9、汽车驾驶员从业行为，提升由租汽车客运服务水平，根据国务院对确需保留的行政审批项 目设定行政许可的决定（国务院令2004年第412号）等有关规定，制定 本规定。第二条从事由租汽车客运服务的驾驶人员，应当遵守本规定。第三条国家对由租汽车驾驶员实行从业资格制度。从业资格制度包括考试、注册、继续教育和从业管理制度。第四条由租汽车驾驶员从业资格管理工作应当公平、公正、公开和便民。第五条由租汽车驾驶员应当依法经营、诚实守信、文明服务、保障安全。第六条交通运输部负责全国由租汽车驾驶员从业资格管理工作。县级以上地方人民政府交通运输主管部门负责组织领导本行政区域 内的由租汽车驾驶员从业资格管理工作。县级以上道路

10、运输管理机构（含由租汽车管理机构，下同）具体实施 本行政区域内由租汽车驾驶员从业资格管理工作。第二章考试第七条由租汽车驾驶员从业资格考试包括全国公共科目和区域科目考试。全国公共科目考试是对国家由租汽车法律法规、职业道德、服务规范、安全营运等具有普遍规范要求的知识测试；区域科目考试是对地方由租汽 车法规政策、经营区域人文地理和交通路线等具有区域服务特征的知识测 试。由租汽车驾驶员从业资格考试实行全国统一考试大纲，按照管理权限 建立相应的考试题库。全国公共科目考试题库由交通运输部负责编制；区 域科目考试题库由设区的市级道路运输管理机构在省级道路运输管理机 构指导下编制。第八条由租汽车驾驶员从业资格

11、考试应当按照交通运输部编制的考试工作规范和程序组织实施。第九条拟从事由租汽车客运服务的驾驶人员，应当填写由租汽车驾驶员从业资格证申请表（式样见附件1）,向所在地设区的市级道路运 输管理机构申请参加由租汽车驾驶员从业资格考试。第十条申请参加由租汽车驾驶员从业资格考试的，应当符合下列条件：（一）取得相应的机动车驾驶证1年以上；（二）近3年内无重大以上且负同等以上责任的交通事故；（三）高中以上文化程度。第十一条申请参加由租汽车驾驶员从业资格考试的，应当提供符合第十条规定的证明材料：3年内无重大以上且负同等以上（一）机动车驾驶证及复印件；（二）道路交通安全主管部门由具的责任的交通事故记录证明;This

20、证明及复印件。第十二条设区的市级道路运输管理机构对符合申请条件的申请人，应当按照由租汽车驾驶员从业资格考试工作规范及时安排考试。首次参加由租汽车驾驶员从业资格考试的申请人，全国公共科目和区域科目考试应当在同一道路运输管理机构完成。第十三条设区的市级道路运输管理机构应当在考试结束10日内公布考试成绩。考试合格成绩有效期为3年。全国公共科目考试成绩在全国范围内有效，区域科目考试成绩在所在 地行政区域内有效。第十四条由租汽车驾驶员从业资格考试全国公共科目和区域科目考试均合格的，设区的市级道路运输管理机构应当自公布考试成绩之日起 10日内核发中华人民共和国道路运输从业人员从业资格证（以下简称从业资格证

21、）。由租汽车驾驶员从业资格证式样参照道路运输从业人员管理规定（交通部令2006年第9号）规定执行。从业资格电子证件另行规定。第十五条 由租汽车驾驶员到从业资格证发证机关核定的范围外从 事由租汽车客运服务的，应当参加当地的区域科目考试。区域科目考试合 格的，由当地设区的市级道路运输管理机构核发从业资格证。第三章注册第十六条取得从业资格证的由租汽车驾驶员，应当经道路运输管理机构从业资格注册后，方可从事由租汽车客运服务。由租汽车驾驶员从业资格注册有效期为3年。第十七条由租汽车经营者应当聘用取得从业资格证的由租汽车驾驶员，并在由租汽车驾驶员办理从业资格注册后再安排上岗。第十八条申请从业资格注册或延续注

