第页共页房屋租赁协议英文租约LEASEAGREEMENT出租方〔甲方〕Lessor〔PartyA〕地址:Address:帐户名:AccountName:银行名称:BankName:帐号:AccountNo.:承租方〔乙方〕Lessee〔PartyB〕地址:Address::PhoneNo.:第1条租赁标的:LeasingPremises:甲方同意将及其设备〔详见附件二〕在清洁及良好状态下租给乙方〔甲方需在入住前清洁并检查该房屋及其设备,确保所有设备为正常工作状态〕该房屋面积为平方米〔房产权属证明见附件一〕产权人:该房屋为居住用处。PropertyOwnerName:TheusageoftheLeasingPremisesisforresidentialpurposeonly.第2条租期:TermofTenancy:2.1租赁期为年,自年月日到年月日止。租期满个月后,乙方可以提早个月书面通知甲方提早终止合同,无需承当任何责任。Theabovepropertyisherebyleasedforatermofyear,mencingonandexpiringon.Aftermonthsofstay,PartyBmayterminatethisAgreementbygivingmonth'spriornoticeinwrittenwithoutbeingliabletherefore.2.2在租期开场前,出租房屋及附件二所列设备应已装修或安装布置完毕,、宽带、电视均已开通,处于可供租赁的良好状态。甲方应按时交付出租房屋及附件二所列设备,如有逾期,乙方有权解除本租约,甲方应应返还乙方已付押金及剩余租金,并向乙方支付相当于两个月租金的违约金。2.3租期届满,甲方有权收回出租房屋及附件二所列全部设备,乙方亦应如期交还;乙方如要求续租,那么享有优先续租权,但必须在本租约期满前2个月向甲方提出书面申请,租金双方另行协商。租赁终止或解除时,如甲方不及时接收房屋,乙方有权将房屋钥匙按通讯地址寄给甲方,以此视为乙方交还完毕以及甲方验收合格。2.4除本合同另有约定外,租赁期内乙方如需提早退租,应提早30日通知甲方,并向甲方支付相当于两个月租金的违约金。UnlessotheragreedinthisAgreement,duringthetermofAgreement,IfpartyBterminatestheTenancyAgreement,PartyBshallinformPartyA30daysinadvanceandshallpayPartyAthepensationwhichequalstotwomonths'srent.第3条租金:Rent:3.1租金每月为人民币元整,包括家具、电器〔见附件二〕物业管理费、房租完税发票、卫星电视的开通费、和宽带M开通费以及.3.2租金每个月支付一次,每次支付金额为元。甲方应于每个支付周期开场日前10日内向乙方开具相应金额的租赁发票,乙方应在收到甲方正式完税发票后个工作日内向甲方指定账户支付月租金。如假设甲方未按时提供有关发票,乙方有权延付租金。假设乙方收到发票后未按上述期限付款,那么每逾期一日,应按未付租金的千分之三向甲方支付滞纳金。PartyBshallpayeachmonthsrentwhichequalstoRMB.PartyAshouldprovidewithPartyBthecorrespondinginvoicewithin10daysbeforethemencingdateofeachpaymentpeoriod,andPartyBshouldpaytherenttothedesinatedaccountofPartyAwithinworkingdaysafterreceivingtheinvoicefromPartyA,IncasePartyAfailstodoso,PartyBshallhavetherighttowithholdrentalpayment.IncasePartyBfailstopaytherentafterreceivingtheinvoiceasagreedintheTenancy,penaltyof3‰foreachoverduepaymentshouldbecharged.3.4租金以人民币支付。在本租约有效期内,租金不予调整。TherentshallbepaidinRMB.TherentcannotbeadjustedduringthetermofthisTenancyAgreement.第4条押金:Deposit:4.1本租约签订之日起个工作日内且起租日前,乙方应向甲方缴付相当于个月租金额的租赁押金计人民币元。甲方应于乙方将水、电、煤、费、宽带等费用及其他损坏赔偿费用〔如有〕结清后7个工作日内将押金退还。WithinworkingdaysaftersigningofthisLeaseAgreementandbeforetheleasestartdate,PartyBshallpaytoPartyAmonth'srentasdeposit,andtheamountofdepositisRMBintotal.PartyAshallreturnthedepositinfulltoPartyBwithin7workingdaysafteralltheutilityfeeanddamagefeesarecleared.4.3甲方因乙方违背本合同的规定而受的损失,可在押金中扣抵合理数目,在甲方做出该种扣抵前,需书面通知乙方将被扣抵的金额和理由,乙方有权回绝不合理或不公正的抵扣,缺乏局部乙方必须在接到甲方付款通知后15个工作日内补足。4.4押金以人民币支付,甲方收到押金时应向乙方开具收据。ThedepositshallbepaidinRMB.PartyAshallissueanofficialreceipttoPartyBuponthereceiptofdeposit.