2、法、山东省劳动合同条例 ,甲乙双方经平等协商同意,自愿签订本合同,共同遵守本合同所列条款。According toPeople Republics of CHINA Labor Law,People s Republic of CHINA LaborContract Lawand Province Labor Contract Regulation, party A and party B are willing tosign the contract on the basis of fair discussion and agreement and comply with it.一、劳动合同
3、期限 Contract Period第一条本合同期限类型为固定 期限合同。(根据劳动法可签订固定期限合同,或无固定期限合同)This contract is fixed period contract.(According toLabor Lawthere could befixed or non-fixed period labor contract).合同日期自年月日起截至到年月日止,其中年月日至年月日为试用期。This contract period is fromto, includingprobation period fromto.二、工作内容Work Contents第二条乙方同
4、意根据甲方工作需要,担任指定的岗位(工种)工作,以及其他由甲方指定的兼职工作和临时工作。工作地点为:XX市 XX 区XXXXX 路 1号。Party B is willing to work asaccording Party A s requirements andother part-time and temporary work required by Party A. Work place: No.1 WildRoad, Development Zone, Rizhao.第三条乙方必须按照甲方的合法要求,按时完成规定的工作数量,达到规定的质量标准。1Party B should ful
5、fill all the work in time and by quality standard according to Party A legals requirements.三、劳动保护、劳动条件、工作时间和休假Work Protection, Condition, Time and Leaves第四条甲方安排乙方执行8 小时 /日工作制,甲方依法保证乙方的休息权利。乙方在劳动合同履行期间依法享受法定节假日以及探亲假、婚丧假、产假、带薪年假等休假权利。甲方安排乙方每日工作时间不超过8 小时,每周工作5 天,平均每周不超过40小时。甲方保证乙方每周休息二天。因特殊原因需要延长工作时间的,
6、在保障乙方身体健康的条件下,甲乙双方友好协商执行,原则上每月不超过24 小时。There are 8 working hours per Day. Party A promises rest time to Party B according to the laws. Party B has the right to enjoy the legal vacation, home leave, marriage and mourning leave, maternity leave and legal paid vacation, etc.Party A arranges Party B to
7、work maximum 8 hours per day and 5 days every week, and the average work hours per week should be not more than 40 hours. Party A gives Party B 2 days vacation every week. Because of special reasons Party B needs to work over-hours on the basis of normal health condition, after agreement of two part

Basically it should not be more than 24 hours every month.第五条甲方安排乙方加班的,应安排乙方同等时间补休或依法支付加班工资;加点的,甲方应付加点工资。If party A requires party B to do overtime work, Party A should give the equal time leave in some other time or give overtime payment according to law; if party B needs to work in extension
9、hours, Party A should pay for the extension hours.第六条甲方为乙方提供必要的劳动条件和劳动工具,建立健全的生产工艺流程,制定操作规程、工作规范和劳动安全卫生制度及其标准。Party A should provide the necessary work conditions and tools, build up complete production process and make operation regulations, rules and safety system and standards.第七条甲方负责对乙方进行政治思想、职业
10、道德、业务技术、劳动安全卫生及有关规章制度的教育和培训。Party A should arrange to give the necessary training for Party B about politicalthoughts, professional morality, operation skills and operation safety andregulations.四、劳动报酬Work payment第八条乙方应按照甲方的要求完成相应的工作,甲方应根据按劳分配、效率优先、兼顾公平的原则,按照国家规定和甲方依法制定的工资分配办法等规章制度按月以货币形式支付乙方的工资,每月
11、7 日前公司为员工支付上月工资(遇节假日则顺延) 。甲方支付乙方的试用期工资标准为:元 /月,试用期过后为元 /月。工资额度必须对第三者保密,甲乙双方都应严格遵守。Party B fulfills the work according to the requirements of Party A. Party A shouldgive the payment in cash every month accordingto national law and party A s2salarypayment regulation on thebasis ofworking, efficiency p
12、riority withdueconsideration to fairness. Every month before 7th, Party A should pay PartyB ssalary of last month(if there is holiday, the paid date will be postponed).Party B sprobationsalaryisYuan/Month,afterprobationperiodsalaryisYuan/Month. Both parties must keep the salary as a confidential mat
13、ter to third party.第九条由于甲方生产任务不足,使乙方待岗的,甲方保证乙方的月生活费不低于日照市最低生活保障。If Party A doesn t haveenough work task and Party B have no work to do, Party A should gives Party B the living allowance which should not be less than Rizhao Minimum living guarantee.五、保险福利待遇Insurance and welfare第十条甲乙双方应按国家和山东省社会保险的有关规
