SHANGHAITENANCYAGREEMENT(协议编号: 01- )(CONTRACTNUMBER:)本协议双方当事人TwoPartiesofthisagreement出租方(甲方):李TheLessor(PartyA):【出租】承租方(乙方):STheLessee(PartyB):S根据《中华人民共和国协议法》、《上海市房屋租赁条例》(以下简称):《条例》的规定,甲、乙双方在平等、自愿、公平和诚实信用的基础上,经协商一致,就乙方承租甲方可依法出租(出租/预租)的商品房(房屋/商品房)事宜,订立本协议。Incompliancewith((TheContractLawofthePeople’sRepublicofChina))and((ShanghaiTenancyAgreement))(hereinasAgreement),thisAgreementismade,throughconsultationonthebasisofequality,voluntariesandmutualbenefit,byandbetweenPartyAandPartyB,wherebyPartyAagreestoletthelegallypossessedrealestatetoPartyBandPartyBagreestotakethesamefromPartyAonthefollowingtermsandconditions.出租或预租房屋情况 One.TheSituationofLeasingorpre-leasingPremises.甲方出租(出租/预租)给乙方的房屋坐落在本市XX区XX路XX号X号楼X室(以下简称该房屋)。该房屋实测(【出租】实测/【预租】预测)建筑面积为120平方米,房屋用途为住宅,房屋类型为公寓、结构为混合一等。甲方已向乙方出示:1-1. PartyAshalllettoPartyB:UnitXXBlockXTheEdifice,Shanghai,whichisthelegalpossessionofPartyA(hereinafterreferredtoas‘thePremises’).ThefloorareaofthePremisesPartyAshalllettoPartyBis120squaremetersinall(Lease/Actual).ThePremisesuseisResidence,thetypeofthePremisesisApartment,andthestructureisReinforcedConcrete.TheplotofthePremisesseestheattachment(一).PartyAshallshowtoPartyBthefollowingitem:【出租】房地产权证/房屋所有权证/;『证书编号:沪房地浦字(2023)第0148XXX号。1) Thecertificateofrealestateownership,theregisterednumberis沪房地浦字(2023)第014XXX号,甲方作为该房屋的房地产权利人(房地产权利人/代管人/法律规定的其他权利人)与乙方建立租赁关系。签订本协议前,甲方已告知乙方该房屋未(已/未)设定抵押。1-2. PartyAshallsetupTenancyAgreementwithPartyBastheownershiprightstorealty(1.ownershiprightstorealty2.bailee3.otherrightstorealtybythelawofthePremises).PartyAshallnotifyPartyBaboutmortgage(Y/N)beforesigningtheTenancyAgreement.该房屋的公用或合用部位的使用范围、条件和规定;现有装修、附属设施、设备状况和甲方批准乙方自行装修和增设附属设施的内容、标准及需约定的有关事宜,由甲、乙双方分别在本协议附件中加以列明。甲、乙双方批准该附件作为甲方向乙方交付该房屋和本协议终止时乙方向甲方返还该房屋的验收依据。甲方可以接受正常的磨损。1-3. Theusagearea,condition,requirementofcommonspaceorshareoccupancyofthePremises,conditionoffacilities,theassociatedamenitiesrequiredbyPartyBbasedontheagreementofPartyAshallbespecifiedintheattachmenttothisAgreementbythepartieshereto.SuchattachmentshallserveasthebasisuponwhichPartyAshallhandoverthePremisestoPartyBasdescribedinthisAgreement,andshallinspectandacceptthePremiseswhenPartyBhandsbacksuchthePremisesupontheexpirationoftheAgreement.FairwearandtearofthePremisesisacceptablebyPartyA.租赁用途 Two.UsageofthePremise乙方向甲方承诺,租赁该房屋仅作为住宅使用,并遵守国家和本市有关房屋使用和物业管理的规定。2-1. PartyBpromisestoPartyAtousethePremisessolelyforthepurposeofResidence,andshallbeabidedbytherelatedprincipleoflocalandthePeople’sRepublicofChina.乙方保证,在租赁期内未征得甲方书面批准以及按规定须经有关部门审批而未核准前,不擅自改变上述约定的使用用途。2-2. WithinthetermofthisAgreement,PartyBshallnotusethePremisesforanyotherpurposewithoutobtainingthepriorwrittenconsentofPartyAandtheconfirmationandapprovalofthedepartmentconcerned.