dayor25thdayofthefirstcalendarmonthofeverythreemonthsstartingfromthedateofmovinginagainsttheofficialtaxinvoicefromPartyA.InvoicesshallbesubmittedtoPartyBasleasttwoweeksinadvance.Iftherenthasnotbeenpaidmorethan30daysaftertheduedatewithoutanyreasonduetoanyfaultofPartyAorwithoutanyreasonofforcemajeure,PartyBwillbedeemedtohaveautomaticallyterminatedthetenancyresultinginabreachofthisAgreement.PartyAwillthenbeentitledtotakebacktheleasedpropertyorPartyBwillpaylatepaymentinterestaccordingtobankloanrateofthesameperiod(calculatedfromthirtydaysafteroverdueandwrittennotificationfromPartyAisrequested) 。月租金必须每六个月支付一次,按规定自入住始于每六个月中第一个月的十日或二十五日左右付清。如不是因为出租方过错或其它不可抗力而超过付款期限三十天未付则视为乙方自动退租构成违约,甲方有权收回出租房屋,或按 0.5%/每日利率向乙方收取滞纳金(自逾期三十天后始计滞纳金,但甲方必须提前一周书面通知乙方 )。5.3PartyAisresponsibleforcomplyingwiththeregulations,requirements,andsubsequentproceduresoriginatingfromtheTaxBureauand/orHousingBureaurelatedtotherentofthisproperty.PartyAshallensurethatitsinvoicesarelegal.IncaseofanylegalsuitowingtotheillegalityofPartyA’sinvoiceorowingtothereasonthatPartyAhasnotpaidrelatedtaxesforrentingofthisproperty,PartyAshallbefullyresponsibleforanylegalissueandshallbearanypenaltyrelatedthereto,PartyBisnotliableforanyresponsibilityrelatedthereto.乙方依照现有的规定支付税务局和 /或房管所规定的各类税费 ,以保证合法承租此物业。6RentingDeposit:房租押金6.1TherentingdeposittotalingRMB_______Yuan(RMB__________yuanonlyequivalentto2months’rentalParty.BshouldpaytoPartyAthedepositwithin10daysaftersignatureofthisTenancyAgreementtoensurethewelfareandgoodconditionoftheleasedpropertyaswellasthepromptpaymentandsettlementofallrelatedchargesduringthetermofthetenancy,PartyAagreestoissueareceiptforthesaidvalue.Oncompletionofthetenancyperiod,afterPartyAinspectsThePropertyforanydamagesresultedbyPartyB,thedepositshallberefundedtoPartyB,lessthetenant’sdamagescostof.
),PartyAshallinsureitspropertyunderleasingagainstPropertyLossInsurance,incaseofanydamagebyPartyB,thecompensationfromPartyBshallbelimitedtothepartnotcompensatedbytheinsurancecompany.ThetenantshallberesponsiblefordamagesintentionallycausedtothefacilitiesbytheTenantbutshallnotberesponsibleforanynormalwearandtearofthefacilities.Priortothedeductionofanyamountfromthedeposit,PartyAisrequiredtoinformPartyBinwritingregardingthecauseforandpreciseamountofthededuction.IfPartyAfailstoreturntheadvancerentalintimeafter7days

gracefulperiod,PartyBhastherighttochargelatepaymentpenaltytoPartyAby0.5%oftherentingdepositeveryday.乙方应向甲方缴付租赁押金共计人民币 _______元(即人民币 整),相当于一个月的租金,乙方于 7月31日支付给甲方,以确保出租房屋及设备之安全和完好及,租赁期内相关费用之如期结算。甲方同时需提供给乙方收据;租约期满,乙方如不再续租,甲方应在扣除了损坏部分(正常损耗,磨损除外)后将押金退还。甲方应对该出租物业保财产损失险,若乙方对甲方物业造成损失,乙方赔偿部分仅限于保险公司未赔偿的损失部分。房客应只对人为造成的损坏承担责任,不应对上述设施的自然损耗负责。甲方若扣除押金,应书面向乙方说明原因及准确数额.并与乙方协商一致,取得乙方认可。甲方如果未能如期归回房租押金 ,超过七天后 ,乙方则每天按租金押金的0.5%向甲方收取相应的滞纳金。