14、定交纳职工养老、失业和大病医疗统筹及其他社会保险费用。 乙方应缴纳的部分按照法律法规应有甲方代扣代缴的,由甲方从乙方工资中代为扣缴。甲方应为乙方填写职工养老保险手册 。双方解除、终止劳动合同后,职工养老保险手册按有关规定转移。Party A and Party B should pay endowment insurance, unemploymentinsurance and serious illness insurance and other social insurance as nationaland province regulations about insurance. The
15、 Part which should be paid byParty B should be withheld from salary by Party A.Party A should fill in Employee Endowment Insurance Handbookfor Party B.After the termination of the contract,Employee Endowment InsuranceHandbook should be handed over according to relevant regulations.第十一条乙方患病或非因工负伤,其工资
16、按照国家已经制定相关规定执行。If Party B gets ill or gets hurt not because of work, then his/her salary should becalculated according to relevant national regulations.第十二条乙方患职业病或因工负伤的工资和医疗保险待遇按照国家和山东省有关规定执行。If Party B gets occupational disease or gets hurt because of work, his salary andmedical insurance should be
17、 calculated as relevant national and provinceregulations.六、劳动纪律 Work Disciplines第十三条乙方应遵守甲方依法制定的规章制度,严格遵守劳动安全卫生、生产工艺、操作规程和工作规范,以及劳动合同附件及职工保密协议书,爱护甲方的财产,遵守职业道德;积极参加甲方组织的培训,提高思想觉悟和职业技能。Party B should follow Party A s discipliande rules, following close to the line ofoperation safety requirements, proc
18、ess, operation rules and regulations,Appendix to Labor Contract and Employee Secret-Keeping Agreement. Party Bshould protect company sproperty, follow professional morality; Party B shouldbe active to attend the training organized by Party A to increase professionalskills.3第十四条乙方违反劳动纪律,甲方可依据本单位规章制度,
19、给予纪律处分, 直至解除本合同。If Party B violates disciplines or regulations, Party A could give the penalty according to the company sregulation or rules, or even to end the contract.七、劳动合同的变更、解除、终止、续订Change, terminate, end or renew the contract第十五条订立本合同所依据的法律、行政法规、 规章发生变化, 本合同应变更相关内容。If the relevant laws, regul
20、ations or rules have changed, this contract will be changed accordingly as well.第十六条订立本合同所依据的客观情况发生重大变化,致使本合同无法履行的,经甲乙双方协商同意,可以变更本合同相关内容。If the objective circumstance has changed a lot, which makes it not possibleto continue this contract; after agreement of the two parties, the contractcould be mod
21、ified accordingly.第十七条乙方有下列情形之一的,甲方可以解除本合同:Party A could end the contract with Party B, If Party B:1 、 在试用期间,被证明不符合录用条件的;It is proved during the probation period that Party B is not qualified forthe work and employment;2 、严重违反劳动纪律或甲方规章制度的;Materially violateParty A s rules and regulations;下列行为属于严重违反甲
22、方劳动纪律或规章制度的行为:Those following actions belong to materially Violation:( 1 )在工作期间饮酒的;Drinking during the work time;( 2 )连续旷工超过15 天或一年内累计旷工超过30 天的;Absent from work continue for 15 days or more than 30 days totalfor one year.( 3 )乙方是驾驶员的,因其自身原因,其营运服务的证、照被吊扣或失效15天(含)以上的或发生行车事故次要责任(含)以上的;If Party B is dri
23、ver, because of his mistake, the car or car license is caught by police or go out of valid period for more than 15 days (including), or in accident Party B take more than subordinate responsibility (including).( 4 )在工作场所打架斗殴、妨碍干扰正常工作秩序及违犯社会治安管理条例的;Fight on working place, disturb normal working syste
24、m, and violatesociety safety management regulation.( 5 )乙方以欺诈、胁迫的手段,使甲方在违背真实意思的情况下订立或者变更合同的;Party B sign or change the contract with party A without the willing the Party A by cheating or threating.( 6) 在劳动关系存续期间,与其他用人单位(或个人)建立劳动关系或发生劳务关系的;During the contract Period, Party B does work for any other
25、third employment Party.( 7) 在工作期间搞其他产业或第二职业的,在工作时间内做与工作无关的事情;During work time, Party B does other work or secondary job, or any other work which is not related to his duty.4( 8) 乙方在招聘录用时所填个人履历和档案等有关内容不真实,提供虚假信息的。包括但不限于:离职证明、身份证明、户籍证明、学历证明、体检证明等是虚假或伪造的;应聘前患有精神病、传染性疾病及其他严重影响工作的疾病而在应聘时未声明Party B gives
