After the5公司劳动合同-Labor-Contract- 中英文版probation period, Party B’snormal basic salary is________,plusannual bonus, which can be adjusted as per the company’soperationandPartyB ’sperformance.在甲方取得中国企业营业执照之前，甲方不承担乙方社会保险费用和医疗保险费用；在甲方取得其企业营业执照后，甲方须承担乙方相关社会、医疗保险费用，并按照国家有关规定对乙方所应承担的社会保险费用及个人所得税进行代缴。BeforePartyAobtainsitsBusinessLicenseofficially,PartyAisnotresponsibleforpayingoffPartyB’ssocialandmedicalinsurance;afterPartyAobtainsitsBusinessLicense,itmustpayrelatedPartyB’ssocialandmedicalinsuranceandwilldeductPartyB’sownsocialandmedicalinsurancepremiumandindividualincometaxfromPartyB’ssalarytopaytotheChinesegovernment.甲方调整乙方工作岗位的，根据乙方能力及其相关职位，双方协商一致后调整乙方劳动报酬。Party B’slabor remuneration will beadjusted asper Party B’scompetenceandjobrequirementsonthebasisofconsensusincasePartyAadjustPartyB ’sjob.11. 甲方将每年对乙方的工作成绩、表现，以及劳动报酬进行评估 .6公司劳动合同-Labor-Contract- 中英文版PartyAwillreviewPartyB ’sworkperformanceandsalaryonanannualbasis.五、社会保险和福利待遇 SocialWelfare&Benefits甲方根据国家有关规定为乙方缴纳北京市城镇社会保险（养老、医疗、失业、工伤），个人缴纳部分由甲方从乙方工资中代扣代缴。甲乙双方解除、终止劳动合同时，甲方按有关规定为乙方办理社会保险相关手续。AccordingtotheState’srelatedrules,PartyAwillpayBeijingsocialinsuranceinurbanarea(i.e.pensioninsurance,unemploymentinsurance,OccupationalInjuryandmedicalinsurance)forPartyB.AndPartyAwilldeductPartyB’spartfromhisorhersalary.Whenthelaborcontractisterminatedbybothparties,PartyAwillhandletherelatedproceduresforPartyB’ssocialinsuranceaccordingtotherelatedregulations.13.乙方非因工疾病或负伤，在医疗期内工资及其医疗待遇按照本合同16条执行。乙方患职业病或因工负伤后的工资和医疗补助执行按照国家和地方的有关法律法规执行。Incaseofillnessesorinjuriesunrelatedtowork,thesalaryduringtheremedial period as well as medical treatment shall be paid in7公司劳动合同-Labor-Contract- 中英文版accordancewithClause16.ThesalaryandMedicarebenefitsofPartyBincaseofoccupationaldiseasesorwork-relatedinjuriesshallbepaidinaccordancewiththerelevantnationalandlocallawsandregulations.因公出差按公司规定实行差旅费报销与补贴。IncasePartyBtravelsonbusiness,PartyAwillreimbursetravellingexpensesandgivesubsidytoPartyBinaccordancewiththecompanyrules.六、假期安排 AnnualLeaveandSickLeave带薪年假–雇佣期满一年后，甲方每年为乙方提供十天带薪年假。乙方需根据甲方经营和工作等实际情况，安排年假，尽量将甲方损失最小化。乙方休年假时，必须提前一个月通知甲方，并取得甲方批准，方可休假。AnnualLeave–PartyBshallbeentitledtotakepaidannualleaveoften(10)workingdaysperannumafterthefirstyeartheemployment.Leavemaybetakenasitisaccruedbutmayonlybetakenattimesagreedtobythecompanyinorderthatdisruptionwillbeminimal.Requestforleavemustbesubmittedone(1)monthinadvanceandapprovedbyPartyA.16. 病假–如乙方不涉及住院治疗，甲方将每年批准乙方共计 15天带薪病8公司劳动合同-Labor-Contract- 中英文版假；其中全薪病假五天，三分之二薪金病假五天，以及三分之一薪金病假五天。如乙方病假日期总数超过甲方允许的病假日期总数，超出部分将在乙方带薪年假日期数中扣除；如果乙方病假日期总数超出了甲方允许的病假和带薪年假日期总和，甲方将不会支付乙方超出日期的任何薪金。乙方必须向甲方财务或行政部出具医院的相关病假证明并通知乙方上级部门，如乙方不能提供相关医院病假证明，视为乙方旷工处理，甲方有权不支付乙方旷工期间任何薪金。PartyBisentitledtofive(5)dayssickleaveperfullcalendaryearatfullpay,nextfive(5)dayssickleaveattwo-thirdpayandnextfive(5)dayssickleaveatone-thirdpay,ifnohospitalizationisincurred.MedicalCertificatesmustbesubmittedtoourAccounts/Admindepartmentuponreturningtotheoffice;ifnot,PartyAhasrightnottopayforPartyB’sabsence.PartyBisrequiredtoinformitssupervisorandthedirectorsifPartyBrequiressickleave.AllabsencebeyondPartyB ’sallocatedsickleaveisdeductedfromitsvacationtime.lfboththesickleaveandvacationleavesareusedup,PartyBwillnotbeentitledtobepaidforits timethatPartyBisabsentfromwork.七、劳动纪律 LaborDisciplines9公司劳动合同-Labor-Contract- 中英文版合同期间，乙方应严格遵守国家的各项法律法规及甲方依法制定的各项规章制度及要求，严格遵守劳动安全卫生、操作规程及工作规范；应爱护甲方财产，遵守职业道德，积极维护公司荣誉和利益。Withinthecontractterm,PartyBshallabidebytheState ’slawregulationsaswellastherulesformulatedbyPartyAaccordingtothelaws;followlaborsecurityandhygienesystems,productionprocesses,operatinginstructionsandjobspecifications;takegoodcareofPartyA’sproperty; and safeguard the benefits and reputation of thecompany.乙方违反劳动纪律，甲方可依据本公司的规章制度给予纪律处分，直至解除本劳动合同。另外，由于乙方的原因对甲方造成经济损失的，原则上必须按照实际损失金额由乙方向甲方承担损害赔偿责任，数目重大者甲方有权追究其法律责任。IncaseParty Bviolates any ofthe labor disciplines, Party AmaypunishPartyBorevenreleasethecontractaccordingtotherulesandregulationsofthecompany.Moreover,PartyBwillbeheldliableforPartyA ’seconomiclossesonacase -by-casebasis,intheeventthatParty B’sbehavior damages Party A’sinterests.
