,youshouldhaveaccesstoreportingthatconfirmsyourdatadecisionshavebeenrespectedandprovidesanassessmentofthepotentialimpactofsurveillancetechnologiesonyourrights,opportunities,oraccess.

Youshouldknowthatanautomatedsystemisbeingusedandunderstandhowandwhyit
contributestooutcomesthatimpactyou.Designers,developers,anddeployersofautomatedsystemsshouldprovidegenerallyaccessibleplainlanguagedocumentationincludingcleardescriptionsoftheoverall
systemfunctioningandtheroleautomationplays,noticethatsuchsystemsareinuse,theindividualororganiza-tionresponsibleforthesystem,andexplanationsofoutcomesthatareclear,timely,andaccessible.Suchnoticeshouldbekeptup-to-dateandpeopleimpactedbythesystemshouldbenotifiedofsignificantusecaseorkey
functionalitychanges.Youshouldknowhowandwhyanoutcomeimpactingyouwasdeterminedbyan
automatedsystem,includingwhentheautomatedsystemisnotthesoleinputdeterminingtheoutcome.
Automatedsystemsshouldprovideexplanationsthataretechnicallyvalid,meaningfulandusefultoyouandtoanyoperatorsorotherswhoneedtounderstandthesystem,andcalibratedtothelevelofriskbasedonthe
context.Reportingthatincludessummaryinformationabouttheseautomatedsystemsinplainlanguageandassessmentsoftheclarityandqualityofthenoticeandexplanationsshouldbemadepublicwheneverpossible.

HUMANALTERNATIVES,CONSIDERATION,ANDFALLBACK
Youshouldbeabletooptout,whereappropriate,andhaveaccesstoapersonwhocanquicklyconsiderandremedyproblemsyouencounter.Youshouldbeabletooptoutfromautomatedsystemsinfavorofahumanalternative,whereappropriate.Appropriatenessshouldbedeterminedbasedonreasonableexpectationsinagivencontextandwithafocusonensuringbroadaccessibilityandprotectingthepublicfromespeciallyharmfulimpacts.Insomecases,ahumanorotheralternativemayberequiredbylaw.Youshouldhaveaccesstotimelyhumanconsiderationandremedybyafallbackandescalationprocessifanautomatedsystemfails,itproducesanerror,oryouwouldliketoappealorcontestitsimpactsonyou.Humanconsiderationandfallbackshouldbeaccessible,equitable,effective,maintained,accompaniedbyappropriateoperatortraining,andshouldnotimposeanunreasonableburdenonthepublic.Automatedsystemswithanintendedusewithinsensi-tivedomains,including,butnotlimitedto,criminaljustice,employment,education,andhealth,shouldadditional-lybetailoredtothepurpose,providemeaningfulaccessforoversight,includetrainingforanypeopleinteracting
withthesystem,andincorporatehumanconsiderationforadverseorhigh-riskdecisions.Reportingthatincludesadescriptionofthesehumangovernanceprocessesandassessmentoftheirtimeliness,accessibility,outcomes,andeffectivenessshouldbemadepublicwheneverpossible.

ApplyingTheBlueprintforanAIBillofRights
WhilemanyoftheconcernsaddressedinthisframeworkderivefromtheuseofAI,thetechnicalcapabilitiesandspecificdefinitionsofsuchsystemschangewiththespeedofinnovation,andthepotentialharmsoftheiruseoccurevenwithlesstechnologicallysophisticatedtools.Thus,thisframeworkusesatwo-parttesttodeterminewhatsystemsareinscope.Thisframeworkappliesto(1)automatedsystemsthat(2)havethepotentialtomeaningfullyimpacttheAmericanpublic’srights,opportunities,oraccesstocriticalresourcesorservices.Theserights,opportunities,andaccesstocriticalresourcesofservicesshouldbeenjoyedequallyandbefullyprotected,regardlessofthechangingrolethatautomatedsystemsmayplayinourlives.
Thisframeworkdescribesprotectionsthatshouldbeappliedwithrespecttoallautomatedsystemsthathavethepotentialtomeaningfullyimpactindividuals'orcommunities'exerciseof:
RIGHTS,OPPORTUNITIES,ORACCESS
Civilrights,civilliberties,andprivacy,includingfreedomofspeech,voting,andprotectionsfromdiscrimi-nation,excessivepunishment,unlawfulsurveillance,andviolationsofprivacyandotherfreedomsinbothpublicandprivatesectorcontexts;
Equalopportunities,includingequitableaccesstoeducation,housing,credit,employment,andotherprograms;or,
Accesstocriticalresourcesorservices,suchashealthcare,financialservices,safety,socialservices,non-deceptiveinformationaboutgoodsandservices,andgovernmentbenefits.
AlistofexamplesofautomatedsystemsforwhichtheseprinciplesshouldbeconsideredisprovidedintheAppendix.TheTechnicalCompanion,whichfollows,offerssupportiveguidanceforanypersonorentitythatcreates,deploys,oroverseesautomatedsystems.
Consideredtogether,thefiveprinciplesandassociatedpracticesoftheBlueprintforanAIBillofRightsformanoverlappingsetofbackstopsagainstpotentialharms.Thispurposefullyoverlappingframework,whentakenasawhole,formsablueprinttohelpprotectthepublicfromharm.Themeasurestakentorealizethevisionsetforwardinthisframeworkshouldbeproportionatewiththeextentandnatureoftheharm,orriskofharm,topeople'srights,opportunities,andaccess.
RELATIONSHIPTOEXISTINGLAWANDPOLICY
TheBlueprintforanAIBillofRightsisanexerciseinenvisioningafuturewheretheAmericanpublicisprotectedfromthepotentialharms,andcanfullyenjoythebenefits,ofautomatedsystems.Itdescribesprinci-plesthatcanhelpensuretheseprotections.SomeoftheseprotectionsarealreadyrequiredbytheU.S.Constitu-tionorimplementedunderexistingU.S.laws.Forexample,governmentsurveillance,anddatasearchandseizurearesubjecttolegalrequirementsandjudicialoversight.ThereareConstitutionalrequirementsforhumanreviewofcriminalinvestigativemattersandstatutoryrequirementsforjudicialreview.CivilrightslawsprotecttheAmericanpeopleagainstdiscrimination.

