Ananti-dumpingmeasureshallbeappliedonlyunderthecircumstances

providedforinArticleArticleVIofGATT1994andpursuantto

investigationsinitiatandconductedinaccordancewiththeprovisionsofthisAgreement.ThefollowingprovisionsgoverntheapplicationofArticleand

conductedinaccordancewiththeprovisionsofthisAgreement.ThefollowingprovisionsgoverntheapplicationofArticleVIofGATT1994insofaras

actionistakenunderanti-dumpglegislationorregulations.

DeterminationofDumping

ForthepurposeofthisAgreement,aproductistobeconsideredasbeingdumped,roducedintothecommerceofanothercountryatlessthanitsnormalvalue,iftheexportpriceoftheproductexportedfromonecountrytoanotherislessthanthecomparableprice,intheordinarycourseoftrade,forthelikeproductwhendestinedforconsumptionintheexportingcountry.

Whentherearenosalesofthelikeproductintheordinarycourseoftradeinthedomesticmarketoftheexportingcountryorwhen,becauseofthe

particularmarketsituationorthelowvolumeofthesalesinthedomesticmarketoftheexportingcountry,suchsalesdonotpermitapropercomparison,themarginofdumpingshallbedeterminedbycomparisonwithacomparablepriceof

thelikeproductwhenexportedtoanappropriatethirdcountry,providedthatthispriceisrepresentative,orwiththecostofproductioninthecountryoforiginplusareasonableamountforadministrative,sellingandgeneralcostsandforprofits.

Salesofthelikeproductinthedomesticmarketoftheexportingcountryorsalestoathirdcountryatpricesbelowperunit(fixedandvariable)costsofproductionplusadministrative,sellingandgeneralcostsmaybetreatedasnotbeingintheordinarycourseoftradebyreasonofpriceandmaybedisregardedindeterminingnormalvalueonlyiftheauthoritiesdetermine

thatsuchsalesaremadewithinanextendedperiodoftimeinsubstantialquantitiesandareatpriceswhichdonotprovidefortherecoveryofallcosts

withinareasonableperiodoftime.Ifpriceswhicharebelowperunitcostsatthetimeofsaleareaboveweightedaverageperunitcostsfortheperiodofinvestigation,suchpricesshallbeconsideredtoprovideforrecoveryof

costswithinareasonableperiodoftime.

ForthepurposeofparagraphForthepurposeofparagraph

2,costsshallnormallybecalculatedonthebasisofrecordskeptbytheexporteroroducerunderinvestigation,providedthatsuchrecordsareinaccordancewith

thegenerallyacceptedaccountingprinciplesoftheexportingcountryandreasonablyreflectthecostsassociatedwiththeproductionandsaleoftheproductunderconsideration.Authoritiesshallconsiderallavailableevidence

ontheproperallocationofcosts,includingthatwhichismadeavailablebytheexporterorproducerinthecourseoftheinvestigationprovidedthatsuchallocationshavebeenhistoricallyutilizedbytheexporterorproducer,inparticularinrelationtoestablishingappropriateamortizationanddepreciationperiodsandallowancesforcapitalexpendituresandotherdevelopmentcosts.Unlessalreadyreflectedinthecostallocationsunderthissub-paragraph,costsshallbeadjustedappropriatelyforthosenon-recurring

itemsofcostwhichbenefitfutureand/orcurrentproduction,orforcircumstancesinwhichcostsduringtheperiodofinvestigationareaffectedbystart-upoperations.

2.2.2Forthepurposeofparagraph2,theamountsforadministrative,sellingandgeneralcostsandforprofitsshallbebasedonactualdatapertainingtoproductionandsalesintheordinarycourseoftradeofthelikeproductbytheexporterorproducerunderinvestigation.Whensuchamounts

cannotbedeterminedonthisbasis,theamountsmaybedeterminedonthebasisof:

theactualamountsincurredandrealizedbytheexporterorproducerinquestioninrespectofproductionandsalesinthedomesticmarketofthe

countryoforiginofthesamegeneralcategoryofproducts;

theweightedaverageoftheactualamountsincurredandrealizedbyotherexportersorproducerssubjecttoinvestigationinrespectofproductionandsalesofthelikeproductinthedomesticmarketofthecountryoforigin;

anyotherreasonablemethod,providedthattheamountforprofitsoestablishedshallnotexceedtheprofitnormallyrealizedbyotherexportersorproducersonsalesofproductsofthesamegeneralcategoryinthedomestic

marketofthecountryoforigin.

Incaseswherethereisnoexportpriceorwhereitappearstotheauthoritiesconcernedthattheexportpriceisunreliablebecauseofassociationoracompensatoryarrangementbetweentheexporterandtheimporterorathirdparty,theexportpricemaybeconstructedonthebasisofthepriceatwhichtheimportedproductsarefirstresoldtoanindependentbuyer,oriftheproductsarenotresoldtoanindependentbuyer,ornotresoldinthecondition

asimported,onsuchreasonablebasisastheauthoritiesmaydetermine.

Afaircomparisonshallbemadebetweentheexportpriceandthenormalvalue.Thiscomparisonshallbemadeatthesameleveloftrade,normallyattheex-factorylevel,andinrespectofsalesmadeatasnearlyaspossiblethesametime.Dueallowanceshallbemadeineachcase,onitsmerits,for

differenceswhichaffectpricecomparability,includingdifferencesinconditionsandtermsofsale,taxation,levelsoftrade,quantities,physicalcharacteristics,andanyotherdifferenceswhicharealsodemonstratedtoaffect

pricecomparability.Inthecasesreferredtoinparagraph3,allowancesfor

costs,includingdutiesandtaxes,incurredbetweenimpoationandresale,andforprofitsaccruing,shouldalsobemade.Ifinthesecasespricecomparabilityhasbeenaffected,theauthoritiesshallestablishthenormalvalueatalevel

oftradeequivalenttotheleveloftradeoftheconstructedexportprice,orshallmakedueallowanceaswarrantedunderthisparagraph.Theauthoritiesshallindicatetothepartiesinquestionwhatinformationisnecessarytoensure

afaircomparisonandshallnotimposeanunreasonableburdenofproofonthoseparties.

Whenthecomparisonunderparagraph4requiresaconversionofcurrencies,suchconversionshouldbemadeusingtherateofexchangeonthedateofsale,providedthatwhenasaleofforeigncurrencyonforwardmarketsisdirectlylinkedtotheexportsaleinvolved,therateofexchangeinthe

forwardsaleshallbeused.Fluctuationsinexchangeratesshallbeignoredandinaninvestigationtheauthoritiesshallallowexportersatleast60ortsale

involved,therateofexchangeintheforwardsaleshallbeused.Fluctuations

inexchangeratesshallbeignoredandinaninvestigationtheauthoritiesshallallowexportersatleast60daystohaveadjustedtheirexportpricestoreflectstainedmovementsinexchangeratesduringtheperiodofinvestigation.

Subjecttotheprovisionsgoverningfaircomparisoninparagraph

Subjecttotheprovisionsgoverningfaircomparisoninparagraph4,the

existenceofmarginsofdumpingduringtheinvestigationphaseshallnormallybeestablishedonthebasisfacomparisonofaweightedaveragenormalvaluewithaweightedaverageofpricesofallcomparableexporttransactionsorbyacomparisonofnormalvalueandexportpricesonatransaction-to-transaction

basis.Anormalvalueestablishedonaweightedaveragebasismaybecompared

topricesofindividualexporttransactionsiftheauthoritiesfindapattern

ofexportpriceswhichdiffersignificantlyamongdifferentpurchasers,regionsortimeperiods,andifanexplanationisprovidedastowhysuchdifferences

cannotbetakenintoaccountappropriatelybytheuseofaweightedaverage-to-weightedaverageortransaction-to-transactioncomparison.

InthecasewhereproductsarenotimporteddirectlyfromthecountryoforiginbutareexportedtotheimportingMemberfromanintermediatecountry,thepriceatwhichtheproductsaresoldfromthecountryofexporttotheimportingMembershallnormallybecomparedwiththecomparablepriceinthecountryofexport.However,comparisonmaybemadewiththepriceinthecountry

oforigin,if,forexample,theproductsaremerelytransshippedthroughthecountryofexport,orsuchproductsarenotproducedinthecountryofexport,orthereisnocomparablepricefortheminthecountryofexport.

