聘(雇)用契约书

1、聘（雇）用契约书_（以下简称甲方）为应业务需要，聘（雇）用_先生（女士）（以下简称乙方）为约聘（雇）人员，双方订立契约条款如下：一、聘（雇）用期间：自_年_月 _日起至 _年_月_日止。二、聘（雇）用报酬：甲方按月支给乙方报酬_薪点（ _元）。三、工作内容（具体叙明）：_。四、受聘（雇）责任：乙方受聘（雇）后须确保甲方公务机密，有保密期限者从其规定，无保密期限者自离职日起_年为限（解聘（雇）者亦同）。乙方不得有不法行为或违背约定义务，如有违背者，除涉及民、刑事责任，由甲方依法追究外，并得随时解聘（雇）。在聘（雇）用期间，乙方愿接受与甲方约定之工作上的指派调遣，并遵守此工作上之相关规定。若乙方违

2、背上述相关规定确属情节重大，甲方得随时终止契约；甲、乙双方如因特别事故须提前终止契约时，应于一个月前提出预告，经甲、乙双方协议后乙方始得离职。乙方离职时，应先依照规定办妥离职手续。如有损害公物，或侵权情事（或违反甲方智能财产权规定），应负责赔偿。五、乙方在受聘（雇）用期间，除应遵守甲方一切行政法规之规第1页共9页定外，其假期、离职储金给与、劳工保险及全民健保等，依左列约定：假期核给：依 _办理。离职储金之扣缴及给与依 _规定办理，按月扣缴储存生息，并于离职时依规定发给。按乙方每月支报酬之百分之 _提存储金，其中百分之 _由乙方于每月报酬中扣缴作为自提储金，另百分之 _由甲方提拨作为公提储金，并

3、由甲方在金融机构开立专户储存孳息，列帐管理。乙方因契约期满离职、或经甲方同意于契约期限届满前离职、或在职因公、因病或意外死亡者，发给公、自提储金本息。乙方因违反契约所定义务而经甲方予以解聘，或未经甲方同意而于契约期限届满前离职者，仅发给自提储金之本息。其余未尽事宜请参考 _有关规定。乙方受聘（雇）用期间，甲方应善尽投保劳工保险及全民健康保险之义务。六、乙方于受聘（雇）期间之著作或工作成果，如系于甲方企划下，或法定工作期间完成者，其所有权归属甲方。因前开著作或工作成果所生之智能财产权，应依本院之相关规定办理。七、本契约期间届满当然失效，如因业务需要须续聘时，另行签订新契约。八、本契约未订定事项，

A also reserves the right toinstitute suit against B for civil compensation or toimpose criminal liability.4.2During the term of this Agreement， B shall complywith the directions and instructions of his/hersupervisors， perform his/he

9、r duties in accordance withall regulations and relevant working rules. Where Bviolates any obligation specified in this paragraph andthe case is considered to be serious in nature， A may inits discretion terminate this Agreement. If at any timethe parties intend to terminate this Agreement due to第4页

10、共9页causes beyond the reasonable control of such party，either shall give thirty (30) days notice ofcancellation to the other party prior to the intendedtermination date. B shall vacate his/her office under andpursuant to the stipulations agreed upon by both parties.B shall submit to the proceedings i

11、n prescribed manner asto be vacated of his/her office.In case of any one of thefollowing conditions which is due to Bs fault， B shallbe responsible for compensation：(1) Where B inflictsdamage to or e cessively abuses machinery， equipment，tools ， raw materials， products or other articlebelonging to A

12、cademia Sinica；(2) Where B commits torts；(3) Where B violates As ownership of intellectual property rights.5. B shall comply with any administrative regulations and rules provided by A. In regard to the matters ofabsence on leave， pay-as-you-go contribution benefit，labor insurance and national healt

13、h insurance， thefollowing terms and conditions shall be applicable.5.1 Absence on leave shall be operated pursuant to Regulation of Absence on leave for Personnel served in all E ecutive Yuan organizations under Civil Contractual第5页共9页Relationship.5.2 The deduction and grant of pay-as-you-go contrib

14、ution benefit shall be operated pursuant to Regulation of pay-as-you-go contribution benefit for Personnel served in all organizations and schools under Civil Contractual Relationship. Certain amount of salary shall be deducted per month and accrue on the financial institute over the term of this em

15、ployment.5.2.1An amount equal to seven percent ( 7 ) of themonthly salary shall be contributed. Fifty percent ( 50 )of the contribution shall be drawn from Bs monthlysalary. ( hereinafter called personal contributionbenefit) A shall provide the other fifty percent ( 50)of the contribution ( hereinaf

16、ter called publiccontribution benefit)， and shall open a special accounton financial institute as to accumulate and manage thiscontribution (personal plus public) .5.2.2The total amount of the contribution benefits(personal plus public) shall be granted to B， if at anytime (a) B leaves the office on

17、 the e piry of thisAgreement， (b) B vacates the office prior to the epiration date with the consent of A， and (c) B deceases第6页共9页due to undertaking of duty， illness or accident.5.2.3The amount of personal contribution benefitsaccumulated shall be granted to B， if at any time (a) Aterminates this Ag

18、reement inasmuch as B breaches any obligation ， and (b) B resigns from the office prior tothe e piration date without the consent of A.5.2.4Any matter or event not provided in the conte t ofthis Article shall be operated pursuant to Regulation ofpay-as-you-go contribution benefit for Personnel serve

19、din all organizations and schools under Civil ContractualRelationship and relevant regulations.5.3During the term of this Agreement， A shall insure Bsubject to the terms and conditions pursuant to labor insurance regulations and national health insurance regulations.6. Both parties agree that A shal

20、l own proprietary right pertaining to the literary works or achievements completed by B under the projects initiated or coordinated by A during the term of this Agreement. The ownership of intellectual property rights ( including butnot limited to certain patents， trademarks ，copyrights， technical i

21、nformation and know-how ) accrued第7页共9页from the literary works or achievements herein contained is subject to the relevant regulations and rules provided by A.7. E pirationAt the e piration of the term of this agreement， theemployment relationship shall automatically terminate without any condition.

22、 A new employment agreement shall be signed for the renewal and continuance of such relationship ， if agreed to any by both parties.8. Any matter or event not provided in the conte t of this Agreement shall be governed by and interpreted in accordance with Employment Regulation for Personnel under C

23、ivil Contractual Relationship (stipulated by Academia Sinica ) & Employment Regulation for Personnel served in all E ecutive Yuan organizations under Civil Contractual Relationship.9. Governing LanguageThe Chinese te t of this Agreement shall be deemed theoriginal. In the event of any dispute or misunderstandingas to the interp retation of the language or terms ofthis Agreement， the C
