中信银行个人贷款合同中英文版借钱人(以下简称甲方)：borrower(hereinaftercalledpartya):身份证件名称及号码：idnameandcodeno:idcardnumber住处：addressoflivingplace:联系电话：postcode:邮编：contactnumber:贷款人(以下简称乙方)：lender(hereinaftercalledpartyb):住处：addressoflivingplace:联系电话：postcode:邮编：contactnumber:抵押人：mortgager:身份证件名称及号码：idnameandcodeno:idcardnumber住处：addressoflivingplace:联系电话：postcode:邮编：contactnumber:出质人：pledger:身份证件名称及号码：idnameandcodeno:idcardnumber第1页共33页住处：addressoflivingplace:联系电话：postcode:邮编：contactnumber:保证人：guarantor:身份证件名称及号码：idnameandcodeno:idcardnumber住处：addressoflivingplace:联系电话：postcode:邮编：contactnumber:依据中华人民共和国合同法和担保法的有关规定，甲方、乙方和担保方经过磋商，就乙方向甲方贷款事宜完成以下合同条款。accordingtotherelevantlawsandregulationsofthecontractlawsandguaranteelawofthepeoplersquo;srepublicofchina,partya,partybandtherelevantguarantor,afterreachingagreementthroughnegotiationsontheloantopartybbypartya,herebyenterintothiscontract.第一条借钱金额article1amountofloan详见本合同第十四条第一款。第2页共33页underthiscontract.第二条借钱用途article2purposeofloan详见本合同第十四条第二款。2.1purposeofloanforthiscontractisreferredtoarticle15.2.第三条借钱利率article3interestofloan一、借钱利率详见本合同第十四条第三款。3.1interestofloanisreferredtoarticleloan.二、本合同执行时期，遇中国人民银行贷款利率调整，借钱利率按有关规定调整与执行，乙方将在营业场所对贷款利率调整状况进行通告，不再另行书面通知甲方。3.2duringthetermofthisloancontract,interestmaybechangedasprescribedbythepeoplersquo;sbankofchina,partybisentitledtoadjustandimplementtheinterestratewithoutfurthernoticetopartya.第四条借钱限期及还款总期数article4lifeofloanandtotalloanrepaymentterms一、借钱限期详见本合同第十四条第四款。第3页共33页4.1lifeofloanandtotalloanrepaymenttermsarereferredtoarticle14.4.二、实质借钱发放日与本合同商定的日期不一致时，以实质借钱发放日为准计算借钱限期。4.2intheeventthattheactualfundsreleasedateisindisagreementwiththedatestipulatedunderthiscontract,thelifeofloanshallbecalculatedbasedontheactualdayoffundsreleasing.三、甲、乙双方商定甲方如期还款，确立还款总期数，详见本合同第十四条第四款。第五条借钱发放article5releaseoffundsundertheloan一、乙方发放借钱的前提是甲方供给了切合乙方要求的证明资料，执行了乙方要求的申请借钱和担保手续，签订了申请借钱所需法律文件并经乙方审察赞同。5.1partybwillreleasethefundsunderconditionthatpartyahasprovidedevidencesplyingwithrequirementsofpartyb,andhaspletedtheloanapplyingandguaranteeingprocedures,andhassignedthelegaldocumentswith第4页共33页checkandapprovalofpartyb.二、甲方受权乙方在审查赞同后，将借钱直接划入甲方指定并经乙方认同的账户(账户名称、账号详见第十四条第五款)，即为乙方如约执行了向甲方供给借钱的义务。5.2afterfundsreleaseisapproved,partyawillgrantpartybtotransfertheloanintotheaccountdesignatedbypartyaandapprovedbypartyb(accountnameandaccountno.aregivenunderarticle14.5).三、本合同项下的借钱发放后，甲方就所购商品或服务发生的任何纠葛，均与乙方没关，本合同应正常执行。5.3afterreleasingoftheloan,anydisputesundertheuseoffundsunderthisloanbypartyahasnorelationshipwithpartyb,andthecontractwillstillbefulfilled.