Page 10 of 10莫仕公司供应商行为准则MOLEX INCORPORATEDCODE OF CONDUCT FOR SUPPLIERS前言Introduction莫仕公司期望在和供应商发生业务往来的时候,对方能够依照莫仕公司的供应商行为准则进行操作,当供应商通过转包商(或临时劳务中介)生产元器件生产及材料提供给莫仕公司,供应商必须向其阐述莫仕公司的供应商行为准则,并确保转包商同样遵守此准则。任何违背本准则的行为将成为莫仕公司终止其合同,并且可能导致将此供应商从莫仕批准供应商名录中除名的充分依据。Molex has a Code of Conduct for its suppliers and expects them to comply with this code in its business dealings. Where a supplier uses a subcontractor (or makes use of a temporary labor agency) to work on components or materials supplied to Molex, the expectation is that the supplier has issued this Code of Conduct to the subcontractor and that this subcontractor also complies with this code. Failure to comply with this Code of Conduct will be sufficient grounds for Molex to terminate its contract with the supplier and may result in its removal from Molexs Approved Vendor List (AVL).所有莫仕公司供应商必须遵循一切适用的国家及当地法律法规条款以及适用的工业标准(例如SA8000)。如法律要求和现行工业标准之间存在冲突, 供应商应优先遵守法律法规。All suppliers to Molex must conform to all applicable national and local legal requirements and, where appropriate, conform to any recognized industry standards e.g. SA8000. If there is any conflict between legal requirements and published industry standards then suppliers must at least be in compliance with the one that by law takes precedence.供应商必须熟知莫仕公司商业道德准则和劳工及用工政策, 同时遵守其中适用条款,详情可参见莫仕公司网站() 中“关于我们”部分。Suppliers must be familiar with the Molex Code of Business Conduct and Ethics and the Molex Labor and Employment Policy that are located on the “About Us” section on the Molex extranet () and abide by these policies where appropriate.环境条例Environmental Practices:莫仕公司期望其供应商的产品供应和商务运作行为必须符合国家及当地法律法规中关于保障及维护环境的相关条款。Molex expects its suppliers to provide products and conduct their business operations in a way that protects and sustains the environment in accordance with applicable national and local laws and regulations.产品: Products: 供应商必须保证遵守国家及当地一切法律法规对于限制或禁止使用的某些化学品作为产品元素的规定,比如,铅。Suppliers must ensure that they comply with all national laws and regulations that restrict or prohibit the use of certain chemical compounds as constituents of products, e.g. lead. 再循环Recycling:供应商必须遵守关于标签、再循环和化学品及材料处理的一切国家法律法规,尤其是对于那些被认定为有害废品的材料。Suppliers must comply with all national laws and regulations regarding the labeling, recycling and disposal of chemicals and materials, especially those materials designated as hazardous waste. 雇工条例Employment Practices:童工:Child Labor:禁止使用童工。供应商禁止在行商国家雇佣低于法定雇佣年龄的员工, 如果当地法律没有指定最低雇佣年龄, 以义务教育年龄作为最低雇佣年龄。莫仕公司不会接受在全球范围内任何工厂有雇用童工行为的供应商,莫仕公司支持符合法律法规的利用合法工作场所进行的有益于年轻人教育的学徒计划。Use of child labor is not permissible. Suppliers are prohibited from employing anyone under the legal age of employment in the Country where the supplier is conducting its activities, and in the event that the minimum age of employment is not specified in local legislation, employees must be not younger than the compulsory age to be in school. Molex will not engage a supplier who uses any child labor in any of their facilities worldwide. Molex supports the development of legitimate workplace apprenticeship programs for the educational benefit of young people.狱工 /强迫劳动Prison Labor / Forced Labor:莫仕公司不接受供应商在生产莫仕产品的过程中使用强制性的狱工或强迫劳动的行为。另外, 也不接受提供材料或服务的供应商有使用狱工或强迫劳动的行为。供应商不得在其工厂或其它生产场所使用无报酬或契约的工人、违背其工作意愿的的人进行生产活动,同样不允许供应商使用有类似行为的转包商。