第5条其它费用:OtherCharges:5.1乙方在租赁期内所用的水、电、煤气〔天然气〕,物业管理公司或公共事业部门将每月按房屋实际耗用量结算,由乙方按单缴付。DuringtheperiodofLeaseterm,PartyBshallpaymonthlychargesforusageofwater,electricity,gasbasedontheactualconsumptionamountbilledbythemanagementofficeorrelatinggover____entutilitybureaus.5.2乙方所用,按电信部门相关标准收费,每月根据实际用量结算,由乙方按单缴付。TelephonebillsshallbepaidbyPartyBandbasedontheactualusageaccordingtotherelevantstandardofthethetelemunicationbureau.第6条甲方的权利和义务:Landlord'sRightsandObligations:6.1本租约签订后,甲方不得无故收回房屋,如甲方中途要求收回房屋或擅自解除合同,乙方有权回绝。在征得乙方书面同意解除租约后,甲方应返还乙方已付押金及剩余租金,并向乙方支付相当于两个月租金的违约金。PartyAisnotpermittedtotakebacktheleasedpropertyorterminatethisAgreementduringthetermofAgreementwithoutanyreason.IfPartyAwishestodoso,PartyBhastherighttorefuse.UponthewrittenconsentofPartyBtoterminatetheLeaseAgreement,PartyAshallreturnthedepositandprepaidrenttoPartyBandshallpayPartyBthepensationofamountwhichequalstotwomonth'srent.6.2甲方应确保房屋的各项附属设施以及家具家电均处于完好、可租赁状态。如上述各项出现损坏或不能正常工作,甲方在收到乙方发出的通知后24小时内迅速修理或修缮该损害处。假设3个日历日内甲方仍不能修缮或修缮无效,乙方有权停顿并免于支付租金直到上述情况改良至乙方合理满意为止,直至上述影响居住的情况改良至乙方合理满意为止。情况严重影响乙方正常居住的,乙方有权以书面形式通知甲方解除本租赁合同,租金付至合同解除日,甲方应返还乙方已付押金及剩余租金,并向乙方支付相当于两个月租金的违约金。6.3甲方谨在此声明及保证甲方为出租房屋的合法拥有人并有合法地位出租此房屋于乙方。就本合同及出租此出租房屋予乙方之事,甲方已获得所有有关机构的批准,包括政府批准及/或抵押权人的同意〔如适用〕甲方于本合同所做出的声明及保证,如有错误或违背者,甲方须就乙方因此而引致的任何损失、损害、支出及费用做出全部补偿。PartyAherebyrepresentsandwarrantsthatPartyAisthelegalowneroftheleasingPremisesandhasthenecessarylegalcapacitytoleasethepropertytoPartyB.PartyAhasalsoobtainedallthenecessaryauthorizationsfromallrelevantauthoritiesinthePeople'sRepublicofChinainrespectofthisLeaseAgreementandtheleasingoftheleasingPremisestoPartyB,includinganynecessarygover____entapprovalsorregistrationsand/ormortgageeconsent〔ifapplicable〕PartyAshallcontinuetobeliabletokeepPartyBfullyindemnifiedagainstanycosts,expenses,lossesanddamagessufferedbyPartyBduetoanybreachofPartyAtoitsabove-mentionedguarantee.6.4如在租赁期内,出租房屋发生所有权全部或局部的转移、或其他影响乙方权益的事情时〔甲方出售房屋或者抵押房屋〕,甲方应保证所有权人或其他影响乙方权益的第三者,能继续遵守本合同所有条款。纵使出租房屋已被转移,如乙方于本合同下的权益受此等所有权人或第三所影响或损害,甲方须负责补偿乙方的所有损失。Ifduringtheleaseterm,allorpartoftheleasingPremisesistransferredormortgagedtoathirdpartybyPartyA,orPartyB'srighttousetheleasedpropertyisotherwiseaffected,PartyAshallensurethatsuchtransfereeorthirdpartyhavinganeffectonPartyB'srighttousetheleasingPremiseswillcontinuetoabidebythetermsofthisLeaseAgreement.EveniftheleasedPremisesistransferredwhereatransfereeorathirdpartyaffectsPartyB'sinterestsunderthisLeaseAgreement,PartyAshallcontinuetobeliabletokeepPartyBfullyindemnifiedagainstalldamagessufferedbyPartyB.6.5甲方应提供无毒无害的居住环境。