交付日期和租赁期限 Three. Deliverydateandleasingterm甲乙双方约定,甲方于200X年06月XX日前向乙方交付该房屋。【出租】房屋租赁期自200X年06月XX日起至200X年0X月XX日止。3-1.ThetermofthisAgreementisXX monthsinall,commencingon JuneXX,200X ,andexpiringon JuneXX,200X.租赁期满,甲方有权收回所有出租房屋,乙方应如期返还。乙方需继续承租该房屋的,则应于租赁期届满前X个月,向甲方提出续租书面规定,经甲方批准后重新签订租赁协议。3-2. PartyAshallbeentitled,uponexpirationofthisAgreement,toclaimbackthePremisesandPartyBshallhavetohandbackthesameintimeasstipulated.IncasethatPartyBwishestorenewthisAgreementuponexpirationofthisAgreement,PartyBshallnotifyPartyAinXmonthbeforetheexpirationofthisAgreement.AnewAgreementshallbesignedafterPartyAexpressesitsagreement.租金、支付方式和期限 Four. Rent,PaymentMethodandTerm甲、乙双方约定,该房屋【出租】月租金总计为(人民币) 1XXXX元。(大写:壹万XXXX整),包含物业管理费,XXXX。4-1. UpontheagreementbetweenPartyAandPartyB,themonthlyrentofthePremisestotalsRMB1XXXX.includingthemanagementfee,XXX乙方应于每月XX日前向甲支付租金。4-2. PartyBshallpaymonthlyrenttoPartyAinadvanceontheXXthdayofeachcalendarmonth.乙方支付租金的方式如下:银行转账,甲方账户信息见补充条款。4-3. ThemethodofpaymentoftherentforthePremisesisasfollows:BankTransfer.PartyA’sbankaccountinformationstatesintheadditionalterms.保证金和其他费用 Five.SecurityDepositandotherFees甲、乙双方约定,甲方交付该房屋时,乙方应向甲方支付房屋租赁保证金,保证金为X个月的租金,即(人民币)XXXX元。甲方收取保证金后向乙方开具收款凭证。租赁关系终止时,甲方收取的房屋租赁保证金除用以抵充协议约定由乙方承担的费用外(水电煤,电话等),剩余部分无息归还乙方。5-1. UponthemutualAgreementbetweenPartyAandPartyB,PartyBshallpaythesecuritydeposit,whichequalstoX(months)rentalfees;thetotalamountshallbecalculatedasRMBXXXXPartyAshallwriteoutreceipttoPartyBafterreceivingthesecuritydeposit.Upontheterminationoftheagreement,PartyAshalldeductthesecuritydepositasthe(Utility,telephonefeeetc)whichshallbeaffordedbyPartyB;therestofsecuritydepositshallbereturnedtoPartyB.租赁期间,使用该房屋所发生的水、电、煤气、通讯费用由乙方(甲方/乙方)承担。其他有关费用及设备、物业管理费、卫星电视费,均由甲方(甲方/乙方)承担。5-2. Theutilityofwater,electricity,gasandtelecommunicationfeeconsumedinthePremiseswithinthetermoftheAgreementshallbepaidbyPartyA.Managementfee,invoiceandsatelliteTVfeeshallbepaidbyPartyA.乙方(甲方/乙方)负责支付的上费述用,计算或分摊办法、支付方式和时间:按帐单及时缴付。5-3. Thedateofthepaymentandthemethodofpaymentofsuchutilityfeesshallbeasfollows:PartyBshallpaytheaforementionedfeetimelytorelateddepartmentsaccordingtothebillsl.房屋使用规定和维修责任 Six. TheresponsibilitiesonRepairofthePremises.租赁期间,乙方发现该房屋及其附属设施有损坏或故障时,应及时告知甲方修复;甲方应在接到乙方告知后的X日内进行维修。逾期不维修的,乙方可代为维修,所有维修费用由甲方承担。WithinthetermoftheAgreement,PartyBshallnotifyPartyAtotakechargeoftherepairsintimeifanylossesordamagesofthePremisesoccurred.PartyAshallberesponsibleforthemaintenancewithinXdaysafterreceivingthenoticefromPartyB.PartyBmighttakeresponsibilityoftherepairsifitisoverdue;AllrepairandmaintenancechargesorexpensesshallbebornebyPartyA租赁期间,乙方应合理使用并爱惜该房屋及其附属设施。因乙方使用不妥或不合理使用,致使该房屋及其附属设施损坏或发生故障的,乙方应负责维修。