onetimelyaftergoodsarriveatPartyB’sCustomsbondedwarehouse.货物运抵目的地现场后，乙方和收货人出具联合检验报告（以货物签收单形式体现）。如有货损货差，请公证行出货物保险勘察报告。全部货物到货后，乙方必须提交甲方货物的交接报告（乙方和收货人共同签署）作为项目全部完成的依据。PartyBandtheconsigneeshall,uponarrivingatthedestinationsite,issueajointinspectionreport(intheformofgoodsreceiptform).Providedthatifanydamageorlossofcargofound,thecargoinsurancesurveyreportshouldbeissuedbythenotaryoffice.PartyBshould,subsequencetosubmitthedeliveryreportofPartyA’scargo(signedbybothPartyBandtheconsignee)asthebasisforthecompletionoftheproject.进入乙方仓库的进港货物，乙方应严格按照航空货运单上列明的收货人，及时通知收货人提取；乙方不得以任何理由积压货物并以此向收货人收取不正当费用，由此引起的一切后果由乙方承担。FortheinboundgoodsarrivedatPartyB’swarehouse,PartyBshouldtimelyinformtheconsigneetodothepickupstrictlyaccordingtothenamelistedasconsigneeonAWB.PartyBcannotmakegoodsoverstockedandchargeconsigneesunlawfullybyanyreasons.OtherwisePartyBwillberesponsibleforallconsequences.乙方如发现有甲方错分货物时，乙方应尽快将货物退还甲方仓库，不得以任何理由拖延。IfPartyBfoundanygoodsmistakendeliveredbyPartyA,PartyBshouldreturnthegoodsASAPandcannotdelaywithanyreason.由乙方负责打板装箱的货物，必须满足民航安检规定“航班起飞前24小时入库”，否则必须经安检检查方能收货。甲方对货物内容的短缺和损坏及货物受潮后产生的损失不负责任。木质包装至美、加等国的货物需提供熏蒸证明。Thecargobuilt-upbyPartyBmustbeputintothePartyA’swarehouseinadvanceandtheregulation,“24hourspriortodeparture”issuedbytheCAAC,willbeapplicable.Otherwisesecuritycheckmustbedone.PartyAwillnotbeliableforshortincontents,lossanddamagearisingfromdamp.IfcargoexportingtoUSAandCanadaispackedwithwood,PartyBshouldprovidethefumigationcertificate.由甲方负责打板装箱的货物，乙方必须遵守第2.7条规定的截止交货时间，甲方按交接清单现场查验，核收航空货运单和货物，乙方负责将货物搬运上安检入口，甲方负责在安检出口处接收，安检过程中发生异常情况的货物或发现不合规格货物有可能使内件短缺或损毁等不正常情况，甲方可以拒收，交乙方处理，若发现货物交接清单与实物不符，由乙方负责更正后交甲方。PartyBshouldcomplywiththeCut-offtimestipulatedinItem2.7tohandovertheloosecargotoPartyAwhichwillberesponsibleforbuild-up.PartyAshouldchecktheAWBandcargoatspotinaccordancewiththeD/L.PartyBshouldmovethecargotoX-RayentranceandPartyAreceivesthecargoatX-Rayexit.PartyAhastherighttorefuseacceptingcargoandreturningittoPartyBincasethatPartyAfindoutsomeirregularitiesorcargonotbeinguptostandardmaybepotentiallycausesthecontentsshortordamagedintheprocessofsecuritycheck.PartyBshouldbeliableformodifyingalldocumentsandthendoredeliveryprovidedthattheD/Lisinconsistentwithphysicalcargo.货物装卸与交接HandlingandDeliveryofGoods货物装车时，甲乙双方均应在现场清点交接（甲方仅需确认货物外包装完好且装车箱数准确）,如发现数量短缺或外包装破损现象，由甲乙双方当场核实，如乙方仍要求运送该批货物，由乙方在托运单据上注明货物实际情况并由甲乙双方签字确认。