2025【英文标准】设备租赁合同范本(中英文)EnglishStandardEquipmentLeaseAgreementTemplate2025本合同由以下双方于年月日在中华人民共和国市签订。THISAGREEMENTismadeandenteredintoonthisdayofintheyearinthecityofinthePeople'sRepublicofChinabyandbetween:出租方（以下简称“甲方”）：LESSOR(hereinafterreferredtoas"PartyA"):名称：Name:地址：Address:联系人：ContactPerson:联系电话：ContactTelephone:承租方（以下简称“乙方”）：LESSEE(hereinafterreferredtoas"PartyB"):名称：Name:地址：Address:联系人：ContactPerson:联系电话：ContactTelephone:鉴于乙方因业务需要向甲方租赁设备，双方根据《中华人民共和国合同法》等相关法律法规，经友好协商，就设备租赁事宜达成如下协议：WHEREASPartyBrequirestheleaseofcertainequipmentforitsbusinessoperations,andPartyAiswillingtoleasesuchequipmenttoPartyB;andWHEREASbothpartiesheretohavereachedanagreementconcerningtheleaseoftheequipmentinaccordancewiththerelevantlawsandregulationsofthePeople'sRepublicofChina,includingbutnotlimitedtotheContractLawofthePeople'sRepublicofChina;NOW,THEREFORE,thepartiesheretoagreeasfollows:第一条设备租赁内容Clause1:EquipmentLeasingTerms1.1租赁设备：1.1Equipmenttobeleased:设备名称：NameofEquipment:数量：Quantity:型号：Model:规格：Specification:设备编号：EquipmentNumber:1.2设备用途：1.2EquipmentUse:乙方租赁上述设备仅限于用于（具体用途），不得用于其他任何目的。PartyBshallleasetheaforementionedequipmentsolelyforthepurposeof(specificpurpose)andshallnotuseitforanyotherpurposes.第二条租赁期限Clause2:LeaseTerm2.1租赁期限：2.1LeaseDuration:租赁期限为个月，自年月日起至年月日止。Theleasetermshallbemonths,commencingonthedayofintheyearandendingonthedayofintheyear.2.2续租：2.2Renewal:如乙方希望续租设备，应在租赁期限届满前日以书面形式通知甲方。续租事宜由双方另行协商。IfPartyBdesirestorenewthelease,PartyBshallnotifyPartyAinwritingatleastdayspriortotheexpirationoftheleaseterm.Thetermsofrenewalshallbenegotiatedseparatelybybothparties.第三条租金及支付方式Clause3:RentandPaymentMethod3.1租金标准：3.1RentStandard:租金为人民币元/月（大写：），租金总计人民币元（大写：）。TherentshallbeRMBpermonth(inwords:),withatotalrentofRMB(inwords:).3.2支付方式：3.2PaymentMethod:租金按（月/季度/年）支付，首次租金应于日前支付，后续租金每期日前支付。Rentshallbepaid(monthly/quarterly/yearly).Thefirstpaymentshallbemadebyandsubsequentpaymentsshallbemadebytheofeachperiod.3.3押金：3.3Deposit:乙方应于本合同签订之日起日内支付押金人民币元（大写：），押金用于保证乙方在租赁期间履行本合同项下的义务。PartyBshallpayadepositofRMB(inwords:)toPartyAwithindaysfromthedateofthisAgreement.ThedepositshallserveassecurityforPartyB'sobligationsunderthisAgreementduringtheleaseterm.3.4退还押金：3.4RefundofDeposit:租赁期满后，如乙方未违反本合同任何条款且设备完好无损，甲方应在日内退还押金。Upontheexpirationoftheleaseterm,ifPartyBhasnotbreachedanytermofthisAgreementandtheequipmentisingoodcondition,PartyAshallrefundthedeposittoPartyBwithindays.第四条设备使用及责任Clause4:EquipmentUseandResponsibilities4.1设备使用地点及方式：4.1EquipmentUseLocationandMethod:设备使用地点为，乙方不得擅自变更设备使用地点或改变设备用途。