1、.租赁合同Tenancy Contract.租赁合同Tenancy Contract出租方(甲方):Landlord (Party A):承租方(乙方):Tenant (Party B):甲、乙双方在自愿、平等、互利的基础上,经协商一致,就乙方承租甲方物业事宜,订立本合同。Having reached unanimity through consultations, Party A and Party B, on the basis of voluntariness, equality and mutual benefit, have entered into this Contractin

2、respect of Party A leasing the Premises to Party B.一、租赁物业Leased Premises1.1甲方将坐落于(以下简称 该物业 )出租给乙方使用,该物业建筑面积为平方米。Party A lets(hereinafterreferred to the Premises), to Party B, and the size of the Premises is square meters.1.2甲乙双方确定该物业用途为住宅 。Both Party A and Party B have confirmed that the Premises sh

3、all be for the purpose of Residential.1.3该物业的家俱、家电配置,见本合同附件一。The furniture & appliances of the Premises please see Appendix I.二、租赁期Leasing Term2.1本合同租赁期为个月,自年月日起至年月日止。The leasing term of this contract shall becalendar months,commencing fromto.2.2租赁期满,甲方有权收回该物业,乙方应如期归还;乙方如要求续租,须在.本合同期满前 1个月向甲方提出书

4、面申请,经甲方同意后重新签订租赁合同。On expiryof thislease,PartyA has the rightto take back the Premises,and Party B shall return the Premises on time. If Party B wishes to extend the lease, Party B is required to give written notice to Party A onemonths prior to the expiry of the lease and subject to Party A and Par

5、ty Bs consent, a new leasing contract shall be signed.三、租金及保证金Rental and Deposit3.1租金为每月元人民币,租金含物业管理费,发票。The monthly rental isper month, inclusive ofmanagement fee,formal invoice 。3.2乙方应予签署本合同后五日内向甲方支付相当于一个月租金的金额,即人民币_元,作为保证金,甲方应出具收据给乙方。在租赁期满,乙方如期交还该物业,并付清居住期间所有租金和其它费用后十五天内,甲方应将保证金无息退还乙方。Within five

6、 days after the signing of this Contract, Party B shall payto Party A as Deposit, which is equivalent to one monthsrental, and Party A shall issue a receipt for the said value. At the expirationof the Contract, Party A shall refund the Deposit to Party B without interest within 15 days after Party B

7、 has returned the Premises and paid all the rent and other expenses for the terms that Party B has occupied the Premises.3.3 乙方应在每月日前支付该月租金,若乙方在租金到期后十五天仍未支付,每逾期一天,则乙方应按日租金的支付滞纳金。若超过三十天未付,则视乙方自动退租并构成违约,甲方有权收回该物业,没收保证金并追究相关损失。Party B shall pay the rental on or before theday of each calendarmonth. Ifth

8、e Rent has not been paid within15 days of itsdue date,PartyB shallbe requiredto pay a latepenaltyfee equal to _of the rentalper day for each day of delay. If the rental has not been paid more than 30 days after the due date,Party b will be deemed to have automatically terminated the leasing resultin

9、g in a breach of the Contract, Party A will be entitled to take back the Premises, retain deposit and seek related losses.3.4 甲方在收到租金后五天内应提供给乙方正式发票, 若甲方在月底前仍未提供乙方发票,则乙方有权延迟支付下月租金直至收到正式发票。 甲方有责任根据税务局和/ 或房管局的规定、要求和有关程序支付相应的有关租赁房屋的税款。Party A will issue an official invoice within 5 days after receiving

If Party A has not issue an official invoice by the end of themonth, Party B has the rightto delay the payment of the followingmonths.rental until the invoice of the said month is received. Party A is responsible for complying with regulations, requirements and procedures originating fro

11、m the Tax Bureau and/or Housing Bureau related to the taxes of the rent of the Premises.3.5 甲方的银行帐户资料:户名:账号:银行:Party A s bank account information:Name:A/C No.:Bank:收取租金时,房东的银行所收的手续费由房东支付。The remittance fee charged by the Landlord's bank for receiving should be paid by the Landlord.四、出租人的责任Landlo

12、rd s Responsibilities4.1 甲方须按时将出租物业及家具电器(见附件一)以良好的状态交付给乙方使用。Party A should deliver on schedule the leased property and the furniture and appliances (refer to Appendix I) in good condition to Party B.4.2 甲方应确保或责成物业管理公司对物业及其公共设施进行定期维修保养,包括4.3 但不限于物业内的空调、上下水管、电线电缆、煤气管道、通讯及有线电视等设施,使之处于正常的使用状态。PartyA sho

13、uld guaranteeor orderthe property managementcompanytocarryout maintenance and repair of thesaid premises and the facilitiesingoodandproperoperationregularly,includingbut notrestrictedtoair-conditions,waterpipelines,wires andcables,gaspipelines,communication and cable TV etc.4.3 房屋基本设施和结构损坏时(不包括乙方损坏的

14、家具和器具) ,甲方必须在 24 小时内提供维修服务或给予乙方答复,并承担相关的费用。In case of the basic facilitiesand structureof the premises being damaged(not includingfurnitureand appliancesdamagedby Party B), Party A shallrepair or respond to Party Bs complaints within 24 hours, and bear allcosts related thereto.4.4 甲方在此声明及保证甲方为出租房屋的合

15、法拥有人并有合法地位出租此房屋给.乙方。就本合同及出租此房屋于乙方之事,甲方已取得所有有关机构的批准,包括政府批准及抵押权人的同意。 甲方于本合同所做出的声明与保证, 如有错误或违反者,甲方须就因此而对乙方引起的任何损失、损害、支出及费用对乙方做出全额补偿。Party A hereby represents and warrants that Party A is the legal ownerof the leased propertyand has the necessary capacityto lease the propertyto Party B. Party A has also

16、 obtained all the necessary authorizationsfrom allrelevantauthoritiesin respect of this Contractand theleasingof the propertyto Party B, includinggovernment approvaland/ormortgageconsent.Party A shallbe liabletokeep Party B fullyindemnifiedagainstany costs, expenses, losses and damages incurred and

17、suffered by PartyB as a result of any breach of Party As representations or warrantiesherein.4.5 如在租赁期内, 租赁房屋发生所有权全部或部分转移, 和其它影响乙方权益的事情时,甲方应保证所有权人或其它影响乙方权益的第三人, 能继续遵守本合同所有条款。如乙方于本合同下的权益受此等所有权人或第三者影响或损害, 甲方应负责赔偿乙方的所有损失、损害、支出及费用。If during the term of the tenancy, all or part of the leased property ist

18、ransferred or Party Bsright to use leased property is affected, PartyA shall ensure that such transferee or third party having an effect onParty B s right to use the leased property will continue to abide by theterms of thisContract.Party A shallalso be liableto keep Party B fullyindemnified against

19、 any costs, expenses, lossesand damages when any of Party Bs interests herein are affected or prejudiced by such transferee or third party.4.6甲方应负责根据中国法律法规所定因本楼宇租赁而产生的一切税务 ( 包括但不限于房产税,所得税和营业税 ) 和法定费用 ( 包括但不限于土地使用费 ) ,并必须将该些税务和法定费用直接向有关税局缴付。The Landlord shall be responsible for and pay directly to th

20、e relevanttax authorities all applicable taxes (including but not limited to RealEstate Tax, Income Tax and Business Tax) and other government charges(including but not limited to Land Use Fee) required by Chinese law orany relevant regulations arising from the leasing of the Premises.4.7在乙方遵守本合同的条款

21、及交付租金的前提下,乙方有权于租赁期内拒绝甲方或其他人骚扰而安静享用出租房屋。ProvidedthatParty B paying the rentaland performingand observingpartyBs terms and conditionshereincontainshallpeaceably hold and enjoy thePremises throughout theterm of thisContractwithoutany interruptionbyParty A or other persons.4.8租期为一年 , 如若任何一方提前解约,支付违约金为一年

22、的租金( 人民币 _元 ) 。Leasing Term is one year. If any side terminates the agreement ahead of time, must pay the penalty is one year rent(RMB78000.00yuan).五、承租人的责任Tenant s Responsibilities5.1 乙方应按时支付合同中规定的保证金、租金及水、电、煤气、电话费 , 宽带费等公用事业费。Party B should promptly pay the deposit, rental and water, broad band,el

23、ectricity, gas, telephone charge etc.5.2 未经甲方书面同意,乙方不得将该物业转租或分租给第三方。Party B shall not transfer or sub-lease the said premises to any thirdparty without Party As written consent.5.3 乙方应爱护使用租赁的房屋,如因乙方的过失或过错致使房屋及设施受到损坏(正常损耗除外),乙方应负赔偿责任。Party B shall treat the leased property with care. If, as a result

24、ofParty B s negligence or misconduct, the leased property and the related facilities suffer any damage (fair wear and tear excepted), Party B shall be responsible for compensating Party A for such damages.5.4 除在物业内已有的装饰和设施外,乙方如要增加设备或装修,须征得甲方的同意,甲方不得无理拒绝或延误;租赁期满必须恢复原状(正常损耗、磨损除外),并承担其费用,经甲方验收认可后归还甲方。甲

25、方同意期满前两个月通知乙方其所需拆除的在物业内的任何改变及改进的设施。In addition to the decoration and equipment already in the property, ifParty B wishes to make any alterations or improvements to the property,Party B mustgetPartyAs consent. Any suchconsentshallnotbeunreasonably withheld or delayed. On expiry of the tenancy, Party