7, EarlyTermination提前终止租约7.1IfPartyBterminatestheLeasingAgreementwithinoneyearofrental,PartyAhastherighttokeeponemonthrentingfeenotrefundedtoPartyBascompensation.However,PartyBhastherighttorentthePropertytootheremployeesinsidethecompanyandsuchacaseshallnotbeconsideredasbreachoftheagreementandtheadvancerentalshallberefundabletoPartyAattheendofthetenancyperiod.IfPartyAterminatestheLeasingAgreementnotinaccordancewithArticle4ofthiscontract,PartyAshallfullyrefundtoPartyAtherentingdepositandPartyBreservestherighttoaskforcompensationfromPartyA.乙方若在租赁期未满终止租约,甲方可将一个月租金押金作为损失赔偿而不予退还,但是,乙方有权将房屋租赁给乙方公司内部人员,该种情况将不视为乙方违约,到租赁结束后,乙方有权收回全额预付租金。若甲方未遵守合同第4条的规定而提前终止本合同,租金押金应全额退回乙方,并且乙方将保留进一步向甲方索赔的权利。OtherCharges:其他费用:8.1Duringtheperiodofthetenancyanduponreceiptofanofficialinvoice,allchargesforpropertymanagementfeeaswellasuseofwater,electricity,gasarepayablebyPartyBaccordingtoconsumptionascanbedirectlyattributedtothePropertythroughthereadingoftheindividualunit’swater,gas,andelectricitymeters.AllthesechargeswillbepaidbyPartyAtoPropertyManagementAgency,andback-chargePartyBalongwiththerentingfeecharging.乙方在租赁期内的水,电,煤气,每月根据单元内独立的水、煤 气、及电表的实际耗用量读数结算,先由甲方垫付物业管理公司,每次支付租金时乙方按发票缴付甲方。半年结算一次。8.2AlltelephonechargesarepayablebyPartyBmonthlyaccordingtotheTelecommunicationsBureaustandardtariffs,uponreceiptandaccordingtoofficialinvoicereceived.PartyAshouldensurethatTelecommunicationBureauinvoiceprovidesanitemizedaccountofalltelephonecalls(Hangzhoulocalphonecallsexcluded)withinthelimitsoftheservicescurrentlyavailablethroughtheTelecommunicationsBureau.TelephonefeewillbepaidbyPartyAtotele-communicationbureauandback-chargedtoPartyBagainstteleinvoicesalongwiththerentingfeecharging.乙方所用电话按电讯局收费标准,每月根据实际费用,乙方按发票缴付。甲方应保证通过电话局现有的服务范围,提供所有电话费用的详细清单 (除市区电话费外)。电话费也由甲方按时先垫付,每次支付租金时乙方按电话发票缴付甲方。以上费用若延期支付产生的责任由甲方负责。AnyresponsibilityowingtolatepaymentoftheabovefeeswillbebornebyPartyA.9. ’sResponsibilities:出租人的责任:9.1PartyAshalldeliveronscheduletoPartyBtheleasedpropertyforPartyBPartyAshallalsoprovidedecorationandrenovationofthepropertyasagreedinthiscontract.IfPartyAfailstohangoverthepremiseintimeorfailstodecoratethepremiseaccordingtotherequirementsofthisagreementandtheappendix,PartyAshallberesponsibleforallthelossesandresultfromit.甲方须按时将出租房屋以良好的状态交付乙方使用。甲方同意按合同要求装修房屋。如甲方未按时交房或未根据本合同及合同附件之要求进行装修此物业,将承担由此造成的一切损失及后果。9.2PartyAshallnottakebacktheleasedproperty,withoutcause,duringthetermofthetenancy(unlessotherwisestipulatedinthisAgreement)租赁期内甲方不得收回出租物业(除非本合同另有规定)9.3ProvidedthatPartyBpayingtherentandperformingandobservingPartyBtermsandconditionshereincontainshallpeaceablyholdandenjoytheleased

在租赁期内拒绝甲方或其他人的拜访而安静享用出租房屋。9.4PartyAisresponsibleforrepairingandmaintainingthebasicfacilities(excludingfurnitureandappliancesaswellasbasicfacilitiesandstructuredamagedbyPartyB),thestructureoftheleasedpropertyandforbearingallcostsrelatedthereto.Ifanybasicinstallationandconstructionofthepremiseisbroken,(notincludingthedamagebyPartyB)PartyBshallgiveanoticetoPartyA.IfPartyAfailstorepairthebrokenthingsintwodaysafterthenotice,PartyBhastherighttoterminatetheagreement.