乙方拒不维修,甲方可代为维修,费用由乙方承担。6-2 WithinthetermoftheAgreement,PartyBshalltakegoodcareof,andmakeproperuseof,thePremises,alltheinstallationsandpropertytherein.PartyBshallberesponsible,onceandforall,forthelossanddamagetothePremisesortotheinstallationstherein,asaresultoftheimproperuseonthepartofPartyB.PartyBshallbeliableeithertotakechargeoftherepairsthereofortoindemnifyPartyAforsuchlossesordamages.PartyAmighttakeresponsibilityoftherepairsinsteadoftherefusingrepairsbyPartyB.PartyBshallliabletotakechargeoftherepairs.租赁期间,甲方保证房屋及其附属设施处在正常的可使用和安全的状态。甲方对该房屋进行检查、养护,应提前X日告知乙方。检查养护时,乙方应尽量予以配合。甲方应竭尽全力减少对乙方使用该房屋的影响。6-3WithinthetermoftheAgreement,PartyAshallguaranteetheuseandsafetyofthePremises.PartyAshallinformPartyBatXdaysinadvanceinordertodomaintenanceandPartyBshalltherebyusereasonableendeavourstoco-operate.PartyAshallusehisbestendeavourstominimisethedisruptiontoPartyBofPartyB'suseofthepremisesduringthemaintenanceperiod.除本协议附件(二)外,乙方另需装修或增设附属设施和设备的,应事先征得甲方的书面批准,按规定须向有关部门审批的,则还应由甲方(甲方/甲方委托乙方)报请有关部门批准后,方可进行。乙方增设的附属设施和设备归属及其维修责任由甲、乙双方另行书面约定。6-4PartyBshallacceptfurnishingsandallinstallationsstatedinattachment(2),andonlyafterobtainingthewrittenconsentofPartyA,shallrefurnishoralteranyorallofthefurnishingsandinstallationstherein.Andincompliancewiththepertinentregulations.PartyBshallpresentareportortheaforesaidrefurnishingandalterationstothedepartmentconcerned.Onlyafterallthereportingandapprovalprocedureshavebeencompleted,shalltheworkofsuchrefurnishingandalterationsbeaffected.ThebelongingsandmaintenanceofadditionalfacilitiesofthePremisesarebasedonthemutualnegotiationbetweenPartyAandPartyB.房屋交还时的状态 Seven. ThestateofthereturnedPremises7-1. 除甲方批准乙方续租外,乙方应在本协议的租期届满后的二日内应返还该房屋,未经甲方批准逾期返还房屋的,每逾期一日,乙方应按双倍日租金向甲方支付该房屋占用使用费。7-1.ExceptforobtainingPartyA’spriorconsentforrenewal,PartyBshallreturnthePremisestoPartyAwithin2daysafterexpiration.IfPartyBfailstoreturnthePremisesonschedule,PartyBshallpayapenaltytoPartyAintheamountofdoublerentalforeachdayofdelay.7-2.乙方返还该房屋应当符合正常使用后的状态。返还时,应经甲方验收方可,并互相结清各自应当承担的费用。甲方接受正常的磨损。7-2. PartyBshallreturnthePremisestoPartyAwithoriginalcondition.WhenPartyAtakesoverthePremises,bothPartyAandPartyBshallsquarethepaymentwitheachother.FairwearandtearisacceptablebyPartyA.转租、转让和互换 Eight. Subletting,transferandexchange除甲方已在本协议补充付款中批准乙方转租外,乙方在租赁期内,需事先征得甲方的书面批准,方可将该房屋部分或所有转租给别人。但同一间居住房屋,不得分割转租。8-1. UnlessotherwisestipulatedbyPartyAheretointheprovisionsandsupplementaryprovisionsunderthisAgreement,PartyBshallnotsubletthewholeorpartofthePremiseswithoutobtainingthewrittenconsentofPartyA.ButPartyBshallnotsubletpartofaroom,ortheroombyberths.乙方转租该房屋,应按规定与接受转租方订立书面的转租协议。并按规定向该房屋所在区、县房地产交易中心或农场系统受理处办理登记备案。8-2. PartyBshallsubletthePremisesinaccordancewiththesubleaseAgreementsignedwithPartyA,whichshallsubmittolocalrealestatedepartmentonfile.在租赁期内,乙方将该房屋转让给别人承租或与别人承租的房屋进行互换,必须事先征得甲方书面批准。转让或互换后,该房屋承租权的受让人或互换人应与甲方签订租赁主体变更协议并继续履行本协议。8-3. WithinthetermoftheAgreement,PartyBmustobtainPartyA’spriorwrittenconsentbeforeifmaysubletitsleasedPremisestoanotherpartyorexchangeitsleasedPremiseswithanotherpartywithinthetermofthelease.PartyAshallcontinuetoperformtheobligationsstipulatedinthisAgreementduringthetermofthesublease,inadditiontoenjoyingtherightsandbearingtheobligationsstipulatedinthesubleasecontract.在租赁期内,甲方如需出售该房屋,需保证本租约在房屋出售后应继续履行。乙方在同等条件下有优先购买权。8-4. WithinthetermoftheAgreement,ifPartyAwantstoselltherentedapartment,PartyAshallmakesurethisleasewillcarryoutbythenewlandlord.PartyBhereinhastheprivilegetobuytheleasedPremisesundersamecondition.解除本协议的条件 Nine. ConditionstoterminatetheContract甲、乙双方批准在租赁期内,有下列情况之一的,本协议终止,双方互不承担责任:9-1. ThisAgreementshallnotbeterminatedduringthetermoftheAgreementexceptinanyofthefollowingcircumstance.NeitherPartyAnorPartyBshallbeartheobligationifthefollowingcircumstanceoccurred.该房屋占用范围内的土地使用权依法提前收回的;ThePremisesrightsaretakenbackaccordingtolaworothercircumstancesoccurredattributabletoprohibitionsbylaw.该房屋因社会公共利益被依法征用的;Social&publicAffairsusethePremises.该房屋因城市建设需要被依法列入房屋拆迁许可范围的;(c)ThePremisesisremovedduringthedurationoftheAgreementfollowingapprovedbytherelevantdepartmentofthemunicipalordistrict(county)government.该房屋毁损、灭失或者被鉴定为危险房屋的;(d)ThisAgreementcannotbeperformedduetoimpairanddamage.甲、乙双方批准,有下列情形之一的,一方可书面告知另一方解除本协议。违反协议的一方,应向另一方按月租金的双倍支付违约金;给对方导致损失的,支付的违约金局限性抵付一方损失的,还应补偿导致的损失与违约金的差额部分。9-2.UndermutualagreementbetweenPartyAandPartyB,eitherPartyshallnotifyeachothertoterminatetheAgreementwithwrittennoticeifoneofthefollowingcircumstancesoccurred.EitherpartyistreatedasinbreachofthisAgreementshallpayliquidateddamagesattherateof2timesofmonthlyrental.Thebalancebetweenliquidateddamagesandlossesshallbecompensatediftheliquidateddamagesthuspaidarenotsufficienttomakeupotherparty’slosses。甲方未准时交付该房屋,经乙方催告后七日内仍未交付的;(a)PartyAfailstodeliveronscheduleandfailstodosowithinPartyBafter7dayswiththetimeagreeduponinthisAgreement.甲方交付的该房屋不符合本协议的约定,致使不能实现租赁目的的;或甲方交付的房屋存在缺陷,危及乙方安全的。(b) TheconditionofthePremisesdeliveredbyPartyAisheretonotinaccordancewiththeAgreement,orthedeliveredPremiseswiththedefectionordamage,whichcouldnotleasedtoPartyB.乙方未征得甲方书面批准改变房屋用途,致使房屋损坏的(c) PartyBusestheleasedpropertyotherthanforthepurposestatedherein.因乙方因素导致房屋主体结构损坏的;(d)PartyBaltersthestructureofthePremiseswithoutauthorization.乙方擅自转租该房屋、转让该房屋承租权或与别人互换各自承租的房屋的;(e)PartyBsublets,transfersorswapsthePremiseswithoutobtainingthepriorwrittenconsentofPartyA.乙方逾期不支付租金累计超过壹个月的;(f)PartyBfailstopayrentformorethanonemonthafterthedueday.违约责任 Ten. LiabilitiesforBreachofcontract该房屋交付时存在缺陷的,甲方应自交付之日起的五日内进行修复。10-1. PartyAshallcarryoutrepairsonthePremisesafter5daysofdelivery.PartyAshallagreetolowertherentalandnotifytherelatedsupplementalclausesifPartyAshallnotrepairthePremiseswithintheduedate.因甲方未告知乙方,该房屋出租前已抵押或产权转移已受到限制,导致乙方损失的,甲方应负责补偿。10-2. IfPartyAfailstorepresentPartyBaboutmortgagestatuesandtherestrictionoftransferringtherightsofthePremisesinthisAgreement.PartyAshallbeliableforPartyB’slosses.租赁期间,甲方不及时履行本协议约定的维修、养护责任,致使房屋损坏,导致乙方财产损失或人身伤害的,甲方应承担补偿责任。10-3. WithinthetermofthisAgreement,PartyAshallberesponsiblefortheindemnificationforthelossesincurredbyPartyBbecauseofthedamagestothePremisesresultingfromthenon-performanceoftheprovisionsinrespectofmaintenanceandrepairsasspecifiedinthisAgreement.租赁期间,非本协议规定的情况,甲方擅自解除本协议,提前收回该房屋的,甲方应向乙方支付相称于两个月租金的违约金。若违约金局限性抵付乙方损失的,甲方还应负责补偿。10-4. IfPartyAarbitrarilyrescindsthisAgreementwithintheleasetermforreasonsnotattributabletothisAgreementhereinandtakebackthePremisesaheadoftime,PartyAshallpayliquidateddamagestoPartyBintheamountof2timesthemonthlyrental;iftheliquidateddamagesthuspaidarenotsufficienttomakeupPartyB’slosses,PartyAshallalsoberesponsibleforpayingcompensation。乙方未征得甲方书面批准或者超过甲方书面批准的范围和规定装修房屋或者增设附属设施的,甲方可以规定乙方补偿损失(恢复房屋原状/补偿损失)。10-5. RestoreorrefurnishthePremiseswithoutobtainingthepriorwrittenconsentofPartyA,orexceedingtheareastatedinthisAgreement.PartyAshallrequirePartyBtopaytheliquidateddamages(a.returntotheoriginalcondition/b.paytheliquidateddamages)租赁期间,非本协议规定的情况,乙方半途擅自退租的,乙方应向甲方支付相称于两个月租金的违约金。若违约金局限性抵付甲方损失的,乙方还应负责补偿。甲方可从租赁保证金中抵扣。保证金局限性抵扣的,局限性部分则由乙方另行交付。10-6. IfPartyBterminatesthisAgreementwithintheleasetermforreasonsnotattributabletothisAgreementherein,PartyBshallpayliquidateddamagestoPartyAintheamountof2timesthemonthlyrental.IftheliquidateddamagesthuspaidarenotsufficienttomakeupPartyA’slosses,PartyBshallalsoberesponsibleforpayingcompensation.PartyAhastherightstoredeemthelossesfromsecuritydeposit.Ifsecuritydepositthusisnotsufficienttoberedeemed,PartyBshallalsoberesponsibleforpayingtheremedialfee.其他条款Eleven.Otherterms租赁期间,甲方需抵押该房屋,应当书面告知乙方,并向乙方承诺该房屋抵押后当事人协议以折价、变卖方式处分该房屋前叁拾日书面征询乙方购买该房屋的意见。11-1. WithinthetermofthisAgreement,PartyAshallberesponsibletotellPartyBwithwrittennoticewhenPartyAneedstomortgagethepremises,andpresentstheguaranteetoinquirePartyBabouttheintentiontobuytheleasedPremises30daysbeforedealingwiththeleasedpremisesondiscountorrealization.本协议自双方签字后立即生效。生效后的15日内,由甲方负责按规定向房屋所在地区、县房地产交易中心或农场系统受理处办理登记备案,领取房屋租赁登记备案证明;本协议经登记备案后,凡变更、终止本协议的,由甲方(甲方/乙方)负责在本协议变更终止之日起的15日内,向原登记机构办理变更、终止登记备案手续。因甲方未办理房屋租赁登记备案或变更、终止登记备案的,所引起的法律纠纷,由甲方承担一切责任。