安全生产责任制是最基本的安全管理制度是所有安全生产管理制度的核心。安全生产责任制是按照安全生产管理方针和“管生产的同时必须管安全”的原则,将各级负责人员、各职能部门及其工作人员和各岗位生产工人在安全生产方面应做的事情及应负的责任加以明确规定的一种制度。具体来说,就是将安全生产责任分解到相关单位的主要负责人、项目负责人、班组长以及每个岗位的作业人员身上。Safetyproductionresponsibilitysystemisthemostbasicsafetymanagementsystemisthecoreofallsafetyproductionmanagementsystem.Thesafetyproductionresponsibilitysystemisasystemthatclearlydefinesthethingsandresponsibilitiesthatresponsiblepersonnelatalllevels,functionaldepartmentsandtheirstaffandproductionworkersatallpositionsshoulddoinsafetyproductioninaccordancewiththesafetyproductionmanagementpolicyandtheprincipleof"managingproductionwhilemanagingsafety."Specifically,itistodecomposethesafetyproductionresponsibilitytothemainpersoninchargeoftherelevantunit,theprojectleader,theteamleaderandtheoperatorofeachpost.

安全生产责任制度的主要内容如下:Themaincontentsofthesafetyproductionresponsibilitysystemareasfollows:

(1)安全生产责任制度主要包括企业主要负责人的安全责任,负责人或其他副职的安全责任,项目负责人(项目经理)的安全责任,生产、技术、材料等各职能管理负责人及其工作人员的安全责任,技术负责人(工程师)的安全责任、专职安全生产管理人员的安全责任,施工员的安全责任,班组长的安全责任和岗位人员的安全责任等。

(1)Thesafetyproductionresponsibilitysystemmainlyincludesthesafetyresponsibilityofthemainpersoninchargeoftheenterprise,thesafetyresponsibilityofthepersoninchargeorotherdeputy,thesafetyresponsibilityoftheprojectleader(projectmanager),thesafetyresponsibilityofthepersoninchargeofproduction,technology,materialsandotherfunctionsandtheirstaff,thesafetyresponsibilityofthetechnicalpersonincharge(engineer),thesafetyresponsibilityofthefull-timesafetyproductionmanagementpersonnel,thesafetyresponsibilityoftheconstructionpersonnel,thesafetyresponsibilityoftheteamleaderandthesafetyresponsibilityofthepostpersonnel.(2)项目应对各级、各部门安全生产责任制规定检查和考核办法,并按规定期限进行考核,对考核结果及兑现情况应有记录。(2)Theprojectshouldstipulatetheinspectionandassessmentmethodsforthesafetyproductionresponsibilitysystemofalllevelsanddepartments,andcarryouttheassessmentaccordingtotheprescribedtimelimit,andrecordtheassessmentresultsandfulfillment.

(3)项目独立承包的工程在签订承包合同中必须有安全生产工作的具体指标和要求。工程由多单位施工时,总分包单位在签订分包合同的同时要签订安全生产合同(协议),签订合同前要检查分包单位的营业执照、企业资质证、安全资格证等。分包队伍的资质应与工程要求相符,在安全合同中应明确总分包单位各自的安全职责。(3)Theindependentcontractingprojectmusthavespecificindicatorsandrequirementsofsafetyproductioninthecontract.Whentheprojectisconstructedbymultipleunits,thesubcontractorshouldsignthesafetyproductioncontract(agreement)whilesigningthesubcontract.Beforesigningthecontract,thesubcontractor'sbusinesslicense,enterprisequalificationcertificateandsafetyqualificationcertificateshouldbechecked.Thequalificationofthesubcontractingteamshouldbeconsistentwiththeengineeringrequirements,andtherespectivesafetyresponsibilitiesofthesubcontractingunitsshouldbeclarifiedinthesafetycontract.

原则上,实行总承包的由总承包单位负责,分包单位向总包单位负责,服从总包单位对施工现场的安全管理,分包单位在其分包范围内建立施工现场安全生产管理制度,并组织实施。Inprinciple,thegeneralcontractingunitisresponsiblefortheimplementationofthegeneralcontracting,andthesubcontractingunitisresponsibleforthegeneralcontractingunit,whichissubjecttothesafetymanagementoftheconstructionsitebythegeneralcontractingunit.Thesubcontractingunitestablishestheconstructionsitesafetyproductionmanagementsystemwithinitssubcontractingscopeandorganizesandimplementsit.

(4)项目的主要工种应有相应的安全技术操作规程,砌筑、抹灰、混凝土、木工、电工、钢筋、机械、起重司机、信号指挥、脚手架、水暖、油漆、塔吊、电梯、电气焊等工种,特殊作业应另行补充。应将安全技术操作规程列为日常安全活动和安全教育的主要内容,并应悬挂在操作岗位前。(4)Themaintypesofworkoftheprojectshouldhavethecorrespondingsafetytechnicaloperationprocedures,masonry,plastering,concrete,carpentry,electrician,steel,machinery,cranedriver,signalcommand,scaffold,plumbing,paint,towercrane,elevator,electricalweldingandothertypesofwork,specialoperationsshouldbesupplemented.Safetytechnicaloperationproceduresshouldbelistedasthemaincontentofdailysafetyactivitiesandsafetyeducation,andshouldbesuspendedinfrontoftheoperationpost.

