1、建设工程安全管理协议建设工程安全管理协议Construction Project Safety Administration Agreement(LS-Ex3 Version 3.0)发包方TheOwner ：（甲方Party A)承包方TheContractor ：（乙方Party B)甲方将本建设工程项目（ “工程项目 ”）发（分 ）包给乙方施工 ,为贯彻 “安全第一、预防为主 ”的方针，根据国家和项目 当地有关法规、规定，为明确双方的安全生产责任，双方在 签订本项目主合同的同时， 签订本协议。 甲方和乙方合称 “双 方”，单独称作 “一方 ”。In connection with con

5、安全生产、防火安全、治安保卫管理等制度。鉴于甲方已 建立了 OHSAS18001 职业健康安全管理体系，乙方在甲方 区域工作期间，应遵守甲方相关规定。Parties shall strictly comply with the requirements of the laws, regulations, ordinances and codes at national level and local level, establish an effective safety administration organization, and set comprehensive safe work

6、responsibility system and regulations on safe work, fire protection and public security administration. In view of the fact that Party A has established its occupational health and safety administration system in compliance with OHSAS18001, Party B shall comply with relevant requirements of Party A

7、while performing the work/service onParty As site.2. 甲方的安全保卫部门作为业主安全管理委员会的常设安 全机构对甲方区域内的安全生产工作实施综合监督管理。 甲 方 的 项 目 主 管 部 门 指 派 部 门 / 区 域先生 /女士负责本项目的业务管理和协调工作， 传达 甲方的安全管理要求，并对乙方的安全、防火、治安工作情 况实施监督。乙方单位主要负责人或项目经理依法对其在甲方的工程项目的安全生产工作全面负责， 是工程项目的安全生产、防火安全以及治安防范第一责任人，并指派专职安全干部 先生 /女士全面负责该项目的安全、防火和治安管理。Actin

8、g as the standing safety organization of the Owner s safety administration committee, SFS (Safety, Fire-protection & Security) shall furnish comprehensive superintendence and administration on behalf of Party A on safe work of any project at Party A s sites. The department in charge of Work implemen

9、tation of Party A appoints from (Department/Section) to be responsible for administration and coordination of the Work, relaying Party A s requirements on safety administration, and supervising Party B s safety, fire protection and public security affairs. Party B s leading superintendent or project

10、 manager bears exclusive responsibilities for safe work at Party A s site, and shall be the primary superintendent as the full-time safety administrator who will be responsible for the safety, fire protection and public security administration of the Work.3. 甲方应就施工 (作业) 现场及毗邻区域的情况和注意事项 (如：涉及到的地下管线、相

11、邻建构筑物、地下工程等)告 知 乙方，并做书面记录，双方确认后一式二份，由双方项目部 各执一份。Party A shall notify Party B the detailed conditions and precautions of the construction/Work site and its surroundings, such as the underground conduit and lines, the adjacent constructions and the underground projects. Two copies of documentation sha

12、ll be confirmed by Parties and shall be held respectively by its project department.4. 甲方应对乙方单位主管领导或项目负责人以及专职/兼职安全干部进行安全生产进场前安全教育培训、安全技术交 底，介绍有关安全生产管理制度和要求。 如本工程项目分包给其他 单位，乙方必须与分包单位签订合同及安全协议，并在合同 或安全协议中明确各自的安全生产权利、义务，乙方对该工 程项目的作业安全生产负总责。Party A shall provide pre-task safety training and briefing on

13、safety work and introduction of the safety administration systems and requirements to Party B s managing staffs or project superintendents and full-time or part-time safety administrators. In case that the Work is subcontracted, Party B shall sign the contract and safety agreement with the Subcontra

14、ctor in which the respective safety rights and duties on safe work shall be specified. Furthermore, Party B shall be solely responsible for the safe work of the Work.5. 乙方应与分包企业签订安全协议， 明确相互安全管理的权 利与义务。Party B shall sign the safety agreement with its subcontractors to specify the respective rights an