Whenthegoodsareloaded,bothpartiesshallcheckanddeliverthegoodsatsite(PartyAonlyneedstomakesurethatthepackagesofgoodsareintactandthenumberofloadingcasesiscorrect).Incasethatthegoodsareinshortageorthepackagesaredamaged,bothpartiesshallcheckoutonsite.IncasethatPartyBstilldemandstodeliverthegoods,PartyBshallindicatetheactualstatusofgoodsonshippingdocumentwhichshallbesignedandconfirmedbybothparties.第二部分目录TABLEOFCONTENTS13托运方的违约责任SHIPPER’SOBLIGATIONFORBREACH14.承运方的违约责任CARRIER’SOBLIGATIONFORBREACH15.承运方的留置权和对逾期不领取货物的处置权CARRIER'SLIENANDDISPOSITIONOFGOODSNOTRECEIVEDOVERTIME16.收货人的违约责任CONSIGNEE’SOBLIGATIONFORBREACH17.货物损毁或灭失的索赔与理赔CLAIMSANDSETTLEMENTFORDAMAGEORLOSSOFGOODS18.仓储库房需求计划WAREHOUSEDEMANDPLAN19.仓储费用标准COSTSTANDARDFORSTORAGE20.仓储费用支付方式PAYMENTFORWAREHOUSINGEXPENSE21.仓储管理方的责任和义务RESPONSIBILITIESANDOBLIGATIONSOFTHEWAREHOUSEMANAGER22.仓储使用方的责任和义务RESPONSIBILITIESANDOBLIGATIONSOFTHESTORAGEUSERS23.免责或责任限制EXEMPTIONORLIMITATIONOFLIABILITY部分章节示例如下：13托运方的违约责任SHIPPER’SOBLIGATIONFORBREACH未按合同规定的时间提供托运的货物，托运方应偿付给承运方违约金___元。Iftheshipperdoesnotdeliverythegoodstothecarrierasperthestipulatedtime,theshippershallpaytothecarrierRMB___asapenalty.未按合同约定接收托运货物的，每逾期一日，向甲方赔付总运费1%的违约金，并赔偿由此给甲方造成的损失。Providedthatiftheconsignmentisnotacceptedasstipulatedinthecontract,PartyBshallpayPartyAaliquidateddamagesof1%ofthetotalfreightforeachdayoverdue,inadditiontocompensatePartyAforthelossescausedthereby.由于在普通货物中夹带、匿报危险货物，错报笨重货物重量等招致吊具断裂、货物摔损、吊机倾翻、爆炸、腐烛等事故，托运方应承担赔偿责任。Inthecaseoftheshipperputtingdangerousgoodstogetherwiththenormalcargo,orconcealingheavyitems,thusresultinbreakageofhoistingtools,droppingofgoods,turn-overofcrane,explosion,corrosion,etc.theshippershalltaketheobligationofcompensation.由于货物包装缺陷产生破损，致使其他货物或运输工具、机械设备被污染腐蚀、损坏，造成人身伤亡的，托运方应承担赔偿责任。Ifother’scargoortransportfacilitiesarepollutedorcorroded,orpersonsareinjuredordeadduetothedefectofpackage,theshippershalltaketheobligationofcompensation.Withoutprejudicetoanyrightsunderclause15,wheretheCustomerdeliverstotheCompany,orcausestheCompanytodealwithorhandleGoodsofadangerousordamagingnature,orGoodslikelytoharbourorencourageverminorotherpests,orGoodsliabletotaintoraffectothergoods,whetherdeclaredtotheCompanyornot,heshallbeliableforalllossordamagearisinginconnectionwithsuchGoods,andshallindemnifytheCompanyagainstallpenalties,claims,damages,costsandexpenseswhatsoeverarisinginconnectiontherewith,andtheGoodsmaybedealtwithinsuchmannerastheCompany,oranyotherpersoninwhosecustodytheymaybeatanyrelevanttime,shallthinkfit.在不损害第15条项下的任何权利的前提下，倘若客户向本公司交付或促成本公司处理危险或具破坏性质的货物，或极可能蔵有或滋生有害昆虫或其他害虫，或有可能污染或影响其他货物的货物，则不论有否向本公司申报，客户须对因此导致与货物有关的一切损失或损坏负责，且须就因此产生的所有罚款、索偿、损坏、费用及支出向本公司作出赔偿，并须按本公司或于任何相关时间保管货物的任何其他人士认为合适的方式处理货物。TheCustom