第六条借钱偿还article6repaymentoftheloan一、甲方应依据乙方有关贷款方法例定，在下述四种还款方式中选择一种方式送还借钱本息，甲方选择的还款方式详见本合同第十四条第六款：6.1partya,basedonrelevantregulationsofpartyb,shallselectwaysofinterestcalculation,interestsettlementandloanprincipalrepaymentunder第5页共33页article14.6.二、甲方应该于乙方规定的每期还款日(详见第十四条第六款)前，将当期应偿还的借钱本息及逾期的罚息、复利等足额存入在乙方开立的还款账户(账户名称及账号见第十四条第六款)，其实不行撤除地受权乙方于当期还款日直接从该账户划收应收款项。6.2thepartyashallpayofftheprincipal,interestandotheritemsinfullpriortothestipulatedduerepaymentdayunderthiscontract(detailsunderarticle15.6),bydepositingoneofanyrepaymentaccountopenedbypartyb(accountnameandaccountno.aregiveninarticle14.6),andirrevocablyauthorizespartybtodrawthefundsreceivabledirectlyfromtheaccountaboveontheduerepaymentday.三、甲、乙两方赞同依据先还息后还本的原则，乙方依据“期前逾期本息、罚息和复利-当期利息-本金”的次序扣划甲方还进款项。甲方违犯本合同商定，逾期或未按商定的金额送还借钱本息，乙方有权依据人民银行的规定对逾期借钱加收罚息。甲方逾期或未按商定的金额偿还借钱利息时，乙方有权按人民银行的规定对甲方未支付的利息计光复利。第6页共33页6.3incasepartyabreachesthecontract,failingtorepaythefundsonduedateorfailingtopayfundsinfull,partybhastherighttochargehigherinterestrateonoverdueloansasprescribedbythepeoplesbankofchina(penaltyinterestrateonoverdueloanisstipulatedunderarticle15.6).incasethatpartyafailstousethefundsfortheagreedpurposedunderthiscontract,partybhastherighttochargepenaltyinterestrateonoverdueloansasprescribedbythepeoplersquo;sbankofchina(penaltyinterestrateonmisappropriationofloanisstipulatedunderarticle15.6).foroverdueloanorloanofmisappropriateuse,partybshallcalculatetheinterestratebasedonpenaltyinterestratefromthedayofoverdueloanormisappropriateuseofloantilltheprincipalandinterestarepaidoff.ifpartyafailstopayofftheinterestonduedate,partybshallcalculatepoundinterestbasedonpenaltyinterestrate.第七条提早还款article7repaymentinadvance第7页共33页甲方如欲提早还款，应于拟提早还款日前三十天将提早还款申请书及还款计划以书面形式提交乙方，经乙方审察赞同后即为不行撤除。甲方经乙方审察确认甲方未有拖欠借钱本息及已还清当期本息后方可提早还款。提早还款日前已计收的利息不作调整。提早还款，乙方有权按提早还款金额的%计收损失赔偿金。7.1ifpartyaisabletopayofftheloanaheadoftime,itshallsubmittopartybtheirrevocableloanrepaymentapplicationandrepaymentplan.aftercheckingandconfirmingthatpartyahasnodelayofloanprincipalandinterestandhaspaidoffthecurrentinterest,partybwillapprovaltherepaymentaheadapplication,thenpartyacanrepaytheloaninadvance.theinterestrepayablebeforerepayment-in-advancedayshallnotbeadjusted.第八条借钱担保article8guaranteeofloan本合同项下的担保条款的效劳独立于本合同。甲方对借钱供给的担保可选择以下方式，详见本合同第十四条第八款。第8页共33页8.1theeffectivenessofguaranteetermsunderthiscontractisindependentofthiscontract.theguaranteetypefortheloanisspecifiedinarticle15.8.一、抵押担保mortgageguarantee(一)抵押人自发将本合同附件一“抵押物清单”所列明的财富(以下简称抵押物)抵押给乙方，作为甲方偿还本合同项下借钱的担保。