(5)工程项目部专职安全人员的配备应按住房和城乡建设部的规定,1万m2以下工程1人;1万一5万m2的工程不少于2人;5万m2以上的工程不少于3人。

总之,企业实行安全生产责任制必须做到在计划、布置、检查、总结、评比生产的时候,同时计划、布置、检查、总结、评比安全工作。

(5)Theallocationoffull-timesafetypersonnelintheengineeringprojectdepartmentshouldbeinaccordancewiththeprovisionsoftheMinistryofHousingandUrban-RuralDevelopment,1personforprojectsbelow10,000m2;notlessthan2personsforaprojectof115,000m2;morethan50,000m2oftheprojectisnotlessthan3people.Inshort,theimplementationofthesafetyproductionresponsibilitysystemmustbedoneintheplanning,layout,inspection,summary,evaluationofproduction,whileplanning,layout,inspection,summary,evaluationofsafetywork.二、安全生产许可证制度(Safetyproductionlicensesystem)

国务院建设主管部门负责中央管理的建筑施工企业安全生产许可证的颁发和管理,其他企业由省、自治区、直辖市人民政府建设主管部门进行颁发和管理,并接受国务院建设主管部门的指导和监督。

企业取得安全生产许可证,应当具备下列安全生产条件：ThecompetentdepartmentofconstructionundertheStateCouncilisresponsiblefortheissuanceandmanagementofsafetyproductionlicensesforconstructionenterprisesunderthecentralgovernment,andotherenterprisesareissuedandmanagedbythecompetentdepartmentofconstructionunderthepeople'sgovernmentsofprovinces,autonomousregionsandmunicipalitiesdirectlyunderthecentralgovernment,andaccepttheguidanceandsupervisionofthecompetentdepartmentofconstructionundertheStateCouncil.Enterprisesshouldhavethefollowingsafetyproductionconditionstoobtainsafetyproductionlicense:

(1)建立、健全安全生产责任制,制定完备的安全生产规章制度和操作规程。

(2)安全投入符合安全生产要求。

(3)设置安全生产管理机构,配备专职安全生产管理人员。

(4)主要负责人和安全生产管理人员经考核合格。

(5)特种作业人员经有关业务主管部门考核合格取得特种作业操作资格证书。

(6)从业人员经安全生产教育和培训合格。

(7)依法参加工伤保险,为从业人员缴纳保险费。(1)Establishandimprovethesafetyproductionresponsibilitysystem,formulatecompletesafetyproductionrulesandregulationsandoperatingprocedures.(2)Safetyinvestmentmeetstherequirementsofsafetyproduction.(3)Setupsafetyproductionmanagementinstitutions,equippedwithfull-timesafetyproductionmanagementpersonnel.(4)Themainpersoninchargeandsafetyproductionmanagementpersonnelhavepassedtheexamination.(5)Thespecialoperationpersonnelobtainedthespecialoperationqualificationcertificatebytherelevantbusinessdepartment.(6)Theemployeesarequalifiedbysafetyeducationandtraining.(7)Participateinindustrialinjuryinsuranceaccordingtolaw,payinsurancepremiumsforemployees.

(8)厂房、作业场所和安全设施、设备、工艺符合有关安全生产法律、法规、标准和规程的要求。

(9)有职业危害防治措施,并为从业人员配备符合国家标准或者行业标准的劳动防护用品。

(10)依法进行安全评价。

(8)Workshops,workplacesandsafetyfacilities,equipmentandprocessesshallmeettherequirementsofrelevantlaws,regulations,standardsandproceduresforworksafety.(9)Haveoccupationalhazardpreventionandcontrolmeasures,andequipemployeeswithlaborprotectionproductsthatmeetnationalstandardsorindustrystandards.(10)Conductsafetyevaluationaccordingtolaw.

(11)有重大危险源检测、评估、监控措施和应急预案。

(12)有生产安全事故应急救援预案、应急救援组织或者应急救援人员,配备必要的应急救援器材、设备。

(13)法律、法规规定的其他条件。(11)Therearemajorhazarddetection,assessment,monitoringmeasuresandemergencyplans.(12)Haveproductionsafetyaccidentemergencyrescueplan,emergencyrescueorganizationoremergencyrescuepersonnel,equippedwiththenecessaryemergencyrescueequipment.(13)Otherconditionsstipulatedbylawsandregulations.

