住宅绿化承包合同编号：__________ResidentialGreeningContractBETWEEN:[Contractor’sName][Contractor’sAddress][Contractor’sContactInformation]AND:[Homeowner’sName][Homeowner’sAddress][Homeowner’sContactInformation]CONTRACTAGREEMENT:WHEREAS,theContractorisengagedinthebusinessofprovidingresidentialgreeningservices;ANDWHEREAS,theHomeownerdesirestocontractwiththeContractorfortheinstallationofaresidentialgreeningsystemontheHomeowner’sproperty;ANDWHEREAS,bothPartiesagreetothetermsandconditionssetforthherein.NOW,THEREFORE,inconsiderationofthemutualpromisescontainedherein,thePartiesagreeasfollows:1.ScopeofWorkTheContractoragreestoprovidetheHomeownerwitharesidentialgreeningsystem,whichshallinclude,butnotbelimitedto,theinstallationoftrees,shrubs,flowers,andotherplantmaterials,aswellasthenecessarysoilpreparation,grading,andirrigationsystems.2.InstallationProcessb.TheContractorshallperformtheworkinaprofessionalandworkmanlikemanner,inaccordancewithindustrystandardsandpractices.c.TheContractorshallberesponsibleforobtaininganynecessarypermitsorapprovalsfromlocalauthorities,attheHomeowner’sexpense.3.CompletionandAcceptanceb.TheHomeownershallhavetherighttoinspecttheworkandrequestanynecessarycorrectionsormodifications,whichtheContractorshallpromptlyperformatnoadditionalcosttotheHomeowner.c.TheHomeownershallaccepttheworkunderthisContractuponsatisfactionoftherequirementssetforthinparagraphs3(a)and3(b).4.Paymenta.TheHomeownershallpaytheContractorthetotalcontractprice,assetforthintheattachedScheduleA,inaccordancewiththepaymentschedulesetforthinparagraph4(b).b.Thepaymentscheduleshallbeasfollows:1.Adepositof[percentage]ofthetotalcontractpriceshallbepaidtheHomeownertotheContractoruponexecutionofthisContract.c.TheContractorshallprovidetheHomeownerwithadetailedinvoiceforallpaymentsmadeunderthisContract.5.Warrantiesa.TheContractorwarrantsthattheresidentialgreeningsysteminstalledunderthisContractshallbefreefromdefectsinmaterialsandworkmanshipforaperiodof[duration]followingacceptancetheHomeowner.b.TheContractorshallrepairorreplace,atitssolediscretion,anyportionoftheresidentialgreeningsystemthatisfoundtobedefectiveduringthewarrantyperiod,atnoadditionalcosttotheHomeowner.c.TheContractorshallnotbeliableforanydamageorinjurycausedactsofnature,misuse,orneglecttheHomeowneroranythirdparty.6.Indemnificationa.TheContractorshallindemnifyandholdharmlesstheHomeowneragainstanyandallclaims,damages,losses,andexpenses(includingattorney’sfees)arisingoutoforinconnectionwiththeperformanceofthisContract,excepttotheextentsuchclaims,damages,losses,andexpensesarecausedthenegligenceorwillfulmisconductoftheHomeowner.b.TheHomeownershallindemnifyandholdharmlesstheContractoragainstanyandallclaims,damages,losses,andexpenses(includingattorney’sfees)arisingoutoforinconnectionwiththeperformanceofthisContract,excepttotheextentsuchclaims,damages,losses,andexpensesarecausedthenegligenceorwillfulmisconductoftheContractor.7.Defaulta.IfeitherPartydefaultsintheperformanceofanyobligationsunderthisContract,theotherPartymaypursueanyavailablelegalorequitableremedy,including,withoutlimitation,specificperformanceandinjunctiverelief.8.GoverningLawandJurisdictionThisContractshallbegovernedandconstruedinaccordancewiththelawsofthe[jurisdiction].Anylegalaction一、附件列表：1.详细的住宅绿化系统安装计划2.合同价格明细表3.支付时间表4.合同担保书5.合同变更记录二、违约行为及认定：1.Contractor未能按照合同约定的时间表完成工作。2.Contractor未能按照行业标准提供合格的专业服务。3.Homeowner未能按时支付合同价款。4.Homeowner未能提供必要的工作场所或access。5.任何一方未能履行合同中规定的其他义务。三、法律名词及解释：1.住宅绿化承包：指Contractor为Homeowner提供的住宅绿化系统的安装服务。2.合同价款：指Homeowner根据合同约定支付给Contractor的费用，用于完成住宅绿化系统的安装。3.违约：指任何一方未能履行合同中规定的义务。4.担保书：指Contractor提供的，保证其履行合同义务的书面文件。5.行业标准：指Contractor在执行合同时应遵循的普遍认可的规范和做法。四、执行中遇到的问题及解决办法：1.天气延迟：如遇不可抗力因素导致工作进度延迟，双方应协商调整时间表。2.设计变更：如合同执行过程中Homeowner要求变更设计，Contractor应提供变更后的详细计划，并重新商定价格和时间表。3.额外费用：如因Homeowner要求增加服务或材料导致额外费