假如该房屋中存在有害气体、噪音或者其他危害安康的情形,经执证机关通过专业检测后证明房屋内的有害气体、噪音或者其他情形确实超过国家规定的安康标准的,乙方有权凭检测报告解除本协议,甲方应返还乙方全额押金和剩余租金。PartyAshallprovideharmlesscircumstance.Ifthereispoisonousgas,andothercaseswhicharehazardoustohealthintheapartment,whichexceedthestandardregulatedbygover____ent,PartyBhastherighttoterminatethisAgreementimmediately.PartyAshallrefundthewholeamountofdepositandtheprepaidrenttoPartyB.6.6除本合同另有约定外,假设甲方违背此租约的任何条款并在乙方发出书面通知15天后仍未改正,乙方有权解除此租约,收回押金,且有权要求甲方支付相当于两个月租金的违约金,同时租金付至合同解除日。UnlessotheragreedinthisAgreement,PartyBshallhavetherighttoterminatetheLeaseAgreementwhenPartyAbreachestheLeaseAgreementandfailstoremedythebreachafterfifteen〔15〕daysofgivingwrittennotificationofPartyB.PartyBshallbeentitledtowithdrawthedepositandrequestPartyAtoundertakethepensationwhichequalstotwomonths'srent.TherentalshouldbepaidtilltheterminationofAgreement.第7条乙方权利和义务:Tenant'sRightsandObligations:7.1乙方应按期交纳押金、租金及其他费用。假设超过限定期限30个工作日,乙方无正当理由仍未支付的,那么甲方有权解除本租约,并要求乙方承当相当于两个月租金的违约金。PartyBshouldpaythedeposit,rentandotherchargesaccordingtotheAgreementterm.IfPartyBfailstopaytheabovementionedfeeforover30workingdayswithoutjustfulreason,PartyAhastherighttoterminatethisagreement,PartyBshallpayPartyAthepensationofamountwhichequalstotwomonth'srent.7.2租赁期内未经甲方同意,乙方不能转租其所租房屋,私自转租无效。Duringtheleaseterm,unlesswiththeagreementofPartyA,PartyBcannotsub-letorletinpartorinfulltheleasingPremises.7.3乙方应保护房屋及其设备,如因使用不当而导致损坏,乙方应负责赔偿。PartyBmusttakegoodcareoftheproperty;otherwisePartyBshouldpaypensationtoPartyAforhisimproperuseoftheproperty.7.4除房内已有的装饰和设施外,乙方如要增加设备或其他装修须征得甲方同意。租赁期满,乙方向甲方交还房产时,除双方另有约定外,应恢复其原状〔正常磨损除外〕未经甲方书面同意,乙方不得擅自设立、安装或挪动设施及设备,不能擅自设立隔断,不得擅自对房屋的构造改动或增加。Inadditiontothedecorationandequipmentalreadyintheproperty,ifPartyBwishestomakeanyalterationsordecorationtosuchproperty,PartyBshouldgettheconsentofPartyA.OnpletionoftheLeaseterm,PartyBmusthandoverthepropertytoPartyAinitsoriginalcondition〔exceptfornormalwear〕PartyBshallnoterect,installorremoveanyfixturesorpartitioning,ortomakeanystructuraladditionsandalterationswithoutthepriorwrittenconsentofPartyA.7.5由于乙方或乙方关联人员的粗心、忽略或成心而造成房屋的损害或损失的,乙方应当承当赔偿责任,并允许甲方或其受权人在事先通知后进入房屋,对房屋的损失或损害进展弥补及修复,由此所发生的费用由乙方负担。PartyBshallindemnifyPartyAfromanylossordamagestotheleasedpropertyfromnegligentactoromissionofPartyBoritsconnecterandshallpermitPartyAorhisauthorizedrepresentativeswithadvancenoticetoentertheleasedpropertytorepairanysuchlossordamageattheexpenseofPartyB.7.6租赁期间,乙方必须严格遵守中华人民共和国的有关法律、细那么、规章及法令的规定,不得利用房屋进展违犯法律及不道德的行为。