企业进行生产前,应当依照该条例的规定向安全生产许可证颁发管理机关申请领取安全生产许可证,并提供该条例第六条规定的相关文件、资料。安全生产许可证颁发管理机关应当自收到申请之日起45日内审查完毕,经审查符合该条例规定的安全生产条件的,颁发安全生产许可证;不符合该条例规定的安全生产条件的,不予颁发安全生产许可证,书面通知企业并说明理由。

Beforeproduction,theenterpriseshallapplytotheadministrativeorganfortheissuanceofproductionsafetylicensestoobtainproductionsafetylicensesinaccordancewiththeprovisionsoftheregulations,andproviderelevantdocumentsandmaterialsstipulatedinArticle6oftheregulations.Theadministrativeorganfortheissuanceofproductionsafetylicensesshallcompletetheexaminationwithin45daysfromthedateofreceiptoftheapplication.Iftheexaminationmeetstheconditionsofproductionsafetystipulatedintheregulations,theproductionsafetylicenseshallbeissued.Ifitdoesnotmeetthesafetyproductionconditionsstipulatedintheregulations,itwillnotissueasafetyproductionlicense,andnotifytheenterpriseinwritingandexplainthereasons.

安全生产许可证的有效期为3年。安全生产许可证有效期满需要延期的,企业应当于期满前3个月向原安全生产许可证颁发管理机关办理延期手续。

企业在安全生产许可证有效期内,严格遵守有关安全生产的法律法规,未发生死亡事故的,安全生产许可证有效期届满时,经原安全生产许可证颁发管理机关同意,不再审查,安全生产许可证有效期延期3年。

企业不得转让、冒用安全生产许可证或者使用伪造的安全生产许可证。

Theproductionsafetylicenseisvalidfor3years.Iftheexpirationofthesafetyproductionlicenseneedstobeextended,theenterpriseshouldgothroughtheextensionformalitieswiththeoriginalsafetyproductionlicenseissuancemanagementauthoritythreemonthsbeforetheexpiration.Duringthevalidityperiodofthesafetyproductionlicense,theenterprisestrictlyabidesbythelawsandregulationsrelatedtosafetyproduction.Ifthereisnodeathaccident,whenthevalidityperiodofthesafetyproductionlicenseexpires,withtheconsentoftheoriginalsafetyproductionlicenseissuingandmanagementauthority,itwillnotbereviewed,andthevalidityperiodofthesafetyproductionlicensewillbeextendedby3years.Enterprisesshallnottransferorfraudulentlyusesafetyproductionlicensesoruseforgedsafetyproductionlicenses.

三、政府安全生产监督检查制度

政府安全监督检查制度是指国家法律、法规授权的行政部门,代表政府对企业的安全生产过程实施监督管理。《建设工程安全生产管理条例》第五章“监督管理”对建设工程安全监督管理的规定内容如下：

(1)国务院负责安全生产监督管理的部门依照《中华人民共和国安全生产法》的规定,对全国建设工程安全生产工作实施综合监督管理。

GovernmentsafetysupervisionandinspectionsystemThegovernmentsafetysupervisionandinspectionsystemreferstotheadministrativedepartmentauthorizedbynationallawsandregulations,whichsupervisesandmanagesthesafetyproductionprocessofenterprisesonbehalfofthegovernment.Theprovisionsofthe"RegulationsontheAdministrationofSafetyProductioninConstructionProjects"Chapter5"SupervisionandManagement"onthesafetysupervisionandmanagementofconstructionprojectsareasfollows:(1)ThedepartmentresponsibleforthesupervisionandmanagementofsafetyproductionoftheStateCouncilimplementscomprehensivesupervisionandmanagementofthesafetyproductionofconstructionprojectsnationwideinaccordancewiththeprovisionsofthe"SafetyProductionLawofthePeople'sRepublicofChina."

(2)县级以上地方人民政府负责安全生产监督管理的部门依照《中华人民共和国安全生产法》的规定,对本行政区域内建设工程安全生产工作实施综合监督管理。(2)Inaccordancewiththeprovisionsofthe"People'sRepublicofChinaProductionSafetyLaw,"thedepartmentsresponsibleforthesupervisionandmanagementofproductionsafetyofthelocalpeople'sgovernmentsatorabovethecountylevelimplementcomprehensivesupervisionandmanagementoftheproductionsafetyofconstructionprojectsintheadministrativeregion.

(3)国务院建设行政主管部门对全国的建设工程安全生产实施监督管理。国务院铁路、交通、水利等有关部门按照国务院规定的职责分工,负责有关专业建设工程安全生产的监督管理。(3)TheconstructionadministrativedepartmentoftheStateCouncilsupervisesandmanagesthesafetyproductionofconstructionprojectsnationwide.Therailway,transportation,waterconservancyandotherrelevantdepartmentsoftheStateCouncilareresponsibleforthesupervisionandmanagementofthesafetyproductionofrelevantprofessionalconstructionprojectsinaccordancewiththedivisionofresponsibilitiesstipulatedbytheStateCouncil.

(4)县级以上地方人民政府建设行政主管部门对本行政区域内的建设工程安全生产实施监督管理。县级以上地方人民政府交通、水利等有关部门在各自的职责范围内,负责本行政区域内的专业建设工程安全生产的监督管理。
