INTERPRETATION
Definitions
1.(1)ThefollowingdefinitionsapplyintheseRegulations.
"container"
contenant
"container"meansareceptacleorpackageinwhichasurfacecoatingmaterialisofferedforsale.Itdoesnotincludeareceptacleorpackagethatisnotcustomarilydisplayedtothepublic,suchasapackageliner,anyouterwrappingorboxorashippingcontainer.
"displaypanel"
aired'affichage
"displaypanel"meansanypartofacontaineronwhichtheidentityoftheproductisdisplayedintermsofitscommonorgenericnameorintermsofitsfunction.
"displaypanelarea"[Repealed,SOR/2007-230,s.1]
"goodlaboratorypractices"
bonnespratiquesdelaboratoire

(2)IncalculatingtheareaofadisplaypanelforthepurposesoftheseRegulations,anyseamandanyconvexorconcavesurfaceatthetoporbottomofthecontaineraretobeexcluded.
Exception–curvedcontainers
(3)Inthecaseofacontainerthatiscurvedinanyway,otherthanabag,thedisplaypanelareaistobecalculatedas40%ofthetotalareaofthecontainer,excludingthetopandbottom.

3.(1)TheinformationrequiredbytheseRegulationstobedisplayedonacontainermustbe
(a)inbothEnglishandFrench;
(b)setoutinapermanent,clearandlegiblemanner;
(c)printedinsans-serifcapitallettersandinbold-facedormedium-facedtype;and
(d)intypeoftheminimumheightandsizesetoutinthetable.

(2)Theminimumheightofthetypereferredtoinsubsection(1)isdeterminedbymeasuringanupper-caseletteroralower-caseletterthathasanascenderordescender,suchas“b”or“p”.

Concentrationandtestmethodcriteria
4.(1)Theconcentrationoftotalleadpresentinasurfacecoatingmaterialmustnotbemorethan600mg/kgwhenadriedsampleofitistestedinaccordancewithamethodthatconformstogoodlaboratorypractices.
Exceptions
(2)Subsection(1)doesnotapplytoasurfacecoatingmaterialthatisused
(a)asananti-corrosiveorananti-weatheringcoatingappliedontheinteriororexteriorsurfaceofanybuildingorequipmentthatisusedforanagriculturalorindustrialpurpose;
(b)asananti-corrosiveorananti-weatheringcoatingappliedonanystructure,otherthanabuilding,thatisusedforanagricultural,industrialorpublicpurpose;
(c)asatouch-upcoatingformetalsurfaces;
(d)ontrafficsigns;
(e)forgraphicartonbillboardsorsimilardisplays;
(f)foridentificationmarksinindustrialbuildings;or
(g)asmaterialforthepurposesofarts,craftsorhobbies,otherthanmaterialforusebychildren.

5.(1)Iftheconcentrationoftotalleadpresentinasurfacecoatingmaterialthatisusedforapurposedescribedinsubsection4(2)ismorethan600mg/kg,thedisplaypanelmustcontainthefollowinginformationoritsequivalent:

6.Sections4and5donotapplyinthecaseofasurfacecoatingmaterialthatisusedexclusivelyinanindustrialsetting,otherthanforausedescribedinparagraphs4(2)(a)to(g),onsurfaceswherethefinishissodurableandtightlyadheredtothesurfacethatitcannotbechewedorchippedunderforeseeableuse.

7.Theconcentrationoftotalmercurypresentinasurfacecoatingmaterialmustnotbemorethan10mg/kgwhenadriedsampleofitistestedinaccordancewithamethodthatconformstogoodlaboratorypractices.

8.TheconcentrationoftotalleadpresentinasurfacecoatingmaterialthatisusedforpavementmarkingsandthatissoldduringtheperiodbeginningonthedayonwhichtheseRegulationscomeintoforceandendingonDecember31,2010maybemorethan600mg/kg,whenadriedsampleofitistestedinaccordancewithamethodthatconformstogoodlaboratorypractices,ifthedisplaypanelcontainstheinformationrequiredbysection5.
Mercuryinrecycledsurfacecoatingmaterials
9.(1)TheconcentrationoftotalmercurypresentinarecycledsurfacecoatingmaterialthatissoldbeforeJuly1,2010,whenadriedsampleofitistestedinaccordancewithamethodthatconformstogoodlaboratorypractices,maybemorethan10mg/kgbutnotmorethan
(a)65mg/kg,ifitissoldduringtheperiodbeginningonthedayonwhichtheseRegulationscomeintoforceandendingonJune30,2007;and
(b)35mg/kg,ifitissoldduringtheperiodbeginningonJuly1,2007andendingonJune30,2010.

(2)Thedisplaypanelofarecycledsurfacecoatingmaterialreferredtoinsubsection(1)mustcontainthefollowinginformationoritsequivalent:
