11、及法律特征1、劳务分包的概念在法律层面， “劳务分包”一词最先由建设部 87 号令提出，2001 年颁布的建设部 87 号令印发了建筑业企业资质管理规定及相关文件，设置了施工总承包、专业分包、劳务分包企业三个层次，从行业法规角度提出建筑劳务分包的概念，为劳务分包的合法性提供了法律依据,确认了劳务分包的法律地位。2004 年 10 月 25 日 最高人民法院关于审理建设工程施工合同纠纷案件适用法律问题的解释（以下简称最高院工程案件司法解释）第七条明确规定:“具有劳务作业法定资质的承包人与总承包人、分包人签订的劳务分包合同 ,当事人以转包建设工程违反法律规定为由请求确认无效的，不予支持”进一步明确