(ifPartyAfailstofinishtheconstructioninthesetwodays,theconstructiontermcouldbedelayedproperlyonlybyPartyB’consent.)Ifsomeseriousproblemsoccurinthispremise,suchasoutofpower,waterorgaswhichaffectthenormallifeinthispremise,PartyAshallberesponsibleforallthefeesproducedbytheseproblems,iftheseproblemskeepover20daysandwithoutPartyB’sforgiveness,PartyBhastherighttoterminatethisagreementwhichisnotseemedasbreachofPartyB.PartyAshallalsoberesponsiblefortherelativecompensation.Ifthebasicfacility,furnitureorelectricapplianceisdamagedowingtothemis-useofPartyB,PartyBshallberesponsibletorepairitimmediatelyorgiveeconomiccompensationtoPartyA.房屋基本设施和结构(不包括乙方损坏的家具和器具以及乙方损坏的房屋基本设施和结构)损坏时,甲方有修缮的责任并承担有关的费用,并对其作定期保养。如房屋基本设施和结构(不包括乙方损坏的家具和器具以及乙方损坏的房屋基本设施和结构)损坏时,乙方将书面通知甲方,如甲方未在通知后两天内修复或修缮的,乙方有权终止本合同(如两天内无法完工,则须得到乙方的谅解后,甲方才可适当延长工期。如因乙方使用不当造成房屋设施或家具器具及电器损坏的,乙方应立即负责修复或予以经济赔偿。如此物业内发生断电、断水、断煤气等严重影响正常生活的情况发生,则甲方须承担乙方由此产生的费用,此情况超过20天且未得到乙方书面谅解的情况下,乙方有权终止本合同,则不视乙方违约,甲方将承担相应的赔偿。9.5PartyAherebyrepresentsandwarrantsthatPartyAislegalowneroftheleasedpropertyandhasthenecessarylegalcapacitytoleasethepropertytoPartyB.PartyAhasalsoobtainedallthenecessaryauthorizationsfromallrelevantauthoritiesinthePeople’sRepublicofChinainrespectofthisAgreementandtheleasingofthepropertytoPartyB,includinggovernmentapprovaland/ormortgageeconsent(ifapplicable)PartyAshallbeliabletoKeepPartyBbefullyindemnifiedagainstanycosts,expenses,lossesanddamagesincurredtosufferedbyPartyBasaresultofanybreachofPartyA’srepresentationsorwarrantiesherein(includingbutnotlimitedtolegalcosts)甲方谨在此声明及保证甲方为出租房屋的合法拥有人并有合法地位出租此房屋予乙方。就本合同及出租此房屋予以乙方之事,甲方已取得所有有关机构的批准,包括政府批准及抵押权人的同意。甲方于本合同所作出的声明及保证,如有错误或违反者,甲方须就因此而引起的任何损失、损害、支出及费用作出全部补偿。9.6Ifduringthetermofthetenancy,allorpartoftheleasedpropertyistransferredorPartyB ’srighttouseleasedpropertyisaffected,PartyAshallensurethatsuchtransfereeorthirdpartyhavinganeffectonPartyB ’srighttousetheleasedpropertywillcontinuetoabidebythetermsofthisAgreement.PartyAshallalsobeliabletocompensatean yloss,damage,costorexpenseincasePartyB ’sinterestshereinareaffectedorprejudicedbysuchtransfereeorthirdparty.如在租赁期内,租赁房屋发生所有权全部或部分转移,和其他影响乙方权益的事情时,甲方应保证所有权人或其他影响乙方权益的第三人,能继续遵守本合同所有条款。如乙方于本合同下的权益受此等所有权人或第三者影响或损害,甲方须负责补偿乙方的所有损失、损害、支出及费用。9.7PartyAshallberesponsibletopayalltaxesinrespectoftheleasedproperty(includingbutnotlimitedtolandusefee,realestatetax,businesstax,stampdutyandindividualincometax)inaccordancewiththePRCtaxlawsandregulations.PartyAshallprovidetoPartyBtheofficialinvoiceprintedundertheauthorizationoftherelevanttaxbureauinthePRC.IncasePartyAfailstodoso,PartyBshallhavetherighttowithholdanyrentalpayment.甲方应根据中国税法规定承担对乙方支付租金而可能产生所有与出租房屋有关的一切税项,包括但不限于土地使用费,房产税,印花税,营业税及个人所得税。甲方必须开具印有税务局监制章的正式发票。如若拖欠有关发票,乙方有权延付租金。Tenant’sResponsibilities:承租人的责任:10.1PartyBshouldpromptlypaytherent,advancerentalandotherchargesassetoutinClauses5,6and9ofthisAgreement.Non-paymentofthesechargeswithinthedefinedtimesetintherelevantparagraphmayconstituteabreachofthisagreement.乙方应按本租约规定缴付租金,预付租金和各项费用,如有拖欠,