ThroughoutthisAgreementtheterm"likeproduct"("produitsimilaire")shallbeinterpretedtomeanaproductwhichisidentical,i.e.alikeinallrespectstotheproductunderconsideration,orintheabsenceofsuchaproduct,anotherproductwhich,althoughnotalikeinallrespects,hascharacteristicscloselyresemblingthoseoftheproductunderconsideration.

ArticleArticle

DeterminationofInjury

AdeterminationofinjuryforpurposesofArticleVIofGATT1994

shallbebasedonpositiveevidenceandinvolveanobjectiveexaminationof

bot(a)thevolumeofthedumpedimportsandtheeffectofthedumpedimportsonpricesinthedomesticmarketforlikeproducts,and(b)theconsequent

impactoftheseimportsondomesticproducersofsuchproducts.

Withregardtothevolumeofthedumpedimports,theinvestigatingauthoritiesshallconsiderwhethertherehasbeenasignificantincreaseindumpedimports,eitherinabsolutetermsor

relativetoproductionorconsumptionintheimportingMember.Withregardtotheeffectofthedumped

importsonprices,theinvestigatingauthoritiesshallconsiderwhethertherehasbeenasignificantpriceundercuttingbythedumpedimportsascomparedwiththepriceofalikeproductoftheimportingMember,orwhethertheeffectof

suchimportsisotherwisetodepresspricestoasignificantdegreeorpreventpriceincreases,whichotherwisewouldhaveoccurred,toasignificantdegree.Nooneorseveralofthesefactorscannecessarilygivedecisiveguidance.

Whereimportsofaproductfrommorethanonecountryaresimultaneouslysubjecttoanti-dumpinginvestigations,theinvestigatingauthoritiesmaycumulativelyassesstheeffectsofsuchimportsonlyiftheydeterminethat(a)themarginofdumpingestablishedinrelationtotheimportsfromeachcountry

morethandeminimisasdefinedinparagraph8Article5andthevolume

ofimportsfromeachcountryisnotnegligiblean(b)acumulativeassessmentoftheeffectsoftheimportsisappropriateinlightoftheconditionsofcompetitionbetweentheimportedproductsandtheconditionsofcompetition

betweentheimportedproductsandthelikedomesticproduct.

Theexaminationoftheimpactofthedumpedimportsonthedomesticindustryconcernedshallincludeanevaluationofallrelevanteconomicfactorsandindiceshavingabearingonthestateoftheindustry,includingactualandpotentialdeclineinsales,profits,output,marketshare,productivity,returnoninvestments,orutilizationofcapacity;factorsaffectingdomesticprices;themagnitudeofthemarginofdumping;actualandpotentialnegativeeffects

oncashflow,inventories,employment,wages,growth,abilitytoraisecapitalorinvestments.Thislistisnotexhaustive,norcanoneorseveralofthese

factorsnecessarilygivedecisiveguidance.

Itmustbedemonstratedthatthedumpedimportsare,throughtheeffectsofdumping,assetforthinparagraphs2and4,causinginjurywithinthe

meaningofthisAgreement.Thedemonstrationofacausalrelationshipbetweenthedumpedimportsandtheinjurytothedomesticindustryshallbebasedon

anexaminationofallrelevantevidencebeforetheauthorities.Theauthoritiesshallalsoexamineanyknownfactorsotherthanthedumpedimportswhichatthe

sametimeareinjuringthedomesticindustry,andtheinjuriescausedbytheseotherfactorsmustnotbeattributedtothedumpedimports.Factorswhichmayberelevantinthisrespectinclude,interinteral,thevolumeandprices

ofimportsnotsoldatdumpingprices,contractionindemandorchangesinthepatternsofconsumption,trade-restrictivepracticesofandcompetitionbetweentheforeignanddomesticproducers,developmentsintechnologyandtheexport

performanceandproductivityofthedomesticindustry.

Theeffectofthedumpedimportsshallbeassessedinrelationtothedomesticproductionofthelikeproductwhenavailabledatapermittheseparateidentificationofthatproductiononthebasisofsuchcriteriaastheproduction

process,producers,salesandprofits.Ifsuchseparateidentificationofthatproductionisnotpossible,theeffectsofthedumpedimportsshallbeassessedbytheexaminationoftheproductionofthenarrowestgrouporrangeofproducts,

whichincludesthelikeproduct,forwhichthenecessaryinformationcanbeprovided.

Adeterminationofathreatofmaterialinjuryshallbebasedonfactsandnotmerelyonallegation,conjectureorremotepossibility.Thechangeincircumstanceswhichwouldcreateasituationinwhichthedumpingwouldcauseinjurymustbeclearlyforeseenandimminent.Inmakingadetermination

regardingtheexistenceofathreatofmaterialinjury,theauthoritiesshouldconsider,interinteral,suchfactorsas:

asignificantrateofincreaseofdumpedimportsintothedomesticmarketindicatingthelikelihoodofsubstantiallyincreasedimportation;

sufficientfreelydisposable,oranimminent,substantialincreasein,capacityoftheexporterindicatingthelikelihoodofsubstantiallyincreaseddumpedexportstotheimportingMember,smarket,takingintoaccount

theavailabilityofotherexportmarketstoabsorbanyadditionalexports;

whetherimportsareenteringatpricesthatwillhaveasignificantdepressingorsuppressingeffectondomesticprices,andwouldlikelyincrease

demandforfurtherimports;and

inventoriesoftheproductbeinginvestigated.

Nooneofthesefactorsbyitselfcannecessarilygivedecisiveguidancebutthetotalityofthefactorsconsideredmustleadtotheconclusionthatfurtherdumpedexportsareimminentandthat,unlessprotectiveactionistaken,materialinjurywouldoccur.

Withrespecttocaseswhereinjuryisthreatenedbydumpedimports,theapplicationofanti-dumpingmeasuresshallbeconsideredanddecidedwithspecialcare.

DefinitionofDomesticIndustry

ForthepurposesofthisAgreement,thetermdomesticindustryshallbeinterpretedasreferringtothedomesticproducersasawholeofthelikeproductsortothoseofthemwhosecollectiveoutputoftheproductsconstitutesamajorproportionofthetotaldomesticproductionofthoseproducts,exceptthat:

whenproducersarerelatedtotheexportersorimportersorarethemselvesimportersoftheallegedlydumpedproduct,theterm"domestic

industry"maybeinterpretedasreferringtotherestoftheproducers;

inexceptionalcircumstancestheterritoryofaMembermay,fortheproductioninquestion,bedividedintotwoormorecompetitivemarketsandtheproducerswithineachmarketmayberegardedasaseparateindustryif(a)

theproducerswithinsuchmarketsellalloralmostalloftheirproductionoftheproductinquestioninthatmarket,and(b)(bthedemandinthatmarket

isnottoanysubstantialdegreesuppliedbyproducersoftheproductinquestionlocatedelsewhereintheterritory.Insuchcircumstances,injurymaybefoundtoexistevenwhereamajorportionofthetotaldomesticindustryisnotinjured,providedthereisaconcentrationofdumpedimportsintosuchanisolatedmarket

andprovidedfurtherthatthedumpedimportsarecausinginjurytotheproducersofalloralmostalloftheproductionwithinsuchmarket.

Whenthedomesticindustryhasbeeninterpretedasreferringtotheproducersinacertainarea,i.e.amarketasdefinedinparagraphsdefined

inparagraph1(ii),anti-dumpingdutiesshallbelevionlyontheproductsinquestionconsignedforfinalconsumptiontothatarea.WhentheconstitutionallawoftheimportingMemberdoesnotpermitthelevyingofanti-dumpingduties

onsuchabasis,theimportingMembermaylevytheanti-dumpingdutieswithout

limitationonlyif(a)theexportersshallhavebeengivenanopportunityto

ceaseexportingatdumpedpricestotheareaconcernedorotherwisegiveassurancespursuanttoArticletheexportersshallhavebeengivenan

opportunitytoceaseexportingatdumpedpricestothearea

concernedorotherwisegiveassurancespursuanttoArticl8andadequateassurancesinthisregardhavenotbeenpromptlygiven,and(b)suchdutiescannotbeleviedonly

onproductsofspecificproducerswhichsupplytheareainquestion.

Wheretwoormorecountrieshavereachedundertheprovisionsofparagraphgraph8(a)ofArticleXXIVofGATT1994suchalevelofintegrationthattheyhavethecharacteristicsofasingle,unifiedmarket,theindustryintheentireareaofintegrationshallbetakentobethedomesticindustryreferredtoinparagraph

TheprovisionsofparagraphTheprovisionsofparagraph6ofArticle

shallbeapplicabletothisArticl

Article5

InitiationandSubsequentInvestigation

.5.1Exceptasprovidedforinparagraph6,aninvestigationtodetermine

theexistence,degreeandeffectofanyallegeddumpingshallbeinitiatedupon

awrittenapplicationbyoronbehalfofthedomesticindustry.

