2、OUR PROCLAMATIONWHEREAS,t has become necessary to amendthe Labour Proclamation No.377/2003;NOW/THEREFORE, in accordance with SubArticles(1)and(3)of Article 55 of the Constitution of the Federal Democratic Republic of Ethiopia, it is hereby proclaimed as follows;1、 Short TitleThis Proclamation may be

3、 cited as the “Labour(Amendment) Proclaimed NO.494/2006”2、 AmendmentThe Labour Proclamation NO.377/2003 is hereby amended as follow:1/ The provision of (c) of Sub-Article 2 of Article 3 is deleted and replaced by new provision (c) of Sub-article 2 of Article 3”(c) managerial employee who is vested w

4、ith powers to pay down and execute management policies by law or by delegation of the employer depending on the type of activities of the undertaking with or without the aforementioned powers an individual who is vested with the power to hire, transfer, suspend, layoff assign or take disciplinary me

5、asures against employees and include legal service head who recommend measures to be taken by the employer regarding managerial issues by using his independent judgment in the interest of the employer;2/ The following new provisions (g),(h)and宣告 NO.494/2006文告提供劳动公告的修订鉴于,2003年第377号劳动宣言有必要修 改;现在,按照Sub

6、 Articles(1) 和埃塞俄比 亚联邦民主共和国宪法”第55条第(3)条规 定,现宣布为如下;1、简明目录本公告可引称为“劳动(修订)宣告 NO.4 94/2006 ”2、修正内容劳动公告NO.377/2003现修改为如下:1/ 劳动公告 NO.377/2003 的第 3 2 )(c) 条规定删除,取而代之的是新规定的第3 2 ) (c)条规定(2)根据法律去落实和执行管理制度的管 理雇员,或者是根据企业工作性质,拥有或者 不拥有上述权利的、被授权去对雇员进行雇 佣、调换、推迟、停职、指派或执行纪律的个 人,还包括给雇主根据雇主利益给提供管理措 施建议的法律服务的主要负责人。2/下面的新

7、规定(g) (h) (i)都添加在劳动公告NO.377/2003的第39 1 )条的规定(1) are added to Sub-Article(1)of Article 39 :a) ) where he has no entitlement to a provident fund or pension right and his contract of employment is terminated upon attainment of retirement age stipulated in the pension law;h) where he has given service t

8、o the employer for a minimum of five years and his contract of employment is terminated because of his sickness or death or his contract of employment is terminated on his own initiative provided that he has no contractual obligation, relating to training, to serve more with the employer ”i) where i

9、s contract of employment is terminated on his own initiative become of HIV/AIDS.3/ Sub-Article(6) of Article 130 is deleted and replaced by the following new Sub-Article(6):6) parties to a collective agreement shall commence negotiation to amend or replace their collective agreement within 3 months

10、before the expiry date of the validity period of the collective agreement; provided however, that if the negotiation is not finalized within 3 months from the expiry date of the collective agreement relating to wages and other benefits shall cease to be effective. ”4/ Article 185 is deleted and repl

11、aced by the following new Article 185:“185. 12、/2003 的第 130 (6) 条规定被删除并替换成下面(6)的新规定:6)在集体协议的有效期届满日期前 3个月 内,集体协议的各方应谈判出是否修改或取代 他们的集体协议;然而,如果谈判没有最终确 定,有关工资及其他福利的集体协议在到期日 3个月内将不再是有效的。4/劳动公告NO.377/2003的第185条被 删除,取而代之的是新的185条:“185.一般过错1/以下的一个雇主,一个商会,一个雇员或 代表:a)违反该法的条款,或者该法颁布的雇员 安全相关的法令或指令,以及导致雇员的生命 或健康处于危险境地,或者没有按照本法对女 雇员和年轻雇员实施特殊保护;b)违反该公告”第160条的规定;

13、c)由劳务检查员根据本宣言和其他法律的 规定检查出不符合给出的顺序;d)给主管机关故意作虚假信息或解释应经定罪,可处罚款不超过1200比尔2/雇主,工会,雇员或雇主代表违反本 公告的第130 (2)或(4)的条款,应经定罪, 可处罚款不超过10000比尔3、生效日期该公告颁布在 Federal Negarit Gazeta报上之日起生效协定于亚的斯亚贝巴,2006年6月29日埃塞俄比亚联邦共和国总统:GIRMA WOLDEGIORGISa) Violates the provisions of this Proclamation, or regulations or directives is

14、sued hereunder relating to the safety of workers and commit an act which expose the life or health of a worker to a serious danger, or does not give special protection to women workers or young workers as provided for in this Proclamation;b) contravenes the provisions of Article 160 of this Proclama

15、tion;c) Does not comply with the order given by a labour inspector in accordance with this Proclamation or the provisions of other laws;ord) Gives intentionally false information or explanations to the competent authorities;Shall be liable to a fine not exceeding Birr 1,200e) An employer, a trade un

16、ion, a worker or representative of employer which contravenes Sub-Article(2) or (4) of Article 130 of this Proclamation shall be liable to a fine not exceeding Birr 10,0003. Effective DateThis Proclamation shall enter into force on the date of its publication in the Federal Negarit Gazeta.Done at Ad

18、ATWHEREAS, it is essential that worker-em-ployer relations are governed by the basic Principle of rights and obligations with a view to enabling workers and employers to maintain Industrial peace and work in the spirit of harmony cooperation towards the all-round development Of our country;WHEREAS,