Theequipmentshallbeusedatthelocationof,andPartyBshallnotaltertheuselocationorthepurposeoftheequipmentwithoutthepriorwrittenconsentofPartyA.4.2设备保管及维护：4.2EquipmentCareandMaintenance:乙方应妥善保管和使用设备，并承担设备在租赁期间的日常维护和保养责任。PartyBshallproperlycareforandusetheequipmentandshallberesponsibleforthedailymaintenanceandupkeepoftheequipmentduringtheleaseterm.4.3设备损坏及丢失：4.3EquipmentDamageandLoss:如因乙方原因导致设备损坏或丢失，乙方应承担修复或赔偿责任。IftheequipmentisdamagedorlostduetoPartyB'sfault,PartyBshallberesponsibleforrepairorcompensation.4.4不可抗力：4.4ForceMajeure:如因不可抗力导致设备损坏或无法使用，双方应及时协商解决，无法协商的可依法终止合同。Ifequipmentdamageorunavailabilityiscausedbyforcemajeure,bothpartiesshallpromptlynegotiateasolution.Ifnoagreementcanbereached,thecontractmaybeterminatedinaccordancewiththelaw.第五条设备维修及保养Clause5:EquipmentRepairandMaintenance5.1设备日常维护：5.1DailyMaintenanceofEquipment:设备的日常维护由乙方负责，甲方提供必要的技术指导。ThedailymaintenanceoftheequipmentshallbehandledbyPartyB,andPartyAshallprovidenecessarytechnicalguidance.5.2设备故障处理：5.2EquipmentMalfunctionHandling:如设备发生故障，乙方应立即通知甲方，并采取必要措施防止损失扩大。甲方应在接到通知后小时内响应并安排维修。Incaseofequipmentmalfunction,PartyBshallimmediatelynotifyPartyAandtakenecessarymeasurestopreventfurtherdamage.PartyAshallrespondandarrangeforrepairswithinhoursafterreceivingthenotice.5.3维修费用：5.3RepairCosts:维修费用由承担（甲方/乙方）。Repaircostsshallbeborneby(PartyA/PartyB).第六条保险Clause6:Insurance6.1设备保险：6.1EquipmentInsurance:甲方负责为租赁设备购买保险，保险费用由甲方承担。PartyAshallberesponsibleforpurchasinginsurancefortheleasedequipmentatitsownexpense.6.2保险责任范围：6.2ScopeofInsuranceCoverage:保险覆盖范围包括设备的损失和损坏，但不包括因乙方操作不当或其他过失造成的损失。Theinsurancecoverageincludesdamagesandlossestotheequipment,butexcludesdamagesorlossescausedbyimproperoperationoranyothernegligenceonthepartofPartyB.第七条违约责任Clause7:LiabilityforBreachofContract7.1违约金：7.1Penalty:如一方违反本合同任何条款，违约方应向守约方支付违约金人民币元（大写：）。IfanypartybreachesanyprovisionofthisAgreement,thebreachingpartyshallpayapenaltyofRMB(inwords:)tothenon-breachingparty.7.2合同终止：7.2TerminationofContract:如一方严重违约，另一方有权单方面终止合同，并要求违约方赔偿由此造成的全部损失。IfonepartycommitsamaterialbreachofthisAgreement,theotherpartyshallhavetherighttoterminatethisAgreementunilaterallyandclaimcompensationforalllossessustainedthereby.第八条合同的变更与解除Clause8:ModificationandTerminationoftheAgreement8.1合同变更：8.1ModificationofAgreement:本合同的任何变更须经双方协商一致，并以书面形式确认。AnymodificationtothisAgreementshallbemadeonlyaftermutualagreementbetweenthepartiesandconfirmedinwriting.8.2合同解除：8.2TerminationofAgreement:如需解除合同，双方应提前日以书面形式通知对方。ToterminatethisAgreement,bothpartiesshallprovidewrittennoticetotheotherpartyatleastdaysinadvance.第九条争议解决Clause9:DisputeResolution因本合同引起的或与本合同有关的任何争议，双方应友好协商解决。协商不成的，任何一方均可向人民法院提起诉讼。AnydisputesarisingoutoforrelatingtothisAgreementshallbesettledamicablythroughfriendlynego
