uralproducts--s.25(2)(2)AninspectorwhoseizesaperishableagriculturalproductunderthisActmaydisposeofordestroytheproductandanyproceedsrealizedfromitsdispositionshallbepaidtotheReceiverGeneral.Redeliveryondepositofsecurity--s.2626.InproceedingsforaviolationtheTribunalmay,andinproceedingsforanoffenceunderthisActthecourtinwhichtheproceedingsareormaybebroughtmay,withtheconsentoftheMinister,orderredeliveryofathingseizedunderthisAct,ordeliveryofanyproceedsrealizedfromitsdispositionundersection25,tothepersonfromwhomthethingwasseizedifsecurityisgiventotheMinisterinanamountandformsatisfactorytotheMinister.DISPOSITIONOFTHINGSSEIZED-26DISPOSITIONOFTHINGSSEIZED--ss.25to29Detention--s.27(1)27.(1)AthingseizedunderthisAct,ortheproceedsrealizedfromitsdispositionundersection25,shallnotbedetainedafter(a)aninspectordeterminesthatthethingisinconformitywiththeprovisionsofthisActandtheregulations,or(b)theexpirationofonehundredandeightydaysafterthedayofitsseizure,orsuchlongerperiodasmaybeprescribed,unlessbeforethattimeproceedingsareinstitutedinrelationtothethingseized,inwhichcaseitmaybedetaineduntiltheproceedingsarefinallyconcluded.Applicationforreturn--s.27(2)(2)Subjecttosubsection28(2),whereproceedingsareinstitutedinaccordancewithsubsection(1)inrespectofathingseized,otherthananagriculturalproductbearinganagriculturalproductlegendoragradename,theownerofthethingorthepersoninpossessionofitatthetimeofitsseizuremayapply(a)inthecaseofaviolation,totheTribunal,or(b)inthecaseofanoffence,tothecourtbeforewhichtheproceedingsarebeingheld,foranorderthatthethingbereturned.DISPOSITIONOFTHINGSSEIZED-27DISPOSITIONOFTHINGSSEIZED--ss.25to29Order--s.27(3)(3)WheretheTribunalorcourt,asthecasemaybe,issatisfiedthatsufficientevidenceexistsormayreasonablybeobtainedwithoutdetainingthething,theTribunalorcourtmayorderittobereturnedtotheapplicant,subjecttoanyconditionstheTribunalorcourtmayimposetoensurethatitispreservedforanypurposeforwhichitmaysubsequentlyberequired.Forfeiture--s.28(1)28.(1)WheretheTribunaldecidesthatapersonhascommittedaviolation,orapersonisconvictedofanoffenceunderthisAct,theTribunalortheconvictingcourt,asthecasemaybe,may,onitsownmotionorattherequestofanypartytotheproceedings,inadditiontoanypenaltyorpunishmentimposed,orderthatanythingbymeansoforinrelationtowhichtheviolationoroffencewascommitted,oranyproceedsrealizedfromitsdisposition,beforfeitedtoHerMajestyinrightofCanada