5.2Anapplicationunderparagraph1shallincludeevidenceo(a)dumping,

(b)injurywithinthemeaningofArticleinjurywithinthemeaningofArticle

VIofGATT1994asinterpretedbythisAgrmentand(c)acausallinkbetween

thedumpedimportsandtheallegedinjury.Simpleassertion,unsubstantiatedbyrelevantevidence,cannotbeconsideredsufficienttomeettherequirements

ofthisparagraph.Theapplicationshallcontainsuchinformationasisreasonablyavailabletotheapplicantonthefollowing:

theidentityoftheapplicantandadescriptionofthevolumeandvalueofthedomesticproductionofthelikeproductbytheapplicant.Whereawrittenapplicationismadeonbehalfofthedomesticindustry,theapplicationshallidentifytheindustryonbehalfofwhichtheapplicationismadebyalistofallknowndomesticproducersofthelikeproduct(orassociationsofdomesticproducersofthelikeproduct)and,totheextentpossible,adescriptionofthevolumeandvalueofdomesticproductionofthelikeproductaccountedfor

bysuchproducers;

acompletedescriptionoftheallegedlydumpedproduct,thenamesofthecountryorcountriesoforiginorexportinquestion,theidentityofeachknownexporterorforeignproducerandalistofknownpersonsimportingthe

productinquestion;

informationonpricesatwhichtheproductinquestionissoldwhendestinedforconsumptioninthedomesticmarketsofthecountryorcountriesoforiginorexport(or,whereappropriate,informationonthepricesatwhich

theproductissoldfromthecountryorcountriesoforiginorexporttoathirdcountryorcountries,orontheconstructedvalueoftheproduct)andinformationonexportpricesor,whereappropriate,onthepricesatwhichtheproductis

firstresoldtoanindependentbuyerintheterritoryoftheimportingMember;

informationontheevolutionofthevolumeoftheallegedlydumpedimports,theeffectoftheseimportsonpricesofthelikeproductinthedomesticmarketandtheconsequentimpactoftheimportsonthedomesticindustry,asdemonstratedbyrelevantfactorsandindiceshavingabearingonthestateofthedomesticindustry,suchasthoselistedinparagraphslistedinparagraphs

2and4ofArticle

Theauthoritiesshallexaminetheaccuracyandadequacyoftheevidenceprovidedintheapplicationtodeterminewhetherthereissufficientevidencetojustifytheinitiationofaninvestigation.

Aninvestigationshallnotbeinitiatedpursuanttoparagraph1unless

theauthoritieshavedetermined,onthebasisofanexaminationofthedegree

ofsupportfor,oroppositionto,theapplicationexpressbydomesticproducersofthelikeproduct,Theapplicationshallbeconsideredtohavebeenmade"by

oronbehalfofthedomesticindustry"ifitissupportedbythosedomesticproducerswhosecollectiveoutputconstitutesmorethan50percentofthe

totalproductionofthelikeproductproducedbythatportionofthedomesticindustryexpressingeithersupportfororoppositiontotheapplication.However,noinvestigationshallbeinitiatedwhendomesticproducersexpress

supportingtheapplicationaccountforlessthan25percentoftotalproductionofthelikeproductproducedbythedomesticindustry.

Theauthoritiesshallavoid,unlessadecisionhasbeenmadetoinitiateaninvestigation,anypublicizingoftheapplicationfortheinitiationofaninvestigation.However,afterreceiptofaproperlydocumentedapplicationandbeforeproceedingtoinitiateaninvestigation,theauthoritiesshallnotifythegovernmentoftheexportingMemberconcerned.

inspecialcircumstances,theauthoritiesconcerneddecidetoinitiateaninvestigationwithouthavingreceivedawrittenapplicationbyoronbehalfofadomesticindustryfortheinitiationofsuchinvestigation,theyshallproceedonlyiftheyhavesufficientevidenceofdumping,injuryandacausallink,asdescribedinparagraphntevidenceofdumping,injuryandacausal

link,asdescribedinparagraph2,tojustifytheinitiationofaninvestigatio

Theevidenceofbothdumpingandinjuryshallbeconsideredsimultaneously(a)inthedecisionwhetherornottoinitiateaninvestigation,and(b)thereafter,duringthecourseoftheinvestigation,startingonadatenotlaterthantheearliestdateonwhichinaccordancewiththeprovisionsof

thisAgreementprovisionalmeasuresmaybeapplied.