11-2. PartyAshall,onbehalfofthetwopartieshereintothisAgreement,registerattheRealEstateExchangeAdministrativeDepartmentofthedistrictorcountyormunicipalgovernmentwithinfifteendays,commencingonthesigningdateofthisAgreement.ThisAgreementshallgofortheregistration,andthereceptionoftheCertificateoftheLeaseoftheRealEstate.IntheeventofanymodificationorterminationofthisAgreementafteritbecomeseffective,PartyAshall,onbehalfofthetwopartieshereintothisAgreement,registerthemodificationorterminationofthisAgreementatthesameregistrywithinfifteendaysoftheactualmodificationortermination.IfPartyAfailstoperformregistration,ormodification,PartyAshallbeliablefordispute.ThisAgreementcomesintoeffectonlyafterSignature(Signature/Registration).本协议未尽事宜,经甲、乙双方协商一致,可订立补充条款。本协议补充条款及附件均为本协议不可分割的一部分,本协议及其补充条款和附件内空格部分填写的文字与铅印文字具有同等效力。11-3. MattersnotcoveredinthisContractmaybesetforthinsupplementaryProvisionssubjecttoaconsensusreachedbetweenPartyAandPartyBfollowingconsultations.TheSupplementaryProvisionsandAttachmentsofthisAgreementarefromaninseparablepartofthisAgreement.ThetextwrittenintotheblankspacesofthisAgreementanditsSupplementaryProvisionsandAttachmentsandtheprintedthatshallbeequallyauthentic.甲、乙双方在签署本协议时,对各自的权利、义务、责任清楚明白,并愿按协议规定严格执行。如一方违反本协议,另一方有权按本协议规定索赔。11-4. UponthesigningofthisAgreement,boththepartiesisequallyeligible,fullyawareoftheirrespectiverights,obligationsandresponsibilitiesherein,andwillingtoactstrictlyontheprovisionsdefinedinthisAgreement.Eachpartyshallbeentitledtolodgeaclaimagainst,andtobereimbursedby,theotherbreachingparty甲、乙双方在履行本协议过程中发生争议,应通过协商解决;协商解决不成的,双方批准选择下列第壹种方式解决:11-5. AnydisputearisingfromtheperformanceofthisAgreementshallbesettledthroughconsultationbetweenthetwoparties.Intheeventthatsuchadisputeshouldfailtobesolvedthroughconsultation,itshallbesettledineitherofthetwowaysstipulatedhereinafterasfollows(forboththepartiestodecideontheadoptionoftheonewayandtherejectionoftheother).提交中国国际经济贸易仲裁委员会上海分会仲裁委员会仲裁.SubmititforarbitrationtotheShanghaiArbitrationCommission;依法向人民法院起诉。OrbringittothePeople’sCourt,underwhosejurisdictiontheseatofthePremisesislocated.本协议连同附件一式叁份。其中:甲、乙双方各执一份,以及上海明大房地产经纪有限公司各执一份,均具有同等效力。中英文具有同等法律效力。中英文条款及意思如有不一致之处,以中文为准。ThisAgreementanditsattachmentarepreparedin3intheoriginal,oneforeachparty,oneforJoannaRealEstate.BothChinesetextandEnglishtextshallhavethesamelegaleffect.IntheeventthatthereisanydisagreementbetweentheChineseversionandEnglishversion,theChineseversionshallprevail.此租赁合约依照中国共和国法律。ThisAgreementshallbegovernedbythelawsoftheRepublicofChina.补充条款SupplementaryProvisions--------------------------------------------------------------------- GuestBedroom:Landlordshouldmovethebedandprovidedoublesofabed,desk,chair.房东需搬走客卧内的床,并提供一套双人沙发床,书桌及椅子。
