第三章物权法律制度第一节物权法律制度概述一、物权法律制度概况物权法是调整因物的归属和利用(占有、使用、收益、分配)而产生的民事关系的法律。财产法的两个支柱分别是物权法和债权法,其,物权法属于财产的归属法,债权法则属于财产的流转法二、物的概念和种类物,包括不动产和动产。法律规定权利作为物权客体的,依照其规定(一)物的概念物权法上的物指的是有体物,是除人的身体之外,凡能为人力所支配,独立满足人类社会生活需要之物。1、有体物我国物权法上的物仅指有体物,权利、行为、智慧成果(包括电脑程序)等均不是物权法上的物,因而不属物权客体。权利在特殊情况下经法律规定可成为物权客体,如以股权、票据权利等出质的权利质权2、可支配性能为人力所支配并满足人的需要。不能为人力所支配或不为人所需之物,因其不具有交易价值而不属于物权法上的物,前者如太阳、月亮、星星等,后者如汽车尾气3、在人的身体之外人是权利主体,不能成为物权客体。不过人体器官如脱离人的身体,则可成为物(二)物的种类1、流通物、限制流通物与禁止流通物流通物是指可自由进入市场流通之物,绝大多数动产以及不动产的房屋均属于流通物BykittyLESSON28FIVEPOUNDSTOODEAR第三章物权法律制度BykittyLESSON28FIV1Newwordsandexpressions
