TOC\o"1-4"\h\zHYPERLINKreferredtoinSub-Clause22.1are:ThePermanentuseoroccupationoflandbytheWorks,oranypartthereof,TherightoftheEmployertoexecutetheWorks,oranypartthereof,on,over,under,inorthroughanyland,DamagetopropertywhichistheunavoidableresultoftheexecutionandcompletionoftheWorks,ortheremedyingofanydefectstherein,inaccordancewiththeContract,DeathoforinjurytopersonsorlossofordamagetopropertyresultingfromanyactorneglectoftheEmployer,hisagents,servantsorothercontractors,notbeingemployedbytheContractor,orinrespectofanyclaims,proceedings,damages,costs,chargesandexpensesinrespectthereoforinrelationtheretoor,wheretheinjuryordamagewascontributedtobytheContractor,hisservantspragents,suchpartofthesaidinjuryordamageasmaybejustandequitablehavingregardtotheextentoftheresponsibilityoftheEmployer,hisservantsoragentsorothercontractorsfortheinjuryordamage.22.3IndemnitybyEmployerTheEmployershallindemnifytheContractoragainstallclaims,proceedings,damages,costs,chargesandexpenseinrespectofthemattersreferredtointheexceptionsdefinedinSub-ClauseThirdPartyInsurance(includingEmployer'sProperty)TheContractorshall,withoutlimitinghisortheEmployer'sobligationsandresponsibilitiesunderClause22,insure,inthejointnamesoftheContractorandtheEmployer,againstliabilitiesfordeathoforinjurytoanyperson(otherthanasprovidedinClause24)orlossofordamagetoanyproperty(otherthantheWorks)arisingoutofperformanceoftheContract,otherthantheexceptionsdefinedinparagraph(a),(b)and(c)ofSub-ClauseMinimumAmountofInsuranceSuchinsuranceshallbeforatleasttheamountstatedintheAppendixtoTender.23.3CrossLiabilitiesTheinsurancepolicyshallincludeacrossliabilityclausesuchthattheinsuranceshallapplytotheContractorandtotheEmployerasseparateensures.24.1AccidentorinjurytoWorkmenTheEmployershallnotbeliablefororinrespectofanydamagesorcompensationpayabletoanyworkmanorotherpersonintheemploymentoftheContractororanySubcontractor,otherthandeathorinjuryresultingfromanyactordefaultoftheEmployer,hisagentsorservants.TheContractorshallindemnifyandkeepindemnifiedtheEmployeragainstallsuchdamagesandcompensation,otherthanthoseforwhichtheEmployerisliableasaforesaid,andagainstallclaims,proceedings,damages,costs,charges,andexpenseswhatsoeverinspectthereoforinrelationthereto.24.2InsuranceAgainstAccidenttoWorkmenTheContractorshallinsureagainstsuchliabilityandshallcontinuesuchinsuranceduringthewholeofthetimethatanypersonsareemployedbyhimontheWorks.Providedthat,inrespectofanypersonsemployedbyanySubcontractor,theContractor'sobligationstoinsureasaforesaidunderthisSub-ClauseshallbesatisfiediftheSubcontractorshallhaveinsuredagainsttheliabilityinrespectofsuchpersonsinsuchmannerthattheEmployerisindemnifiedunderthepolicy,buttheContractorshallrequiresuchSubcontractortoproducetotheEmployer,whenrequired,suchpolicyofinsuranceandthereceiptforthepaymentofthecurrentpremium.25.1EvidenceandTermsofInsurancesTheContractorshallprovideevidencetotheEmployerpriortothestartofworkattheSitethattheinsurancesrequiredundertheContracthavebeeneffectedandshall,within84daysoftheCommencementDate,providetheinsurancepoliciestotheEmployer.WhenprovidingsuchevidenceandsuchpoliciestotheEmployer,theContractor,theContractorshallnotifytheEngineerofsodoing.SuchinsurancepoliciesshallbeconsistentwiththegeneraltermsagreedpriortotheissueoftheLetterofAcceptance.TheContractorshalleffectallinsurancesforwhichheisresponsiblewithinsurersandintermsapprovedbytheEmployer.25.2AdequacyofInsurancesTheContractorshallnotifytheinsurersofchangesinthenature,extentorprogrammefortheexecutionoftheWorksandensuretheadequacyoftheinsurancesatalltimesinaccordancewiththetermoftheContractandshall,whenrequired,producetotheEmployertheinsurancepoliciesinforceandthereceiptforpaymentofthecurrentpremiums.25.3RemedyonContractor'sFailuretoInsureIftheContractorfailstoeffectandkeepinforceanyoftheinsurancesrequiredundertheContract,orfailstoprovidesthepoliciestotheEmployerwithintheperiodrequiredbySub-Clause25.1thenandinanysuchcasetheEmployermayeffectandkeepinforceanysuchinsurancesandpayanypremiumasmaybenecessaryforthatpurposefromtimetotimededucttheamountsopaidfromanymoniesdueortobecomeduetotheContractor,orrecoverthesameasadebtduefromtheContractor.25.4CompliancewithPolicyConditionsIntheeventthattheContractorortheEmployerfailstocomplywithconditionsimposedbytheinsurancepolicieseffectedpursuanttotheContract,eachshallindemnifytheotheragainstalllossesandclaimsarisingfromsuchfailure.26.1CompliancewithStatutes,RegulationsTheContractorshallconforminallrespects,includingbythegivingofallnoticesandthepayingofallfees,withtheprovisionsof:anyNationalorStateStatute,Ordinance,orotherLaw,oranyregulation,orbye-lawofanylocalorotherdulyconstitutedauthorityinrelationtotheexecutionandcompletionoftheWorksandtheremedyingofanydefectstherein,andtherulesandregulationsofallpublicbodiesandcompanieswhosepropertyorrightsareaffectedormaybeaffectedinanywaybytheWorks,andtheContractorshallkeeptheEmployerindemnifiedagainstallpenaltiesandliabilityofeverykindforbreachofanysuchprovisions.ProvidedalwaysthattheEmployershallberesponsibleforobtaininganyplanning,zoningorothersimilarpermissionrequiredfortheWorkstoproceedandshallindemnifytheContractorinaccordancewithSub-ClauseFossilsAllfossils,coins,articlesofvalueorantiquityandstructuresandotherremainsorthingsofgeologicalorarchaeologicalinterestdiscoveredonSiteshall,asbetweentheEmployerandtheContractor,bedeemedtobetheabsolutepropertyoftheEmployer.TheContractorshalltakereasonableprecautionstopreventhisworkmenoranyotherpersonsfromremovingordamaginganysucharticleorthingandshall,immediatelyupondiscoverythereofandbeforeremovalacquainttheEngineerofsuchdiscoveryandcarryouttheEngineer'sinstructionsfordealingwiththesame.If,byreasonofsuchinstructions,theContractorsuffersdelayand/orincurscoststhentheEngineershall,afterdueconsultationwiththeEmployerandtheContractor,determine:anyextensionoftimetowhichtheContractorisentitledunderClause44,andtheamountofsuchcosts,whichshallbeaddedtotheContractPrice,andshallnotifytheContractoraccordingly,withacopytotheEmployer.28.1PatentRightsTheContractorshallhaveharmlessandindemnifytheEmployerfromandagainstallclaimsandproceedingsfororonaccountofinfringementofanypatentrights,designtrademarkornameorotherprotectedrightsinrespectofanyContractor'sEquipment,materialsorPlantusedfororinconnectionwithorforincorporationintheWorksandfromandagainstalldamages,costs,chargesandexpenseswhatsoeverinrespectthereoforinrelationthereto,exceptwheresuchinfringementresultsfromcompliancewiththedesignorSpecificationprovidedbytheEngineer.28.2RoyaltiesExceptwhereotherwisestated,theContractorshallpayalltonnageandotherroyalties,rentandotherpaymentsorcompensation,ifany,forgettingstone,sand,gravel,clayorothermaterialsrequiredfortheWorks.29.1InterferencewithTrafficandAdjoiningPropertiesAlloperationsnecessaryfortheexecutionandcompletionoftheWorksandtheremedyingofanydefectsthereinshall,sofarascompliancewiththerequirementsoftheContractpermits,becarriedonsoasnottointerfereunnecessarilyorimproperlywith:theconvenienceofthepublic,ortheaccesstouseandoccupationofpublicorprivateroadsandfootpathstoorofpropertieswhetherinthepossessionoftheEmployerorofanyotherperson.TheContractorshallhaveharmlessandindemnifytheEmployerinrespectofallclaims,proceedings,damages,costs,chargesandexpenseswhatsoeverarisingoutof,orinrelationto,anysuchmattersinsofaratheContractorisresponsibletherefor.30.1AvoidanceofDamagetoRoadsTheContractorshalluseeveryreasonablemeanstopreventanyoftheroadsorbridgescommunicatingwithorontheroutestotheSitefrombeingdamagedorinjuredbyanytrafficoftheContractororanyofhisSubcontractorsand,inparticular,shallselectroutes,chooseandusevehiclesandrestrictanddistributeloadssothatanysuchextraordinarytrafficawillinevitablyarisefromthemovingofmaterials,Plant,Contractor'sEquipmentortemporaryWorksfromandtotheSiteshallbelimited,asfarasreasonablypossible,andsothatnounnecessarydamageorinjurymaybeoccasionedtosuchroadsandbridges.30.2TransportofContractor'sEquipmentorTemporaryWorksSaveinsofarastheContractotherwiseprovides,theContractorshallberesponsibleforandshallpaythecostofstrengtheninganybridgesoralteringorimprovinganyroadcommunicatingwithorontheroutestotheSitetofacilitatethemovementofContractor'sEquipmentofTemporaryWorksandtheContractorshallindemnifyandkeepindemnifiedtheEmployeragainstallclaimsfordamagetoanysuchroadorbridgecausedbysuchmovement,includingsuchclaimsasmaybemadedirectlyagainsttheEmployer,andshallnegotiateandpayallclaimsarisingsolelyoutofsuchdamage.30.3TransportofMaterialsorPlantIf,notwithstandingSub-Clause30.1,anydamageoccurstoanybridgeorroadcommunicatingwithorontheroutestotheSitearisingfromthetransportofmaterialsorPlant,theContractorshallnotifytheEngineerwithacopytotheEmployer,assoonashebecomesawareofsuchdamageorassoonahereceivesanyclaimfromtheauthorityentitledtomakesuchclaim.WhereunderanylaworregulationthehaulerofsuchmaterialsorPlantisrequiredtoindemnifytheroadauthorityagainstdamagetheEmployershallnotbeliableforanycosts,chargesorexpensesinrespectthereoforinrelationthereto.InothercasestheEmployershallnegotiatethesettlementofandpayallsumsdueinrespectofsuchclaimandshallindemnifytheContractorinrespectthereofandinrespectofallclaims,proceedings,damages,costs,chargesandexpensesinrelationthereto.Providedthatifandsofarasanysuchclaimorpartthereofis,intheopinionoftheEngineer,duetoanyfailureonthepartoftheContractortoobserveandperformhisobligationsunderSub-Clause30.1,thentheamount,determinedbytheEngineer,afterdueconsultationwiththeEmployerandtheContractor,tobeduetosuchfailureshallberecoverablefromtheContractorbytheEmployerandmaybedeductedbytheEmployerfromanymoniesdueortobecomeduetotheContractorandtheEngineershallnotifytheContractoraccordingly,withacopytotheEmployer.ProvidedalsothattheEmployeralsothattheEmployershallnotifytheContractorwheneverasettlementistobenegotiatedand,whereanyamountmaybeduefromtheContractor,theEmployershallconsultwiththeContractorbeforesuchsettlementisagreed.30.4WaterborneTrafficWherethenatureoftheWorksissuchastorequiretheusebytheContractorofwaterbornetransporttheforegoingprovisionsofthisClauseshallbeconstruedasthough"road"includedalock,dock,seawallorotherstructurerelatedtoawaterwayand"vehicle"includedcraft,andshallhaveeffectaccordingly.31.1OpportunitiesforOtherContractorsTheContractorshall,inaccordancewiththerequirementsoftheEngineer,affordallreasonableopportunitiesforcarryingouttheirworkto:anyothercontractorsemployedbytheEmployerandtheirworkmen,theworkmenoftheEmployer,andtheworkmenofanydulyconstitutedauthoritieswhomaybeemployedintheexecutiononorneartheSiteofanyworknotincludedintheContractorofanycontractwhichtheEmployermayenterintoinconnectionwithorancillarytotheWorks.31.2FacilitiesforOtherContractorsIf,however,pursuanttoSub-Clause31.1theContractorshall,onthewrittenrequestoftheEngineer:makeavailabletoanysuchothercontractor,ortotheEmployeroranysuchauthority,anyroadsorwaysforthemaintenanceofwhichtheContractorisresponsible,orpermittheuse,byanysuch,ofTemporaryWorksorContractor'sEquipmentontheSite,orprovideanyotherserviceofwhatsoevernatureforanysuchTheEngineershalldetermineanadditiontotheContractPriceinaccordancewithClause52andshallnotifytheContractoraccordingly,withacopytotheEmployer.32.1ContractortoKeepSiteClearDuringtheexecutionoftheWorkstheContractorshallkeeptheSiteseasonablyfreeformallunnecessaryobstructionandshallstoreordisposeofanyContractor'sEquipmentandsurplusmaterialsandclearawayandremovefromtheSiteanywreckage,rubbishorTemporaryWorksnolongerrequired.33.1ClearanceofSiteonCompletionUpontheissueofanyTaking-OverCertificatetheContractorshallclearawayandremovefromthatparoftheSitetowhichsuchTaking-OverCertificaterelatesallContractor'sEquipment,surplusmaterial,rubbishandTemporaryWorksofeverykind,andleavesuchpartoftheSiteandWorkscleanandinaworkmanlikeconditiontothesatisfactionoftheengineer.ProvidedthattheContractorshallbeentitledtoretainonSite,untiltheendoftheDefectsLiabilityPeriod,suchmaterials,Contractor'sEquipmentandTemporaryWorksasarerequiredbyhimforpurposeoffulfillinghisobligationsduringtheDefectsLiabilityperiod.Labour34.1EngagementofStaffandLabourTheContractorshall,unlessotherwiseprovidedintheContract,makehisownarrangementsfortheengagementofallstaffandlabour,localorother,andfortheirpayment,housing,feedingandtransport.35.1ReturnofLabourandContractor'sEquipmentTheContractorshall,ifrequiredbytheEngineer,delivertotheEngineerareturnindetail,insuchformandatsuchintervalsatheEngineermayprescribe,showingthestaffandthenumbersoftheseveralclassesoflabourfromtimetotimeemployedbytheContractorontheSiteandsuchinformationrespectingContractor'sEquipmentastheEngineermayrequire.Materials,PlantandWorkmanship36.1QualityofMaterials,PlantandWorkmanshipAllmaterials,PlantandworkmanshipshallbeoftherespectivekindsdescribedintheContractandinaccordancewiththeEngineer'sinstructions,andsubjectedfromtimetotimetosuchtestsastheEngineermayrequireattheplaceofmanufacture,fabricationorpreparation,orontheSiteoratsuchotherplaceorplacesasmaybespecifiedintheContract,oratalloranyofsuchplaces.TheContractorshallprovidesuchassistance,labour,electricity,fuels,stores,apparatusandinstrumentsasarenormallyrequiredforexamining,measuringandtestinganymaterialsorPlantandshallsupplysamplesofmaterials,beforeincorporationintheWorks,fortestingasmaybeselectedandrequiredbytheEngineer.36.2CostofSamplesAllsamplesshallbesuppliedbytheContractorathisowncostifthesupplythereofisclearlyintendedbyorprovidedforintheContract.36.3CostofTestsThecostofmakinganytestshallbebornebytheContractorifsuchtestisclearlyintendedbyorprovidedforintheContract,orparticularizedintheContract(incasesonlyofatestunderloadorofatesttoascertainwhetherthedesignofanyfinishedorpartiallyfinishedworkisappropriateforthepurposewhichitwasintendedtofulfil)insufficientdetailtoenabletheContractortopriceorallowforthesameinhisTender.36.4CostofTestsnotProvidedforIfanytestrequiredbytheEngineerwhichisnotsointendedbyorprovidedfor,or(inthecasesabovementioned)notsoparticularised,or(thoughsointendedorprovidedfor)requiredbytheEngineertobecarriedoutatanyplaceotherthantheSiteortheplaceofmanufacture,fabricationorpreparationofthematerialsorPlanttested,showsthematerials,PlantorworkmanshipnottobeinaccordancewiththeprovisionsoftheContracttothesatisfactionoftheEngineer,thenthecostofsuchtestshallbebornebytheContractor,butinanyothercaseSub-Clause36.5shallapply.36.5Engineer'sDeterminationwhereTestsnotProvidedforWhere,pursuanttoSub-Clause36.4thisSub-Clauseapplies,theEngineershall,afterdueconsultationwiththeEmployerandtheContractor,determineanyextensionoftimetowhichtheContractorisentitledunderClause44,andtheamountofsuchcosts,whichshallbeaddedtotheContractPrice,andshallnotifytheContractoraccordingly,withacopytotheEmployer.37.1InspectionofOperationsTheEngineer,andanypersonauthorisedbyhim,shallatallreasonabletimeshaveaccesstotheSiteandtoallworkshopsandplaceswherematerialsorPlantarebeingmanufactured,fabricatedorpreparedfortheWorksandtheContractorshallaffordeveryfacilityforandeveryassistanceinobtainingtherighttosuchaccess.37.2InspectionandTestingTheEngineershallbeentitled,duringmanufacture,fabricationorpreparationtoinspectandtestthematerialsandPlanttobesuppliedundertheContract.IfmaterialsorPlantarebeingmanufactured,fabricatedorpreparedinworkshopsorplacesotherthanthoseoftheContractor,theContractorshallobtainpermissionfortheEngineertocarryoutsuchinspectionandtestinginthoseworkshopsorplaces.SuchinspectionortestingshallnotreleasetheContractorfromanyobligationundertheContract.37.3DatesforInspectionandTestingTheContractorshallagreewiththeEngineeronthetimeandplacefortheinspectionortestingofanymaterialsorPlantasprovidedintheContract.TheEngineershallgivetheContractornotlessthan24hoursnoticeofhisintentiontocarryouttheinspectionortoattendthetests.IftheEngineer,orhisdulyauthorisedrepresentative,doesnotattendonthedateagreed,theContractormay,unlessotherwiseinstructedbytheEngineer,proceedwiththetests,whichshallbedeemedtohavebeenmadeinthepresenceoftheEngineer.TheContractorshallforthwithforwardtotheEngineerdulycertifiedcopiesofthetestreadings.IftheEngineerhasnotattendedthetests,heshallacceptthesaidreadingsasaccurate.37.4RejectionIf,atthetimeandplaceagreedinaccordancewithSub-Clause37.3,thematerialsorPlantarenotreadyforinspectionortestingorif,asaresultoftheinspectionortestingreferredtointhisClause,theEngineerdeterminesthatthematerialsorPlantaredefectiveorotherwisenotinaccordancewiththeContract,hemayrejectthematerialsorPlantandshallnotifytheContractorthereofimmediately.ThenoticeshallstatetheEngineer'sobjectionswithreasons.TheContractorshallthenpromptlymakegoodthedefectorensurethatrejectedmaterialsorPlantcomplywiththeContract.IftheEngineersorequests,thetestsofrejectedmaterialsorPlantshallbemadeorrepeatedunderthesametermsandconditions.AllcostsincurredbytheEmployerbytherepetitionofthetestsshall,afterdueconsultationwiththeEmployerandtheContractor,bedeterminedbytheEngineerandshallberecoverablefromtheContractorbytheEmployerandmaybedeductedfromanymoniesdueortobecomeduetotheContractorandtheEngineershallnotifytheContractoraccordingly,withacopytotheEmployer.37.5IndependentInspectionTheEngineermaydelegateinspectionandtestingofmaterialsorPlanttoanindependentinspector.AnysuchdelegationshallbeeffectedinaccordancewithSub-Clause2.4andforthispurposesuchindependentinspectorshallbeconsideredasanassistantoftheEngineer.Noticeofsuchappointment(notbeinglessthan14days)shallbegivenbytheEngineertotheContractor.38.1ExaminationofWorkbeforeCoveringupNopartoftheWorksshallbecovereduporputoutofviewwithouttheapprovaloftheEngineerandtheContractorshallaffordfullopportunityfortheEngineertoexamineandmeasureanysuchpartoftheWorkswhichisabouttobecovereduporputoutofviewandtoexaminefoundationsbeforeanypartoftheWorksisplacedthereon.TheContractorshallgivenoticetotheEngineerwheneveranysuchpartoftheWorksorfoundationsisorarereadyorabouttobereadyforexaminationandtheEngineershall,withoutunreasonabledelay,unlessheconsidersitunnecessaryandadvisestheContractoraccordingly,attendforthepurposeofexaminingandmeasuringsuchoftheWorksorofexaminingsuchfoundations.38.2UncoveringandMakingOpeningsTheContractorshalluncoveranypartoftheWorksormakeopeningsinorthroughthesameastheEngineermayfromtimetotimeinstructandshallreinstateandmakegoodsuchpart.IfanysuchparthasbeencovereduporputoutofviewaftercompliancewiththerequirementofSub-Clause38.1andisfoundtobeexecutedinaccordancewiththeContract,theEngineershall,afterdueconsultationwiththeEmployerandtheContractor,determinetheamountoftheContractor'scostsinrespectofsuchofuncovering,makingopeningsinorthrough,reinstatingandmakinggoodthesame,whichshallbeaddedtotheContractPrice,andshallnotifytheContractoraccordingly,withacopytotheemployer.InanyothercaseallcostsshallbebornebytheContractor.39.1RemovalofImproperWork,MaterialsorPlantTheEngineershallhaveauthoritytoissueinstructionsfromtimetotime,for:theremovalfromtheSite,withinsuchtimeortimesasmaybespecifiedintheinstruction,ofanymaterialsorPlantwhich,intheopinionoftheEngineer,arenotinaccordancewiththeContract,thesubstitutionofproperandsuitablematerialsorPlant,andtheremovalandproperre-execution,notwithstandinganyprevioustestthereoforinterimpaymentthereforofanyworkwhich,inrespectof(i) DesignbytheContractororforwhichheisresponsible,isnot,intheopinionoftheEngineer,inaccordancewiththeContract.39.2DefaultofContractorinComplianceIncaseofdefaultonthepartoftheContractorincarryingoutsuchinstructionwithinthetimespecifiedthereinor,ifnone,withinareasonabletime,theEmployershallbeentitledtoemployandpayotherpersonstocarryoutthesameandallcostsconsequentthereonorincidentaltheretoshall,afterdueconsultationwiththeEmployerandtheContractor,bedeterminedbytheEngineerandshallberecoverablefromtheContractorbytheEmployer,andmaybedeductedbytheEmployerfromanymoniesdueortobecomeduetotheContractor,andtheEngineershallnotifytheContractoraccordingly,withacopytotheEmployer.Suspension40.1SuspensionofWorkTheContractorshall,ontheinstructionsoftheEngineer,suspendtheprogressoftheWorksoranypartthereofforsuchtimeandinsuchmannerastheEngineermayconsidernecessaryandshall,duringsuchsuspension,properlyprotectandsecuretheWorksorsuchpartthereofsofarasisnecessaryintheopinionoftheEngineer.UnlesssuchsuspensionisotherwiseprovidedforintheContract,ornecessarybyreasonofsomedefaultoforbreachofcontractbytheContractororforwhichheisresponsible,ornecessarybyreasonofclimaticconditionsontheSite,ornecessaryfortheproperexecutionoftheWorksorforthesafetyoftheWorksoranypartthereof(savetotheextentthatsuchnecessityarisesfromanyactordefaultbytheEngineerortheEmployerorfromanyoftherisksdefinedinSub-Clause20.4),Sub-Clause40.2shallapply.40.2Engineer’sDeterminationfollowingSuspensionWhere,pursuanttoSub-Clause40.1thisSub-Clauseapplies,theEngineershall,afterdueconsultationwiththeEmployerandtheContractor,determineanyextensionoftimetowhichtheContractorPrice,inrespectofthecostincurredbytheContractorbyreasonofsuchsuspension,andshallnotifytheContractoraccordingly,withacopytotheEmployer.40.3Suspensionlastingmorethan84DaysIftheprogressoftheWorksoranypartthereofissuspendedonthewritteninstructionsoftheEngineerandifpermissiontoresumeworkisnotgivenbytheEngineerwithinaperiodof84daysfromthedateofsuspensionthen,unlesssuchsuspensioniswithinparagraph(a),(b),(c)or(d)ofSub-Clause40.1,theContractormaygivenoticetotheEngineerrequiringpermission,within28daysfromthereceiptthereof,toproceedwiththeWorksorthatpartthereofinregardtowhichprogressissuspended.If,withinthesaidtime,suchpermissionisnotgranted,theContractormay,butisnotboundto,electtotreatthesuspension,whereitaffectspartonlyoftheWorks,asanomissionofsuchpartunderClause51bygivingafurthernoticetotheEngineertothateffect,or,whereinaffectsthewholeoftheWorks,treatthesuspensionasaneventofdefaultbytheEmployerandterminatehisemploymentundertheContractinaccordancewiththeprovisionsofSub-Clause69.1,whereupontheprovisionsofSub-Clauses69.2and69.3shallapply.CommencementandDelays41.1CommencementofWorksTheContractorshallcommencetheWorksassoonasisreasonablypossibleafterthereceiptbyhimofanoticetothiseffectfromtheEngineer,whichnoticeshallbeissuedwithinthetimestatedintheAppendixtoTenderafterthedateoftheLetterofAcceptance.Thereafter,theContractorshallproceedwiththeWorkswithdueexpeditionandwithoutdelay.42.1PossessionofSiteandAccessTheretoSaveinsofarastheContractmayprescribetheextentofportionsoftheSiteofwhichtheContractoristobegivenpossessionfromtimetotime,andtheorderinwhichsuchportionsshallbemadeavailabletotheContractorandsubjecttoanyrequirementintheContractastotheorderinwhichtheWorksshallbeexecuted,theEmployerwill,withtheEngineer'sNoticetoCommencetheWorks,givetotheContractorpossessionofsomuchoftheSite,andsuchaccessas,inaccordancewiththeContract,istobeprovidedbytheEmployerasmayberequiredtoenabletheContractortocommenceandproceedwiththeexecutionoft