RELATIONSHIPTOEXISTINGLAWANDPOLICY
Thereareregulatorysafetyrequirementsformedicaldevices,aswellassector-,population-,ortechnology-spe-cificprivacyandsecurityprotections.Ensuringsomeoftheadditionalprotectionsproposedinthisframeworkwouldrequirenewlawstobeenactedornewpoliciesandpracticestobeadopted.Insomecases,exceptionstotheprinciplesdescribedintheBlueprintforanAIBillofRightsmaybenecessarytocomplywithexistinglaw,conformtothepracticalitiesofaspecificusecase,orbalancecompetingpublicinterests.Inparticular,lawenforcement,andotherregulatorycontextsmayrequiregovernmentactorstoprotectcivilrights,civilliberties,andprivacyinamannerconsistentwith,butusingalternatemechanismsto,thespecificprinciplesdiscussedinthisframework.TheBlueprintforanAIBillofRightsismeanttoassistgovernmentsandtheprivatesectorinmovingprinciplesintopractice.
TheexpectationsgivenintheTechnicalCompanionaremeanttoserveasablueprintforthedevelopmentofadditionaltechnicalstandardsandpracticesthatshouldbetailoredforparticularsectorsandcontexts.WhileexistinglawsinformedthedevelopmentoftheBlueprintforanAIBillofRights,thisframeworkdoesnotdetailthoselawsbeyondprovidingthemasexamples,whereappropriate,ofexistingprotectivemeasures.Thisframeworkinsteadsharesabroad,forward-leaningvisionofrecommendedprinciplesforautomatedsystemdevelopmentandusetoinformprivateandpublicinvolvementwiththesesystemswheretheyhavethepoten-tialtomeaningfullyimpactrights,opportunities,oraccess.Additionally,thisframeworkdoesnotanalyzeortakeapositiononlegislativeandregulatoryproposalsinmunicipal,state,andfederalgovernment,orthoseinothercountries.
Wehaveseenmodestprogressinrecentyears,withsomestateandlocalgovernmentsrespondingtotheseprob-lemswithlegislation,andsomecourtsextendinglongstandingstatutoryprotectionstonewandemergingtech-nologies.Therearecompaniesworkingtoincorporateadditionalprotectionsintheirdesignanduseofauto-matedsystems,andresearchersdevelopinginnovativeguardrails.Advocates,researchers,andgovernmentorganizationshaveproposedprinciplesfortheethicaluseofAIandotherautomatedsystems.TheseincludetheOrganizationforEconomicCo-operationandDevelopment’s(OECD’s)2019RecommendationonArtificialIntelligence,whichincludesprinciplesforresponsiblestewardshipoftrustworthyAIandwhichtheUnitedStatesadopted,andExecutiveOrder13960onPromotingtheUseofTrustworthyArtificialIntelligenceintheFederalGovernment,whichsetsoutprinciplesthatgovernthefederalgovernment’suseofAI.TheBlueprintforanAIBillofRightsisfullyconsistentwiththeseprinciplesandwiththedirectioninExecutiveOrder13985onAdvancingRacialEquityandSupportforUnderservedCommunitiesThroughtheFederalGovernment.TheseprinciplesfindkinshipintheFairInformationPracticePrinciples(FIPPs),derivedfromthe1973reportofanadvisorycommitteetotheU.S.DepartmentofHealth,Education,andWelfare,Records,Computers,andtheRightsofCitizens.4Whilethereisnosingle,universalarticulationoftheFIPPs,thesecoreprinciplesformanaginginformationaboutindividualshavebeenincorporatedintodataprivacylawsan