15、d duties on safety administration.6. 乙方应遵照 建筑施工企业安全生产管理机构设置及专职 安全生产管理人员配备办法 配置足够的专兼职安全管理人 员。Party B shall provide enough properly trained full-time and part-time administrators in accordance with the requirements of the Regulations on the Establishment of the Administration Organization for Safe Wor

16、k and the Designation of the Full-time Safety Administrators.7. 乙方应依据国家法律法规以及根据甲方的安全管理规定 编制相应的安全规章制度，并对项目作业进行工作危险分 析，填 写危险分析表，制定有针对性的安全技术措施计划，并严格 落实执行。乙方应遵照危险性较大工程安全专项施工方案 编制及专家论证审查办法编制各施工组织设计方案，并上 报监理公司审核和甲方备案。如施工中遇架空管线、地下管 线或其它障碍物等可疑情况， 乙方应及时与甲方有关部门联 系，采取对策。Party B shall prepare relevant safety re

17、gulations in accordance with the requirements of national laws, regulations, ordinances and codes and Party A s safety administration requirements as well as fill in risk analysis forms after making risk analysis on the Work. Party B shall establish and strictly execute the specific safety technolog

18、y plans. Party B shall prepare Work plan schemes in connection with Special Construction Schemes on High-risk Project Safety and the Regulations on Experts Reasoning and Reviewing, and submit them to Supervision Company and Party A as the written records. Upon the occurrence of doubtful situations s

19、uch as lifted pipes and lines, underground conduit or other barriers, Party B shall promptly contact relevant departments of Party A as well as take corresponding measures.8. 乙方必须对本单位员工进行三级安全教育培训， 增强员工 安全、防火及治安防范法制观念，提高员工的安全意识和自 我 保护的能力，督促员工自觉遵守各项安全规章制度。乙方保证进入施工现场的设备、设施、特殊工具安全可靠，实行设备设施验收挂牌制度。在作业过程中应

20、强化日常检查、维修保养制度，发现隐患后应立即停止作业，并制定计划落实整 改。Party B shall provide three-tier safety training to its employees in order to strengthen their legal awareness on safety, fire protection and public security prevention, enhance the sense of safety and self-protection expertise, and urge them comply with various

21、 safety regulations. Party B shall guarantee the safety and reliability of the equipments, facilities and special tools transported from the off-site location to the jobsite and implement the acceptance and hanging out a shingle system to the equipment and facilities. Furthermore, Party B shall cons

22、olidate regulations on routine inspection and maintenance. Party B shall immediately terminate the performance of the Work and take corrective measures and conduct corrective action upon discovery of hidden hazards and problems.9. 乙方应确保与工程项目有关的项目管理人员、 安全管理人 员、特种作业人员等持有效证件上岗。Party B shall ensure that

23、 its project administrator(s), safety administrator(s) and special on-site personnel to obtain validqualification before their assignment to work on-site.10. 乙方应向作业人员提供劳动防护用品，并着装、标识统 一（须与甲方有所区别） ；乙方人员进入甲方的生产区域或 其他特定区域，应同时遵守该区域的劳防用品佩戴规定。Party B shall furnish its on-site personnel with proper PPE and

24、unified clothes and marks that shall be different from Party A s. When entering into Party A s premises or other specific sites, Party B s personnel shall comply with the requirements on wearing of PPE in this location.11. 乙方聘用员工必须符合国家劳动法规要求，有合法的用 工手续并签订用工合同， 并按国家规定为作业人员办理工伤 保险、意外伤害保险。 若聘用外省市人员必须根据本

25、地相关法规办 妥相应的手续。Employment of its personnel by Party B shall be in compliance with the requirements of labor laws and regulations. Party B shall hold legitimate certificates to employ personnel and sign employment contract with the employees, and purchase work related insurance and accidental insuranc