propertyinguarantylist-theattachmentaofthiscontract,andagreestoberestrictedbythiscontract.(二)本合同抵押物的共有权人赞同将本合同项下的抵押物作抵押，并赞同受本合同拘束thiscontractagreestomortgagethepropertyandberestrictedbythiscontract.(三)抵押担保范围：scopeofguarantee本合同项下的借钱本金、利息(含复利)、罚息;8.3.1theprincipalofloan,interest(includingpoundinterest),penaltyinterestunderthiscontract;第9页共33页2.违约金、赔偿金、赔偿金;8.3.2penalty,pensation,reimbursement;为实现债权和抵押权而支付的花费(包含但不限于因违约方产生的律师费、抵押物处理费)。liabilityandguaranteeright(including,butnotlimitedtoattorneys'fees,assessmentfee,auctionfee,lawsuitfee,all-riskfee,travele_penseetc.).(四)抵押人一定依据法律规定办理抵押物的登记手续。抵押人向乙方供给该抵押物的所有权证明文件及有关资料，抵押登记证明文件正本交乙方保存。8.4themortgagershallpletetheregistrationofmortgagedpropertybasedonlawsandregulations.themortgagershalltakeonthefeesforthemortgagedproperty.themortgagershallprovidetothepartybtheevidencedocumentsandrelevantmaterialsofownershipoftheguaranty,andtheoriginalofmortgageregistrationcertificateshallbekeptbypartyb.(五)出现以下情况之一，乙方能够履行抵押权：第10页共33页8.4partybcane_ercisethemortgagerightincaseoneoffollowingsituationshappens:甲方债务执行限期届满，乙方未受清账或未受完好清账的;(1)partyafailstorepaythedueloanpayableand/orotheritemspayablebasedonthiscontract;甲方违犯本合同的商定，乙方宣布提早回收借钱，乙方未受清账或未受完好清账的;(2)partybreachesthecontract,partybclaimstotakebacktheloaninadvance,andpartybfailstobepaidoffornotfullypaidoff;抵押人违犯本合同的商定，私自处罚抵押物，或实行足以使抵押物价值减少的行为，乙方要求抵押人恢还原状或许供给担保遭拒绝，乙方能够提早履行抵押权。themortgagerbreachesthecontractbydisposingtheguaranty,orimplementsactionenoughtodecreasethevalueofguaranty,andpartybisrefusedofrestoringtheguarantytooriginalvalueorprovidingguarantee,partybcane_ercisethemortgage第11页共33页rightinadvance.(六)乙方可选择以下方式之一实现抵押权：partybcanselectanyoneofthefollowingwaystorealizethemortgageright:1.与抵押人协议以抵押物折价受偿;discountofmortgageinagreementwithmortgager;2.拍卖受偿;(2)auctionofguaranty;变卖受偿;(3)saleofmortgage;法律赞同的其余方式。(4)otherwaysallowedbylaw.(七)抵押人应向乙方供给抵押物的权益证书及其余有效证明文件和相应资料，经乙方确认后，由乙方保存。themortgagershallprovidetopartybtheownershipcertificateandothervalidcertificationdocumentsandrelevantmaterials,afterconfirmationofpartyb,alldocumentationaforementionedshallbekeptbypartyb.(八)甲方还清所有贷款本息及其余对付款项，并执行了本合同的所有条款，则抵押关系停止。underconditionthatpartyapaysoffthetotalloanprincipalandinterest,第12页共33页andinfulfillmentofallitemsunderthiscontract,themortgagerelationshipshallterminate.(九)抵押权存续时期，抵押人应将其所知道或应该知道的对抵押权产生或可能产生不利影响的情况实时书面通知乙方。withintheperiodofmortgage,themortgagershallinformthepartybinawrittenwayallsituationsheknowsorshouldknowthathaveproducedormayproduceadverseimpactontheguaranty(十)抵押权存续时期，抵押人对抵押物应该妥当保存;负有维修、养护、保持抵押物完好无损的义务并随时接受乙方的监察与检查。