Molex will not use involuntary prison or forced labor in contracting relationships in the manufacture of our products. In addition it will not engage suppliers who use involuntary prison or forced labor in the production of materials or services supplied to it. Suppliers will not use factories or other production facilities that force work to be performed by unpaid or indentured workers or those who must otherwise work against their will, nor shall they use any subcontractors who use such practices.纪律Disciplinary Practices:莫仕公司不接受任何有采取体罚或其他形式的精神及身体压迫行为的供应商,例如,使用身体上的,性别上的或口头侮辱或谩骂等行为作为维纪或控制手段。Molex will not engage any supplier who uses corporal punishment or other forms of mental or physical coercion e.g. physical, sexual or verbal harassment or abuse as a means of discipline or control. 工作时间Working Hours:莫仕公司尊重供应商灵活运用工作方式的权利。但是, 我们期望供应商制订合理的每日以及每周的工作计划表并遵守一切国家及当地适用的有关工作日及工时的法律法规。作为一项方针, 正常情况下, 我们期望员工在七天中至少有一天休息, 并且至少被给予符合法律规定最少天数的假期。Molex respects the right of suppliers to operate flexible working conditions. However we expect employees to be granted reasonable daily and weekly work schedules and that suppliers adhere to all applicable national and local laws with respect to the number of hours and days worked. As a guideline, under normal circumstances we expect that employees will be granted at least one day off in seven and also be given vacation days that at least meet the legal minimum. 工资及福利Wages and Benefits:莫仕公司期望其供应商依照一切国家及当地关于工资和福利的适用法律给予员工公正的报酬,包括国家及当地法律关于加班工资和其他情况补偿的规定(例如, 公共假期) 。供应商应依照国家及当地适用法律法规为员工支付社会保障金及其它相关福利金。Molex expects its suppliers to compensate employees fairly, which means that wages and benefits must comply with all applicable national and local laws. This includes appropriate wages for overtime work and other circumstances (e.g. Public holidays) where compensatory pay is required by local or national laws. Suppliers will also pay all required social security and other contributions on their behalf and that of their employees in accordance with applicable national and local laws.歧视Discrimination:莫仕公司认可并尊重文化差异同时相信对员工的认可应基于其能力而不是个性或信仰。因此, 莫仕寻求并只与那些在雇佣过程中无针对种族、 性别、肤色、宗教信仰、 年龄或其它因素的歧视行为, 遵守国家及当地禁止雇佣歧视的法律法规的供应商合作。Molex recognizes and respects cultural differences and believes that employees should be engaged on the basis of their ability to do the job as opposed to employment on the basis of personal characteristics or beliefs. Therefore Molex will seek to work only with suppliers that conform to local and national laws prohibiting discrimination in hiring and employment practices on the grounds of race, sex, color, religion, age or any other prohibited grounds. 健康和安全Health and Safety:莫仕公司期望供应商为员工提供良好的安全和健康的工作环境,必要时,包括生活条件。工作场所必须保证充足的照明, 有明显标记的消防通道, 经过定期的检查和保养确保可以正常使用的消防和安全设施,工作场所必须至少符合国家和当地法律的要求。Molex expects its suppliers to provide its employees with a safe and healthy working environment as well as, where appropriate, living conditions. Work facilities must include an adequately lit area, well marked fire exits, working fire and safety equipment that is regularly checked and serviced as well as other conditions that, at a minimum, meet local and national laws.员工知情Employee Awareness供应商应告知其员工相关条款并且在工作场所显而易见处张贴劳工及环境条例以供所有员工了解。必要时,相关条款应对应地翻译成一种或多种当地语言。Suppliers shall notify their employees of these terms and place a copy of their labor and environmental practices in one or more work locations easily accessible to all employees.