26、B musthand over theproperty toParty A inits original condition(fair wearandtear excepted). All fees arising from such work to do so are to be borneby Party B. PartyA agrees to provideParty B withtwo monthsnoticepriorto the expiry of the contract, in the event Party A requires demolitionof any altera

27、tion or improvement carried out to the property by Party B.5.5 若乙方、乙方雇员或任何其他经乙方许可的人员进入该物业,对甲方或其他住户造成损失,不论故意或过失,乙方皆应对造成的所有损失予以赔偿。In case of Party B, employees of Party B or any other person permitted byParty B toenter the property causing damagesto Party A or other tenants,whether intentionallyor neg

28、ligently,Party B shallcompensate forallthe.losses caused by such damages.5.6 乙方不得携带任何违禁危险物品进入该物业,严禁从事任何违反中华人民共和国法律法规的活动;如因此发生损害,乙方应承担全部责任。Party B shall not bring anything dangerous or forbidden in the leasedproperty, and not behave against the laws or regulations of the PeoplesRepublic of China, and

29、 shall be fully responsible for any damagesor losses as a result thereof.5.7在本合同期满前一个月内,乙方应允许甲方或其指定的代理人经与乙方预约后,在合理的时间内陪同其他有兴趣租住该楼宇的人士参观The Tenant shall permit the Landlord or its designated agent to enter the Premises with other potential tenants to see the Premises, at reasonable time and upon prio

30、r appointment with the Tenant within one month before the expiration of this Contract.5.8 租期为一年 , 如若任何一方提前解约, 支付违约金为一年的租金( 即人民币 _元) 。Leasing Term is one year. If any side terminates the agreement ahead of time, must pay the penalty is one year rent(RMB78000.00yuan).六、违约处理Breach of Contract6.1 甲、乙任何一

31、方如未按本合同的条款履行,构成违约,应承担相应的违约责任,双方同意违约方应赔偿受害方之直接损失(间接和结果性损失除外) 。甲方若有违约并在七日内未予补救,乙方则有权延付租金和管理费或做相应的扣除。If either Party A or Party B fails to perform its obligations hereunder,itshallconstitutea breach of thisContractand the defaultingpartyshallundertake the liabilitiesforsuch breach.The partiesagree that

32、the partyin breach shall pay the other party the direct losses and damage(excluding indirect and consequential loss and damages). If Party A is in breach ofthis Contractand does notrectifywithin 7 days, then PartyB is entitledto withhold or deduct the rental as well as management fee.6.2甲方有下列行为之一的,乙

33、方有权中止本合同,甲方除应退还乙方保证金和已支付但未居住的租金外,还应支付乙方两个月的租金的金额作为赔偿。Party B shall have the right to terminate the Contract and have recourseto a refund of the two month s security deposit and rental already paid together with a compensation sum equivalent to two months rental if party A commits one of the followin

34、g:.(a) 未经乙方同意,在租赁期间收回该物业。During the lease term, take possession of the Premises without Party s B consent.(b) 本合同开始三十天后,仍未向乙方移交该物业。Fail to hand over the Premises to Party B within thirty days after the commencing date of the Contract.6.3 乙方有下列行为之一的,甲方有权中止本合同,收回该房屋并且保证金不予退还。Party A shall have the rig

35、ht to terminate this Contract, re-possess the leased property and forfeit the security deposit if Party B commits oneof the followings.(a) 将承租的房屋擅自转租,但转租给乙方本公司人员除外。Sublets the leased property to another person without Party Asconsent, but associated person of Party B excepted.(b) 未得甲方同意,将承租的房屋擅自拆改结构

36、或改变用途的。Alters the structure of the premises without authorization or uses the premises other than the purpose stated herein.(c) 无故拖欠租金超过三十天。Fail to pay rental without any reason for more than 30 days after the due date.七、不可抗力Force Majeure若由于不可抗拒的自然灾害(包括但不限于火灾、洪水、地震、施工、战争、暴动、敌队等行为等)或其它非双方过错所造成的对本物业的损

37、毁致使其无法居住或使用本物业,双方有权中止本合同, 甲方必须退还乙方所有保证金和已支付但未居住的租金。届时合同双方将不再承担进一步的任何责任。If the leased property is destroyed, damaged and rendered uninhabitable and unusable due to force majeure (including but not limited to fires, flood, earthquake, accidents, strikes, wars, insurrections, public enemy etc.) oractio

38、ns that are not the result of Party A or Party Bs fault, either partyhas the rightto terminatethe Contractand proratedbalance of al rentalprepaid,as well as the deposit, shall be returned to Party B. Thereafter, the both parties shall not have any responsibilities to each other.八、争议的解决Dispute Resolution凡因本合同条款、翻译、任何合同相关事宜所引起的一切争议 , 双方应友好协商解决;协商不成,应提交上海市仲裁委员会,按其仲裁原则和中华人民共和国仲裁法在上海.进行仲裁,仲裁裁决是终局的,对双方都有