22、册的由租汽车驾驶员，应当受聘于由租汽车经营者，填写由租汽车驾驶员从业资格证注册登记表（式样见附件2）,持其从业资格证及与由租汽车经营者签订的劳动合同（含聘用协议）或经营合同，到发证机关所在地的市县级道路运输管理机构申请注册。个体由租汽车经营者自己驾驶由租汽车从事经营活动的，持其从业资 格证及车辆运营证申请注册。第十九条由租汽车驾驶员注册有效期届满需继续从事由租汽车客运服务的，应当在有效期届满前90日，向所在地市县级道路运输管理机构申请延续注册。第二十条由租汽车驾驶员不具有完全民事行为能力，或者受到刑事处罚，刑事处罚尚未执行完毕的，不予延续注册。第二十一条由租汽车驾驶员变更服务单位的，应当重新申

35、规定完成继续教育。第二十五条交通运输部统一制定由租汽车驾驶员继续教育大纲并向社会公布。继续教育大纲内容包括由租汽车相关政策法规、社会责任和 职业道德、运营安全、服务规范和节能减排知识等。第二十六条由租汽车驾驶员继续教育以由租汽车企业为主组织实施。具备条件的由租汽车企业经市县级道路运输管理机构备案后，组织开 展由租汽车驾驶员继续教育工作。不具备条件的由租汽车企业和个体由租 汽车驾驶员的继续教育工作，由其他继续教育机构承担，具体包括以下形 式：（一）交通运输部或省级交通运输主管部门备案的网络远程继续教育；（二）县级以上道路运输管理机构认定的其他继续教育形式。第二十七条由租汽车驾驶员完成继续教育后，

52、一）未经备案擅自从事继续教育或者提供虚假继续教育资料的；（二）未按照继续教育大纲要求组织相应继续教育的；（三）发布继续教育虚假信息的。第五章从业管理第三十一条由租汽车驾驶员从业资格证由交通运输部统一制发并制定编号规则。设区的市级道路运输管理机构负责从业资格证的发放和管 理工作。第三十二条由租汽车驾驶员从业资格证遗失、毁损的，应当到原发证机关办理证件补发手续。第三十三条由租汽车驾驶员办理从业资格证补发手续，应当填写由租汽车驾驶员从业资格证补发登记表（式样见附件3）。道路运输管理机构应当对符合要求的从业资格证补发申请予以办理。第三十四条由租汽车驾驶员在从事由租汽车客运服务时，应当携带从业资格证。第

56、Ttd auciiea a - 1rle-e - ert aIt.ac a. - 6业资格管理档案。由租汽车驾驶员从业资格管理档案包括：从业资格考试申请材料、从 业资格证申请、注册及补发等记录，违章、事故及服务质量信誉考核、继 续教育记录等。从业资格管理档案标准见附件4 o第三十九条由租汽车驾驶员有下列情形之一的，由发证机关注销其从业资格证。从业资格证被注销的，应当及时收回；无法收回的，从业资 格证公告作废。（一）持证人死亡的；（二）持证人申请注销的；（三）持证人达到法定退休年龄的；（四）持证人机动车驾驶证被注销或者被吊销的；（五）因其他原因不宜继续从事由租汽车客运服务的。第四十条由租汽车驾驶员有下列不具备安全运营条件情形之一的，由发证机关撤销其从业资格证，并公告作废：（一）持证人身体健康状况不符合有关机动车驾驶员和相关从业要求 且没有主动申请注销从业资格的；（二）发生重大以上且负同等以上责任的交通事故的。第六章法律责任第四十一条违反本规定，有下列行为之一的人员，由县级以上道路 运输管理机构责令改正，处200元以上2000元以下的罚款；构成犯罪的，依法追究刑事责任：（一）未取得从业资格证，驾驶由租汽车从事经营活动的
