WecallonICTregulatorsgloballytoconsiderArcep’sapproachasanexamplefortheirowncountries.TheurgencyofglobalclimateactionneedsregulatorstoadoptcomprehensivemethodologiesformeasuringtheenvironmentalfootprintoftheirICTsector.AspartoftheGreenDigitalActionatCOP29andbeyond,thereisanopportunitytobuildaunifiedglobalefforttotrackandreduceICTsectoremissions,tousedatatoinformdecision-makinganddigitalinvestments.Bycollaboratingandsharingknowledge,challenges,andbestpractices,regulatorscanhelpcreateasolidfoundationthatalignswithglobalclimategoalsandacceleratesthetransitiontoagreenerandnetzeroICTsector.Addressingthecurrentgapsindatacollectionisvitaltounderstandingthetrueenvironmentalimpactofthedigitalsector.

1.INTRODUCTION
T
heInformationandCommunicationTechnology(ICT)sectorfindsitselfatapivotalmoment—whilepropellingdigitaltransformationacrosstheglobe,itisalsocontributingtoclimatechange.Thesector'sgreenhousegas(GHG)emissions—estimatedat1.5to4percentoftheglobaltotal—exceed
thoseoftheinternationalaviationindustry1Digitalizationalsoimpactsotherenvironmentalareassuchasincreasedenergyandwaterconsumption,rawmaterialdepletion,ande-waste.2Therefore,thepressingchallengeliesinclosingtheconnectivitygapfor2.6billionwhoremainofflinewhileleveragingICTsinanenvironmentallysustainablemanner.
Inalmostallcountries,datacollectionandanalysisoftheICTsector’senvironmentalfootprintislimited.Asaresult,evaluatingitsenvironmentalimpactreliesheavilyonestimations,whichareoftenavailableonlyataglobalscale.Intheabsenceofthisinformation,policymakerswillencounterchallengesinmakingwell-informeddecisionsaboutreducingICTsectoremissions,managingenergyresourcesandminimizingotherenvironmentalimpacts.
Sincetheimpactsofclimatechangearealreadynoticeableitisessentialtoreduceemissionsacrossalleconomicsectors.3AvailableevidencefortheICTsectorsuggestsemissionsandenergyusearegrowing.Forinstance,onereportfoundthattheoperationalGHGemissionsoftheworld's200largestdigitalcompaniesgrew12percentbetween2021and2022.4AnotherreportestimatedthatelectricityuseoftheICTsectorgrew8.2percentbetween2020and2022.5Thismakesitimperativetomonitorthesituation.AtthesametimethewidespreadadoptionofstandardsformeasuringsustainabilitybydigitalcompaniescouldmakeICTademonstrationsectorifnationalauthoritiescompiledthedata.SuchdatacouldalsobeusedtoinformNationallyDeterminedContributions(NDCs).6
Thereareafewexamplesofdatacollectionatthecountrylevelwhichvaryinscopeandperiodicity.Thesearecollectedbydifferenttypesofentitiessuchasutilityregulators,nationalstatisticsofficesandelectroniccommunicationsregulators.Despitethescarcityofenvironmentaldatacollectedbysectorregulators,sometelecommunicationsoperatorspublishdataontheiremissionsandenergyuse.AnITU/WorldBankreportaggregatedemissionsandelectricitybasedoncompanyreportsfrom30countries.7Thisillustratesthatdatacouldbeavailablefromanumberoftelecommunicationsoperators.Forinstance,insomejurisdictions,

companiesarerequiredtodiscloseenvironmentaldatainpubliclyavailablereports8whileinotherstherearevoluntaryinitiativestoprovidesuchdatatoacountryportal.9
In2023,theITUsurveyedICTregulatorsregardingsectoremissionsplans.Itreceivedcompleteresponsestothesurveyfrom75countries.Keyfindingsincluded:
•ICTregulators’mandatesdonotfullycaptureemergingclimategoalsandpriorities.CurrentlyonlyoneinfiveregulatorsareofficiallymandatedtocollectemissionsdatafromtheICTsector.However,roughly40percentofcountriesrankemissionsmonitoringasahighormediumpriorityandwouldbewillingtoundertakeactionstothatend.Further,30percentintendtointroducegoalsrelatedtoemissionsmonitoringinthefuture.
•ICTregulatorsareunfamiliarwithbuteagertolearnaboutreportingstandardsandmethods.While72percentofregulatorsidentifiedaseitherslightlyornotatallfamiliarwiththeGHGProtocol,roughlyhalfemphasizedtheneedforcapacitybuildingonclimateandenvironmentalissues.
Arcep10,theindependentFrenchElectronicCommunications,PostalandPrintmediadistributionRegulatoryAuthority,isnotableasthefirstandonlysectorregulatortoregularlypublish,withinitsannualsurvey“Achievingdigitalsustainability”,indicatorsfromdataitcollectsdirectlyfromdigitalplayerstoassessandmonitortheirenvironmentalimpact.ThismakesitamodelforICTregulatorsonhowtocollectandanalyzetheenvironmentalfootprintwhichcombinesGHGemissions,energy,andotherenvironmentalimpacts.ThisreportprovidesdetailsonhowArcepinitiatedtheprocesstocollectsustainabilitydata,neededlegalchanges,howandwhichcompaniesandsectorsaresurveyedandoutputsfromthedata.

2.MANDATEANDREGULATORYMODIFICATIONS
2.1OVERVIEWOFARCEP
Arcepwasestablishedin2005fromthethentelecommunicationregulatorART(createdin1997)duetotheadditionofpostaloversighttoitsremit.Arcep'sresponsibilitieswereexpandedconsiderablytoincludenotablytheprotectionofnetneutrality,theregulationofprintmedia,theregulationofdataintermediationprovidersandcloudservices,andthemeasurementofICTenvironmentalimpact.
Withastaffofaround185,Arcepactivelyparticipatesinseveralregionalandinternationalassociations.ThisincludestheBodyofEuropeanRegulatorsforElectronicCommunications(BEREC),FRATEL,anetworkofFrench-speakingtelecommunicationsregulators,OECDandtheITU.
Arcep'sresponsibilitiesandpowersareoutlinedinthePostalandElectronicCommunicationsCode11TheCodeincludesthemandateforcollectingdataontheelectroniccommunicationssector(e.g.,subscriptions,traffic,financialindicators,employment)ataskithascarriedoutsince1999.Thisactivitydeepeneditsknowledgeoftheelectroniccommunicationsectorandcreatedstatisticalexpertise.ThedataandaccompanyinganalysisarepublishedinthequarterlyandannualElectronicCommunicationMarketinFranceobservatories12
2.2.PATHTOCOLLECTINGICTSECTORENVIRONMENTALDATA
InApril2022,Arcepreleasedthefirsteditionofitsannualsurvey“AchievingDigitalSustainability”andbecamethefirstsectorregulatorintheworldtopublishenvironmentaldataoftelecommunicationoperators.ThisincludedGHGemissions,energy,andend-userdevices(salesofmobilephonesbytelecomoperator,andvolumesofmobilephonescollectedbyoperatorsforrecyclingorreconditioning)13ThisfirsteditionistheresultofdatacollectionfromtelecommunicationoperatorsinitiatedbyArcepin2020,throughitsmandateatthattimeandafterdecidingonitsowntotacklethesubject.TheinitialrequestsforenvironmentaldatawereincludedintheregulardatacollectionquestionnairessenttotelecommunicationsoperatorsfortheannualElectronicCommunicationMarketreports14ItisworthmentioningthatnolegalmodificationswerenecessaryforArceptolaunchthisinauguralreportfeaturingenvironmentaldataoftelecommunicationsoperators.