Strictlytoplyandadhereintheusageoftheleasedpropertyaccordingtoalllaws,regulationsanddecreesofthePeople'sRepublicofChina,andspecificallynottopermittheleasedpropertytobeusedforanypurposethatisunlawfulorimmoral.第8条违约责任BreachofAgreement任何一方违背本协议的规定,或其他在本协议内所作的陈述、保证或承诺,造成另一方经济损失的,违背方应按照合同约定承当相应的违约责任和赔偿责任。AnyPartywhobreachestheprovisionsofthisAgreement,oritsrepresentations,warrantiesorconventsmadehereunder,causingtheotherPartyloss,shallbearresponsibilityforpensationaccordingtotheAgreementterm.第9条不可抗力ForceMajeure房屋由于火灾、恶劣天气、战争或其它不可抗力因素,而不是因为乙方直接或间接的忽略及成心行为造成房屋毁坏而不能被正常使用及居住时,乙方从该日起停顿支付租金,直至房屋可再被使用及居住时为止。假设甲方根据自己的意愿及经济、实际意义等原因认为没有必要修缮复原房屋时,应书面通知乙方,并在做出上述通知后三日内将押金及预付租金全部退还乙方。第10条适用法律及争议的解决:Legislation&ArbitrationoftheDispute:本租约受中华人民共和国法律的约束,如发生与本租约有关的争议,由双方友好协商解决,协商不成,按以下第_________种方式解决:〔1〕提交_________仲裁委员会仲裁;〔2〕依法向租赁房屋所在地人民法院起诉。1〕submitittoArbitrationmitteeforarbitration.2〕appealtothePeople'sCourtattheplacewheretheLeasingPremiseslocates.第11条通知Notice甲方和乙方特此约定,所有关于对方的权利或义务的交给对方的通知应书面做出,并由通信员、邮件、或急件信使送至扉页地址。任何一方名称或地址发生任何变更应立即书面告知对方,否那么应自行承当由于不能送达导致的法律后果。PartyAandPartyBagreeherebythatallnoticestobedeliveredtotheotherPartywithregardtoeitherParty'srightsorobligationsshallbeinwritingandbesentbymessenger,mail,facsimileorcouriertotheaddresseslistedatthecoverpage.Eachpartymustinformtheotherpartyimmediatelyanychangeofitsnameoraddressifany,otherwise,itshouldsolelytakethelegalresponsibilityresultedfromsuchdeliveryfailure.第12条其它:Others:12.1本租约未尽事宜,经甲、乙双方协商一致,可订立补充条款。本租约补充条款、附件均为本租约不可分割的组成局部,本租约正文及其补充条款、附件具有同等法律效力。12.2本租约自签字之日起生效,租约文本一式肆份,甲、乙两方各执两份,中英文具有同等法律效力。中英文条款及意思如有不一致之处,以中文为准。ThisAgreementshallbeeeffectonthedateafterthesigningbybothparties.Fouroriginalsshallbesigned.EachPartyshallholdtwocopiesofthisoriginalAgreement.AndtheagencyholdoneoriginalBothChinesetextandEnglishtextshallhavethesamelegaleffect.IntheeventthatthereisanydisagreementbetweentheChineseversionandEnglishversion,theChineseversionshallprevail.本租约于____年____月__日在_______签订。ThisAgreementisconcludedin_______on________.1〕出租方资料房屋产权证复印件/购房合同复印件ownershipcertificate/Purchasecontractcopy身份证复印件PartyA'sIDcard委托书复印件AuthorizationLetter2〕承租方资料营业执照复印件BusinessLicensecopy设备〔含家具〕清单房屋租赁合同〔英文〕出租方〔甲方〕Lessor〔hereinafterreferredtoasPartyA〕:承租方〔乙方〕Lessee〔hereinafterreferredtoasPartyB〕:根据国家有关法律、法规和有关规定,甲、乙双方在平等自愿的根底上,经友好协商一致,就甲方将其合法拥有的房屋出租给乙方使用,乙方承租使用甲方房屋事宜,订立本合同。一、物业地址Locationofthepremises甲方将其所有的位于上海市_________区____________________________________的房屋及其附属设施在良好状态下出租给乙方___________使用。PartyAwillleasetoPartyBthepremisesandattachedfacilitiesallownedbyPartyAitself,whichis