则作违约论。10.2Inadditiontothedecorationandequipmentalreadyintheproperty,ifPartyBwishestomadeanyalterationsorimprovementstotheproperty,PartyAmustgivehisconsent.Anysuchconsentshallnotbeunreasonablewithheldordelayed.Oncompletionofthetenancy,PartyBmusthandoverthepropertytoPartyAinitsoriginalcondition,fairwearandtearexcepting.AllfeesarisingfromsuchworktodosoaretobebornebyPartyB.PartyAagreestoprovidePartyBwithtwomonth
’noticepriortotheexpiryofthecontract,intheeventPartyArequiresdemolitionofanyalterationorimprovementcarriedouttothePropertybyPartyB.WithoutPartyA ’sconsent,PartyBshallrecoverhisaddedequipmentanddecorationaftertheleasetermofthisagreement.(exceptthenormaldamagesandwearing)除在物业内已有的装饰和设施之外,乙方如要增加设备或装修须征得甲方的同意;甲方不可无理拒绝或延误,在未得到甲方同意的情况下乙方所做的增加设备及装修,租赁期满后乙方必须恢复原状(正常损耗、磨损除外),并承担其费用,经甲方验收认可后归还甲方。甲方同意期满前两个月通知乙方其所需拆除的在物业内的任何改变及改进的设施。10.3PartyBshalltreattheleasedpropertywithcare.If,asaresultofpartyBnegligenceormisconduct,theleasedpropertyandtherelatedfacilitiessufferanydamage(fairwearandtearexcepted),PartyBshallberesponsibleforcompensatingPartyAforsuchdamages.乙方应爱护使用租赁的房屋,如因乙方的过失或过错致使房屋及设施受到损坏(正常损耗出外),乙方应负赔偿责任。10.4PartyBshallusetheleasedpropertylegallyasagreedinthisAgreementandmaynotchangesuchuseonitsown.PartyBshallnotstoreanydangerousitemswhichareprohibitedbythelawsinthePeopele ’sRepublicofChinaintheleasedpropertyandshallbefullyresponsibleforanydamagesorlossesasaresultthereof.乙方应按本合同的约定合法使用租赁房屋,不得擅自改变使用性质,不应存放中华人民共和国法律下所禁止的危险的物品,如因此发生损害,乙方应承担全部责任。11 BreachofAgreement:违约处理:IfeitherPartyAorPartyBfailstoperformitsobligationshereunder,itshallconstituteabreachofthisAgreementandthedefaultingpartyshallundertaketheliabilitiesforsuchbreach.Thepartiesagreethatthepartyinbreachshallpaytheotherpartythedirectlossanddamage(excludingindirectandconsequentiallossanddamages).IfpartyAisinanybreachofthisAgreementanddoesnotrectifywithin7daysorfailstomeetPartyB ’srequirement,thenPartyBisentitledtowithholdordeducttherentaswellasmanagementfeesandstillreservetherighttoterminatethisagreement.IfPartyBisinanybreachofthisAgreementanddoesnotrectifywithin7daysorfailstomeetPartyA ’srequirement,ParyAisentitledtodeductthepre-paiddepositandwithholdstherighttoterminatetheagreementandforfurtherclaim.乙任何一方如未按本合同的条款履行,构成违约,应承担相应的违约责任
,双方同意违约方应赔偿对方之直接损失(间接和结果性损失除外)。甲方若有违约并七日内未予补救或未达到乙方要求,乙方则有权延付租金和管理费或做相应的扣除并保留中止合同的权利。 乙方若有违约并七日内未达到甲方要求,甲方有权相应扣除预付定金并保留中止合同,向甲方进一步索赔的权利。ForceMajeure:不可抗力:IftheLeasedpropertyisdestroyed,damagedandrendereduninhabitableofunusableduetoforcemajeure(includebutnotlimitedto,fires,flood,earthquakes,accidents,strikes,wars,insurrections,publicenemyetc.)oractionsthatarenottheresultofPartyB’sfault,PartyBshallhavetherighttoterminatethisAgreementandproratedbalanceofallrentsandmanagementfeespaid,aswellassecurityadvancerental,shallbereturnedtoPartyBwithoutanyset-offsordeductions.若由于不可抗拒的自然灾害(包括但不限于火灾、洪水、地震、施工、战争、暴动、敌对等行为等)或其他非乙方过错所造成的对本物业的损毁致使其无法居住或使