June2020acollaborativeplatformcalledAchievingdigitalsustainabilitycallingonallinterestedassociations,institutions,operators,digitalindustrybusinessesandexpertstocontribute.
Themanyexchangesconductedaspartofthisplatform(workshop,discussions)resultedinthepublication,inDecember2020,oftheAchievingDigitalSustainabilityreport16Thisreportputforward11proposalsfordealingwiththeongoingincreaseintheuseofdigitaltechnologyandreducingitsenvironmentalfootprint.Abovealloneoftheseproposalsaimstoentrustacompetentauthoritywiththepowertocollectrelevantinformationfromtheentiredigitalecosysteminordertoobtaingranularandreliabledatathatisessentialtoassessingandmonitoringthedigitalenvironmentalfootprint.Thereportalsocallsforadata-drivenapproachtoregulationtoenhancetheregulator'straditionaltoolbox.Theintentisthatthiswillresultinmoretransparencytoreduceinformationasymmetriesandtohelpusersmakeinformedchoices.Thisconceptofdata-drivenregulationsprangfromanotebytheFrenchCompetitionAuthorityandfellowregulatorsincludingArcep17Inthemeantime,inAugust2020,thegovernmentassignedArcepandADEME(FrancesNationalAgencyfortheEcologicalTransition)thetaskofassessingthedigitalenvironmentalfootprintinFrance.
BOX2.1:DIGITAL'SCARBONFOOTPRINTINFRANCE
AJanuary2022reportbyArcepandADEME,onthedigitalenvironmentalfootprintinFrancein2020foundthatdigitaltechnologywasresponsiblefor2.5percentofthecountry'scarbonfootprint18Itwasestimatedthatthecarbonfootprintfromdigitaldevicesaccountformostofthecarbonimpact(79percentin2020),followedbydatacentersandthentelecommunicationnetworks(Figure2.1,left).Thereportrecommendedaddressingthewholevaluechainasthosethreesegmentsareintertwinedandinfluenceeachother.Furthermore,asidefromthecarbonfootprint,thereportalsofoundthatdigitalenvironmentalimpactsarenotlimitedtoGHGemissionsandenergyconsumption,andthatmetalsandmineralsdepletionmustbeconsidered.Thefinalvolumeofthereport,publishedinMarch2023,featuredaprospectiveassessmentofthedigitalenvironmentalfootprintthrough2030and2050.Thereportfoundthatifnoactionistaken,thedigitalcarbonfootprintinFrancecouldalmosttriplebetween2020and2050(Figure2.1,right).

TheADEME/Arcepstudymentionedaboveshowedthatend-userdevicesareresponsiblefor65percentto90percentofthedigitalenvironmentalfootprintinFranceandthatenvironmentalimpactisnotlimitedtocarbonemissions.TheseresultscorroboratetheAchievingDigitalSustainabilityreportproposaltoextenddatacollectiontotheentiredigitalecosystem.ThisproposalcametofruitionwithachangeinlawexpandingArcep'smandateforenvironmentaldatacollectionfromtelecommunicationsoperatorstootherICTsectorindustries.ThischangetoitsmandatewasvotedbytheFrenchlegislatureinDecember2021(LawNo.2of23December2021).19
ThatlawresultedinarevisiontothePostandElectronicCommunicationsCode.SectionL36-6givesthepowertoArcepforcollectingenvironmentaldatafromtelecomoperators,terminalmanufacturers,datacenteroperators,onlinecommunicationserviceproviders,networkequipmentmanufacturersandsuppliersandoperatingsystemproviders20:
TheAutoritéderégulationdescommunicationsélectroniques,despostesetdeladistributiondelapresse)setsouttherulesfor:

ThelawandchangestothePostandElectronicCommunicationsCodewasthenoperationalizedbyArcepthroughanenvironmentaldatacollectiondecisionissuedinNovember2022.22Thisdecisionincludesdatacenteroperatorsanddevicemanufacturersinadditiontoelectroniccommunicationsoperatorsaspartofafirstroundofenlargementofthedatacollectionperimeter,whichaimstobeprogressivelyextendedtotheentiredigitalecosystem.Aquestionnaireaskingforenvironmentaldatawassenttotelecommunicationsoperatorsandthenewcompanies(i.e.,devicemanufacturersanddatacenteroperators)inJanuary2023withtheresultspublishedinMarch2024inthethirdeditionoftheannual“Achievingdigitalsustainability”survey.Meanwhile,Arcephascontinuedtograduallyextendthescopeofenvironmentaldatacollection.InFebruary2024,ArceppublisheditsnewDecisiononenvironmentaldatacollection23thatexpandsitsdatacollectiontomobilenetworkequipmentsuppliers,focusingonthemaintypesofhardwarethatmakeupacellsite,forpublicationin2025initsfourtheditionofitsannual“Achievingdigitalsustainability”survey.