Anapplicationunderparagraphraph1shallberejectedandaninvestigationshallbeterminatedpromptlyassoonastheauthoritiesconcernedaresatisfiedthatthereisnotsufficientevidenceofeitherdumpingorof

injurytojustifyproceedingwiththecase.Thereshallbeimmedieterminationincaseswheretheauthoritiesdeterminethatthemarginofdumpingisdede

minim,orthatthevolumeofdumpedimports,actualorpotential,ortheinjury,

isnegligible.Themarginofdumpingshallbeconsideredtobededeminim

ifthismarginislessthan2percent,expressedasapercentageoftheexportprice.Thevolumeofdumpedimportsshallnormallyberegardedasnegligible

ifthevolumeofdumpedimportsfromaparticularcountryisfoundtoaccountforlessthan3percentofportsofthelikeproductintheimportingMember,unlesscountrieswhichindividuallyaccountforlessthan3ortsofthelike

productintheimportingMember,unlesscountrieswhichindividuallyaccountforlessthan3percentoftheimportsofthelikeproductintheimportingMembercollectivelyaccountformorethan7percentofimportsofthelike

prodtintheimportingMember.

Ananti-dumpingproceedingshallnothindertheproceduresofcustomsclearance.

Investigationsshall,exceptinspecialcircumstances,beconcludedwithinoneyear,andinnocasemorethan18months,aftertheirinitiation.

Article6

Evidence

Allinterestedpartiesinananti-dumpinginvestigationshallbegiven

noticeoftheinformationwhichtheauthoritiesrequireandampleopportunitytopresentinwritingallevidencewhichtheyconsiderrelevantinrespectoftheinvestigationinquestion.

Exportersorforeignproducersreceivingquestionnairesusedinananti-dumpinginvestigationshallbegivenatleast30daysforreply.Dueconsiderationshouldbegiventoanyrequestforanextensionofthe30-day

periodand,uponcauseshown,suchanextensionshouldbegrantedwheneverpracticable.

Subjecttotherequirementtoprotectconfidentialinformation,evidencepresentedinwritingbyoneinterestedpartyshallbemadeavailablepromptlytootherinterestedpartiesparticipatingintheinvestigation.

Assoonasaninvestigationhasbeeninitiated,theauthoritiesshallprovidethefulltextofthewrittenapplicationreceivedunderparagraph6.1.3

Assoonasaninvestigationhasbeeninitiated,theauthoritiesshallprovide

thefulltextofthewrittenapplicationreceivedunderparagraph1ofArticle

totheknownexporteandtotheauthoritiesoftheexportingMemberandshallmakeitavailable,uponrequest,tootherinterestedpartiesinvolved.Dueregardshallbepaidtotherequirementfortheprotectionofconfidentialinformation,asprovidedforinparagraphved.Dueregardshallbepaidtothe

Throughouttheanti-dumpinginvestigationallinterestedpartiesshallhaveafullopportunityforthedefenceoftheirinterests.Tothisend,theauthoritiesshall,onrequest,provideopportunitiesforallinterestedpartiestomeetthosepartieswithadverseinterests,sothatopposingviewsmaybe

presentedandrebuttalargumentsoffered.Provisionofsuchopportunitiesmusttakeaccountoftheneedtopreserveconfidentialityandoftheconveniencetotheparties.Thereshallbenoobligationonanypartytoattendameeting,and

Theauthoritiesshallwheneverpracticableprovidetimelyopportunitiesforallinterestedpartiestoseeallinformationthatisrelevanttothe

presentationoftheircases,thatisnotconfidentialasdefinedinparagraph

esforallinterestedpartiestoseeallinformationthatisrelevanttothepresentationoftheircases,thatisnotconfidentialasdefinedinparagraph

5,andthatisusedbytheauthoritiesinananti-dumpinginvestigation,and