19、it has been found necessary to guarantee the right of workers and employers to form their respective associations and to engage, throughtheirlawfulelectedrepresentatives, In collective bargaining , as well as to lay down the procedure for the expeditious settlement of labour disputes, which arise be

20、tween workers and employers;WHEREAS, it is necessary to strengthen and define by law the powers and duties of the organ charge with the responsibilityof inspecting, inaccordance with the law, labour administration, particularlylabour conditions,occupationalsafety, health and work environment;WHEREAS

21、,it has been found necessary to revise the existing labour lawproviding for the basicprincipleswhich govern worker-employerrelations and for labour conditions taking into account the political,economic and socialpolicies of the government and in conformity with the internationalconventions and other

22、legal commitments to which Ethiopia is a party with a view to translating into practice the objectives referred to above;NOW, THEREFORE, in accordance with sub-article1 and 3 of article 55 of theconstitution of the federal democratic republic of Ethiopia, it is hereby proclaimed as follows:PARTONE G

Short TitleON2003年第377号宣言%动旦百鉴于,在我们国家的发展建设过程中,为 了使工人与雇主之间在协调与合作的精神下 和平工作,需要一些基本法则来规定工人与雇 主之间的权利与义务;鉴于,为了使工人与雇主之间相互尊敬、 为了使双方有法可依、以及为了有据可循的解 决雇主匕工人之间的争端,有必要明确雇主与 工人的权利;根据法律,劳动管理部门,尤其是劳动条 件、岗位安全、健康和工作环境,有必要通过 法律来加强责任监察部门的权利与义务。为了雇主和工人之间的关系,为了纳入政 治、经济和社会制度范畴的劳动条件,为了与 国际社会惯例以及其他埃塞俄比亚加入的组 织惯例接轨,

24、有必要修改现有的劳动法。现在根据埃塞俄比亚联邦共和国宪法第55条款第3条第1项规定,做出宣言如下:第一部分 概述1.简称本宣言命名为“第377/2003.号劳动宣言”This proclamation may be cited as the labour proclamation no. 377/2003.2. DefinitionsIn this proclamation:1) employer means a person or an undertaking who employs one or more persons in accordance with article 4 of th

25、is proclamation;2) undertaking means any entity established under a united management for the purpose of carrying on any commercial, industrial, agricultural, construction or any other lawful activity;Any branch carrying on the activities of an undertaking which is designated separately and which en

26、joys operational or organizational autonomy shall be deemed to be a separate undertaking;3) worker means a person who has anemployment relationship with an employer in accordance with article 4 of this proclamation;4) minister or ministry means the minister or ministry of labour and social affairs r

27、espectively or bureau of regional labour and social affairs.5) work rules means, subject to theprovision of this proclamation and other relevant laws, an internal rules which govern working hours, rest period, payment of wages and the method s of measuring work done, maintenance of safety and the pr

28、evention of accidents, disciplinary measures and it s implementation as well as other conditions of work;6) conditions of work means the entire field of relations between workers and employers and shall also include hours of work, wage, leave, payments due to dismissal, workers health and safety, co

30、动或 者社会事务、以及地方性劳动或者社会事务部 长或者部门。5) “工作规定”指从属于本宣言和其他 相关法律,对工作时间、休息时间、薪水支付 以及工作计量、安全维护和事故措施、劳动纪 律及实施、以及其他劳动条件做出规定的一种 内部规定。6) “工作条件”指和雇主与工人之间的 关系,以及包括工作时间、薪水、请假、解雇 支付、工人健康与安全、工作伤害赔偿、因为 人员过剩等进行解雇、以及其他所有的类似事 情的相关的所有内容。7) “地区”指埃塞俄比亚联邦共和国宪 法第47条规定的地区。本宣言中的地区还包 括亚的斯亚贝巴和戴尔达瓦区。3 .适用范围1)不影响本第3(2)条相关规定,本宣言适用7) re

For the purpose of this proclamation it also include Addis Ababa and dire Dawa administration.3. Scope of application1) Without prejudice to sub-article (2) of this article, this proclamation shall

32、 be applicable to employment relation based on a contract of employment that exist between a worker and an employer.2) This proclamation shall not be applicable to the following employment relations arising out of a contract of employment:a) Contractsforthepurposeofupbringing, treatment, care or reh

33、abilitation;b) Contractsforthepurposeofeducating or training other than apprentice;c) Managerial employee who is vested with powers to lay down and execute management policies by law or by the delegation of the employer depending on the type of activities of the undertaking with or without the afore

34、mentioned powers and individual who is vested with the power to hire, transfer, suspend, layoff, assign or take disciplinary measures against employees and include professionals who recommend measures to be taken by the employer regarding managerial issues by using his independent judgement in the i

35、nterest of the employer;d) Contracts of personal service for non-profit making purposes;e) Contracts relating to persons such as members of the armed force, members of the police force, employees of state administration, judges of courts of law, prosecutors and other whose employment于基于雇主和工人之间签订雇佣合同的所有 雇佣关系2 )本宣言不适用于以下不基于雇佣合同 的所有雇佣关系:a )以抚养、治疗、照顾为目的的合同b)不是学徒性质的以教育和培训为目的 的合同c )根据法律去落实和执行管理制度的管 理雇员,或