26、the false information when filling in the Company Entrance Form, including but not limited to, Dimission Prove, ID prove, Residence Prove, Education Prove, Physical Checking Prove; have serious mental disorder, infected illness or other illness which affects his work.3 、严重失职、营私舞弊,对甲方利益造成重大损害的((包括但不限
27、于因个人故意或过失, 一次给甲方造成 3000 元以上损失或连续 12 个月内累计造成 5000 元损失的);Commits serious dereliction of duty or practices graft, causing substantial damage to the Party A (including but not limited to the loss of 3000Yuan by one time or total 5000Yuan within continue 12months caused by Party B s deliberately or fault
28、) ;4 、被依法追究刑事责任的。Has his criminal liability pursued in accordance with the law.第十八条下列情形之一,甲方可以解除本合同,但应提前三十日以书面形式通知乙方:If one of the following situations applies, Party A could terminate the contract, but has to inform Party B 30 days in advance by written:1 、乙方患病或非因工负伤,医疗期满后,不能从事原工作也不能从事由甲方另行安排的工作的;A
29、fter the recovering period of medical care for an illness ornon-work-related injury, Party B can engage neither in his original work nor in other work arranged for him by Party A.2 、乙方不能胜任工作,经过培训或者调整工作岗位,仍不能胜任工作的;Party B is incompetent and remains incompetent after training or adjustment of his posi
30、tion.3 、双方不能依据本合同第十七条规定就变更合同达成协议的。Two parties can not reach the agreement to modify the contract ascontract Item 17.第十九条甲方濒临破产进行法定整顿期间或者生产经营发生严重困难,经向工会或者全体职工说明情况, 听取工作或者职工的意见, 并向劳动行政部门报告后, 可以解除本合同。During restructuring period pursuant to the Enterprise Bankruptcy Law or Serious difficulties in produc
31、tion and/or business operations, after Party A has explained the situations to its Labor Union or to all of his employees, and has considered the opinions of the Labor Union or the employees and has subsequently reported to the labor administration department, Party A may terminate the contract.第二十条
32、乙方有下列情形之一的,甲方不得依据本合同第十八条、第十九条终止、 解除合同:Party A may not terminate an employment contract pursuant to Article 18 or Article 19 hereof if Party B:1、患病或非因工负伤、在规定的医疗期内的;5Has contracted an illness or sustained a non-work-related injury, and the recovering period of medical care therefore has not expired;2
33、、女职工在孕期、产期、哺乳期内的;Is a female employee in her pregnancy, maternity or breast feeding period 3、在本单位连续工作满十五年,且距法定退休年龄不足五年的;Has been working for the Employer continuously for not less than 15 years and is less than 5 years to his legal retirement age4、法律法规规定的其他情形。Other situations pursuant to Laws or reg
34、ulations.第二十一条乙方患职业病或因工负伤, 医疗终结,经市、区、 县劳动鉴定委员会确认完全或部分丧失能力的,按劳动合同法有关规定办理,不得依据本合同第十八条、第十九条解除劳动合同。Party B Has been confirmed as having complete lost or partially lost his ability to work due to an occupational disease contracted or a work-related injury sustained with the Employer, after diagnosed by C
35、ity, Zone, County Labor authentication Committee ,Party A should not terminate the contract as Article18,19, but should follow relevant regulations.第二十二条乙方解除本合同,应当提前三十日以书面形式通知甲方。If Party B wants to terminate the contract, he/she should inform Party A by written 30 days in advance.第二十三条有下列情形之一的,乙方可以随
36、时通知甲方解除本合同:Party B may terminate the contract in any time under the one of the following situations:1 、在试用期内的;During the probation period2 、甲方以暴力、威胁或者非法限制人身自由的手段强迫劳动的;Party A forces or threats Party B to work or illegally restrict freedom of Party B.3 、甲方不能按照本合同规定支付劳动报酬或者提供劳动条件的。Party A can not pay
37、or provide work conditions as Contract.第二十四条本合同期限届满,甲乙双方经协商同意,可以续订劳动合同。After the termination of the contract, Party A and Party B could renew the contract after discussion and agreement.第二十五条订立无固定期限劳动合同的,乙方离休、退休、退职及死亡或本合同约定的解除条件出现,本合同终止。If the contract is open-ended contract, when Party B has leaved, retired, died or other factors which would end the contract as we mentioned in the contract, this contract can terminate.第二十六条乙方承诺已知悉了甲方的各项规章制度,并保证在任职期间认真学习甲方制定的各项规章制度。Party B should promise that he has know all