26、e as required by the laws. Party B shall acquire all government approvals necessary for employing its personnel out of the local area.12. 乙方员工应按要求在指定门岗、区域出入口进出。进入 甲方地域期间，必须全程佩带甲方发放的卡证。乙方员工不 得将本卡证借给他人使用， 乙方人员不得进入与本人工作无关的 区域。乙方因合同终止，员工离职或调离时，必须及时将卡 证归还甲方，预期不交还所引发的一切后果由乙方承担。Party B s personnel shall en

27、ter into and exit from Party A s premises only through designated entrance and locations. Gate entrance badges provided by Party A shall always be worn by Party B s personnel while entering into Party A s premises. These badges shall not be lent by Party B s personnel to any third party. Party B s p

28、ersonnel shall not be permitted to enter into a site that is irrelevant to their assigned work. Upon the termination of the Contract and the dismissal or removal of its personnel, Party B shall promptly return the gate badges to Party A; otherwise, all corresponding obligations and liabilities arisi

29、ng hereinafter shall be borne by Party B.13. 乙方货物车辆进出应该严格遵守甲方相关规定，并接受 甲方门岗检查。Any vehicle of Party B entering or leaving Party A s jobsite10 shall be strictly in compliance with Party A s relevant requirements and subject to inspection by Party A s gatekeeper.14. 乙方带入甲方厂区内的设备设施必须经检验合格后投入 使用，并向甲方提供检验证

30、明。乙方必须根据国家法规要求 按时做好其特种设备维护保养及检测取证工作， 确保使用的特种 设备在检测有效期内。Party B s facilities and equipments transferred from the off-site location to Party A s premises can be put into use only after they have passed the testing process and upon the submittal of the testing certificates to Party A. PartyB shall prom

31、ptly execute the maintenance and test certification on its special types of equipments as the requirements of national laws, regulations, ordinances and codes to warrant that they are operated within the testing term of validity.15. 如甲方同意乙方使用其机器设备，乙方对工具和设备是 否能够满足预期的任务承担全部责任， 乙方并应仔细对工具 和设 备进行检查，对可能导致

32、安全事故的工具和设备的损害、缺 陷或不足在使用前进行整改。 乙方对由于使用甲方工具和设11 备引发的事故负全责。If Party A consents to Party B s use of its tools and equipment, it is Party B s sole and exclusive responsibility to determine whether the equipment is adequate to safely perform the contemplated tasks and to carefully inspect the tools or equ

33、ipment and correct any damage, defects or other deficiencies that may present a safety hazard prior to its use. Party B is solely and exclusively responsible for the accidents arising from the use of Party A s tools and equipment.16. 乙方应加强对于员工及分包商的安全管理，以达到甲方 的要求。如甲方认为乙方的作业存在风险，甲方有权暂停乙 方作业，并不承担任何因素造成

34、的损失。Party B shall consolidate safety administration on its personnel and subcontractors so that they perform their work in a manner consistent with the requirements of Party A. In case that Party A reasonably deems Party B s performance is resulting in potential hazards, Party A has the right to sus

35、pend Party B s performance without any liability for any loss.17. 甲方对于乙方施工方案的审批，各类申请的批准不涉及 任何安全责任上的承担， 乙方在合同项下的以及依法承担的12 安全 责任不因此而转移至甲方。Party As approval of Party Bs construction schemes or of Party Bs various applications shall not impose upon Party A any liability for Party B s safety administrati

36、on and shall not exempt Party B from any liability under the Contract or subject to the laws.18. 乙方应迅速对于甲方关于违反安全的情况的置疑进行反 馈。如果乙方无法遵守甲方的安全要求， 不能保证安全作业， 甲方保留经济处罚的权利。Party B shall promptly response to Party A s challenge to its breach of safe work. In case of Party B s failure to comply with Party As r

37、equirements on safe work or Party B s failure to ensure the safe performance of the Work, Party A will reserve the rights to impose economic sanction on Party B.19. 乙方不得擅自变更或改变甲方所提供厂房、办公场所、 电力线路以及设施设备的建筑结构和用途、使用性质等。乙 方若需搭建临时设施时必须向甲方项目主管部门办理审批手续， 在施工区域内禁止搭建食堂和宿舍。13Party B is not permitted to modify o