withintheperiodofmortgage,theentireguarantyshallbetakengoodcareofbythemortgager,whoaswellresponsibleforrepairandmaintenancetomakesurethattheguarantyisallpreservedwell,andsubjecthimselftothesupervisionandinspectionfrompartybatanytime.(十一)抵押权存续时期，抵押人的行为足以使抵押第13页共33页物价值减少时，乙方有官僚求抵押人停止该行为，并要求抵押人在十天内恢复抵押物的价值或许供给与减少价值相当的担保。withintheperiodofmortgage,shouldanydecreaseshappenowingtotheactionofmortgager,partybhastherighttorequestthemortgagertostoptheactionandrestorethevalueorprovideguarantyworththeequalvalueofthedecreaseswithinten(10)days.(十二)抵押权存续时期，抵押人能够将抵押物出借、(在抵押行为建立后)出租;抵押人在从事上述行为前，均需实时通知贷款人，若上述行为影响债权安全，贷款人有官僚求抵押人严禁实行上述行为。未经乙方书面赞同，甲方不得转让、更改、赠与抵押物。withintheperiodofmortgage,withoutanywrittenapprovalfrompartyb,themortgagershallhavenorighttodisposetheguaranty(disposingwayincludes,butnotlimitedto,transferring,renting,selling,donatingthe第14页共33页guaranty).(十三)抵押权存续时期，经乙方赞同的抵押物转让所得价款，应提早清账本合同项下的债务或转为按期存款质押。8.4.12withintheperiodofmortgage,anymoneygotbytransferringtheguarantybasedontheapprovalofpartybshallbeusedforpayingofftheloanaheadofscheduleorchangedtofi_eddepositforguarantee.(十四)抵押人应该依据乙方的要求购置抵押财富等保险并以乙方为优先受偿人，且不得商定任何有损乙方权益的条款。保险限期应擅长借钱限期，如本合同借钱展期，抵押人赞同持续办理抵押物延伸投保的手续。保险单和续保单正本由乙方保存。如抵押人拒绝办理续保手续，乙方能够取代抵押人直接手理续保手续，续保花费由抵押人担当。aspertherequestsofpartyb,themortgagershallgiveaninsurance第15页共33页e_tended,themortgagershallagreeontherenewalinsurancefortheguaranty.theoriginalsofinsurancepolicyandrenewalordershallbekeptbypartyb.ifmortgagerrefusese_tendingtheinsuranceterm,partybhastherighttodealwithinsuranceterme_tendinginsteadofmortgager,andtherenewalinsurancecostshallbetakenonbythemortgager.shouldanylossescausedbyrefusalofinsuranceorrenewalinsurance,orfailingtopayfortheinsurancefrommortgager,themortgagershalltakeonthem.(十五)抵押权存续时期，抵押人不得中止或许撤除上述保险。withintheperiodofmortgage,themortgagershallnotdiscontinueorcanceltheabovementionedinsurance.(十六)抵押权存续时期，抵押物发生保险事故，保险赔偿金应该用于提早清账本合同项下的债务。withintheperiodofmortgage,shouldanyaccidenthappenstotheguaranty,insurancepensationshouldbeusedforpayingofftheloanunderthiscontractaheadofschedulewithpriority.(十七)乙方与甲方更改本合同(包含但不限于借钱金额、限期、利率、结息方式、还款方第16页共33页式，还款期数、每期还款额)，只需不加重抵押人的责任，无须征得抵押人赞同，抵押人仍担当担保责任。whenpartybandpartyachangethecontract(including,butnotlimitedto,amountofloan,termofloan,interestrate,typeofinterestsettlement,typeofrepayment,periodofrepayment,repaymentamountforeachperiod),themortgagerisnoneedtobenotifiedifresponsibilityofmortgagerisnotincreasedaccordingly,andthemortgagerisstillbearthere
