钢结构安装分包商资质认证办法合同编号：__________单位名称：____________________单位地址：____________________联系人：____________________联系电话：____________________电子邮箱：____________________单位名称：____________________单位地址：____________________联系人：____________________联系电话：____________________电子邮箱：____________________鉴于委托方拟对钢结构安装工程进行分包，为确保工程质量和施工安全，委托方hereinafterreferredtoas"theClient"andthesubcontractorhereinafterreferredtoas"theSubcontractor".TheClientandtheSubcontractorhereagreeasfollows:1.ScopeofWorkTheSubcontractorshallberesponsiblefortheinstallationofsteelstructuresasspecifiedinthedrawingsandtechnicalspecificationsprovidedtheClient.Theinstallationworkshallbecarriedoutinaccordancewithrelevantlaws,regulations,standardsandindustrypractices.2.QualificationRequirements2.1TheSubcontractorshallbealegalentitydulyestablishedandlawfullyoperatinginthePeople'sRepublicofChina,withavalidbusinesslicenseandrelevantqualificationsforsteelstructureinstallationworks.2.3TheSubcontractorshallhaveexperienceinsimilarsteelstructureinstallationprojects,withtheabilitytoproviderelevantprojectexperienceandtechnicaldocumentationforreference.2.4TheSubcontractorshallhaveasoundfinancialconditionandtechnicalcapabilities,capableofundertakingthecontractworkandensuringthequality,safetyandprogressoftheproject.3.QualificationVerification3.1TheClientshallhavetherighttoinspectthequalificationsoftheSubcontractor,includingbutnotlimitedtothebusinesslicense,constructionlicense,safetyproductionlicense,andrelevanttechnicalqualifications.3.3TheClientmayconductonsiteinspectionsorentrustthirdpartyprofessionalinstitutionstoverifythequalificationsoftheSubcontractor.4.ContractExecution4.2TheSubcontractorshallperformtheworkinaccordancewiththetermsandconditionsofthecontract,andshallbefullyresponsibleforthequality,safetyand进度ofthework.5.Confidentiality5.1TheSubcontractorshallkeepconfidentialallinformationobtainedfromtheClientinrelationtotheproject,andshallnotdisclosesuchinformationtoanythirdpartywithoutthepriorwrittenconsentoftheClient.6.DisputeResolutionAnydisputesarisingoutoforinconnectionwiththisContractshallberesolvedthroughfriendlynegotiation.Intheeventoffailuretoresolvethroughnegotiation,eitherpartymaysubmitthedisputetothePeople'sCourtwithjurisdictionovertheplacewheretheClient'sregisteredofficeislocated.7.ValidityandTermination7.1ThisContractshalltakeeffectfromthedateofsigningandshallbevalidforoneyear.IftheSubcontractor'squalificationsarestillvalidaftertheexpirationofthisContract,theClientmayrenewthisContractuponmutualagreement.7.2eitherpartymayterminatethisContractgivingwrittennoticetotheotherpartyinadvanceof30days.INWITNESSWHEREOF,thepartiesheretohaveexecutedthisContractasofthedatefirstabovewritten.Client:____________________Subcontractor:____________________Representative:____________________Representative:____________________Date:____________________一、附件列表：1.承包方的营业执照复印件2.承包方的建设施工许可证复印件3.承包方的安全生产许可证复印件4.承包方的项目经验和技术文档5.承包方的财务报表复印件6.委托方提供的工程图纸和技术specifications7.委托方和承包方签署的书面合同二、违约行为及认定：1.承包方未能按照合同约定完成工作：认定标准为未达到约定的工程质量、安全或进度要求。2.承包方未能按照合同约定提供相关文档和信息：认定标准为未按时提供或提供的文档和信息不符合要求。3.承包方泄露了委托方的商业机密：认定标准为未经授权向第三方披露了与项目相关的机密信息。4.委托方未按时支付合同款项：认定标准为超过合同约定的支付期限未支付款项。三、法律名词及解释：1.钢结构安装分包商：指依法成立并具有相关资质，从事钢结构安装工程的企业。2.分包合同：指委托方与承包方之间签订的，委托承包方承担特定工程项目的合同。4.赔偿责任：指因违约行为给对方造成损失时，违约方应承担的赔偿责任。四、执行中遇到的问题及解决办法：1.工程质量问题：发现工程质量不符合约定时，应及时通知承包方进行整改。如整改后仍不符合要求，委托方可按合同约定追究承包方的责任。2.工程进度延误：如承包方未能按约定时间完成工作，委托方可要求承包方支付违约金或延迟完成工作的相关费用。3.泄露商业机密：如发现承包方泄露了委托方的商业机密，委托方