38、r change the construction frame, the purposes and functions of the workshops, offices, electrical lines and other facilities provided by Party A. Any Party B s need to build any temporary facilities or infrastructure shall be approved by Party A and Party B is not permitted to build any eatery or do

39、rmitory on Party A s premises.20. 乙方应严格执行甲方的建设项目安全管理规范等相 关安全管理制度要求。Party B shall strictly carry out Party A s requirements of the safety regulations such as the Safety Administration Regulations on the Construction Projects.21. 甲乙双方的人员，对作业现场的各类安全防护设施、安 全标志和警告牌，不得擅自拆除、更动。如确有需要拆除变 更，必须经项目负责人 /经理和甲乙双方指

40、派的安全代表同意， 并 采取必要、可靠的安全措施后方能拆除。任何一方均须对其 人员擅自拆除所造成的后果负责。The personnel of Parties are not permitted to dismantle or change any safety facility, safety sign and warning board at the job-site. Unless otherwise approved by the project superintendent/ manager and the safe work representatives14 designated

41、by Parties, these facilities shall not be dismantled or removed without necessary and reliable safety measures. A Party shall assume any loss arising from the deliberate dismantling by its employees.22. 根据 “谁主管、谁负责 ”的原则，当发生事故，乙方应根 据有关法律规定立即上报，调查，处理事故，并及时通知甲 方。According to the principle of “ AP arty

42、who supervises theWork shall be held accountable for it ”, upon the occurrence of an accident, Party B shall report, investigate and dispose as well as notify Party A the accident pursuant to the requirements of the laws.23. 甲方人员不得指派乙方人员实施合同外的作业，乙方应 拒绝项目外的作业任务， 否则由此造成的一切后果由有关方 负责。Party A s personnel

43、 shall not designate Party Bs personnel to conduct and Party B shall reject to conduct tasks not included in the Agreement; otherwise, all negative effects shall be borne by the defaulting Party.24. 乙方只有在得到甲方许可下才能携带化学品、压力容器 进入甲方地域。Party B will not be permitted to carry any chemicals or15 pressure ve

44、ssels into Party As premises without Party A s prior consent.25. 如果证明乙方不具备达到甲方期望的安全状况的能力， 甲方有权终止合同，并不承担任何损失。Party A has the right to terminate in its sole discretion the contract without liability for any loss in occurrence of Party Bs failure to satisfy Party A s requirements on safe work.26. 乙方对职业

45、健康安全特别承诺如下：Party B hereby makes the following special commitments concerning occupational health & safety (OHS): 26.1 贯彻 “健康与安全第一 ”的原则，遵守适用的法律法规及其他要 求；Party B shall implement the principle of “ OHS activities possess an overriding priority” and abide by the applicablelaws, regulations, ordinances an

46、d codes and other requirements.26.2 强化设施设备及化学品的管理，不断降低风险；Party B shall strengthen management of facilities, equipment and chemicals to continuously reduce risks.26.3 实施标准化管理， 制定有效的工作程序和标准， 通过过 程控制来完成预定的目标；Party B shall carry out standardized management, establish16 effective work procedures and crit

47、eria, and achieve pre-determined objectives through process control.26.4 为员工和外来人员提供安全培训和指导；Party B shall provide safety training and instruction to its employees and external personnel that will perform the Work at Party A s jobsite.26.5 创造安全的工作环境，不断提高职业健康安全绩效。Party B shall create safe work environment to continuously improve its performance on OHS.27. 本协议经双方签字、盖章有效，作为合同正本的附件一 式四份，甲方执三份(一份由安全保卫部门备案、一份由业 务主管部门备案、一份由采购部门备案) 、乙方执一份。Each Party has caused four copies of this Agreement to be signed and delivered by its duly aut
